Are you talking about the police certificate/birth certificate and such? My fiance was also told to send in all his forms.

I'm sorry, I should have specified. I meant the documents I need to send him for his interview. We found out today that his interview is Nov. 6th and I think it would be worth the extra cost sending it UPS/FedEx to not have to agonize over it arriving in time for his interview.

My fiance should be getting his interview date soon and I was wondering what you all have found to be the best way to ship the documents required for the interview. I'm a bit scared to send it USPS with the strikes going on. I don't have any experience with couriers.

What do you recommend?

helpsmilie.gif I met my husband online on January 14th, 2007.....He had never been married and I just recently out of a 20yr marriage......We decided that we wanted to go ahead and get married because we knew this process was going to take a little while to complete......So I went to Jamaica on March 13th and we were married March 17th.......I have read several threads on here and everyone says to be honest.......Does anyone know if they frown upon this when told of such a short romance before marriage? Hello Sarah......I met a wonderful Jamaican gentleman online on January 14, 2007......I just came from a 20 yr marriage that was physically, mentally and verbally abusive and had an 18 yo son that was killed in an automobile accident in June 2005. So really, I wasn't looking for another marriage anytime soon......I always said "It would have to be Mr. Right!".......Well I happened to be popping in and out of yahoo chat rooms, scared to really start chatting......When my Mr. Right sent me an instant message.......He asked me to marry him within the next month.......Chatting and seeing each other every day online.....We married on March 17, 2007 in Ocho Rios......After spending nine wonderful days together, he had to return to Cuba to work and I had to return home to the 14yo son I have here.....He is now back in Jamaica due to having a heat stroke at Gitmo......We have been approved for the I-130 and I have recently sent back the AOS fee bill.....Drew sent his DS-3032 Choice of Agent back last week so hopefully we will hear something soon from it.......It scares me about this interview process because I don't really know what they think of online relationships......I hope that they will see that we truly love each other and want to make a life together here in the States with me and my son......Keep in touch!

I feel the same way! I kindda realized that a January date wasn't a viable option for me at the end of last week. Look on the bright side at least you are further ahead than me! Your getting February for sure...me, I'm thinking March at this point...or should I say HOPING March! laughing.gif laughing.gif

Hang in Sweets...It's a coming!! Plus, it could go a lot quicker than she expressed. You never know what to expect from USCIS...that's the beauty or the ugly about them...depending upon your viewpoint laughing.gif !

My heart goes out to you.......This process takes forever it seems like but it is coming to an end.....I hope things pick up speed on your end.....I talked to the lady again this morning......She said that they will continue to schedule interview dates for December until they reach their quota......I am keeping an open mind and continue to hope and pray that he will be home soon! The people that I have met on here has been a tremendous support group......and I count my blessing for everyone......Hats off to all!

Well, NVC will receive our DS-230 Visa Application and all the necessary documents to finish processing our case today! kicking.gif

Does anyone know approximately how long it takes for them to case complete and then how long it takes to get to the embassy?

I was looking at some of the timelines and it looks like once NVC receives it, it takes approximately another month before the interview date. Can anyone help?

I am like others here, getting impatient........but still holding out for the day to bring him home!

kicking.gif Hello All.....I talked to an operator at the NVC this morning and our IV payment was processed on October 5th......She stated that the DS-230 Application instructions will be mailed this week.......I am so happy!..... jest.gif Now since the application will be mailed this week......is this the time that I should go ahead and send it to Drew in Jamaica.......the only things that he needs to send back with it is.....original birth certificate, original marriage certificate and police record.......He has never been married so no divorce documents.......Just trying to make sure that I get all my things in proper order.......

My last exam is the 14th so I was planning on hopping on a flight on the 16th but Air JA never has good fares for Christmas/New Years travel. mad.gif

Has anyone ever flown Spirit?

I hear more and more people are using that airline to go to JA. I need to check out their fares.

I used it to go to MoBay in February...they were really very good. The flight left from LGA ONTIME...got to Fort Lauderdale ON TIME...left FLL...ON-TIME and arrived in MoBay...ON-TIME! I also had all my bags and the flight is one of the earliest to get into MoBay so the crowds aren't too bad. But, someone told me they get frazzled around Christmas time and have an issue wid luggage arriving with the passenger. Plus, getting out of MoBay was a breeze. When everyone else was piled up by the AJ counters...spirit counters in MoBay were empty.

But, I tell you compared to AJ, I'm sorry to say, I will take my chances! I went down with them in June...can you say NIGHTMARE!!! First, we didn;t even use an AJ plane it was a charter North American plane...both going and coming back. Which left 1 and 1/2 late from JFK! They lost my son's suitcase...later found it in Miami and sent it down 2 days later! Then when it was time to go back. By the time we navigated deh HELL of a line to check-in, they were paging us to board the plane...oh and we got there 4 hours early. I would love to support my Country's Airline...but Customer Service is everything to me and AJ has ALOT to learn about Customer Service!!

