That statement about K1 Visa's doesn't make sense at all to me. I think that is just someons wrong feeling, because are coming to get married those of us that married in Morocco notified the Consulate before we even started the marriage process so I think that is a bunch of BS and nothing more. Sorry, but it makes no sense and can only give people false hope that the K1 is better than the K3 because of a false statement.


But they should be handling all family based visas before any others. And to say they are checking these people out for the family visas is a lie, they have been checked out before they come to the Consulate and they only sit and wait to be touched to set up our interviews, then more waiting for the big interview date. They don't start checking our security until the interview when they finally take the fingerprints. Why can't they take the fingerprints when we are doing the physical exam, that way the security check stands a chance to be back before the interview so if approved they don't scare you to deaf with limited scary imformation, making you worry for up to a couple weeks that you will not get the visa, until you get the visa finally. Morocco must have a policy of not explain anything or letting you really know why you are not getting the visa, if you are getting the visa they don't tell you until you get the visa call come and pick it up. They must want to not mislead so they don't share any information worth anything.

At first, I had wondered that too. Why not get the fingerprints done at the time of the medical? After I thought more about it, however, it made financial sense. Not everyone going through the consulate is going to be approved. Can you imagine the FBI backlog if ALL applicants had their fingerprints submitted? Holy heck! People would be waiting 5 times as long as they are now. I also had wondered why when entering on a K-1 and having to adjust status you had to go back through all the checks. I have since found out that fingerprints/IBIS check/etc. have a 90 day limit. So...if it has been longer than that, here you go again!

BTW...I saw my name on the inside of my husband's folder at our AOS interview showing they had done an IBIS check on me too! (YES...I kept my eyes on his folder. I was amazed at the stuff they keep. All the envelopes you ever mailed anything to them in, etc.)

I was talking to Hicham last night about the diversity lottery requirements of having the high school diploma. He said some people used to go to a private school and basically get a certificate of attendance thru grade 12 and the consulate thought that was the diploma. Then...they started investigating and finding out how many of them were fraudulent. It seems they could just have their hands full with the DV applicants! (It is no excuse, but I know I the day Hicham went for his interview there were a good 20-25 DV interviews and he said something like 2 of them got a visa.)

One more thing I am pissed at his on the lottery visas most of the people being denied are because they don't have the bachalor degree. I guess this is a new requirement from what my husband said. But why didn't they make this clear to these lottery visa applicants and why did they send them a letter saying they have wrong the lottery visa to take their money ($700) my husband said to only deny them. Sounds like they know they are going to deny them and are taking their money and they are only slowing down our interviews. Is this a way Morocco is trying to get their budget???????????????????


That is real crappy if they changed requirements and are still taking all that money from people. I think the whole lottery thing is horrible. Yeah...if you give us enough money we'll consider you...for like a minute.

IR-1 / CR-1 Spouse Visa Process & ProceduresInterview Casablanca

First of all, I would like to thank all the VJ members for the information they provide but I also would like to ask something about the interviews and especially the ones conducted in Casablanca.
In 2 weeks my husband will go for an interview in Casablanca and therefore I would like to know whether the fact that his brother is the one who introduced us to each others is a red flag? Does he have to state or not this fact if he is asked during his interview?

He should definitely tell the truth if asked how you met (and he probably will be asked). It could be a red flag, but don't try to hide it. He should emphasize how your relationship blossomed, the things you have in common, etc.

For my own better understanding, what would the red flag be in regards to the brother introducing them? :)


Some people whose visas have been denied at the consulate level in Casablanca have suspected it was because of having a family member in the States. However...it is speculation at best. For Casablanca it appears to be a question of visa fraud. Did the family member in the States pay off the petitioner? Or...is the petitioner being used merely as a way to come to the States (since other routes are much more difficult from Morocco)?

It is true that it varies from country to country and what level of visa fraud the consulate sees OR whomever seems to be working at the consulate at that time. I would go to the regional forum for the country you are applying for and ask in there. You might get a better idea.

