United KingdomOctober DS-2001 Filers?

Hi,

Thanks for sharing your info.

When you called the embassy, did you just ask for a code so that you could email them? Or were you more specific?
I sent my packet 3 on 29th of october too, but only had my medical last monday so im hoping to hear something this week.

Thanks

Realised I didn't really answer the question, sorry. I just explained to the guy that I had an appointment date after our wedding and he gave me the email address, didn't ask for my name or case number or anything. Then I asked if I needed a code and he said no.

I called them embassy as soon as I got my letter and they just gave me the email address. They said since it was an immigrant visa that I didn't need a code (I asked on the phone). It took a week and a day after my medical for them to 'process' the results (that was last Tuesday) and I got the letter on Saturday with the interview time and date and that's when I called the embassy. I had to call to see if they had processed the medical and my packet 3. When I called they said it would be 2-3 'til I got the appointment letter, but we had contacted my fiance's senator, so don't know if that helped speed the process up.
Hope this has helped you. I just feel so lucky and thankful that they have been so cooperative with us and understanding./

Been following this forum even though I haven't posted on here yet. Just thought I'd let you all know that we contacted my fiancé's senator and they contacted the London Embassy and from the day of them 'processing' our medical results we waited 3 days for the letter to come through and be allocated an interview date. It's really worth a try if anyone else is about to have their medical or are waiting for their interview date. I'm not sure if it was luck or if because the senator got in touch that made the difference but I guess anything can help. Unfortunately, the interview has been set for January 7th, 2 days after our wedding date (despite sending proof of wedding bookings and 15 friends and family flight confirmations), but we have emailed to ask if there is any chance it can be changed, although I doubt that will be able to happen. This is a long process and I can't wait to get to America and marry my fiancé :) The end is in sight.

We have an NOA1 date of March 1st but still have no NOA2 :( we have planned a wedding for January 5th (foolishly) but really thinking I won't make it for then since we don't even have our NOA2 yet. Any suggestions/opinions on whether we will have our visa on time for January 5th or not?

I realise it was silly to plan a wedding in advance now, but what's done is done. Praying we still by a miracle get out visa on time.

Removing Conditions on Residency General DiscussionI-751 following Divorce, waiting for response

Hello,

I am sorry for everything.

Yes, for now, everything sounds normal.

It happens more than you think.

When the interview will come, be yourself. According to the information, and a lot of people, this interivew should be more personal. They will ask more intimate question to verify whether or not the marriage was geniune. They may become hostile, and sometime they are hostile. Be prepared. Do not try to lie in any way. If you are yourself, if your marriage was real, then tell the truth and everything will be fine. You'll see.  :-)

Thank you so much.  I have nothing to hide, I will not lie.  Your message is of help.

Have a good day.

Removing Conditions on Residency General DiscussionI-751 following Divorce, waiting for response

Hello.

I am posting with the hope that someone else is/has experienced what I am and can tell me if it is a normal occurrence.

I was married Oct 16th 2010 with a K-1.  The marriage was very difficult coming into 2011 and we went to counseling a number of times with 2 counselors.

I left my then wife Jan 1st 2012.

Filed for divorce in May 2012.

Divorce was final July 31st 2012.

I sent I-751 in and was received January 28th 2013.

Got and RFE June 6th 2013.

Responded July 28th 2013.

...Heard nothing for a number of weeks so I called USCIS 1st week in December.  The girl in the phone told me that I have nothing to worry about and that there was a notice for an interview to be sent out in 2-3 weeks on the system.  She said it would be sent to the address on file which she read out as my current address.  I have yet to receive this notice.  Does this sound normal? (It has been 5 weeks since I called).   My extended residency expires May 3rd 2014 and I am becoming a little concerned.

If I do get the notice eventually, what should I expect in the interview?

Many thanks in advance.

Dara

Removing Conditions on Residency General DiscussionFiled I-751 01/'13 - Still pending status

Hello all.

I filed my I-751 in Jan 2013.  I did biometrics; I was given a one year extension on my Green Card. Received an RFE and I filed extra required evidence in July '13.  I have contacted USCIS a couple of times in the last 3 months as my extension will expire soon.

