both your fiance and the co-sponsor need to fill out seperate I-134 and yes the co-sponsor needs to meet the poverty guideline, this is the purpose of getting a co-sponsor. if your co-sponsor meets the poverty guideline then your fiance's income doesn't really matter anymore.

Well, No lawyer or not, we are changing plans. I don't know what will happen within 2 1/2 years. Long story short, she's still in school for RN nursing in Sydney. She'll be done by the end of 2011. Hopefully she will pass her exam to enter US Hospitals and apply for a job Visa. In the mean time while working at the hospital (if all goes well) she will find a sponser and hopefully get a PR. If it works that way.

Looks like I'll have a long journey!

Ok, now I am worried after reading these post. I have met my fiancee in person in March of 2009, we started to committ to each other in 11/08. I cannot go back to see him because I will not have the funds or time to take from work. Do you think that we negatively affect us when it is time for his interview?


it will be wise to take another trip if not then at least be there for the interview, less time actually being together could hurt....

no waivers possible, the fee is to pay for the agents to work on your I-129F. you can get a co-sponsor that is not a problem. if you applied now, you will probably have an interview 6-8 months down the line, so see if you can find a job, because financial information is not needed until the interview.

if you already sent in those evidence then it will be inside with your file in China so don't worry about it. what you can do it print CURRENT phone records and emails and bring them to the interview. you don't need to bring an exact duplicate of whatever you sent to the interview because it's not needed, GUZ wants to see on going relationship evidence, so whatever you sent to USCIS a long time ago will not matter much, they want to see what have you two been doing after the I-129F was filed. so bring the current stuff and don't think too much about the old stuff that was sent to USCIS. if you have some newer pics, bring those too, also if you haven't already, you should write and Evolution of Relationship letter, this will help you alot.

if you plan to attend ACS then you should get that letter notarized and then have your fiancee present it during the interview.

Whoever told you six months for the whole process was a bit off base. The petition stage alone is taking 5 to 6 months now. You'll probably hear something from VSC within the next month.

it's scary but its a risk you have to take if you want to come and visit.. people have been turned away before, so just prepare yourself to explain to the Customs and boarder patrol agent, he makes the decision weather to let you enter or next flight home... if you can get another business VISA then you should have no problem, but a visitor VISA might be difficult..

i would suggest that you keep the K-1 in the process and don't postpone it, you getting a tourist VISA to the US is pretty difficult, you will need to prove to the US consulate and to the boarder agent that you will return home, some example of proof is letter from employment, utility bills, some sort of debt that you owe to China that requires you to return to China in a short period of time.. besides, the K-1 petition is already on your file, so even if you cancel it now, it will be there, and even if you made your way across the ocean to the US, the boarder patrol agent already see your your attempt intent to move to the US, so he might not even let you through and he will put you on the next flight back to China... this is my 2cents..

It is not a big deal, because USCIS sent off your "approved" case to NVC and they in turn to the consulate. I would call NVC and start the tracking from there.