There are advantages and disadvantages to each type of visa. You have to do your research and come up with the best solution for you. When my DH and I were looking at the options, here are a few of the things we looked at:

(1) How easy is it for a foreigner to marry in your country?
(2) How much money can you afford to pay up front? (At the time, a K-1 was easier for us as everything happened step-by-step and the money was gradual...not as much of the upfront expenses as other visa types.)
(3) Whom do you want at your wedding? (My family would have been devastated to not have been there and would not travel overseas.)
(4) Look at the stats for your consulate and weigh the options as well.

Just a few of my thoughts! Good luck!

Hello there....first post here smile.gif

I started filling out the forms for the K1 visa and my fiance sent me the G 325 filled out. I noticed that on the fields that require you to enter your address for the last five years, it says 'Street and Number'; my fiance just put on the street and number of where she lives. For example, she just filled it out as "1 Bishop's Way".

Since she lives in a condo, her full address looks more like: "1 Bishop's Way, Building 4, apt 999". The street and address is a good way to fill out if you live in a house, but I suppose when you have a condo or apt, the street and address doesn't cut it, but technically speaking, it didn't say full address. Should I have my fiance fill out the forms again with the full address, or the street and number are just fine for the G-325 form?

You show evidence of income only at the end of the process (at interview). The instructions that come with the I-134, Affidavit of Support will be helpful. I suggest you study them carefully.

Once the fiance(e) arrives you file another affidavit of support, the I-864 with your application to adjust status.

For clarity, you, the US Citizen do not apply for a K1 visa. You petition for your fiance(e) to have the privelege of applying for a K1 visa. You are the petitioner. They are the petition beneficiary and visa applicant.

Hi,

I had planned to start the process way back in september, but because i was sent back to europe for work, we had to postpone the application...
Now that I'm back in the USA, I'm going thru all the papers and I way back in sept my fiance had signed her letter of intent to marry me, and also, dated the letter sept 01 2007.

I could ask my fiance to send me a new letter, but it would take about 10 days to arrive, and I will have to leave the country in about 4 days, so i was trying to send this package out before I left, so i wondered if
1. I could cover the date on the 'old' letter, and make a photocopy, thus resulting in a letter that has no date
2. Have my fiance print out a new letter, scan it, and send it to me
3. Enclose the old letter as it is....

We are using the letter template from this site, and since is not officially specified they want the date on the letter, i figure that maybe is best to make the copy without the date....but i was also thinking---are they expecting an original document for the letter of intent, or does a xerox copy suffice?
any suggestions?

This is kind of a complicated question, so I'm attaching an image of the question to better visualize what i'm saying; however, I'll still describe it



Question 10 on the i129f form reads as follows:

10.My citizenship was acquired through (check one)

birth in the usa naturalization ( i checked this)


If "Yes," give certificate number, date and place it was issued.

I put the number of certificate and location it was issued at

then there is a box that says "parents"

I leave that blank because i already checked the naturalization box, and it said to check only one.

Below the parents box, there is a question that says:

Have you obtained a certificate of citizenship in your name?

Yes, No

(here is my question---I already specified my certificate in the section of the question above, but this question is still under question 10, and technically, yes i do have my own certificate of citizenship, so i wondered if i filled this out too, as if check yes, then it says:)

If "Yes," give certificate number, date and place it was issued.
(And this i have already given above....)

So what to do here? any ideas?

Hi,
I'm filling out the question on the g325a form that ask about the addresses in the past 5 years....
Because I moved quite a bit within the same city in 2003 or so, I can't remember when my lease started or ended at my apt; from there I was renting a room for about 3 months at 2 different locations, but i can't remember when i started renting after my lease ended.
Im thinking of taking a guess, but don't want to get an RFE...how critical is this question?

