K-3 Spouse Visa Process & Procedureshow to contact USCIS?

I have been trying to call USCIS to get an update on our case but everytime I call I keep holding for ten minutes listening to automated messages and then finally it says that no one is available and call at some other time and they hang up! I am really frustrated about that...I am calling this no. 1-800-375-5283...isn't this the no. u are supposed to call? we got our NOA1 for I-129F on Feb.13th and we still havn'et gotten the NOA2 yet and I would like to know what's going on...Any suggestions on how to contact them (apart from online case status check that we do a million times everday!)? thanks

Hi
I had the same problem last week I tried calling around 5 times that day..I kept choosing the
option to change my address. It kept saying that everyone was busy to try again later then it
would hang up on me..I called back and tried the option that says push this number if there was
a typo on your notice..And sure enough about 10-15 min later a lady answered the phone and
was very nice in answering my question. You might want to try that.I don't know if it will work
again, but it did for me..GOOD LUCK TO YOU.

[quote name='Yodrak' date='Jun 5 2006, 12:18 PM' post='233105'] Michelle,

I'm not quite sure what you're saying here, but I can tell you that foreign doctor's do not set US immigration law or policy.

The INA does not require non-immigrant visa applicants, including K-visa applicants, to have the vaccinations required for immigration. The Doctor is simply required to record the facts on the DS-3025 vaccination documentation worksheet - yes the person has had the vaccination or no the person has not had the vaccination, and if no then additionally indicate whether the vaccination can be waived as medically inappropriate.

If a particular consulate does require K-visa applicants to have the vaccinations it's a local policy.

Required for the visa or not, the vaccinations will be required for adjustment of status and it's often less expensive to have the vaccinations in one's home country before coming to the USA.

Many APOLOGIES to YOU from ME..YOU were RIGHT about this and I was WRONG on this issue..

I did find this on USCIS website...

K and V nonimmigrant (temporary) visa applicants. Individuals applying for a K nonimmigrant visa as the fiancee or the spouse of a U.S. citizen or for a V nonimmigrant visa as the spouse or child of a lawful permanent resident (LPR) (including those applying for V status in the United States) must undergo a medical exam, but are not required to comply with the vaccination requirements at that time. They will be required to comply with the vaccination requirements when they eventually apply for adjustment of status.

Again Yodrak I APOLOGIZE to YOU..Thank you for making me aware of this.

Michelle

K-3 Spouse Visa Process & ProceduresK3 visa medical

calibound,

If that's so, it's a consulate-specific policy. The INA does not require K-visa applicants to have vaccinations any more than any other non-immigrant. The vaccinations are not required by the INA until adjustment of status time, when the person is applying to immigrate.

Yodrak

K3 needs to have all the vaccinations as well!

When my husband had his medicals done. I called the doctors office and ask what he needed to bring with him for the medicals and I was told proof of his needels if he didn't have a record for them then he had to get them again..We could not prove that he had recieved his MMR.

So we had to go and get this needle before his medical was done. And as far as the chickenpox

all he had to do was give a verbel that he had chickenpox when he was young.

There is also a section on the paper that the doctor has to mark saying if he had all of his needles

or not.

K-3 Spouse Visa Process & Procedureshow to contact MSC by email or phone ?

Just do a google search on USCIS service centers and various combinations of that and you can find any information you want. Several Immigration lawyers also post the e-mails and tel numbers on their websites. Good luck.

They dont have a phone number. I meand they do have an email address and a phone numb but only senators/representatives know it. My husbands representative talked to them by email every day. They dont release it to the public, of course. Otherwise imagine how many ppl would bust their ba*&s lol.
You can contact California Service center, they actually have an email, but I dont know how much it owuld be good for you.
Good Luck

Maria

Dont say BS pls. There's no way u can ever find the NBC phone numb on the internet! And on google.com Come on pls, I thought this was a web site made for helping ppl, not a BS line

Maria

THIS IS CALLED RESEARCH AND IT COME FROM A GOOGLE SEARCH!!!!!!!!!!!!!!!!!!!!!!!!!! :P

How can customers obtain case status information on filed Forms?
The National Benefits Center is designed to be a support mechanism for Field Offices. As such, the NBC is not set up to deal with a large volume of status inquiries from the public. Customers can check the status of cases filed with the NBC online through the USCIS website (most preferred method), by calling the USCIS National Customer Service Center (NCSC) toll-free number, or by writing the NBC (least preferred method).

