I was told that I wouldn't be able to enter the embassy for my wifes interview, however I was let in (with a little coersion)and attended. I personally think that American spouse should always be prsent, even if you have to wait outside for if there are any issues/concerns, you probably would be brought in to interview as well, therefore resolving any possible problems.

This process is so long and expensive, I think that we should do whatever possible to ensure no delays...

Really you are so right and besides as I mentioned earlier it will be more precious time together as well as evidence of our commitment to each other.

I thought of that too and we called the embassy to ask if I would be permitted , they never answered directly and I think it really will depend on the moment and who is there and how they are feeling that day. I also thought even if I couldn't go in at least I would be there, just in case, moral support and time together.

I was not allowed in. However, I hand carried all the documents for the interview and was there for moral support (aside from the fact I got to be with my fiancee!) The CO asked my fiancee during the interview the last time she saw me and she told him that morning as we waited in line for her to go into the interview. She also took my passport inside with her to show the CO my most recent arrival stamp. While I may not have been let in, it was important for me to be there with her.

Speaking only for the US, the former part is a right (to love each other) the latter is a privilege, not a right.

I appreciate your opinion however I cannot agree,as is my right. Maybe the government of the US can say it is a privilege to be together in the US but it is our right to be together even if we had to find somewhere else in the world to live. It is our right to pursue all avenues as humans who need each other, love each other, and can show kindness to one another. In this latter I speak of all mankind. A human right.

Hi everyone,

I've spent several hours reading through the forums trying to get help/ advice on situations where people are in the K1 process and have managed to successfully visit their Fiances in the US, however most of the applicants are in 1st world countries ( UK and Canada mostly). Here is our situation:

NOA1 received in April 2012, K1 being processed in Vermont, the 5 months normal processing time have already passed, I called USCIS and they said that they are still processing February 2012 applications so we have to wait 60 days until we can make a case. With the two months for them to process (NOA2), it will probably be another additional 2 months before she can come to the US (most likely December 2012 or January 2013).I have not seen my Fiance since January and we are now seriously considering applying for a tourist visa so she can come visit me in the US for a few weeks before returning back to Zimbabwe for K1 processing. I cannot get leave from work so will not be able to visit her unfortunately.

I called both USCIS and State Department about the possibility of her getting a tourist visa while our K1 is pending and both said it is possible as long as she can prove she will return to her home country after her vacation in the US. She is currently employed and can provide documentation showing she is employed and that she has sufficient funds. I also am working full time and can provide the necessary financial evidence. We have maintained good records of the entire application which we can also provide if needed for the tourist visa.

My questions:

1) Given that she is from a 3rd world country and also is a widow, are we simply going to get denied the tourist visa or she will be refused entry at POE? As much as I want to see her, I would hate for her to fly all the way to the US and then be denied entry. I understand we first need to obtain the visa in Zimbabwe and then pass through POE.

2) If we take the risk and go ahead with applying for the tourist visa, if we either get denied the visa or refused entry at POE is this going to negatively impact the full K1 application? (We are willing to take the risk but not at the cost of the K1 being denied)

If anyone has applied for a tourist visa while K1 is being processed from a 3rd world country ( especially African countries), then please kindly share your experience. Also for those of you who are more experienced with these processes your advice / feedback on the above would be very helpful.

I apologize if this post seems repetitive but I have not been able to find any posts that are similar to our situation.

I have applied for K1 and submitted all three forms at once i129f/g325/i134 to Vermont service center. It has been two months since we have been together and we are going insane. We too are thinking of applying for b2 visa so I called USCIS yesterday and while she said it was "possible to apply" she more or less told me without coming right out and saying so that it would be unlikely that he would be approved at this time (referring to the political unrest in Africa right now,especially North Africa). Sure they will let you apply, they make $160 non-refundable at your time and expense so they can say no? It might be worth a try if you can afford the expense the time and the possible let down. I hate to be negative about it because I am missing my man like crazy, just trying to be realistic. This is an emotionally draining process. Good luck to you and keep us posted.

