Hi all Vjer,

Quick question, I filed for K1 Visa on 6/27, they cashed my check yesterday.Does that mean that my paperworks is good and that they will be sending me the packet1 soon? I am happy about getting it started and moving along...


No... it just means that they got your file and cashed the check :lol:
You should receive NOA1, which is not a packet, but a paper (notice of action), where they state they received your file. From there you will be able to get your case number, so that you can follow it online (you can also get the number from the back of the checque).
NOA2, which is the approval, will come later on... hang on, you are just at the beginning of the road :thumbs: good thing you're with Vermont... they are moving faster as far as I know.

I see. So NOA1,next NOA2 then Packet 3 and finally Packet4 right? How long it the time from NOA1 to NOA2? Just planning ahead so when it comes down to it I would have everything ready....


The time between NOA1 and NOA2 varies, you can see an estimated time on the processing page http://www.visajourn...h...&page=times. VSC is currently estimated at 63 days, but some people on here have been waiting over 80. There's been a slow down for some reason and there's alot of VSC filers waiting for NOA2's.

I also filed I-129F for K-1 Visa for my Cuban Fiancee...Mailed on: 6/25/2007 to TCS as instructed on Form....Received date 6/29/2007 from CSC...
I recieved a Hard Copy from CSC???? Seems to be sent over from TCS.....NOA Notice Date:07/9/07 was recieved by me on 07/13/07.
I was excited, but when I checked the case stauts on-line with my reciept number provided on the NOA, it reads:
Receipt Number: WACXXXXXXXX
Application Type: I129F, PETITION FOR FIANCE(E)
Current Status: We mailed you a notice requesting additional evidence.
On July 13, 2007, we mailed a notice requesting additional evidence and/or information in this case. Please follow the instructions on the notice to submit the evidence and/or information requested

How can July 9 NOA Notice date be followed by RFE on July 13? I was very accurate and made sure are required documents and evidences of relationship were included.... What Can this be for? Any assitance?


It sounds like you got an RFE. You'll probably get a notice in a few days telling you what they need you to send them. I think most people's case status' are updated online before they get it in hardcopy. It could be for anything, maybe you were just randomly selected to provide orginals for verification. Be happy they've already looked at your application. Once you send in the evidence they are requesting you'll probably be approved immediately (if it's what they are looking for). Alot of people on here have to wait ALOT longer than that. It must be something to do with Cuba.

Not only do we hope they hire more staff. But take a look online with the USCIS careers these Adjudicators make: $50,000-$60,000 a year. Now, for THIS amount of pay, there must be SOME sort of responsibility. Think of ALL the information we EACH sent in to them in our personal package. They can't just glance and say, looks good, give them noa2. This information we send MUST be LOOKED at, reviewed, scrutinized. They are PRE-APPROVING us. Remember, the Embassy has NO AUTHORITY to reject an petition after USCIS approves it with NOA2 UNLESS its for NEW evidence they find. So the job these initial Adjudicators have is important. It helps keep out those looking to commit fraud, or worse. (Would you feel good if they rushed this process more and let in someone who used love to plan a terror attack???) They have tons of petitions to go through. I know this is hard, painful and tiring. But I for one am greatful that someone is taking the time to make sure all is ok, so I have better security in my home. So I have better security knowing that no one on the Embassy level can find some reason to deny. Im NOT saying that any of OUR loved ones would be this way...but we only see a SMALL fraction of those that petitioned here on VJ. I don't know those people. I have grandkids to protect. I'll gladly wait for my SO. Whats a year or two out of 30, 40 or 50 together??? Lets be patient....let them do their jobs. We may not like how long we have to wait..but Im sure those representatives are working to get these out.

Well i rode what you people said! most of are dispointing... if we all contact our cong and sen, they have to do someting for us, because they are working for us! thats there job, if we all ... I don't know what to say... I know there is 2 million files in CSCIS, but still they can hire people to prosses faster! thats what we paying for!


Don't be disappointed. Just about everyone here goes through a phase when they don't think they can stand waiting on USCIS anymore. 3-4 months seems like a long time, but it will pass much faster than you think. I'm already on my second month, and even though it's hard being away from my fiance, I know I'll make it and I'm certain it's worth it. You'll be with your loved one quicker than you expect. You'll probably look back on this once your together and think "that wasn't too bad." At least that is what many of the people who have already been through this process have said.

