US Embassy and Consulate DiscussionDoes it depend on interviewer ?
I think they have certain guidelines to follow, but why would you want to argue with the interviewer? Just bite your tongue for 15 minutes and get the visa. Same goes with bribing. It would be crazy to take the chance after all the hardwork you've done. Don't stress over it, most people are pretty reasonable and easy to get along with. Just bring all your paper work and proof and don't give them any reason to doubt your marriage.

My question what if you dont meet the 2007 poverty guidlines and you have to get a co-sponsor. If Im lacking 2k so my co-sponsor has to make up the 2k or so she have to quality for an income of 2or 3?

Your co-sponsor wouldn't have to make up the 2k. They don't combine both of your incomes. Your co-sponsor would have to make atleast 125% of the poverty guideline for his/her family size including your fiance and any children coming along.

I forgot to add that earlier.

US Embassy and Consulate Discussionangel1973
If you dont meet 125% of the 2007 poverty guidelines you'll have to get a co-sponsor that does. The co-sponsor would have to meet 125% of the poverty guidelines for the number of people in his/her household, as well as your fiance and any children coming along. For example, if your mother is your co-sponsor and lives with your younger sister and your father, she would have to meet 125% of the poverty guidelines for 4 people (your mother + your sister + your father + your fiance). If there are any children coming with your fiance then you would add them to the total.

Also, income and assets can be counted, but if you're using assets you must use 5 times the difference in income if you're a co-sponsor, or 3 times the difference if you're the petitioner. So if your co-sponsor makes $25,000 and the guideline is $30,000, your co-sponsor must have $25,000 in assets (5 x the $5,000 difference).

hi guys! i dont wana start a new thread...im just wondering about the co-sponsor thing. if ever someone needs a co-sponsor,... what would be the format? i mean what form should the co-sponsor fill up? and what form for the sponsor? is it the same I-134? so you have to submit 2 I-134? im confused! thanks!

TIMELINE......
FEB. 23, 2007 sent I-129F
MAR 02, 2007 CSS
MAR 09, 2007 checked cashed
MAR 12, 2007 touched
MAY 17, 2007 touched
MAY 20, 2007 RFE
JUN 23, 2007 sent RFE
JULY 09, 2007 Approval Notice from CRIS

Yep, one I-134 for the petitioner and one for the co-sponsor.
Congratulations on getting approved :D

US Embassy and Consulate DiscussionYet Another I-134 Question

How exactly does one determine what 125% of the poverty line is?

Is there a national guideline for what the poverty line is?

How would one find this out?

My father is going to be a co-sponsor, along with myself, and I imagine his $50,000 a year is more than 125% away from the poverty line.

So, if he signs the form, and shows "Hey I made $50 grand this past year", would that be all the info necessary? Would that be enough? Or would we need to do anything else?

You can find the guidelines here:

http://www.uscis.gov...form/I-864P.pdf

Read some of the above posts to see what to have your father send along with the I-134. You need supporting documents, like employer letters, pay stubs, etc.

Also, he has to meet the guideline level of his household. So if he has like a wife and 2 kids as dependents, it would be a household of 5 counting your fiance. Make sure you keep that in mind when checking household size.

US Embassy and Consulate DiscussionYet Another I-134 Question
My fiance will (someday) be having an interview at the London Embassy and am just wanting to get an idea of everything needed for the I-134.

I found this on their website:

To substantiate the information regarding income and resources the sponsor should attached two or more of the following items to the affidavit.

1. notarized copies of his or her latest federal income tax return;
2. a statement from his or her employer showing salary and the length and permanency of employment;
3. a statement from an officer of a bank regarding his or her account, the date the account was opened and the present balance;
4. any other evidence adequate to establish financial ability to carry out his or her undertaking toward the applicant for what might be an indefinite period of time.

We are going to have a co-sponsor (or sponsor other than me) and I just want to give them an idea of what we will need. They make over the poverty guidelines, so I know the bank statement and other assets aren't really needed. What about the federal income tax returns? How the heck do you get notarized copies of those? I was planning on transcripts, can you get those notarized? How do you go about that? Just go to the notary and swear that they are yours?

Thanks so much for your replies.

Thanks guys,

I didn't give them an exact draft, just a list with all the information I would need on it. I think I'll ask about it Monday, since that would be the two week mark. I just hope the secretary didn't forget to give it to him, or he didn't forget to do it.

I was wondering how long you should give your employer to supply you with the employment verification letter before asking about it again? I hate to nag about it, so I was thinking maybe waiting two weeks and then just asking the secretary if she'd had a chance to ask the boss for the letter yet. I work in a tiny office, but it's part of a pretty big college, so I know they're busy with other important tasks.

I have a quick question. My fiance is STILL working on his packet 3 headbonk.gif and we were wondering how many photos he needs to get. He's supposed to attach one to the DS-156, which is to be sent in in duplicate. So are those the only ones he needs or does he need to bring two more to the interview?

CanadaRCMP record check
Hi
My husband lives in Canada he is a PR there..So he needs to go back to the age of 16yrs old?
I thought I read somewhere not to include any US address...Am I correct on this?
He lived in the US from 1999 til 2003 He was born and raised in India, And he doesn't think it will
be very easy getting this from India hence he hasn't been there since 1999...Is it possible INS would still
have this on record hence he came to the US as a student and had to go through police checks then?
Any thoughts on this?

