Personally, and this is only my personal opinion, I think you have a pretty good attorney. She has kept you updated with the situation and has tried to explain, diplomatically, how the USCIS and NBC works. There may be rules and dates and processing times they are supposed to meet, but in reality it isn't that simple. Rarely do they meet deadlines and many others are in your situation, waiting, waiting, waiting, for one thing or another. When it comes to requesting information as to why certain applications are taking forever, there are specific times you have to wait before you can even submit a question to them! This appears to be the problem with your I-129F and she is right, you can only wait for now. Frustrating I know.

If they are going to issue an RFE with regard to your I-130 you will probably hear soon. She is suggesting filling out the waiver paperwork because she suspects (and probably with good reason, due to her experience) that this is what is going to be required. You have two choices really, you can pay the $1000 and have her prepare it for Adiel to take with him, so he has it on hand. The alternative is to get there, find he needs a waiver and then there if further delay, which can be considerable. It is good that she has requested an "update" and she should hear back with regard to that soon.

I don't think contacting your congressional representatives or senators will help much - they have never helped us and just ask the same questions any of us can ask, really. That's just my experience in dealing with them. I suspect that is why your attorney hasn't even bothered mentioning it. You can request them to help, they will ask you to sign a paper allowing them to request information on your behalf, but they only get the same information your attorney and yourself will, if you put in a request for information.

I don't feel that his ethnicity is the reason for any of the delays, although others on VJ may be able to confirm this one way or another. I think it is just down to huge backlogs that have accumulated in the USCIS, NBC, State Department and FBI. The whole immigration process is just a mess at the moment and the government seem to be placing their focus on how to deal with the problems of "undocumented" aliens over those that are going through the preferred process.

I don't know what happens when you are already married and coming to visit your spouse in the US. I know that you would need to show "ties" to your country of origin to prove that you are not entering to circumnavigate the required immigration process, such as mortgage papers, or a lease, a letter from an employer, bank details, that kind of thing. I am sure there are others on VJ that can advise you on that.

Hang in there! I can only imagine this is torture for you. For what it's worth, to me it sounds like you have a good attorney. She is doing all the right things, she is keeping you informed (which is more than our attorney does) and she seems sympathetic to your concerns.

It will all be over, soon I hope, and you will be able to enjoy married life together. Keep that goal in mind and you will get through this.

Dear Mireya,

This is just to update you on the two petitions you filed last year for Adiel. I completely understand your frustration with the terrible delay for both petitions and here is what I found :

1-129F : USCIS / National Benefits Center is currently processing K3-K4 applications filed on July 17th, 2006. Your petition was filed on July 18th, 2006 (can you believe it?). So, it has not even been processed yet. Apparently, there is a terrible backlog at the National Benefits Center and therefore, this horrible delay.
So, for this petition, it is not outside the processing time and there is nothing we can do about it except wait.



2. I-130 : I called USCIS to inquire about the unusual delay in the processing of your I-130 Petition. It is already way out of the NORMAL processing time. They could not tell me exactly why this is the case but indicated that it is possible that they are going to issue a request for further evidence. This is just speculation and could be with regard to either the issue of the marriage such as the issue of the parties not residing together or they are doing some kind of background check. I believe that they are taking precautions with regard to persons of certain ethnic origin and especially from the UK and some Middle Eastern countries. With this, the agent told me that all I can do right now is to put in a service request for information / update, which I have already done yesterday. They will contact me or you directly with this update / status or request for further evidence. This will apparently happen within 45 days. I calculated that we should hear something about the I-130 no later than March 8th, 2007. Please let me know if you hear anything before the expiry of this date.

Mireya, I am sorry about this. I hope that you understand that this delay is beyond my control. Each case is treated and processed on its own merits. Your case is a little unusual and of course, is complicated by Adiel's summary exclusion, reasons for which are still totally unknown to anyone except them.