Yes, you are correct about reading instructions very very closely, and I really did. Took me almost 3 weeks to prepare all the information and make sure it was accurate and what they were looking for. One MUST really read the instruction page and understand what they are looking for. It really is emotionally draining, almost feels hopeless at times, but HOPE is all we have in these situations.


The G325A has to accompany the I-129F. There has to be 1 from you and 1 from your significant other (both signed etc).

The I-134 goes to embassy (where they actually make the decision on the Visa) with whoever the foreign national is to show proof of ability to support.

Do not send the I-134 with the I-129F.

I would read the I-129F instructions on what is required very very very closely.

No. The process won't be quicker if you add the I-134 form, because that form needs to be revised by the embassy, not by USCIS.

If you want to still include them in your packet, go right ahead; but it will not make any difference. They won't pay attention to it and you'll still have to re do it at the time of the interview (+5 months down the road) to show you can support your SO.

I called USCIS before applying for i129f and they told me where to find forms and instructions so I assumed all three were necessary at once. I hope they don't get lost in the shuffle, even though I made copies of everything. Is it possible by sending all three at once the time to process will be quicker?

Every year it swings back and forth who is slowest. First VSC filers complain then CSC filers. This slowdown is nothing new. It is the nature of the beast.

Maybe that's true but we all know doing nothing will change nothing. If for no other reason, one should sign it for future petitioners even if we see no results from it ourselves. Like I said it can't hurt and it is certainly worth a try and for a worthy cause.

I just got my RFE in the mail, so since both me and my fiance both met in dubai, i showed both passport stamps from both sides stating we met in dubai not pakistan, and in the RFE it saids: The petitioner only submitted copies of passprt pages with admission stamps but missing identification pages: USCIS is unable to recognize who is the passport holder So I sent them my boarding passes as evidence already so here is my questions "SO are they asking me to photocopy the entire passport to prove that this is my port of entry stamp and exit?? In my petition i only submitted the page of the stamp of entry and exit..pls give as much answers as possible on how u guys show ur entry stamps on passport .. thanks again

They want all the Information what the PP Issuing agency had put on your PP from Holder's name,DOB,POB,Place where the PP was issued,Parents name,Issuing-expiration dates.US Visa if any (and sending all the other visas and entry stamps would not be a bad idea )

The wait is frustrating.we are doing the AOS.got a RFE online on sept 11 and the hard copy on sept 16.the mail should reach ya in 28 days(i think).i knew what my RFE was going to be for(i did not submit the I-693 with the petition,the attorney screwed us for that)and i got a good 2 months to reply to the notice.i am pretty sure they will give you plenty of time to reply but yeah,the notice will put a hold on the both I-485 and I-751.i did my medical and the biometrics in this week and will be sending the sealed I-693 by tuesday and than will join the wait club again.i am confident that i will be done with the whole AOS procedure by Feb 2013.good luck to you , do not lose hope and be positive.after all immigration is a privilege not a right.wait is what we can all do.god bless

Hello everyone! I have a question.

I have a permanent address and a present address. I also do have previous addresses.

I had 2 previous addresses, the first one was 10 months and second one was 4 months. 10 months as a bed spacer and 4 months as a tenant too. now 4months on my present address as a bed spacer too. I want to use my permanent address in all the forms im going to fill out. So how should i fill out the G325A saying list address within 5 years. so if i put my present address first, how am i going to date my permanent address in "from" and "to" box.. and can i also use my permanent address in my Letter of intent to marry" instead of my present address? How am i going to use my permanent address so that all the correspondence that a beneficiary will receive would go to my permanent address? can i just not put my present address besides im just a bed spacer or what?

im kinda confused. all comments will be appreciated. TIA!

What are the consequences of marriage in the foreign country in regards to the I-129F, fiance visa? Would it delay our "be together date" if we were to marry before our child was born? We were not expecting the I-129F process to take so long and now we realize that my boy will be born before she can come. None of my expedite requests were approved, unfortunately. She might have preclampsia and need to be added to my insurance ASAP!