USCIS have told me to be patient each time as my case is still pending and it was transferred to CA because of a back-log.

My problem is that I am working full time and I have a lot of identification and other such things that run parallel with the expiration of my extension.

Is there anything that I could ask of USCIS if I am to call again: some sort of an extension? I do not want to lose my job.

My application is legitimate, but I am still worried I will not receive some solid information in time.

Kind Regards

Dara

K-1 Fiance(e) Visa Process & ProceduresQuestion on visiting

If I'm understanding the question correctly; No, there is no boundary - you may use the K-1 the day it is issued (regardless of previous visits). Technically you could 'use' the K-1 visa anywhere from the day it is issued until it expires 6 months later, but there is no requirement to wait.

Some helpful tips about traveling to the US while the K-visa is being processed can be found here.

Thank you for the quick response! That answers my question perfectly, I hope we can be of help to you sometime,

Cheers,

Dara

K-1 Fiance(e) Visa Process & ProceduresQuestion on visiting
Hey all,

I have a quick question; my Fiancée and I are about to mail our I-129F, which I must add, the use of this site has been unbelievably helpful. I have been with her in Georgia 2 times, twice for 2 month stays, both on I-94 visas.

Our question is, is there a boundary where if I am to visit her between now and the issuing of the K-1 (please God that happens smoothly) I will need to wait 90 days before I use it, like there is after returning on an I-94? For example, if say I were to visit her on an I-94 in June and the K-1 was issued in September, would I have to clear 90 days from when I returned in June before I departed using the K-1?

Thank you,

Dara

K-1 Fiance(e) Visa Process & ProceduresAdvice on I-134

If he receives a steady monthly pension that could be used to work as the co-sponsor. He will need to fill out his own I-134 separate from yours. In addition he will need to supply check stubs or something to show the payments or possibly use bank statements showing a regular auto deposit.

Also assets can ve used as opposed to income or a short-fall in income.

He provides an I-134 and supporting documentation as evidence of income. His statement of retirement benefits should be sufficient but it's best to include at least the most recent tax return as well.

Thank you very much, appreciate the help.

K-1 Fiance(e) Visa Process & ProceduresAdvice on I-134
Hey people,

We have a question on the I-134, regarding the working status of a co-sponsor. My fiancée is trying to find out if her grandfather would be eligible as a co-sponsor. He is retired from the Marine Corps and they pay him well since he has retired. He would like to help out but would they accept him as a co-sponsor and if so, how would this be filled out on the I-134 in his name?

Thank you very much,

Dara

K-3 Spouse Visa Process & ProceduresStarting the K-3 visa process

I just had a look at your timeline - so you went the Direct consulate filing route. Do you think that would be a viable option for us?

Thank you so much for your advice

K-3 Spouse Visa Process & ProceduresStarting the K-3 visa process

My husband is a US citizen and I'm a British citizen both living and working in China. We got married in Hong Kong in May and are about to start the process of applying for CR-1 and the K-3 visa,  where we should apply for the K-3 visa ? My Chinese visa runs out in January so i'm concerned that they won't be able to process it before I have to leave China. Is it  possible for them to start processing the K-3 in Hong Kong and issue it in the UK if I have to need to leave China before the process is finished?

Thanks

Lindsey

IR-1 / CR-1 Spouse Visa Process & ProceduresChina - re-establishing domicile.

Hi, I am a British citizen and my husband American we have both been teaching in China for the last five years. We are preparing documents for the affadavit of support however we are finding it difficult to find evidence of re- establishing domicile. So far we have:

A letter from my spouse's parents saying we will live temporarily at their house whilst we organize permanent accommodation,

Emails from real estate agents asking about apartment availability,

Evidence of actively seeking employment- daily job alerts on monster.com, interview offers, emails to potential employers.

Is this evidence sufficient?

We  tried to open a bank account  online and over the phone  this evening but were told that we can't as my husband isn't physically in the US. Will not having a US bank account affect the domicile requirement? Can anyone suggest any alternatives? Not only do we need to show re-establishment of domicile but we need somewhere to transfer our Savings to.

Thanks

Lindsey
