Your daughter does not need a K2, she is eligible to be a citizen as you are now a citizen.  She/you will need to file her citizenship with the consulate and get a US passport.  

 

You will likely also run into a problem with the K1 as many people have.  Many people have been denied an I-130 without a marriage certificate and then are denied a K1 because they are married.  A marriage certficiate does not "make you married", it proves you are married.  

 

You ARE married, your wife is not eligible for a K1 visa and they have a record that you have stated you are married.  You either need to get divorced and have a divorce certificate to send with your I-129f or you need to get a marriage certificate and apply for a CR-1.  This is a problem that often happens with what people think are "unofficial" traditional marriages.  The US federal government recognizes them as a marriage but requires a certificate to PROVE it.

If what you say is true, how come do they approve my I129F petition for Fiancee? they are suppose to know better than that.Before I apply for K1 visa, I call USCIS and ask them what I should do, and they recommend me the K1 visa.

I did it and they approve it here in the US. Why would they approve if they know (from expreience of previous cases) that the consulate would refuse to issue the visa?

First I apply for the I730(asyle family relative petition) not the I130 , and secondly,when they refuse the visa to my wife, they ask her to bring a valid marriage certificate.

Yes, I use to be an asylee and when my daughter was born I was here in the US. and never got back. I join the US navy, got my citizenship and apply for them. they waive the 2 years requirement because a couldn't go back to my country, they olso expedite my case. I apply on May the 3 rd and got approved on June 7th.

My fiancee and I were married according to our custom,but we did not have a valid or offical marriage certificate. that is why when i Petition for them I730 in 2010, only my daughter got approved after a DNA test, the embassy refuse to issue the visa to my wife, stating that I did not have a marriage certificate. So I decided to reapply for both of them K1 ans K2 since I am a US citizen now.

Here is excatly my situation. I am a US citizen, and my Fiancee back home has our daughter of 3 years old.In my case I have no picture at all with my fiancee, and my daughter was born when I was In the US. The only proof of relationship I have are

Western Union Receipt, a DNA test result previously done at US embassy and phone call bill.

She is waiting for Packet 3 presently and I hope all will be ok

If the child is a USC because one of the parents is, then they do not need a K2 visa. The child needs to get a US passport, not a US visa.

All you have to do is to put the name of the baby in the I129F wile you apply, that's it. and when your case is send to the embassy for interview, you will prepare 2 packet 3 one for ur fiancee and the other one for your Baby, K1 et K2 Visa.

In may case,I am the US citizen petitioner and mi future wife and I have a baby girl, same situation as you.

The fact of the matter is, time and again we have seen people on visa journey have "traditional" non registered marriages in their home countries, and have gone on to be denied their visas. In the eyes of the consulates, anything that looks or smells like a wedding, is a wedding. You are advising the OP to take a huge risk, which could eventually result in the denial of their visa. Search and you will find many threads on the subject. People have even been denied for having so called engagement ceremonies and parties, because they were elaborate and looked like weddings.

Many cases I have come thru are K1 visa first and then Cr1 latter, my case is quite special, and I would like to hear from you before my "wife/fiancee" go for interview.

In 2010 I apply for I730(asylee relative petition) which is like I130, for my wife and daughter. my daughter got approved but my wife denied, the reson was that I do not have a valid marriage certificate. I only did a traditional marriage and family members sign affidavits.

the 221g handed to my wife stated: petition is being returned to US with a recomandation to be revoked.

I become a Us citizen in 2013 and apply for K1 visa for both my wife and daughter. in all my forms, I state married(traditional only)

my wife is waiting for interview and I would like to know what you guys think. My case is quite special in a sence that I preciously were denied I730(or I130) because they say I am not married. Can they use the opposite argument today to deb=nied the K1 visa to my wife?

The petitioner should file I134 and attache copies of tx return, of almost last 3 years to be sure.this is one of the option that I think is easy, since everyone in the US file taxes.

If you are at the Initial petition, I129f, then NO, but if you have already receive NOEF2, and completing application form for packet 3 to the embassy yes, 2 application with passport photo for each one.

My Case has never been like those I see who got denied for traditional mariage.In many cases, people apply first for the K1 visa, are denied and then letter apply for I130.

In my case it was totally the contrary, I first apply for married I730, they refused on the base that I am  NOT MARRIED( they refused to recognize the cameroonian traditional mariage),and I then apply for K1.Look at many cases that got refused for traditional marriage you will notice that they start with K1 visa which was not my case.It would have been very comflicting to refused someone on the basis that he is not married and then letter on refused again on the basis that he is married.

I honestly do not know how to answer you on that one. I would have not stated anything about being married on the I-129F either. You can go ahead and continue to put the same thing as you did on your I-129F, but I think it is very risky to list you are married on application forms for a K-1 visa that requires both parties to be UNmarried.

 
My guess is that If USCIS has approved the I129F (with Married) it won't be a problem for the Consulate.When I ask for a case expedition, I mention all of that in the letter, and I know the letter is also forwarded to the embassy.
my fear is not on that side, my greatest fear is that I have not pictures at all with my fiancee. On the other hand, we have a daughter whose case was previously approved after a DNA test by the Embassy.
Is wester Union receipts, Phone call bills and the fact that we have a daughter enough to proove our relationship?
Do you know some case that have been approve without Pictures?