My RFE was pretty frivolous, in my opinion. Of course, my lawyer could have messed up the original paperwork without telling me (all the more reason to do it yourself, also, your lawyer is the only person to receive the RFE, so I never saw it). They sent me a multiple choice question that asked if my fiance was ever arrested, yes or no. Being that this is something the Embassy handles during the interview, I saw little reason why they should be asking me this now.

Also, the NCSC is always extremely nice to everybody and they don't offer any opinions, so you're going to have to go with your gut. I read somewhere early on that one guy got accepted for an expedite because he didn't have any more vacation time for work and would have to take unpaid time off to go to the interview if he had to wait for the new year.

I submitted an expedite request (after the fact of submitting my I-129F). If you are going to send it, I recommend that you send it with the I-129F submittal. They will review it and get back to you before even putting your application into the file system they have over there. I sent in an expedite for the cost of birth and the pain I would have to go through being separated from my first born and it was denied. Maybe I wasn't exact enough. Now, I feel like they are jerking me around. I received an RFE on the exact day before my 7 month point, the day that I would have been eligible to request an expedite based on the amount of time things are taking. They mailed me the RFE, which they say could take 15 days. They really want to make me wait now that I thought I should be given priority over all the other I-129F filers. I must have rustled somebodies feathers and now they really want to get back at me. Everyone else who submitted at the same time as me received their RFEs AND acceptance letters (even after an RFE) before they even bothered sending mine. My case is not that complicating. I recommend that, if you try the expedite, that you try the expedite. After the expedite was denied, I continued to follow up with my senator... Probably each time pulling my file and pushing it further and further back in the stack of files.

In my opinion, they need a better filing system that keeps things more fair. On the other hand, if they really do want to mess with me now that I've persisted too much, then I guess they have that right and I can't do anything about it. Keep these things in mind as you pursue your application. I should have taken the advice of others "It's best to wait".

It looks like the moral of the story is that the immigration law is too confusing for those people who need it and the USCIS customer service is too vague for those who need help understanding it. I realize that they don't want everybody getting accepted for an expedite, especially those who don't need it, however, if you could show proof, it shouldn't matter which category you fall under and the customer service should be more direct with help on an expedite request. Upon first glance, many would assume that a pregnancy would be a humanitarian reason or a moral reason. I wish I knew this was not the case when I applied because, while I painfully described the angst I felt not being able to share in the life of my son, I saw 2 other categories that I could have fit under for an expedite. Looking back, this was frivolous and it did me no good because now I'm 50k in the hole and $2k more every month as a result of immigration and their nonsense. I would have been much better off applying for an expedite based on financial reasons. I thought that this could be counter-intuitive because we need to be able to financially support our fiance/wife here in the US on the affidavit of support and I assumed that claiming a financial issue could get me denied later. Either way, now I am stuck with the angst and the misfortune. Live and learn. Unfortunately, I imagine that nothing immigration-wise would be as important to me than being with my son, even though I applied after only being 1.5 months pregnant and still waiting as he turns 3 months now. (expecting a visa for my fiance when he turns 5 months). To me, this is an outrage.

Unfortunately, United States immigration is not a humane, kind, or feel good service and they would never tell you otherwise. You are guilty until proven innocent and humanity doesn't matter. The response was straight up honest, in my experience.

Stupidly, when I submitted my I-129F, I thought it would be too difficult and I paid a lawyer (3 installments of $800; $800 initial, $800 after she receives her visa, and $800 for the AOS interview). Well, my lawyer does not share the same level of urgency that I prefer. Maybe I am wrong (If I am, please let me know).

First, look how long my petition took to get through USCIS. He told me it shouldn't be more than 4 or 5 months. I submitted to him on February 26, he sent them 2 weeks later in March and I receive an NOA1 on March 19. Then, after waiting 7 months, we received an RFE on October 24 asking if she has ever been arrested. This sounds ridiculous, but please tell me if you agree. It must mean that he never filled in the circle on the I-129f which stated that she had never been arrested, right? I mean, why would that be such an urgent question for USCIS to address when we have to provide her full police report at the interview? The RFE was a multiple choice question "yes or no".