Hi everyone,

I've submitted my 129F application about 2 weeks ago. Check has been cashed, and now is just waiting for the next step. However, at work, I learned today that I might have to do an expatriate assignment in the UK for a year. My fiancee is from Romania, so the good news is that she could come and stay with me in the UK. However, I wondered what would happen to the 129F application? What would be the best way to continue the process? I was thinking she could fly back to Romania, do the interview, but then once she gets the visa, how long does she have to wait to come to the usa? Can we stall the process, or is there a better way to handle this situation? The expat assigment is a 70% chance it might happen so I just wanted to find out what my options are to help me decide if to take it or not.

All jobs are temporary unless you work for yourself and even then it might be temporary - one can be fired in a minute, a business can go belly up, there are no guarantees - Income from any source is Income and it will not matter two hoots to the Consulate if your jobs are temporary or permanent. Do not worry about that - your ability to get a job that pays - is what proves that you can support people. Good Luck

Hello everyone!

So I was working today and early in the morning today, I got the email saying my NOA2 had been approved. I wasn't expecting the approval to be this fast, so now here is my situation and question. I have 2 new jobs full time. One that I started exactly 4 weeks ago, and another one that I started last week; the first job is temporary for 10 weeks, and on that 10th week, i can decide to continue or leave the job. Most likely I'll leave the job cause the 2nd job is less stressful, and pays just as well as the first job.

Looking at the time line for Romania, which is the country where my fiance lives at, they seem to be averaging 30+ days from the time the NOA2 is received, to the time an interview is scheduled. By then I will have proof of 2 months of salary, which will come from the first job. However, since is a temporary job, I wonder if it matters when submitting proof of income for the visa. Also, would I have to submit proof from the 2 jobs? And yes, the one job is good enough to support 2 people.

I had the same situation; for the year of 2007 I was living in europe because of my job; however, I still had a base address in the usa where i got my mail, and bills and such. That's the address I used for my application....

When I first looked into the k1 visa, because of my hectic work schedule, I looked into hiring a lawyer; my friend knows one in the south florida area, and I was quoted 1500 dollars to file for the k1 visa; mind you, that fee was also discounted since the lawyer knew my friend.

I was pondering on the subject of hiring a lawyer, when I came across this site; after reading all the horror stories people had with lawyers, I had a bad feeling about getting one and I did all the paperwork; If i can do it, anybody can; in the last 3 years I have had about 5 different addresses, lived abroad, can't even find my tax return from the previous year, but yet, our petition got approved with no RFE's; matter of fact, as soon as i sent paperwork, I figured I might as well get ready for an RFE, but never got one. I had my fiance re-read all the documents (scanned them and emailed them to her) before I sent them and she found a few mistakes; then on the day that I went to kinko's to make some final copies and mail my package, I realized I hadn't signed some forms, but because i was so paranoid about it, as I put each document on the envelope, i went over it twice to make sure every field was filled out. So as they say, stay away from lawyers, unless you got a difficult or weird case.

My k1 application got approved in february, and I had flown to see my fiance around 5 times; however, I had lost couple of the boarding passes for the trips, but I had the last 2 recent trips complete fully documented (all boarding passes, passport stamps, hotel receipts, etc); when I submitted my application, I had the trips categorized by date, and then I also indicated, 'boarding pass to xyz on april 2, 2007, lost, but see itinerary, passport stamp etc..." And on the same page, I also included the corresponding evidence; I basically created a word document with tabels, and I inserted the scanned item to each cell, and the table was labeled with the trip.... I didn't get any RFE's, so maybe if you include your partial evidence, you might want to specify that you're missing such and such.

That is correct. They can't file everybody's pretty purple binders in their file system. Just the papers. Mine looked exactly like the picture above. I believe they punch at the top and put in their standard file folder. You just save them time by punching is my total guess and putting on the fastener keeps it together. I'm sure they will take anything, but will have to spend time taking it apart. My NOA1 was 1 day after arrival. Don't know if my submission made it faster or that was a fluke. Maybe there's a person assigned to taking apart all the plastic and binders and when they get finished, they pass it on to the receipt giver. I am totally making all that part up.