Anyway...that's just my 2 cents!

I swear I was looking around for the video camera...cause you couldn't tell me I wasn't in a 'Oliver' episode!! blink.gif When I finally translated for my son (who understands patois- but hers was BAD!!!) Hey all......I listened to the automated system that our case was reviewed and is missing forms and is incomplete as of 9/20/07.....now the IV bill was generated on 9/17.......well I called back and talked to the operator and she said that the missing document was the IV bill......which I haven't even received in the mail yet.......But at least I know that we are moving right along! good.gif

Last nite Drew and I were discussing Empress and her situation.......even though he doesn't smoke but is occassionally around 2nd hand smoke.....ganja shouldn't be an issue with him......but he is so scared that they will deny him due to a short romance before marriage......I told him to be positive......he asked me......if something happens and I get denied......are you still going to be my wife....... heart.gif ......I told him of course, I will always be your wife......

Hi Tonya, I overnighted everthing and it took a couple weeks, but not too long...If yours was not yet approved I would not plan on a November date because remember you still ahve to send in the DS230 part one and 2 with supporting docs and wait till they COMPLETE your case and then put you in line for a interview date...My case was just completed last week and I was told this morning I am not even in the October interviews so I will have to wait for October to see if I was scheduled for November interviews.... crying.gif

He was never fingerprinted, but had to appear before a magistrate. He's being advised not to discolse this, but I think he should. An arrest means that you were detained for a certain period of time, even if you were not charged with a crime. (Maybe I'm wrong, but that's how I understand it).

(3) He lives in Montego Bay...is it better for him to do his physical in Kingston or in Montego Bay. I have a few friends who had problems with the results getting back from MoBay in time for the interview.

I met my husband online on January 14, 2007....we married in Ochi on 3/17/07 and I began our paperwork at the end of March or 1st part of April......We are going through the IR1-CR1 process which is for a spouse......Not sure what to tell you about the police issue.......My husband still has to get his medical and shots and I believe he is going to go to MoBay.......BTW.....I am in West Virginia......not too far away from you........have a great day!

We were approved for the K1 Visa but the police report was not 100% what they were looking for. So they gave him the directions to get the correct police report and said once he has it back call the embassay and they will have it picked up. He did get the police report back and the embassay picked it up last friday the 26th of June.

Now for my question, does anyone know how long will it take the embassay to get the Visa to him now that they have the police report and the approval was already given. Does he go back into a waiting period or will it come within the 3 to 4 days like it would have if they has just approved him and were not waiting for anything else from him.

IMO letter writing has little effect at all - we have written to, literally, hundreds of people and all you get is the "standard" reply "thank you for your interest in Homeland Security". It is likely that those whom the letter is addressed don't even see it - some office-bod replies.

I would suggest contacting t.v. stations - perhaps suggesting a programme on "legal" immigration and all the difficulties people go - versus "illegal" immigration, which seems so much more acceptable these days.

That is the route I would take - contact the media.

Dear Mr. Khatri:

I recently filed a K1 fiance(e) visa petition (Form I-129F) with the USCIS Vermont Service Center on behalf of my husband-to-be, a citizen of the United Kingdom. According to the United States Postal Service returned receipt, my petition arrived at the Center on May 19. I have since heard some very distressing news from the Department of State concerning the processing of K1 fiance(e) visa petitions in light of the International Marriage Broker Regulation Act (IMBRA) (please see the Visa Telegram at http://travel.state....grams_2927.html, dated May 6th, 2006).

This information included news of the recall of over 1,000 approved K1 petitions from their consular destinations, and provided the vaguest of explanations concerning the future of submissions currently awaiting processing at the USCIS Service Centers. I am writing to seek some general information on the current K1 visa processing situation at the Service Centers (particularly the Vermont Center, where the recalled petitions appear to have originated), and to offer my input on how the USCIS can best address the concerns and understandable anxiety of United States citizens and their fiancé(e)s abroad.

I write to you not only out of concern for my own case, but out of concern for other K1 petitioners who have shared their distress with me. People seeking family-based immigration benefits suffer anxiety and frustration resulting from separation from loved ones and the uncertainty of the process by which they are hoping to be reunited with their family members. It is not surprising that the World Wide Web is home to communities of family-based immigration petitioners and applicants who seek understanding and support during this difficult time. As a member of one such community, my thoughts as I write to you are as much of them as they are of my own situation.

My areas of concern include the following:

1) The relevant federal agencies (which include the USCIS under the Department of Homeland Security, as well as the Department of State), have failed to keep the public informed of the IMBRA-related developments and how they affect the way K1 petitions will be processed at the USCIS Service Centers.

2) The relevant federal agencies have failed to provide effective channels through which current petitioners and applicants can obtain reliable, complete information concerning their pending cases.

3) Officials at the relevant federal agencies, having made the grave error of failing to implement the required procedural measures for IMBRA by the legislative deadline, have compounded that error by requiring that petitions received after that deadline be processed in compliance with IMBRA when petitioners and applicants were not themselves informed of the need for compliance.