Now in regards to the thing that she is calling "summary exclusion" she is referring to my husband being denied entry last year in Feb, when he tried to come in for a visit at which time he was held over night and denied entry on his passport for "immigrant intent" . He was turned around and put on the next flight back to the UK the next day. Before we got married he entered the USA with out a problem. We were told by an immigration officer tha beacuse he ws not married to a USC he could no longer enter to visit on his British VWP

When we got married we did not file for any type of visa immediately after because we both had other things to sort out in regards to jobs and school and family. We got married unexpectedly on his last visit to Texa. Our original plans were to get married latter in 2006 but we just could not wait and we took the big step. After we got married he left back to the UK and I remained in TX. 2005 was a tough year. Due to natural disastsers *hurrican Rita, financial strain and because we both had new jobs we were not able to see each other for over a year because we had no allocated vacation and money was tight. Well when we finally got every thing in order we planed for Adiel to come and visit so that we could prepare a Catholic ceremony and get the visa process started. We got married unexpectedly and our plans were to save money and have a more formal ceremony latter with our family and friends. We only had a civil marriage and an Islamic one in a Masjid where only him and I were present with four witnesses and that was it.

Our plans were not for Adiel to stay here but for him to go back to the UK until the whole visa process was complete. Adjusting status here after we got married was not a possibility because he has two small children that he has from a past girlfriend who he needs to provide for. As you can imagine with that kind of responsibility he can’t be with out work for too long. Well to make the long story short when he tried to return latter for a visit we were totally shocked when he was denied because he had never had a problem entering the USA before. This is the complete time line of events:

04/16/03 Met online
08/16/04 Mireya flies to UK to meet Adiel
08/21/04 Trip to Greece
09/02/04 We return to London
09/05/04 Mireya returns to the Texas :0(
12/13/04 Adiel flies to Houston :)
12/31/04 We bring in the new years with a bang we get MARRIED!
01/06/05 Adiel returns to London. :(
08/ / 05 Adiel visit to Texas gets canceled because hurricane Rita.
02/12/06 Adiel is refused entry on VWP and both him and I are interrogated by FBI officials at Houston Intercontinental airport. We are both clueless as to this. I was not allowed to see him and he was not allowed to see me. The FBI asked me the weirdest questions like: How many times a day does he pray, has he ever said any thing against the USA, when was the last time he went to a mosque, is that ring on your finger from him or from another marriage? Where does he work, what does he do? How did you meet?
03-04/ 06 Gather fees and all paper work to start K-3
05/23/06 K3 process begins (see time line below)

Any ways what do you think about what the lawyer has said in regards to why our case might be difficult because we got married and we have not live together? Also it pissed me off that she did not even mention lets try and contact a congressman or senator to make an inquiry. At lease I had sense enough to do that. Apparently she has no clue that even though my application has a receipt for July 18, applications that were submitted way after me have already been approved. =0( My husband is Pakistani but he was born and raised in London and has only been to Pakistan about 2 times when he was like 3 yrs old and some other time when he was in his late teens early 20’s. He is currently 36. I hate the fact that the lawyer implies that because of his ethnicity or maybe even religion we are having such difficulties with the applications. Is the lawyer correct in stereotyping? What are your thoughts to her comments? Is she correct in saying that my husbaned was summaryly exluded is that the term for people that are denied on VWP and refused entry? Am I over reacting? I forgot to mention that this lawyer also wants to charge 1,000 extra to prepare a waiver for my hubby for him to have ready and take to his interview in case they ask him to file a waiver because he was refused last time he tried to come and visit me. Hsi passport got an ugly " refused-intent to immigrate" stamp. She says he is not sure if he will or will not need it but in the event that he does not need the waiver he will have it ready. She is not sure if the waiver will be needed but she chis chargeing 1,000 regardless if they ask for it or not because she is going to "prepare it for him to have at the interview in case they as for one." Let me know your feed back on this also.

Seriously, many of the people that man the phones at the NVC or on the mis-information line aren't interested in your case, in the slightest. They are just there to earn a salary. There is no accountability, you don't know who they are, they don't care!

I am pleased that you no longer have to deal with them, but remember how you felt when you next have to deal with a customer on the phone - it will have made the whole experience worthwhile if you can pass on the love!

I had to comment, just based on the title of your post. "Should we get married in India?" Well, if you do just make sure, like my husband's work colleague, that you invite all your friends and co-workers in the USA, knowing that they can't attend because the wedding is in India!

