Before I accuse your attorney of being a useless f*up who took your money and botched your petition, I have to ask... were you completely open and honest about everything with your attorney? He should have asked you a lot of questions. For example, he should have asked about the criminal record of the petitioner, or if the petitioner has filed any visa petitions before. If you didn't answer honestly, then these things could cause the adjudicator to request more evidence, and cause serious delays in processing your petition.

Presuming you answered all of your attorney's questions honestly and completely, then your attorney is worthless. The fact that you got an RFE means evidence was needed but not included with the original petition. Any decent attorney should have recognized this before sending the petition. Either he wasn't competent enough to know, or didn't ask the right questions to find out, or simply didn't spend enough time on your case and didn't care. Unfortunately, now you have to suffer the consequences. There's not much you can do other than wait, and hope he didn't screw it up so badly that it ends up causing more delays at the consulate, or possibly even a denial of your visa.





Well, I have to admit that he (our attorney) did take about 3 hours when talking to us on how to file, which I most def. appreciate. In our case I'm the petitioner and I don't have a criminal background except maybe for doing a "rolling stop" which I only got a warning,and no I have never filed another visa application for anyone else and well he's never been petitioned for by anyone except by me. Also , we have pretty much giving up all hopes on this, I know that we have to have a ####### load of patience and faith but geez I would really love for him to spend Christmas with me this year. So does that mean that he's approved or are we still waiting for an approval? This whole process is very confusing to me, thanks for all your help and hopefully everything will work out for the best.

I'm in the same boat as you. We however did decide to hire a lawyer, and to be honest I think had we thought about it better we would've never hired him. Why because we file last Nov2008, and got our NOA 1 in Dec,2008 then we got a RFE in May2009 if I hadn't called the freaking lawyer I would've never known about it mad.gif , now its freaking Oct. and we still done know NOTHING. I guess its really just depends if you really think its necessary or not. I, myself think I should've put that money to better use then to spend it on our "lawyer". BEST WISHES TO YOU GUYS!

I understand where you are coming from and I wouldn't advice setting a date either. We did thinking that we would already have the visa in his hands and nope nothing (seeing as to how its October). So we set the date and everything, and we still don't have the visa not even the NOA2. So we're def. disappointed and really it just some down the drain, so no don't start ordering invites just yet.

You don't need this for the K1 in Mexico unless your SO has been in trouble before. My fiance got his just to have it, but has never had a run in with the police. He went to his local police station where he lives and just asked...no cost.

Hey,

If you filled out your time line you should be able to find your name on Igors list. Go to "Immigration Time Lines" at the top of the page. click on Igors list and then fill out the search for your service center and date of NoA1 and then look for your NoA1 date then you and your S/O's name. It will let you know approx. how long you are in line to wait. But some ppl do not fill out their time lines or they abandon their accounts and it not completely "Dead on point" accurate but will give you the gist of where you are at in line for adjudication.

"Touch" means anytime USCIS looks or moves your petition package. It may because they are adjudicating it or they moved it to another part of the building, pretty much any time they touch it. You can tell when you have been "Touched" by logging on to your USCIS CRIS account and look at the part that says "Last Updated" then if the date is different then your NoA1 date, you have been "Touched". I never got a touch or anything during my wait.

He is more than likely asking for a letter from your employer verifying your employment. Should be on company letterhead, state when you started, how much your yearly pay is and that you are generally going to continue working there in the foreseeable future. Copy of Your Three Months Bank Statements

Take your bank statements for the past 3 months and copy them

Original Letter from Your Bank on Bank Letterhead proving the day you opened your account(s) and the account's current balance

What I did was took my bank statements for the last year and made a letter showing when I opened the account at my bank, then I listed the past years deposits for each month and what my current balance was. Took it to my local branch and they made me one up on their letterhead took about 3 days. Some banks you can call the customer service line and they will generate one of these and mail it to you, tell them you need it for immigration purposes, you might get lucky and they MIGHT know what you mean. Again, By ORIGINAL he wants the one they give to you so the signature is ORIGINAL. Make sure you keep a copy for your records.