4) Officials at the relevant federal agencies have now released information (see the Visa Policy Telegram from the Department of State) stating that petitioners for K1 visas submitting on or after March 6, 2006 will be subject to new requirements when completing Form I-129F, but have failed to explain what information (if any) the petitioner will be required to supply. References to a “new Form I-129F” and “additional questionnaires” have triggered panic among petitioners and applicants, who envision massive delays as the petitioners collect the IMBRA information and turn it over to Service Centers for processing.

The situation has become untenable for those of us who have submitted a K1 petition we know or think will be affected by IMBRA, and some remedies are necessary. People who have resigned from jobs, sold or purchased homes, relocated, and made wedding plans upon receipt of an approval notice (or even upon approval at the foreign consulate) are now suffering financial as well as emotional hardship as their approvals are revoked. We who have not yet received an approval notice from our Service Centers are left to wonder anxiously about the future of our petitions, and to speculate on what information will be required from us in order to proceed (as well as how long it will take to obtain it).

We are United States citizens who have acted in good faith and conformed to the laws and regulations of the United States, and the requirements of the K1 petition process as published at the time of filing. To effectively penalize our petitions for an administrative failure we could not possibly have anticipated is rapidly eroding our faith in the ability of our Government to provide transparent guidance and competent administrative service.

My proposed solutions are as follows:

1) The Department of State and the USCIS must as soon as possible publish a notice describing any new requirements for the submission of K1 petitions due to IMBRA. The notice should include information on any new version of Form I-129F that may be forthcoming, and instructions for submitting K1 petitions pending new regulations or forms. In addition to any other forms of publication, the notice should be displayed prominently on the homepage of the USCIS website, and should also be available on the Department of State web page concerning visas.

2) As soon as possible, the web pages displaying the visa processing dates at the individual USCIS Service Centers should provide a notice updating the user on the status of Form I-129F processing at the Center (i.e., whether all processing has been suspended, some processing is taking place, normal processing has resumed, etc.).

3) As soon as possible, the Departments of State and Homeland Security, as well as USCIS itself, should issue a notice providing the public with a single information resource for questions concerning the IMBRA situation as it affects pending K1 petitions. This resource should be able to provide individuals with, among other things, a) the current location and status of the individual's petition; B) any information that is still needed from the petitioner before the petition can be approved; c) an estimated timeline for approval of any petition recalled from a foreign consulate by the Department of Homeland Security.

4) Given that petitioners with cases currently pending at a Service Center, the National Visa Center, or a foreign consulate received no notice concerning any additional procedures or requirements for approval of their petitions or applications for visas, and that there is no guidance on the IMBRA requirements available for U.S. citizens contemplating a K1 petition, it may be argued that fundamental fairness requires that all K1 submissions be processed under the pre-IMBRA regulations until notice of new procedures and requirements can be widely disseminated by the relevant federal agencies. It is one thing to require that all petitions submitted after a specific date conform to a specific set of regulations made available prior to that date; it is quite another to subject all pending and future petitions to a set of regulations that do not yet appear to exist and therefore cannot be followed by petitioners, researched by attorneys, or explained to users by USCIS officials.

I recognize that USCIS and other Department of Homeland Security personnel work hard on a daily basis to provide the most efficient and thorough service possible, for the benefit of visa-seekers and for the protection of American citizens. It is disturbing, however, to witness at this critical point in the development of our country's immigration policies and procedures, such confusion and absence of transparency. I urge you to consider the issues I have identified here, and their accompanying proposals, and to recommend that USCIS take action as soon as possible. I very much appreciate your time and attention to this matter, and would be interested in hearing your thoughts.

There are pro's and con's to each and every case, I guess. I am sure not having your husband with you causes considerable stress, as being unable to plan for a future together is - not knowing where you are to be as a family.

I just wanted you to see the difficulties we have been through and that we have been going through this for over three years now. The Ombudsman did nothing for us, after numerous requests for help.

I am sorry this is discouraging - but, believe me, I don't want to paint a rosey picture of a situation that has not been rosey at all. I can only be honest.

We wrote to the Ombudsman back near the end of 2003 and we didn't receive a response at all.

Then our congresswoman sent me an e-mail containing the Ombudsman's annual report for 2004. Her e-mail had the originator's e-mail address on it and I sent an e-mail request, to the ombudsman, for help.

An "official inquiry" was instigated and nothing more was ever heard from them, apart from the usual response of "Thank you for providing us with the requested information pertaining to your son's pending case problem filed with USCIS. We will keep you posted on any case status information that we receive concerning your son s’ case problem. Again, thank you for your continued patience."

I had this response from them last in September 05 and my patience ran out and I didn't bother writing to them again. They did nothing - nothing at all.

Our letter said that we they are required to respond to both them and us within 45 days. Of course I plan to drive them crazy as well.