I had to chuckle today when my hubby comes home "We've been invited to a wedding!" "Aaaaah, that's nice" I said. "Only one problem.......it's in India!" "Oh well, the thought was there, I guess!" lol

I think they are all three time same thing, just different ways of saying them. I think the hard copy means they have received the actual letter.

It sounds like the touches might have been triggered by the call you made. Was the call concerning the processing of your NOA1? If so they might be generating it for you to be sent out. I've read where some people on here have received their NOA2 without ever getting a hardcopy NOA1.

does anyone know about fiances visiting the us? my fiance was saying he's heard of people have trouble because of the landing cards and how theere is a clause that states you dont' have intentino on trying to become a citizen? he hasn't been visiting here because of it- making be have my 129038129038129 th visit to the uk... ha. i have been reading though that peoples fiances have been visiting here.


Some people have trouble and others don't. If he decides to visit make sure he brings alot of proof of times to his country, such as an employment letter, an apartment lease, etc. They may let him in, but they want to be certain he is going back home.

After reading the Affidavit of Support info I am all worried. Well it says they can deny everything if I have been on govt help. To sum it all up I have been on govt help since I had my kids. I do plan on getting a job once he is here to help out. My mom is co signing but it says if I have been on govt help and dont plan on getting a job anytime soon they could deny it all. I do plan on getting a job but at the moment its not easy to so I wont be able to do that until he gets here. Thats besides the point though. I am just plain worried now. :(


Is there anyway you could start looking for a job? Maybe you could submit your resume with your I-134 and some information about jobs you've been applying to. Maybe you could put your starting date at a time when you think he'd be here. I'm not really sure what to tell you.

This would probably be better addressed in it's own thread. Alot of the more experienced VJ'ers don't visit "filers" threads. If you post it in it's own thread you'd probably get alot more information about what options you have and what steps you can take.

It does seems that it is getting harder and harder for me to get throught the weekends lately. During the week, it seems that I am able to find things to do to keep my mind occupied and not stress to much on being separated from my fiancee. Well, most of the time. Like everyone on here, I think about my love one 24/7.

We all know that the waiting and not knowing are the hardest part of the visa process. Unfortunately, what we know logically is still hard to deal with emotionally. It is human nature to want what we want when we want it. I think the hardest part is that we have no control over this process. It is what it is. I remind myself every minute of the day that stressing out over something I cannot control is like hitting my head against a brick wall. Believe me, it takes a lot of my energy to keep everything in perspective but for me this is easier than dealing with a severe headache.

So ok.....I think I am going to go ahead and start gathering what I will need next after NOA2. I know I prob wont get it till next month but I am trying to keep myself occupied and what better to do than to get stuff prepared for the next step. My mom will be the financial help person. I forget the name. But since I dont have a job she will be there for that end of the deal. What forms will I need? What forms will she need? Hmm, some not so great news. As you know, I got two touches last week.

And....in the mail yesterday, I finally got my NOA1. I had called quite some time ago about still not getting the notice.

I'm thinking the touches were the NOA1 being generated.

Boooo!

Well, I'm not POSITIVE about that, of course, but it makes sense to me.

On the plus side, for about three hours yesterday, my estimated ajudication date was up to August 13th! That's only 6 days away! On the minus side, it's back to August 20th now. But, that's still only 13 days away...

Almost guys, almost. My receipt date was May 1st, so once things start happening on my case, they'll start rolling in on yours too!

I have some news I called the USCIS and used the RFE trick this morning and the man I spoke with was some what helpfull. He told me that they were processing applications received on April 5th 2007. So I guess that means we should all be next, I knew this before calling but it gave me peice of mind to here it from them. Sooooo I pray for some May approvals.

I'm surprised he told you they were processing April petitions, from what I've read on here they usually swear they are processing ones from six months before. You must have got a new employee who hasn't been trained to say that yet :P.

Ooooh! I just got the "your password is about to expire" message on the USCIS website. That made me really happy, for some reason. I wasn't expecting it to expire (although I should have, I work for the government myself and all our passwords do the same thing), and it said it does every 90 days and you have to change it. So, it was the "wow, it's been almost 90 days now since I've had my case number? Action HAS to be coming soon..." kind of thing. Plus, it doesn't feel like (now that they've passed) it's been 90 days! I purposely don't keep precise track of how long it's been, and I have to say, it really surprised me it's been that long.