Online (most preferred): If you have your MSC receipt number, you can find the status of your case through Case Status Service Online, also available en Español. This service provides you (and your representative) access to case status for applications and petitions that were submitted to the National Benefits Center. This site provides around the clock and immediate access to this case status information. For more information about this service, please review the Case Status Online frequently asked questions.

Calling: You may obtain case status by calling 1 (800) 375-5283, and following the automated instructions. Please have your receipt number(s) ready.

Writing (least preferred): While calling can be more convenient, you may instead choose to request an update by writing the National Benefits Center at:

USCIS-NBC
PO Box 648005
Lee's Summit, MO 64064

If you write, please provide the following in your letter:

Your current name and address, and, if different, your name as it appears on your application;
Any A-number, which is an 8 or 9 digit number following the letter "A", assigned to you or to your application
Your date of birth;
The date and place where your application was filed;
Any receipt number from any receipt notice issued by INS or USCIS for your application;
A copy of the most recent notice sent to you by INS or USCIS on your case, if you have received one;
The date and office where you were fingerprinted and where you were interviewed, if this has been done.
If you filed electronically, include a copy of your Confirmation Receipt notice.
Sign your request, or, if you are preparing the request for the applicant, have him or her sign the request. Please mark your envelope "ATTN: Status Inquiry," and send your inquiry to the address listed above.

US Embassy and Consulate Discussionwhats up with Montreal?

I relaize a lot of people are upset, not sure how it is BS. I'm sure the staff there are doing their best. Mtl does more than marriage based Visa's. Would be nice if the Gov't woke up and spread the work load around.

I tell you how it is BS it is because I am not with my husband and the wait gets langer and longer
and of course you wouldn't see it as BS because you are with your spouse....And people might be doing the
best that they can but with only two consullates in Canada doing these types of visas is very hard to
believe....Yes it would be nice if the US Gov't would wake up....
Sorry for venting but thats just the way I feel.........

I just called Montreal to see what is going on with the interview date for a K3...They have had packet 3
since mid March and the lady there tells me that we are looking at anywhere from another 3 to 12 weeks
before getting a interview date...I can't believe this....She said they have a very big back log it is due to
a huge demand for US visa's and the amount of people coming through their office...This is such BS....
Anyone aware of what Vancouver looks like as far as visa interview wait time?

Hi
I feel your pain....We are going through the same thing I called Montreal yesterday and was told
it could be another 12 weeks before my husband got an interview....But someone posted today that
they recieved an interview for June 20, 2006 and they submitted their papers In March 2006
only about 9 days before my husband did....So maybe something will happen sooner then they are saying...But yesterday I did email the Office of Inspector General..About the back log in Montreal and
ask for them to increase funding so they can bring on more employees to handle the extra work load
I don't think the email is going to help but at this point anything is worth a try...Here is the info that
was given to me from a post I had on here in another section yesterday...Also I emailed Vancouver
about letting us transfer the case to them I am still awaiting word from them to see if we can.....
Good luck to you..

Michelle,

You provide only two bits information relevant to your question, and secondary information at that. What is this sponsor's current financial situation and what does your husband have from the sponsor to document her current financial situation?

Your husband's visa application may not be approved, but it will probably not be denied either. Rather, if the financial documentation that is submitted is inadequate, he will most likely be asked to provide additional information.

Yodrak

Hi

I posted this question over in the regional forum Canada never got a response prehaps someone over here
can help ease my worries..

My husbands interview is this Friday July 21, and I am little concerned.

I had to get a co-sponser in order to meet the income guidelines...My question is hence my co-sponser
does not have a bank account whether checking or savings she does not have one..She did provide
the last 3 years tax returns..Will this be sufficient for the interview? or would this possibly be reason
enough for my husband to be denied? Any thoughts on this would be greatly appreciated..

Thank you in advance...

Michelle

Yodrak

Hi I am the sponsor for my husband but I am on workers compensation and I have been for the past 4 years. I have a letter from them stating what I recieve a month, and even though I am about $200.00 under meeting the guidelines I still filled out the I-134 form. And give one to the co-sponsor to fill out.

My step mother is co sponsoring for us. She is a nurse RN has been for the past 10 years she has no problem meeting the income guidelines. It is just that she has no bank accounts she does everything with cash or money orders..She has provided 3 years of tax returns...

