Yesterday I’m coming home from work and all I could see was love all around me, couples holding hands laughing and hugging, squirrels playing catch me if you can. I’m on my bike sitting at the light and a bike pulls up next to me with his girl on the back we give the usual bikers nod and thumps up and I’m thinking to myself everybody’s friken with their love one but me.

So let me understand..since USCIS has stopped all work visas for the year, our service center can now get on with its normal duties???? (i.e. getting our noa2's done??) If THAT is the case...will we see things progress FAST again? And that was effective immediately...so does that mean that they are NOW processing other visa apps? Or just that they stopped accepting applications for work related visas for this year...IM BRAINDEAD TODAY

I'm not sure how fast they will start processing, but another member posted that they had to catch up on alot of other paperwork by the 13th of July, so I'm guessing we'll start to see an increase in I129F touches after that date. I certainly hope so. It would be nice to see them earlier....

I don't mean to depress you guys but VSC's processing time dropped from 57 to 62 days, ahh. The I-130 jumped up by like 8 days, though, so at least we know they are doing SOMETHING. I hope they are wrong and we all get our NOA2's soon. Tomorrow I'm expecting to see a ton of April filer's get their NOA2's :D. I expect that everyday when I get on here, though.

We check ours twice a week. Tuesday evening and saturday evening GMT. Just to satisfy ourselves that it's still there. Ideally I've heard you don't want to see a touch within first 4 weeks after NOA1 as that points towards an RFE which non of us want right???!!!???

really? i have never heard that before...does someone look over all of the petitions to make sure they are complete, before they actually go through and decide whether or not the petition is approved? so one generally gets an rfe much earlier than they would have been expecting to get the approval notice?


I'm sure it depends on the processing center. Since VSC USED TO (not currently) processed applications in about 30 days, a touch in the first 4 weeks would have been GREAT. I don't know about now, though.

Interesting thought, I inquired to my attorney about just that thought on Monday! I asked him specifically if certain countries where processed quicker than others, the reply I got was "not to the best of my knowlage", yet I was also told that it appeared some countries visas went through the USCIS faster than others. So your guess is as good as mine.
It would also appear that the USCIS "pending time for K1 visas" is not accurate per cases he has filed, though Vermont has slowed down, 60 -90 days seems to be more in line with what he has been seeing. Hopefully the process will speed up once we get through the summer months, as they seem to be typically slower, (not to mention they are cutting back from 4 to 2 USCIS processing centers)!

Dear Friends:
A little insight as to challenges that face Cuban K-1 applicants and why there is no reason for some VJers to be envious, angry or even stressed out on why CSA appears to approve or even look over some Cuban cases so quickly while others sit around and take longer. If you could only imagine how a normal, loving relationship in Cuba is so exhausting and difficult to manage as basic human necessities are daily challenges that no one could ever understand. Not even Cubans! For example; there are no visits of any kind permitted due to a 45 year old US economic embargo and if such visits indeed take place, there is often no proof of entry as the Cuban government does not stamp US Passports. Letters never reach your loved ones due to a failed Cuban postal system. There is no Fed-Ex, UPS or any priority or overnight services to Cuba so you better have all your documents in order or else. E-mails, IM's, Chats are non-existent because Cubans are not allowed internet access. Phone calls (at a rate of $1.89 per minute) are to different numbers as most Cubans (especially from the interior) do not have their own telephone lines at home and have to depend on a neighbor or a public phone to maintain contact with their loved one's. Cell Phones are for foreign tourists or diplomats only and no ordinary Cuban can legally own one, so no text messaging either. How about that! Now, can you imagine a simple request for proof of relationship? This is actually a very simple request but a very difficult task for petitioners like us given these types of circumstances. With all that said, even when you are lucky enough to have your US visa approved during the whole K-1 Process, the Cuban immigration now has to approve the departure by paying a $400 departure tax and a very lengthy wait and let's see process where they can tell you if you can actually leave the country. OH! Let's not forget that you only have 3 months to enter the US once your K-1 visa has been issued by the consulate or your visa gets cancelled. How about that! Now, would you want to trade places? So I beg of you not to get hysterical, offended, enraged or even jealous as to why (if true) Cuban petitions are processed more quickly, as I am quite certain that none one of you is willing to endure our pain and sufferings just to have our loved ones next to you. So a month or two of longer wait time is a very small price for freedom that we often take for granted.


I think you have six months to enter and once you arrive three months to be married.

