Thanks for your quick reply guys! You've really calmed my fears.

One problem though. We are in the process of refinancing the mortgage. My name isn't on it.Hopefully he can add me. When my hubby tried to add me to the utility bills they wouldn't let him. We don't have a land line phone , just pay as you go cell phones. I don't have a car so no car loan or insurance. Hoping to get one but not till next year. My 11 yr old daughter flies down here for visits and stays with us,( she was here for the summer. Just left yesterday) Would sending her flight iteneray help? We usually buy her flight online.

We have 2 years of Joint taxes filed. So I have that. He is on my health care program from work. I'm on his health care program from the Military. He is also the benificery to my 401 K & insurance from work.

We have a joint savings/checking account. Plus I also have my own Visa Card under just my name. We have lots of mail addressed to us both and separately. I get a TON of junk mail sent to me all the time. Lots of Clothing Catolgues etc...

I guess if need be, I could get my boss to write a letter stating she knows us both and she knows where I live cuz she's driven me home from work many times.
I have a few friends that could also attest to where I live and that they know my husband & me as a couple. Would that help?

We just had family portraits done which will be ready next Wednesday. I could include some of those.
I don't know what else I could send.

Also, my Canadian Passport expired. I need to get a new one, but I hear that it's taking over 3months to get one if you live out of country. Do I have to have a valid passport to file the removing conditions or just when it's time for the interview?

I am so confused!!! When my husband & I had our AOS interview back in March 2006. The officer told us to call the Salt Lake Office to arrange an interview to remove conditions for November 07. nothing was said of sending in forms or anything.

In looking over the guides it states we have to send in form I-751. In the guides there is an area that's really confusing me.
it's this in bold type:
When to File:

If you are filing jointly, the I-751 form must be filed within the 90 days just preceding the expiration date on your permanent residence card. This is the date that your conditional residence expires. Note that, despite the fact that you may see word "anniversary" used in a confusing way regarding the filing date for removal of conditions, your wedding date is completely irrelevant to determining the window of time during which you may file for removal of conditions. If you and your spouse are outside the United States on orders of the U.S. Government during the period in which the petition must be filed, you may file it within 90 days of your return to the United States. See the USCIS webpage for more specific instructions, and search the forum for stories of several people who have done this successfully.

It is very important to file the I-751 within the correct window of time, and be sure not to file it before the 90-day window. If you file it too early, they will send your application back. You may file at any time during the 90 day window, but it is prudent to file fairly early in the window.

If you fail to properly file the Form I-751 (Petition to Remove the Conditions on Residence) within the 90-day period before your second anniversary as a conditional resident, your conditional resident status will automatically be terminated and the USCIS will order removal proceedings against you. You will receive a notice from the USCIS telling you that you have failed to remove the conditions, and you will also receive a Notice to Appear at a hearing. At the hearing you may review and rebut the evidence against you. You are responsible for proving that you complied with the requirements (the USCIS is not responsible for proving that you did not comply with the requirements).

Our 2nd anniversary was August 4th. We didn't know that we had to send this 90 days BEFORE our 2nd anniversary. I haven't been sent any letter from immigration stating they are starting removal proceedings against me.

I am freaking out here!!! Is the guide wrong? My Greencard doesn't expire till Feb 15 2008.

We went to the UPS Store to send the package 2 day Air and they said they couldn't send it. They don't send things to a Post Office box. (were sending to Nebraska). They said we would have to go to the regular US post office and ship it priority mail.

If your sending your packet to a PO Box number you must use the regular post office. UPS & Fedex will not deliver to a PO Box. You can have the mail certified so that you get a tracking number & know that it's been signed for.

I noticed at the bottom of it, it said CSC . Did we get transferred to California?

I'm suprised how fast things are moving. I sent my packet to remove conditions Feb 8th. Recieved NOA to extend for 1 yr just last week and already have Biometrics appt set for march 11th.

Awww I'm sorry to hear of your sister-in-laws Illness. My thoughts are with you.
My brother died of Cancer 5 yrs ago. I was the lucky one to have survived Stomach Cancer. I've had it 3 times though!

Wow! That is slow!
I noticed on my NOA to extend my grteencard that it was from CSC so maybe they transferred my case to there? I'm hoping they did!

had my biometrics done yesterday. They had a hard time getting my finger prints, The guy said they are pretty much worn off thanks to all the data entry/typing I do. It took him over an hour to get the finger print part of it done. I could tell he was getting frustrated. He then had another person try to do them. She couldn't either. So it was back to him trying. finally he got enough of them that it would pass. kicking.gif

I was in the same boat. My hubby until recently worked nights, I worked days. My 12 yr old daughter is still in Canada ( ex was a butthead and decided at the last minute he wasn't letting her move)

I had my mom do an affidavit
and I had my boss who met my hubby many times, thru work functions , phone calls etc... I also had our neighbour write one she can attest to me living in the house, seeing me doing the gardening, taking out the trash etc...

Well, we sent our package to remove Conditions Feb 8 2008
Recieved NOA Feb 23rd 2008 stating they were extending greencard for another year.
Had Biometrics March 11 2008
Didn't hear anything, kept checking online
then 2 emails may 29th 2008 stating Card production ordered

Just a quick comment, you can renew your Canadian passport in a much shorter time than that. Using the old form you can get a US guarantor - one of the professionals previously allowed - get a professional camera place to do the passport photographs to meet Canadian (not American) standards and send it by courier - I got my application and expiring passport sent off and the new one and canceled old one returned in less than 2 weeks last January. I too expected it would take months, especially with the new Guarantors requirement.