I have tried this with both congressmen and senators and they are of no help unless you are outside the processing time. You need USCIS more than USCIS needs you. Have you any idea how many "customers" they have? They offer a service for which the demand is so high, that they can drag their feet indefinitely and still rake in the dough. The only real way to make a difference is through the law. You gather enough people and a smart group of lawyers who know how to make the arguement, and you can make some real change. But that is going to take a lot of people who are willing to have their NOA1 and NOA2 for their petitions offerred into evidence. I am not a lawyer and I am quite frustrated with this process, but I honestly believe this is the only way to make USCIS make sensible and pragmatic changes. Just my opinion.


You're right. It's not like we can boycott their service...then we'd never see our loved ones.

honestly it can only help everybody...this does not mean that my application is going to go ahead of anybody, it just means that the people, or better the system in the centers will get a little nudge and maybe process things a little more efficiently


I wasn't meaning you were trying to get your application in front of anyone else's. I was just pointing out that if we bombard the congressmen with emails/letters/phone calls, they will have to sort through all of them to find the ones that need immediate attention, like those sent from people who have waited over six months for their NOA2, or those whose paperwork has been lost and need help getting USCIS to do anything about it.

This is small time compared to the other "more important" things going on. Money is the only thing that really talks. If you have the cash to spare to pledge to their campaign, then perhaps, just perhaps, they could help you out.


well if it comes to money, last i checked they were raising the prices to all the immigration processes absurdly...if enough makenoise by saying , hey you raised our prices and the service isonly worse, maybe just maybe something will be done...hey we have nothng to lose!!!


Prices haven't raised yet. We don't know if service is going to be better or worse after they do. We just need to be patient. We'll all get a turn. :thumbs:

I need to address this issue since I started the thread. First and Fremost, I am not the poster "getalife" nor did I make an account just to past rude comments. I have no clue who this poster is nor do I care. I don't need to hide behind a ghost poster to state my views! I however, do care about my own reputation and why I am here in this forum. Like the rest of you, I am here to learn, to share and to prepare myself so I too can be next to my loved one ASAP. I shared my stories to make readers aware of our unique situation and challanges directly or indirectly relating to K-1 Visa issues. I choose not to share my detail information that may effect me and readers must understand and respect my wishes. I Frequently discussed the travel restrictions to Cuba but sadly some readers need to have everything spelled out for them. Travel is not permitted without a lisence from the Treasury Department, phone calls can be made if you are willing to pay 2 bucks a minute, letters can be delivered via DHL in Holland.....Get the point? It is not impossible to meet or communicate with your loved one, but rather difficult and costly. However, love seems to bypass all barriers in life......So please try to understand and act accordingly...

You go to Cuba through Canada. Or if you have dual citizenship and a passport through another country. Or via a religious or cultural mission. There are many ways to get there legally and illegally.

And since you'd have to have show THE FEDS how you got to Cuba, I'm guessing being cagey about it is a little silly, no? What did you use for evidence?

Anyway - as for the original topic, ignore anyone hating on Cuban filers just like Vermont filers should get over bitter comments from CSC filers. If you get through fast, hey, more power to ya. I am jealous of people who got through faster. But that's just jealously, I don't hate them or think it's "unfair." It is what it is, and any normal person facing a 90+ day wait would rather NOT face that wait, right?


TimsDaisy; you are right and wrong at the same time...Let me explain to best of my knowledge what is legal travel and what is not. According to the (OFAC-Treasury Department) Cuba travel for all US Citizens and Legal Residents are illegal regardless of dual citizenship or nationality. Although many travellers use third countries for travel to cuba such as Canada, these types of travels are indeed illegal if not licensed by the OFAC. Now, due to pressure from the powerful Cuban-American Republicans in Florida the religious licenses are under review for sometime now and this is no longer an option for travel. Cultural visits are also canceled and last year the President made it more difficult for Cuban Americans to visit their families in cuba and licensed family visits are now once every 3 years for a maximum of 2 weeks limited to immidiate family, no aunt cousin etc... So you are right because people do travel illegaly and legal travel is very limited and is usually set aside for politicians and big shots in the agriculture sector to go visit Castro and his gang to sell them American goods legally. Ironic but families are torn apart because our dollars could help Castro stay in power, but the sale of goods from US Agricultral companies are somehow different....

I thought you were given a six month period to come to America, and once you arrived you had to be married within 3 months. At least that's what the flowchart says is "typical".


What you say here is correct... you have 6 months to enter and you will receive a 90 day entry (stay). The original post said 6 month entry (stay).


I just assumed that since "entry" means "right to enter" the original post meant they had the "right to enter" for 6 months. Sorry for any confusion. :thumbs:

Just wanted to say involving your state Congressman really does help.