Hey Michelle, did you guys pay for the H&R insurance? the one that says they'll go with you to an audit and pay for the fees if they messed up?

Hi
yes we did and all they did for us file the T1 with is some kind of adjustment paper..And when my husband questioned them at the promise to stand behind their work and pay this 3 grand and CRA could send it back to them so we file this years taxes they said no that they didn't trust our check not to bounce...And that they had already done us a favor by filing the T1 free of charge..Plus they offered to do this years taxes at a 15% discount as if we would go back to them again..LOL And they would not pay the interest on this 3 grand...Something about the promise to stand by the work had to do if you had to pay penalties...I don't know what the difference is? Penalties-interest it's all the same to me it comes out to owing more money..
We have contacted a lawyer about all of this...

CanadaStill waiting for Montreal

hi, I don't know if this helps, because I don't know if montreal schedules K visas differently than CR1's, but we had been waiting since february 6 when our case was complete to get an interview. learned the week before last it is for the beginning of June (only a month away from when we received the letter)

and if it's any consolation, we were hearing that the best we could expect was a late june/july interview. so there's a chance you may have a July interview, despite what they may say..

I sure hope so thank you for the update..I called USCIS to check on the I-130 website says Dec 10,2005
but the lady there says Dec15,2005 so that was a surprise to me..Maybe Montreal will have a surprise as
well..One can only hope..Good Luck with your interview and congrats....

Hello all,
Our fiance petition will expire Oct. 1 and we still don't have an interview date. I emailed the embassy, asking them if the petition would be extended, and all they would answer me is that the appointment hasn't been scheduled yet. Has anyone else had this experience or can anyone comment? They didn't answer my question, and the answer I got was not helpful at all. I know that others have been denied visas due to expired petitions.

US Citizenship General DiscussionQuestion on N-400 Part 10 Section D Line 16
Hi Everyone

We are looking over things a bit early in order to be very thorough and hopefully get it right the first time. :)

But I am wondering, on the line mentioned in my Topic Title, the question is this.......

"16. Have you EVER been arrested, cited or detained by any law enforcement officer (including USCIS or former INS and military officers) for any reason?"

so our question is this.........

last year my husband got a speeding ticket so yes he has been detained along side a highway and yes he was cited and had to pay the fine for it so I'm thinking, in order to be completely honest we would have to list that here.

Are they gonna hold that against him in any way? I mean, the section is under "Good Moral Character" and it sounds bad that way ya know?

A little concerned here,

US Citizenship General DiscussionDocument Translation

YuAndDan quoted the correct procedure for translating any non-English document that you send in support of paperwork that you are filing with a USCIS service center. You got away without a translation when you did DCF because you were filing with the consulate instead of with a USCIS service center.

For naturalization, I can't think of any reason why you'd need to send any divorce papers. If you don't need to send them, you don't need to send a translation.

In the instructions for filing the Naturalization application, on the Document Checklist, it says to send proof that all prior marriages were ended either by divorce papers, death certificate, or annulment papers.

And yeah, duh, makes sense we didn't need the translation since we filed in Amsterdam. Didn't think of that til now. Thanks!

US Citizenship General DiscussionDocument Translation
We are preparing our forms and documents to apply for naturalization in December 2006.

My question is this, where can I find affordable and accurate, trusted translation for Dutch to English.

More, is it necessary? The reason I ask is, when we filed DCF in 2003, we submitted my husband's divorce papers in their original language (Dutch) and it was not necessary to also include a translation of them into English. So now, I am wondering if it is necessary to have them translated for the Naturalization process.

Can anyone help?

US Citizenship General DiscussionReceived First Notice of Action
We received our first Notice of Action today from Homeland Security on Rob's citizenship application.

I says that they have received our payment. (I already knew that coz the check already cleared our bank account. lol)

It also says that the application is in proces but has the following exceptions......

"Missing Evidence(s) - your application was missing evidence(s) that you will need to provide at the time of your naturalization interview. You will be notified under separate notice of the necessary evidence(s) that you will be required to bring to your interview. Do not submit the evidence(s) by mail."

Then it also goes on to say check your birthdate and address & notify them if anything is changed.
It says we will be notified of the date & place of your interview when it has been scheduled by the local USCIS office. And that it should be within 365 days from this notice.

And in a tiny paragraph at the bottom it says this.......

All naturalization applicants who were between the ages of 14-75 at the time of filing must have their fingerprints taken at a USCIS Application Support Center (ASC) so they can be submitted to the Federal Bureau of Investigation for a criminal history check. If we received your application without a fingerprint card (FD-258), or your fingerprint card was received on or after December 3, 1997, you will need to go to an ASC to be fingerprinted. Do not have your fingerprints taken anywhere else. You will receive a notice that will provide you with information about when and where to go to have your fingerprints taken, and what youwill need to bring with you.

So anyway, my whole questions are these.....
I followed the Guide to Naturalization Checklist to the letter. Checked and re-checked the things shown on their checklist. So what could possibly be missing???????
And also, should we have sent fingerprints in with the application? It did not say this either on the Guide/Checklist. It said we would receive the notice of where to go and have them done.

I guess this whole notice just made me feel like I didnt do the application right or something. I don't know.

Did anyone else here have the same experiences? And do you think the evidence(s) would be anything major that might take alot of time for me to locate or get copies of????????