We finally received approval on November 19 and I am the one who notified my lawyer of this! With the help of this website, I was also the first one to know that NVC had received my submittal from USCIS and that I received an NVC number. I was the one who told my lawyer about this number... They assumed wait until things arrive in the mail! They still have not received anything...

So now, after calling the Embassy directly to find out, they told me that they issued an interview date for February 4. My lawyer seems like he is not concerned at all about getting anything done and insists that he cannot help me until she receives the packet! I fear that we will get to January 15 when my fiancé finally receives her packet in the Dominican Republic and my lawyer will want to delay our interview date to make sure we have time to do everything. I've already done everything as written on this website and now await the packet so that she could go for her medical and we could submit everything else. I want to submit everything else without my lawyers help because I've lost faith in his work ethic, and for such an important matter in my life! If you want something done right, I guess you SHOULD do it yourself.

Can you imagine if this had happened to you? I mean, I'm less than 30 days from my interview and my lawyer has told me on a number of occasions that he would send a copy of his submittal to USCIS over the last 10 months (and has not sent it to me yet). We negotiated the second payment of $800 AFTER she received her visa, so maybe he is trying to hold out for the second payment. But, how can I fill out the new forms without knowing what he put on the USCIS forms? I fear that the slightest discrepancy between the two submittals could jeopardize our approval. Is this a bad fear to have? I mean, I feel like documentation is more important than sensibility (we obviously have a very long and healthy relationship after over 30 visits to her country to see her, talking every single day for over 2 years, many of those days for many hours.) I cannot stand to visit her one more time and not have her come back with me.

How can I make a clean break from my lawyer? Does it really matter if her Mother was born in Santo Domingo on one form and in an urbanization of Santo Domingo on another? I really don't feel like having to discuss problems I had with my lawyer in an already nerve-racking interview...

Does anyone have any other suggestions?

The case with my ex was a CR1. Should I get a letter from my ex saying that we were separated? I did move to another state in Aug 2010. I knew my fiance before this time, but we didn't officially start dating until Nov 2010.

My ex husband also had a child with another woman in Dec 2007. This is what caused the marriage to fail. I tried to work through it and move on from it, but I finally decided it was not someone I wanted to be with. I was never in the marriage for just papers, but after I found out about the child I have thought that maybe that was all he was in for.

Any documents, papers, letters you all think I should get to help my Fiance and I?

I am married to an immigrant from Mexico. We separated in 2010, but I could not pay for the divorce until now. The divorce will be finalized in May or June if all goes well. I never completed the case. It sat at NVC and they finally terminated the case.

I am now engaged to a man from England. I want to file the I-129F as soon as the divorce is final. How will this effect my case with my current fiance? I want to do this right and prove that we are in a true relationship. We have talked on Skype daily since Nov 2010. He came to visit for a week in Feb 2012 and then extended his stay another week. I tried to get transcripts off Yahoo from our talks, but only got back to Aug 2011 as it must have erased after they updated their program.

Any suggestions will be helpful.

Also if we file the I-129F in May can he come visit in August?

My fiance just recieved his packet from the U.S. embassy in Bucharest, Romania. He has been telling me the things he needs me to mail to him. First of all, I have recently been laid off from my job due to lack of work. He says I have to mail a letter from my employer stating when I was hired and what my salary is. Will I still be able to get that letter even though I'm laid off now? My income will not be enough now, so I will have to get my stepfather to co-sponsor. My stepfather and my mother have a joint bank account. Will they both need to fill out the I-134, or just my stepfather? My mother does not work, only my stepfather. Also, I have applied for unemployment. Will I need a letter or something from them showing how much I will be getting from unemployment benefits? Also, I get a check from Social Security once a month for my 16 year old son. (His father passed away in 2009.) I assume I will need to get a letter from Social Security stating how much I recieve from them as well? I'm very nervous about all this. I'm so afraid he will be denied now because of my lay off. My fiance called the embassy today and spoke with a consulate. She told him it will be fine if he has a co-sponsor. But I'm still worried. In the packet he recieved, it said that it was optional for the co-sponsor to write a notarized statement declaring their willingness and ability to support my fiance, and also their motive for doing so. Does anyone feel that it would be a good idea for my stepfather to do that? I feel that it might be beneficial. Any advice on all this would be appreciated. Thank you!