I also filed I-129F for K-1 Visa for my Cuban Fiancee...Mailed on: 6/25/2007 to TCS as instructed on Form....Received date 6/29/2007 from CSC...
I recieved a Hard Copy from CSC???? Seems to be sent over from TCS.....NOA Notice Date:07/9/07 was recieved by me on 07/13/07.
I was excited, but when I checked the case stauts on-line with my reciept number provided on the NOA, it reads:

Application Type: I129F, PETITION FOR FIANCE(E)
Current Status: We mailed you a notice requesting additional evidence.

How can July 9 NOA Notice date be followed by RFE on July 13? I was very accurate and made sure are required documents and evidences of relationship were included.... What Can this be for? Any assitance?


It sounds like you got an RFE. You'll probably get a notice in a few days telling you what they need you to send them. Be happy they've already looked at your application. Once you send in the evidence they are requesting you'll probably be approved immediately (if it's what they are looking for). Alot of people on here have to wait ALOT longer than that. It must be something to do with Cuba.

Give them a call. That is the best thing to do to find out what the hell is going on. It seems after looking at all the June filers here going into California, that CSC is very discriminating as to which country's are getting priority in being processed. Anyone else realize this too? I live in Cali and sent my 129f in early June, got the WAC# off my cashed check and called them the other day and nothing has been done at all! No NOA1 or nothing. They told me that havent got that far with my case. It must have something to do with Brazil and south of the border in general that they dont like. This process is loaded with discrimination. They are deliberatly trying to make people suffer to make them give up is my view. Its been six weeks and my case has not moved an inch. So dude, just call them ask alot of questions.


I, too, think they are discriminating between which countries get priority access, but not in the way you're thinking. CSC is usually pretty slow at processing applications, currently at 103 days, and that's after you get your NOA1. So relax and be patient. Maybe there is some sort of agreement to rush Cuban applications, I don't know, but I honestly doubt they are intentionally processing southern applications slowly. It's only early July, you've only sent it a month ago. I've read on here alot of people are not getting NOA1's from CSC yet because of computer errors, so don't jump to conclusions. You're probably in for a much longer wait, and blaming the service centers for trying to force you to give up isn't going to help anything. The only cases I've seen get approved in less than a week or two on here are Cuban cases, so it's nothing specific to Brazilians or Mexicans. My fiance is from England and we filed over two months ago and still haven't recieved our NOA2, and we we're filing at VSC, the fast:rolleyes: service center. So calm down and wait you're turn like the other 99% or more of filers have to do.

We'll all get there eventually. :thumbs:

We filed I-130 in April.....I just sent in the AOS packet (I-864) via DHL on Sept.5th.......Husband sent out DS-3032 (Choice of Agent) Aug.21st from Jamaica......They still say they haven't received his DS-3032 yet......and I call daily......was told by NVC once they receive something in the mail or overnite.....it takes up to 5 business days to post......So as we patiently wait......I can only hope my baby is home for Christmas......Birthday in November would be GREAT as well..... yes.gif

When I completed the I129F Petition I included my fiance's two girls. They are from Nigeria and have 4 or 5 different names. So I used the middle name that we discussed using. Now I have their birth certificates and that name is not on them because they can only use so many of their names when filing. The other concern is that their mother who has passed and my fiance were not leagally married but had her name as his on the birth certificates. Does either of these issues have reason for concern?

Any help is appreciated.

Yay!!! Another step in the process is over! We recieved a letter dated 19th March that our petition was being forwarded but I havent recieved my packet 3 yet so I am calling this morning (£1.20 per minute aggghhhhhh my poor phone bill)to see if London have recieved it. Eeeeeeeeeeeeek, people keep asking me if I'm scared about immigrating. I wasnt whilst that NOA 2 was still in the pipe line....but I'm starting to get scared now....its all happening!

This may be a silly question but is the letter considered the NOA2 approval? I recieved my letter also and my fiance has already recieved his letter with istructions in it. No packet just a letter. How long is the I129F petition good for? The instructions stated to gather all information he will be needing and then contact them for an interview once he has all the paperwork. He sending for the London police report tomorrow and I think it takes 10 days. Once we have that he will get his medical and be ready to go.
Any insight on the process would be greatly appreciated.

Everyone brings up discrimination. It is perfectly legal to discriminate. We all do it. The only type of discrimination from a state actor that is illegal involves race, age, gender....and so on. Also, you have no constitutional right to bring someone here from another country.

Of course the embassy will look at obvious differences. There is no legal issue concerning age. She isn't being denied a visa due to her age. Doesn't matter what age you are, you can get a visa. She is being denied because the difference in age is suspect. If I were working at the embassy, and I saw the picture posted and knew of only one trip being made....I'd tend toward fraud on his part.
