Ours says 6th September but we are not even getting touches at the minute and with people getting no help on the phone or being given discouraging info like 2 more months, we don't know what to do and are very distraught.

So basically at this point we are 3 days over our VJ timeline and 128 days since our NOA1.

Lets have a fantastic Wednesday!! Anyone with CSC any idea of why I should not have been assigned a case officer yet with May 3rd NOA 1. According to the timeline for CSC that means ours should be one of the next ones to be approved but the fact that it has not been touched in a while leads me to believe its still sat in the back room which surely cannot be right can it after 125 days since my NOA 1 ??

If ANYONE has any more info about what date they are processing, because like I say according to date only most people posting here are behind me !?!

Are there any more people who have been at least assigned a case officer who can post about how long its been since there first real touch and not just the RFE trick ??

congrats to people getting touches ,

Just wondering if there might be a reason why ours is not getting assigned and touched still praying nothing has gone wrong.

Good to luck to all here, hope someone can predict when we might get our approval.

I quit my job yesterday due to all the stress and can only hope we get approved soon as otherwise we could be in real trouble financially.

Can't help feeling the stress now. I just pray for all of us to hear good news soon.

Yeah that is exactly what I was meaning,

If anyone overstays in the UK more than 6 months there is absolutely no way of extending any further for ANY reason.

Am I right ?> Also from everyones posts I gather the following;

1. We cannot be detained at the airport just maximum is have or passport stamped restricting my fiance's return
2. My fiance's overstay does NOT affect my K1 fiance visa for the US.

Do we not fall short on part 44 (ii) the extension cannot mean that they would be here longer than six months ?

Sorry if im reading it wrong, but it sounds to me as is extensions can be grant so long as the extension would not mean they are staying longer than 6 months.

Please let me.

We have taken them all on board and they cover everything that we need and more. I realise there is no exact answer as it all depends on who is at the desk when you pass through I guess, however your words of wisdom and reassurance are a REALLY big help to us.

My fiancee and her daughter and I are very worried however we feel a great ease at what has been said.

I we were unaware of this, even though we went to an immigration lawyer before her 6 months ran out. He said that NOTHING could be done and that she would have to leave.

So I guess there is nothing we can do now that she is outside the first six months then ?:(

Sorry you misunderstand me, I mean six months is allowed for a visit to the UK without a specific visa.

I am aware that my immigration to the US should not be affected by this, this question is purely about what will happen at the airport when we come to leave and how they will react when they see my US fiancee has overstayed in England.

My fiance is with me in the UK while we wait for the US K1 visa to be approved. Unfortunately it has not been approved within the 6 months allowed however due to the fact we have her daughter in school and don't want to have to leave each other they are still here after close to 11 months.

The question is what will happen when we do come to leave with me holding a K1 (fingers crossed).

She has never tried to work while in the UK and both have been totally supported by me.

ON the biometrics form we put that they were living with her Mom due to the fact that at that time we thought they would be travelling back and that is where they would have been staying.

We thought about getting married here however it was not an option without them leaving according to a rubbish lawyer who we consulted.

SO basically thats it. - they are here with me waiting it out.

Any ideas? or has anyone actually faced this situation.

I realise by the letter of the law they could be banned from coming back to the UK for a while (maybe a year I think) but how does this happen ?


Please help :unsure:

Thanks for that, it does make things clearer for us, we sent our response back yesterday , so fingers crossed.

I will post as soon as we know so that hopefully it may avoid anyone else getting a similar thing happen to them.

Yes our RFE was about IMBRA, however we never used a marriage broker so dont know really why we got it.

Have you had an RFE about IMBRA or heard of others ?? just wondering why you would ask that.

Many many thanks to you all for your kind words, yea it has been very hard to wait this long thinking we would be approved and have yet more anxiety with the wrong info sent, however, God willing we will all receive our Visas in due course and our happiness will last the rest of our lives.

Once again Many many thanks, and I will probably post what happens in a couple of weeks (fingers crossed it might be an approval)

Hi there,

Okay so after 170 or so days we got notice of an RFE and finally received the info in the mail, HOWEVER they had missed half the pack out including copies of our origonal petition which they wanted an extra answer on.

SO we got on the phone and after lots of calls and us saying we couldn't return the info because we did not have all the questions....(the RFE states that your answer must be in full or they could deny you) we FINALLY got a revised RFE pack in the mail yesterday !!!

Well guess what !! they put two excerpt questions for the RFE from form I-129F onto a seperate piece of paper however they included the questions from the K3 I-129F Not the K1 I-129F.

Not a problem you might think however one question is different on the K3 version. It is the conviction one.
On the K3 version the conviction one does not have to be answered at all if no convictions apply, on the K1 version there are two boxes, one for yes and one for no.

Q. should we make the boxes for yes and no and answer NO, which is our official response. Or/
should we send back the officers form with no response ?

Sorry if this sounds confusing but I can't belive they got this wrong again and don't want to send back the wrong thing.

We received our RFE in the mail yesterday, however we are not sure what the heck they are wanting from us.

The only thing we received was three sheets of paper; two blue ones giving case number and standard stuff and one white one requesting info. NOTHING else at all, We did NOT receive our petition back again. ( some of the points seem to be in regards to circled sections of the petition which we did not receive.

What should we do, we tried calling once today but the lady at CSC said she would need to look at it and call us back and she would take a week to call us back. (she was no help at all and sounded like she didn't have a clue what we were asking about)

Here is the copy of what was on the white piece of paper;


INITIAL EVIDENCE REQUEST -1-129F

1. OMITTED ITEMS: Complete item(s) circled in red on the attached copy of the petition. If any item does not apply, please write "NONE". N/A is not an appropriate response.

2. The International Marriage Broker Regulation Act of 2005, Pub. L. No. 109-162 0anuary S. 2006) (IMBRA) has established new requirements pertaining to Form I-129F, Petition for Alien Fiance (e). In light of the new amendment, USCIS is requesting you complete the following questions, sign, date, and resubmit to the address listed below.


3. Additionally, IMBRA imposes limitations on the number of petitions you may file or have approved without seeking a waiver of the application of those limitations. If you have filed two or more K-1 visa petitions at any time in die past or previously had a K-1 visa petition approved within two years prior to the filing of this petition, you must apply for a waiver. To apply for a waiver, you must attach a signed and dated request for the waiver, explaining why a waiver would be appropriate in your case, together with any evidence in support of your request. Examples of such evidence include, but are not limited to: a death certificate, police reports, news articles, or medical reports from a licensed medical professional, regarding the death of an alien approved for a prior K visa.


4. If you answered yes to question part A-11, " have you ever field for this or any other alien fiance' (e) or husband/wife before'? However, the petitioner omitted to include the names of the aliens he's applied for; as well as the place and date of filing of the petition/application. Please provide this missing information.