I am in the same situation. I wasn't sure how to handle it either. My stepfather is co-sponsoring my fiance. When I filled out my I-134, I put "Temporarily laid off due to lack of work." I didn't know what else to put. I put this on the line where they ask for your employer. I sent my tax returns, the letter that shows how much I get from unemployment, and a letter fron the Social Security administration showing how much I receive monthly. (I recieve benefits for my 16 year old son from my previous husband's death.) I was unable to get a letter from my employer where I'm laid off. I tried, but they wouldn't give me one since I am on lay off status. :( My stepfather's income exceeds the poverty limits. I'm just praying that it will work. My fiance's interview is December 4th at the U.S. embassy in Bucharest, Romania. I'm praying he will be approved. I'll certainly let you know how it goes. Just throwing this out there even though I'm pretty sure what the deal is... I was laid off work a couple of weeks ago and my NOA2 is happening any day...I already have a co-sponsor and I expect to be gainfully employed again within the next couple of months. How do I fill out my I-134? I have all the tax returns to prove my earning potential and my co-sponsor earns well above the poverty limit so does anyone have any advice for how to approach this? I will be collecting unemployment benefits but only for a short time.... Any advice is appreciated, thanks!

Thanks for the replies. I guess I'm just curious as to what kind of answer they could give, such as if anything else is being looked at, etc. I'm kind of worried that we'll wait the 60 days or close to to have another RFE thrown at us.

We filed our initial application back in Dec 2011, and finally received an RFE which we responded to and received notice it was received on May 16. My question is, knowing they have "60 days" to process, would calling to check status do any good at all? Has anyone had positive or negative results? I just feel the file is sitting on a desk with a note showing the 60 days date, and someone is ignoring it until it's that date...

I was reviewing the I-134 form and there is a part about real estate on it.

In my divorce, I let my ex keep the house, and signed a quit claim deed, etc. We had an 80/20 loan, and the mortgage company would only let him assume the 80% portion of the loan. The remaining 20% loan still has my name on it, although I have a hold harmless agreement and the quit claim deed has been filed. My ex is in possession of the house and still making payments since the divorce three years ago. Does the 20% loan and house still need to be claimed on the paperwork when I send it in?

My ex is still trying to find a way to get my name off that loan also, but hasn't been able to yet.

I sent copies of my actual divorce papers, showing the stamps and signature of the judge. I received an RFE and had to get actual "certificates" from the state showing everything is on file with them. Save yourself the time, and see about getting the certificates before you send everything in.

On line 8, I know I have to list my son as a dependent. I have majority custody, and receive child support for him. Do I list him as "partially" dependent, or "wholly".

How does that affect the amount I need to make?

Also, will they calculate the needed amount based on two people (myself and my son) or three (adding my fiance)?

I found the sticky in the Canada portal, it answered most of the questions I had :)

We called today and the NVC told us our info had been sent to the consolate. Hopefully we're in the home stretch. I guess it will just depend on how quickly we get the interview. My fiance's been working on gathering what is needed for the third packet and interview for a while now.

Thanks for all the input.

I've read over the flowchart several times, and while it's helpful, it doesn't really explain how things progress as far as "now you'll wait to receive a letter from NVC", etc. There is a lot of useful info, but things get a little vague after the NOA2, at least in my opinion. Maybe I'm missing something, I'm not sure. I tend to work better with lists, etc to work from, though.