I di dbasically the same thing. I wrote the bank letter myself (there is nothing it can say you do not already know) and brought to the branch President. I said "Please type this on letterhead and sign it" I then sat down and sais "I'll wait here" I had it in about 5 minutes. Have them print and sign 4 of them or so, why not? I used them for the AOS also.

Two things...

from what I have read Manilla will accept co-sponsors if they are immediate family, parents or siblings. Check the regional forums

Another regards the job search. DO NOT be turned off because an ad says "must have..." That's a wish list. Send them your resume anyway. I have had serveral positions I "wasn't qualified" for according to the ads. I have also hired a lot of people that did not have the specified "qualifications" but were excellent for the job nonetheless. No door is going to open if you don't knock!

You should be able to use any equity in your home, and also your cars. I have many cars and I will be using them as hard assets I own. I am submitting appraisals of the vehicles, backed up with NADA book values on the vehicles, and that backed up with the copies of the titles in my name showing no liens. This proces shows them that they indeed are owned by myself, the vin numbers will all match up, and they have NADA book values, so there should be little questions in regards to the vehicles value(s). I am assuming your time frame to get a ticket is probably over buy now. I will only say, I hope indeed you were able to muster through somehow and get that ticket. Looks like we're in it for the long haul with 6 mos behind us waiting for the NOA2 and a letter received stating "additional processing" is required. We may try and pursue a B2 (tourist) visa for her while we're waiting for the K1. Anybody from Colombia have any experience with the B2? My fiance lives in Colombia, is self employed, has money in the bank, and rents an apartment. I know a tourist visa can be tough to get but it may be worth a try at this point. Of course we have no intention of marrying prior to the K1, it would only be a visit and she would return to Colombia as needed. Looking for input from those experienced with similar situations please.

Aren't both of these incorrect? You may have submitted form I-129F but it was for a K1 Visa.

If the question is "What visa are you applying for" neither "I-129" nor "I-129F" are valid answers. There is no visa called the I-129F visa. I-129F is a form. K-1 is a visa. Right?


considering these people just started the process, let's give them a break, and not be so technical. the OP asked a question we should reply with answers, not technicality that is off topic.

I wouldn't risk it. As I recall the instructions are pretty clear that the letter showing intent to marry must be original and signed, so the fiancee is going to have to mail something to the US one way or another. I'd include an original G-235A and a passport picture in that package.

WELLLLLLLLLLL can i say i hate all forms of the immigration system!!!!!!!!!!!!!!!!!!!

we got there early she gave us five minutes after driving one and half hours to get there (100 miles)
she said there is nothing u or anyone can do its been delayed due to back ground check and it has been in its since Feb of 2008.........this could take two to four years to resolve i asked well what is the issue lets try to resolve this in a respectful and timely manner, she stated that she could only see what everyone else sees on the computer screen and that she had no idea what the issue is, i asked if i could get our file transfered to the local office since i saw they had a room for adjudicators when we walked thru looking for the info pass appointment she said no........
so i then asked maybe i should contact the FBI and all the rest of ur security people to find out just what is going on with our case she said they will not tell u anything best u can do is just wait like everyone else.
so i asked well why did ur site state that everyone that was 180 into checks would be processed, she said it does not apply to k1, k2, k3 or direct filing it apply s to removable of conditions on the gc and citizenship
so now im going to just go and have a good cry and pray thats all that is left because i asked so if i sue for adjudication what happens she said we will deny u because it has not cleared security.

it should be in the mail.... NOA1 is notice of receipt, means they got your file and filed it in their warehouse and they cashed your check..

if they cashed your check your NOA1 could be in the mail, if you want to track the progress online you can look on the back of the check and get the receipt number. NOA1 could take about 2-4 weeks to arrive to your house...