Montreal is taking a life time to schedule an interview.So I had emailed

Vancouver and ask them if they would take my husbands case. They emailed

me back and said they would look into it. Two weeks went by and I never heard

back from them I emailed again and ask if they had decided to take it. They emailed

back and said it is still being considered.So this past Monday I contacted my Congressman

and ask them if they could contact Vancouver to see what was going on. So they sent an

email and inquired for me instead of Vancouver emailing the Congessman's office they emailed

me and said they were sorry it took so long to get back with me and wanted my husband's

current address. And a brief reason to why we wanted it transferred.So we emailed them back

with what they wanted. That was this past Wednesday today I got an email from Vancouver

saying they would take the case. They even sent an email to the Congessman's office as well.

Saying they would accept the case. Vancouver says they are now giving interview dates for mid

June.

Any suggestions from anyone on the best and least costly way to go from Toronto to Vancouver?

i hope we get lucky!! our interview is the 30th of june, which means we wouldnt get mail until mid the following week with the 2 holidays hitting atthe same time!

Just do the prepaid envelope! Dave has his interview on Tuesday. Flew back the same night and by Thursday morning, his passport was in his hands (DH lives in BC and his interview was in Montreal)

interview is on a Friday in Montreal..

Does this mean he will not recieve his visa (if approved) till Monday? I was under the impression

that they didn't give visa's same day there. Is this true?

Hi,

Can those of you that have already had your K3 interview in Montreal pleasse advise on the paperwork

that must be presented to them at the time of interview aside from whats on the check list if any.

I know the interview is still a little over a month away, But I am so afraid that we are going to get there

and not have something they want.

Also do they want to see pictures? if yes about how many should we have?

Do they accept photo copies of the papers they need or does it have to be originals? Or photo copies making

originals availible if needed? Sorry for so many questions just losing our minds here..

I just looked over the interview letter again and I don't see anything on there as far as when the pictures need to be taken it just says to bring 2 photos, Your medical examination, a valid passport and USD $100.00 cash only..Now packet 3 says 2 full face photos for each visa applicant measure 2x2 inches (roughly 50mm square) with head centered in the frame.Again nothing about date of photo. hope this helps.

I've had the same problem but coming into Canada, I am the USC and my husband is a permanent resident of Canada..When I crossed at the Rainbow bridge in Jan I was with my mother coming into Canada...I could not believe how I was haressed..The CO did not think I was going to leave Canada and go back to the USA. I tried explaining that we were in the process of the K3 he wanted to see the papers I showed him he still didn't believe me. So he called my husband ask him if he was married? What is his wife's name? where did we get married? After speaking to my husband the CO gave my a paper and said I had to leave Canada in 6 days..And when leaving Canada I had to bring the paper back to the CO's at the crossing of my choice.They didn't say two words to my mother she could have stayed upto 180 days no problems. So I left in 5 days, On my way out I went back to the Rainbow bridge gave them the paper so they could note that I was leaving Canada the CO walked out side and watched me cross over.. I went back to Canada one week later crossed at rainbow again the CO asks whats your Citizenship? why are you coming into canada I said to see my husband..The CO tells me go on have a nice visit..I mean go figure, It is just by luck and draw on both sides I think.

I just recieved an email back from Montreal about not having any bank accounts here is their reply..

Should be ok, we will make the final decision on interview day.

Sorry no answers for ya but some people don't believe in bank accounts , my gut feeling is that as long as you have all her other financial records it'll be fine.





Thanks to evey that replied..Buttons you are right alot of people don't believe in bank accounts and my step mother is one of them she feels her money is safer with her then in a bank...Good Luck to you with your interview...Also Good luck to you and your husband as well blahblah yes my husband's interview is on Friday as well.. I can understand about the nervousness. Our interview isn't till August 11th and I'm already nervous. Last night, I kept on waking up every hour. :blink:





Thank you Cygnet for your kind wishes..I am on my third day of no sleep..This whole thing is killing me slowly..I arrived in Canada on Canada Day and I have been a mess ever since. Just the thought of making the trip back to the states alone again has put me in a mess of mind.. :wacko: Good Luck to you with your interview as well..

Hi,

Everyone well my husbands interview is only 5 days away. And I am getting very nervous now, I am sure we have everything that is required for the interview.

My only worry is that my co-sponsor doesn't have a checking account, We have 3 years of tax returns for her but I worried that Montrel is going to make an issue out of this..Any thoughts on this anyone?

I hope that I am worrying for nothing..

Let me rephrase my question here and perhaps I will get a response from someone.....

I had to get a co-sponser in order to meet the income guidelines...My question is hence my co-sponser

does not have a bank account whether checking or savings she does not have one..But she did provide

the last 3 years tax returns..Will this be sufficient for the interview? or would this possibly be reason

enough for my husband to be denied? Any thoughts on this would be greatly appreciated..