Michelle

Yodrak
I forgot to say that she provided a letter from her employer stating her rate of pay and how long she has been employed with the hospital..

Is there any one on VJ that interview was actually scheduled by the NVC. This process is only for the IR1/CR1 visa applicants. I would like to understand the process. Once your case was completed at the NVC how soon was the automatic system updated to indicate that an interview had been scheduled? Did it list the date of the interview? Was the interview for the next month or was it a couple of months out. Did the NVC rep ever tell you that an interview date was scheduled or did you have to wait until you got a letter in the mail? Any insight that you can provide is greatly appreciated!

For Jamaica the process of the NVC scheduling interviews was just implemented in June. I know there are other countries where the NVC was already scheduling interviews. Per the NVC interview are schedule the 2nd week each month for the next month. My case was completed Jun 25. I did not get a date in July. The NVC is not very helpful. wacko.gif And I can not seem to locate anyone who has been through this process helpsmilie.gif

Jenice

Very good topic to start Jenice. I am curious as to this new process, because when I file at in November, I will be going through this new process. It would be enlightening to know the process and what to expect from the new change. I think this should be pinned in the Yardies thread.

Proud a yu girl.

Claire

Hey Jenice......I am in the States waiting for my husband to join me.....NVC says that they have received our AOS Fee Bill and the I-864 was generated on 8/28 and being sent out this week.....However, Drew mailed his DS-3032 back to NVC last week, shortly after Hurricane Dean, and they still haven't said they received it yet......I am wondering if I should have him go ahead and prepare to get his police certificate or do we have to wait for some kind of paperwork from NVC...I am thinking that I read somewhere that the police certificate is only valid for so long......Do you know any information on this? Thanks!

I called the NVC again last night, since I had not received any correspondence from them since that last letter. The person I spoke with confirmed that the Visa fee was received on 11/28 and that a letter was sent out to me last week.

Can anyone speculate (I like to) what that could/would be? Could it be the DS-230? I would be so happy. But then again maybe not as Mike is dragging his feet with the police report. He is waiting until he get his christmas holidays to go take care of it. I am tired of talking to him about it. I wil let hime do it at his own pace. I have done my part.

Yes, for some reason, NVC doesn't actually send you the DS-230, just instructions on where to download it. They call this letter a "checklist letter." Most definitely, they are ready to receive the DS-230 with the letter they sent.

Thanks Chris Parker good.gif good.gif

National Visa Center (Dept of State)Dilemma between the USCIS and the NVC!!!!

Again, you are NOT DCF. DCF is when the US citizen is a legal resident of the country of the beneficiary and files the I-130 directly with the consulate

You are simply following the procedures for an applicant outside of the US (with the US citizen in the US) you will apply for the visa in your home country - NOT DCF.

Your interview will occur in your home country (also, if you were deported, you are facting the I-212 and a possible ban). That is the way it is supposed to go. You are doing everything right. Your terminology is just wrong

Good luck

Thank you canadian_wife. You made it clear to me, now I understand better. Yes I have a 10 years ban, however I will apply for a waiver, I will file the I-601 to overcome my illegal presence and I-212 to overcome my deportation. Again thank you. God bless you.
babyshaq4MaleCameroon2010-11-14 14:21:00
National Visa Center (Dept of State)Dilemma between the USCIS and the NVC!!!!

DCF is only allowed by certain consulates.. and most times the US Citizen has to reside in the country where the DCF is being requested if offered. IF the I-130 was mailed to USCIS then it was not a DCF. This is done locally and they (office) accepts the receipt of the form.. some offices may process it there while others may send it to the USCIS office over your area to have the form adjudicated.... Others might have something to add.

Thank you RICARDO4EVA2. However, I'm lost as ever after reading your reply. Let me try to explain again, my wife and I filed the I-130 with the USCIS in August 2008 and it was approved in January 2009, I was still living in the US. In August 2010 I was deported from the US. My understanding was that I will go through the NVC with my approved I-130, the USCIS should transfer my I-130 to the NVC because I was not in the country anymore, the NVC will set me an interview date at the embassy in my country after I go through their process, after they have requested a million papers from me, when it meets they requirements they will close my case and send it to the US embassy in my country, where I will be found inadmissible at the interview for illegal presence and submit my waiver package at the interview. So am I a DCF or not? Am I going the right way about getting back in the US? Please could anyone help me understand what my process should be or what I should be doing? Again thank you RICARDO4EVA2. God bless you.