On the other hand, I was very let down! It just occurred to me now, at 6 pm, that I hadn't checked my status. I think that was the first time since I got my case number that I haven't checked first thing in the morning at work. I just went there now and logged in and it took me to a different screen, so for a SPLIT SECOND I was like yes!!!!!!! It's different!!! Something is happening!!!!

But of course, no. Haha.

Aww, I'm sorry you didn't have any change it status. It would have been great after having that password email:P. I still have a little while to go until I have to reset my password. I hope it doesn't come to that, ahh.

That's a good idea not to keep track of the time you're visa's being processed, it might seem like it's going by faster that way. I'm crazy, though, and like ot keep track of everything, so I think that would drive me even more crazy:P.

yeah and actually, the employer pays the fees - the checks are always written from the company's name. so try convincing the people you work for to pay 1,000 in fees to keep you there! wow.


Wow, I find it hard to find people that even want to HIRE me, let alone pay 1000 to keep me.

WE SHOULD ALL BE PATIENT...WEIRD COMING FROM THE MOST IMPATIENT PERSON POSSIBLE, BUT IM LOOKING AT IT AS A TEST TO THE RELATIONSHIP...ITS A 6 TO 8 MONTH PROCESS, I WILL TRADE 6 TO 8 MONTHS FOR A LIFETIME WITH HER ANY DAY!!!!!!!!!!! BUT HOPEFULLY IT DOES GO A LITTLE FASTER.. :blink:


Aww, hopefully it does speed up for everyone. I been trying to find ways to make time go faster but nothing seems to work. I started cleaning up and preparing for him to arrive, but I get frustrated because I know it's going to be a long time away.

On a positive note, I found the most amazing folder today to use to organize my fiance's papers and then send to him. It has 8 seperate folders and each folder has a really nice transparent envelope stuck to front which I'm going to use to hold proof of our relationship (photos, boarding passes) and pay stubs. It's also alot lighter than a binder and folders, so it might not be as much to mail. Woo. I was so excited when I bought it, then really depressed when I got home because I don't have any papers to put into it. I don't want to fill out his I-134 yet or get any of it's supporting documents because I want them to be dated really close to his interview. But it's really cute, so I'm happy about that :D.

They had an article today in the Los Angeles Times regarding employment based visas. It stated USCIS was able to approve these visas in one day. HUH! How come visas for wives and fiancees take upwards of 6 months? Do you think the large corporations that need these people for employment pay extra as an incentive to have these visas approved quicker? Makes you wonder!



Yes, they pay an extra $1000:00 for premiums processing which typically takes 10 to 15 days to approve I-129 employment visas.

my good news is not a NOA2 however, my passport status finally came up online and apparently it's in the mail coming to me!!!!!
im so happy - my fiance's parents are having a party for us, we're travelling all about, going to a wedding, havent seen him since beginning of april!!

I got my NOA1 in the mail today. WOOT WOOT! I already had the receipt # but it just feels more like we are really rolling now. Does that sound cheesy? Heehee! I wonder if they sent one to the lawyer aswell? The lady on the phone said they would send it to my lawyer but I got it. Or yall think they send 1 to each? I will e mail her in a bit to let her know that I got it.

Ugh, I'm having a "this is never going to end, we'll never get our visa" kind of day. Now that we've had one NOA2 in our happy May group, I find myself checking my status on the USCIS page all day long again. I KNOW it's going to be another month but...I'm sure you all have those days, right?

Sorry. Vent offically over. Just have no patience today. Thanks for being around, I think the support on this site is the only thing holding me together some times!

My fiance is leaving for Poland for the weekend to attend a wedding so I probably won't be on VJ at all after tonight(can you say withdrawl symptoms?). I have crappy stinking dial-up (I live a million miles from civilization and DSL isn't available yet) and want to keep the phone lines open in case he tries to call. Which he had better!

So it's a long weekend of tv and chocolate covered raisins. Who knows, maybe I will get some long overdue chores done. But I doubt it.

Hopefully everyone will see some progress on their cases while I'm gone!!! I'll come back Monday and everyone will be approved... I can dream, can't I?