First, congratulations on the good news on your green card. Second, I wouldn't put up with that staffing agency, there are soooo many of them out there. WHy don't you try going to a different one? I know it's a pain to get tested and everything. When I was looking for a job, I registered with 4 different ones.

You should be able to visit SSA and get the card replaced, using expired green-card and extension letter.

To prove employment eligibility all you need is on item from A OR (an item from B AND C) on form I-9

A, 2. Permanent Resident Card or Alien Registration Receipt Card (Form I-551), OR 3. An unexpired foreign passport with a temporary I-551 stamp

OR

B, 6. Military dependent's ID card, AND;
C, 1. U.S. Social Security card issued by the Social Security Administration (other than a card stating it is not valid for employment)

I applied to remove conditions back in February 2008. Had Biometrics in February as well. I was sent a letter stating they would extend my Greencard for 1 year.
I went to apply for a job thru Adecco (it's a clerical referral firm) Did all the testing, paperwork, etc... She told me she wasn't sure I could work because my green card had expired. I brought the extension letter with me and she photocopied it. She said she would call to verify that I could work.

She just called me back and said that she called them and they said they couldn't verify that I am able to work.
I know I could probably make an info pass appt. and get a stamp in my passport but the problem is, my Canadian passport expired last year. It will take months to send it in and have a new one made. I can't be out of a job that long!

She said that the letter of extension doesn't say the date of which the extension starts. The extension letter is dated feb 13/2008

My daughter received her interview date in Montreal for August 26th. We weren't expecting to get an interview this summer as we had received an RFE asking for copies of her passport and another copy of her Birth Cert.
She had to re-knew her passport and we haven't had a chance to get copies as she lives in Canada. She's coming for a visit on Friday . The problem is, She is already expecting to start school in September in Canada. School starts in mid August here and she will miss it. She doesn't want to start school half way between grades and would rather wait until next August to start school here. So, Can I reschedule her interview and how far away can it be re-scheduled? its also a money issue/ time off work issue as we werent expecting to get an interview this summer.

It is completely subjective, depending entirely on the mood and whims of the border agent you happen to get when you cross. If he's having a good day, he may just wave you through. If he's having a bad day, he'll ban you for 12 months, or worse. Ruining peoples' lives means nothing to them.

There's a good chance you could be turned away.But you can still try. Bring anything that shows ties to your country. Car lease, bank statments, if your going to college , bring documents proving that. Any bill in your nameDo you have a medical appt or something coming up?, if you do, bring documentation to show that. Without a letter of employment & rent reciept it might be hard.
I had ALL that stuff and was still denied.I had been going to the states quite often without ever a problem until one jerk decided to be mean. Just be honest. Tell them you are coming to suprise your fiance for his birthday.

If you are denied, don't worry. My denial had no bearing on my K-1 interview. They did mention it but said it happens all the time.

its totally up to the officer when he trys to come thru. Make sure he has lots of ties to his country. Be prepared to answer questions truthfully. If they ask who he is seeing tell them the truth, don't try to hid the fact that he is engaged to a US citizen.
I had a horrendous time trying to cross and was denied, but others were luckier.
If he does get denied entry , don't worry. It will be fine. They will have record of it when he goes for his K-1 interview and most likely ask about it. They did at my interview but they guy said its quite common and nothing to worry about. I got my Visa regardless.

Well, technically thats true. BUT ...... If she enters with a B2 with the intention of marrying you AND staying then thats Visa fraud.
If on the other hand , she came to the states on an extended vacation, hadn't met you before and then by chance meets, falls in love and marrys you and stays then thats considered " without intent". Its a very Grey line.

The problem arises when you go to adjust status. They "might" question that.
Some people have managed to do this without problems. There is always the chance of being denied at the AOS interview stage. It really depends on what you consider is worth taking a chance.
Also, depending where she's comming from, they "might" question her upon entrance at the POE. If they ask her what her purpose of her trip is and she says to "visit her fiance" she might encounter more questioning and she definetly doesn't want to lie to the POE officer. If they found she lied about her intentions, They could even ban her for up to 10 yrs.

A K-1 really isn't all that long to wait for and then your pretty much guarenteed no problems. Check out the "Guides" tabs at the top of the page to get an idea of how long it takes.

Make sure when you do track the father down that you have him sign a legal document with the courts. I made the mistake of trusting my ex who had just written on a piece of paper that he would give permission, only to have him re-cinde that 2 weeks before my interview. I had to leave my daughter behind.

I do now however have it in legal binding contract that she will move in 2 yrs tho. :thumbs:

see this is why this whole immigration thing is flawed. There should be a separate visa for people who want to get married stateside but not live there right away.

This is what we came up against when we had planned on getting married in the states but I wasn't planning to move there right away.

The Embassy told me just go as if your visiting and then get married ( The EMBASSY TOLD ME THIS)
So when I went to do this I was denied entry. I was told by the customs guy I needed a K-1 to marry.
Then I called the embassy back and they said I didn't need a K-1 that was people who were getting married in the USA and intending to live there.
The embassy even spoke to this custom guys supervisor and he said I could go thru without the K-1
But, when I got there, I got the same customs guy I had before and he was adamant that I needed a K-1 and refused to let me speak to his supervisor.
We ended up getting the K-1 and I had to move down here without my daughter ( this was the main reason I DIDN"T want to move right after I married. ) My daughter couldn't move here legally. So now I'm down here and separated from my little girl thanks to Immigrations B.S.