Furthermore, there was a long post from a forum member that used to work at the uscis or whatever the place is where they receive all the i129f applications; his post described what he used to do when he got the 129f applications, and he also happened to hava sent his own application for a k1 visa. After reading his post, i ended up not using the fasteners recommended on this site, but i used that big black (metal) fastener, and that's how all my papers got mailed; i did follow the other site instructions about the passport pics in a bag, etc....But what i didn't do was punching holes in the documents and doing the acco binders.

Have you tried adjusting the settings of the photocopier? I know i adjusted the settings until I had a decent copy.....Or you can also try scanning the passport and then printing that...

It said to copy both front and back side of Certification of Naturalization, but the back is blank, do I still have to copy and send it in?

Also, has anyone noticed that the page number for U.S. passport is in white? So, when I copy it with a black and white copier, the page numbers do now show up in the copy. Will that be a problem?

I ended up sending both (passport and naturalized certificate) because I had lived in europe, and I traveled with my fiance there, so that was my proof of ongoing relationship; i also sent copy of my naturalized certificate just in case; and yes, you make a copy of front and back, even though the back is blank; when you make your index of documents being sent, you indicate that such and such page is the copy of the back of the certificate---at least, that's how I sent mine in.

And yes, the white numbers in the passport come out just fine because somehow photocopiers give a shade of grey; you can still make the numbers out.

I was also very busy and I thought of hiring a lawyer. I travel every week, and then when I got home, i had work to do, or was very tired; so my fear was that I would mess up filling out the forms. I did a search on this forum for lawyers to see if others had hired one, and there were a lot of complaints how lawyers forgot to fill something out, and they got RFE's. I finally decided against hiring a lawyer and so far, the case is moving along fine. Fiance will have her interview soon, and I'm glad i ended up not getting a lawyer. I know at first things looked very overwhelming but like somebody else mentioned, you will have to gather all the documents yourself. Is not like somebody will do that job for you. What I ended up doing to tackle the beast was to go one step at a time. I came to this site, printed out the guide step by step, and every other day or so, I familiarized myself with the process. Then I started filling out the form by taking a break from work, and when questions came up, I would post a question here, get an answer and continue. The people on this forum are amazingly fast at answering my questions---they are all the lawyers I need thus far. Good luck!

Now, given the timeline you have....It could well be that you get your interview before november (not sure how fast california is approving the k1s lately).
So fiance takes the job now....lets assume you get approved in september; then you have to provide the i134 for the interview. By then your fiance can still request the letter of employment from his employer, you go to the interview, get approved move to the usa and then fiance can quit his job and start school; of course, now you would need somebody to sponsor the rest of the process and maybe another member has gone thru this scenario.

One thing to remember is that getting into these respiratory therapist programs nowaday is nearly impossible; my sister tried to get into one for 2 years and never quite made it, even though she had good grades. So it might be best to try to find sponsors.....
Couldn't your fiance take the job, and hopefully youll get the interview before november

Once you send in your k1 application, the processing times are different depending if you send it to the california center or the virginia center. For example, I sent mine in February and it went to virginia. It got approved in less than 2 months. A friend of my friend sent his in january of this year, and hmmm....the case hasn't been approved. So that is the first time variance that you might find; and yes, then I believe it also depends on the country the fiance is from. You can go to the timelines and look at couples from fiance's country and kind of estimate how long it took for them to receive the paperwork from the consulate, etc.

I would tend to think that these people don't make exceptions to the rule...my family has gone thru naturalized citizenship and believe me, there has been no mercy when it came to submitting the required paperwork, so I don't see how this k1 process would be any different. After all, your case is just another number in the scheme of all things.

1. Date and nature of employment;
2. Salary paid

I remember going over this trying to figure out how come people tell you to submit 3 years worth of income taxes. I decided to submit mine just in case. smile.gif Maybe overkill, but I prefer to err on the safe side and it's not difficult at all to get the returns for the last 3 years.