You had a traditional marriage and were denied a spousal visa for not being legally married. You are now applying for a K-1 fiance(e) visa. Do NOT fill out your forms stating you are in fact married. It does not matter if you had a traditional marriage and consider yourself married. If you want to be approved for a K-1 visa, then you will state on the forms that you are NOT married. You will not be approved if you keep insisting to them that you are married. For the K-1 you need to stress that you are NOT LEGALLY MARRIED. The forms need to state your fiance(e) has NO spouse. I cannot stress this enough.

 

You need to approach this differently. You need to go in and prove to them that you are in fact both unmarried and free and willing to legally marry within 90 days of entry to the US. If you do not convince them that you are not legally married, then you will be denied the K-1 too. Listing that you are married on the forms is just asking them to deny you.

Look I agree with everything you are saying, but here is my fear.my Initial petition I129F to uscis I filed all forms as married traditionaly.

now you are recommending me to state in DS156, DS156k and DS230 that I am not married. look, If I state that now, I personaly think it' is a good reason to refuse the visa on the basis of misrepresentation. they have a record of all my documents.

I don't know all the details of your timeline and history BUT with your letter you show should you NOT make up your mind that you are married or not married or simply remain silent on this as you are applying for a K-1 visa which is for a finacee, as an american I read this letter and I am confused and so I think the "American Consulate" will be also.

I understand your preocupation, but I have mention before, I did a traditional marriage but did not registerd it. when I applied in 2010 for I730 I stated that I were married traditionaly. and they refused to issued the visa , the CO state that I need to show them a marriage certificate.which I do not have.

Now I am applying for K1 visa, and because In all previous form I have stated that I ma married, I do not want to give them the opportunity to refuse the visa on the basis of misrepresentation. to stay in the same line I have to keep saying I am married but because it's a K1 visa for not m, I join the letter to explain .I did the same for initial petition of I129f with USCIS.

Dear Honorable American Consulate in Yaoundé ,It is my understanding that pursuant to 9FAM 41.81 N6.2 (Period of validity of I129f), the consulate can extend the approval notice for another 4 months, if my fiancée and I remain legally free to marry and continue to plan to marry after my fiancée enters the United States.

 

Because of this, please be aware:

 

  • I and my fiancée continue to be legally single and free to marry.
  • I and my fiancée are planning to get married as soon as she get into the United States.
  • If my I-797 approval notice has expired by the time of my fiancée?s interview,

 

I sincerely request that you extend the approval notice  so that my fiancée, XXXXXXXXXXXXX  may receive the K-1 visa.

 

I would also like to note that the Consulate previously  revoke my I730 approval for my "wife" on the basis that I did not have a legal or valid marriage certificate. I have  filed out all application form( DS156, DS156k, DS157 and DS230) as married because I consider myself married(customary marriage) even though I do not have any legal document to support my claim. My  marriage was not performed according to legal proceedings of local civil authorities, but rather, according to our tradition, so technically I am not legally married and would therefore draw the attention of the consular not to refuse the K1 visa on the basis that I am married.

They do not apply to everyone. Not everyone is in an extreme emergent situation. Only a small amount of people would fit into one of the categories for expedition. You must prove to the USCIS why you deserve to have your petition expedited. Not everyone that asks for an expedite gets one.

A K-1 is a non-immigrant visa so no need to pay an immigrant visa fee. The K-1 entrant does not need anything from the USC petitioner to enter the US. They need the sealed envelope from the consulate and their passport with visa affixed inside.

That is exactly what I thought, But this morning my fiancee scan me the seal envelop for my daughter(k2) and it is mentioned on it that I should pay $165 with credit card online or at the port of entry.
The strange thing is that they only required that for my daughter not , my wife. Can anyone giveme more details about this?

i THINK i HAVE FIGURED OUT WHAT IS GOING ON.

As a US citizen, and the baby is my biological daughter, she had the immigrant visa approved in 2012, but I did not want to separete her from her mother, my guess is that they reaprove her immigrant visa.If I am right she will get her green card when they get here in the US , and I will have to get married and apply for my fiance before she can get the GC.

I am just trying to understand , I am not shure.

My fiance will be arriving in America on her K1 visa in early December, and we are trying to make sure that we have all of our ducks in line to get the ball rolling on the I-30 application as soon as she arrives. 
 
One question that I have regards our options for getting married.  The idea of planning a full-on wedding inside of 3 months of her arrival is unfortunately out of the question.  We were hoping to get a civil union and plan a proper wedding after she gets her permanent residency, but I have read here that a civil union will not suffice for the I-30.
 
I'm sure that we are not the first couple who has been unable to plan a full-on wedding within the 3 month window.  How do people usually handle this?  Do they just "sign the papers" and then have a real wedding sometime in the future even though they are already married?

I got approved whithout the 2 years requirement, because I am an asylee, I could not return to meet my fiancee. I have been in the US since 2009, and my fiancee and I have a baby girl, born in 2009.

the case is right now t the embassy, we are waiting for the interview. I am also in the military. hope it helps.
