i personally will stop working at the end of this year, taking the risk of being unemployed for abt. 6 weeks. we hope to have the interview in the last week of january and i really want to have the time to visit my friends and to say goodbye. but that's just me.

1-both the petitioner and the cosponsor must fully complete the I134, even if the petitioner has $0 assets
2-Yes - i think technically 3 years but i have heard London not being so strict on this. Nevertheless, i would recommend taking at least 1 years tax returns and W2s, or transcripts from IRS are good too apparently
3-dont know this one about the notary! Is there a way of having it completed and posted to the states to get it notarized, then posted back to uk?

1-book full check up as soon as you have your LDN number. It has be done at the Knightsbridge doctors http://www.visamedicals.info/
2-that list is good, i would just recommend birth certificates and copies for both you and the petitioner, copies of literally everything to be on the safe side and a nice credit card to pay them to give you the visa!

Now i am getting really worried about this. I was working for 2 months in summer 2006 on a J1 Visa and am worried that i may be subject to the 2 year home residency requirement. It doesnt say anything about it anywhere on the visa that's still in my passport, and i dont have the ds2019 anymore. If it makes any difference i didnt do any studying at all, and the trip was 100% funded by me and not by any 3rd party/government.

There is no hard rule that your fiance will be denied entry into the US. 129-F applicants do make it into the US on a tourist VISA or VWP. However, the immigration officer at POE might refuse permit if (s)he is not confinced he's not gonna leave the US within 90 days. Chance of one being refused is higher when in application process of 129F since immigration officers are aware of the opportunity of bypassing the procedure by traveling to the US. I recomment you not to take the risk and wait for a few months.

Exactly, you can do your wedding ceremony whenever you want as long as you are legally married within 3 months. If you do it really fast you can apply for AOS+AP+EAD and have your AP before you leave in December. This is not guaranteed but you might have a chance if you file asap.

Well, if you haven't filed your application yet, you cannot clame that you have the job you're mentioning on your fincancial support form. So, you have to revise your paperwork. I would recommend you to wait filing till you have found either a new job or sponsor(s) who can sponsor the applicant. If you already have sponsor(s) meeting the income requirement, you can eliminate your share. That is I think the only way that allows you to send immidiately.

This may be a silly question, but, does anyone know if it is possible for my fiance to continue working for his company in France via internet/telecommuting while he is in the USA waiting for his EAD? He would be paid in Euros/Francs to his French bank account. He and his company are well aware he would not be able to travel to France while he is waiting for his AOS etc. Thanks to anyone who can shed some light!


I agree with people that this is a grey area but I would reckon he is allowed to work from his own chair at home.

From my perspective EAD or no EAD is only relevant for US employers. He cannot work without EAD for a US employer but I would argue that if he is doing business within France, he doesn't work Americans and is just using a room in his own house he would be fine working remotely in Europe. As a French citizen he is obviously allowed to work in France and receive his pay check there. Bear in mind he would still have to report his income to the IRS in USA.

Remember, since I'm not a lawyer this cannot be considered as legal advise. It is just my gut feeling that this will be alright.

As far as I know Premium Processing is only an option for certain employers - not for K1 Visa - I looked into this as well.

My highest cell bill was over $1000 - oops! Gotta watch out for the phone bills! Good evidence though :D

When I use Firefox, this problem does not occur, it opens the detailed view, although you can see that the checkbox state changes when clicked and then it switches to the detailed view.

It seems that the J-1 program number that is on the DS2019 which in my case is P-1-xxxxx must provide the DoS agent with some details about the program that I don't know about. Is there any way to look up details about J-1 programs by this number for ordinary people like me? I'd really like to understand what is going on here.

So, today I checked my status. It's now about 9 weeks after I've applied for their opinion and I am very surprised to find that they consider me being subject to INA212(e). Unfortunately, there's no reason shown on the status page and it just says "Subject" without any further explanantion which leaves me pretty clueless about what to do know.
As I was about to turn in my AoS application this week, I guess I keep on going and pursue this but I should also get prepared to deal with bad news from USCIS as they might be deciding just like the committee. So, would someone here maybe have a recommendation for a good immigration lawyer that has experience with J-1 HRR cases? I still think that I am not subject to this rule as there was no government funding involved in my delegation neither from the US nor from Germany and Germany is not on the Skill List. So I think I would challenge a negative decision and apply for a Waiver in parallel.
Any other suggestions from someone here that could help me???? I'd really appreciate any help from you guys!

As you will get a case number, this might speed up the processing time on behalf of the State Department and you'll also be able to verify the staus of your case using the mentioned link.
The same link can be used to apply for a waiver for the HRR - same procedure: fill out the forms online, receive a PDF, print it out, add documents and check and mail it to the same address.

Oh, if you can't easily find the link to get to the Advisory Opinion.... it's a bit hidden.as the main intention might have been to provide a way to apply for a waiver. You find the option for the Advisory Opinion on this page. Follow the option "Online Application" and then click on the option "complete a survey". This will ask you questions about the criteria for being subject to INA212(e) and will then make a guess if if applies to you or not, giving you the option to ask for an Advisory Opinion.
BTW: In my case the guess was wrong. It explicitly stated that Germany would be on the Revised Country Skills List and so I might be subject to the INA212(e). This statement is wrong. Germany is not mentioned in that list at all. But, well, what do I know ...

I'm currently in the state that we collect all the required documents for the AOS based on IR-1. I am in the US on a J-1 right now and my DS-2019 says I'm NOT subject to INA212(e). There is no statement on that on the visa in my passport. Anyway, I'm German, so I got concerned about this anyway ;-).
Googling for it revealed, that even if your DS-2019 shows that INA212(e) does NOT apply it doesn't mean nothing. "Decisions of consular officers on INA212(e) are not authoritative and can be changed during later review." is what I found somewhere in the list of rules.

The only way to definitely find out if INA212(e) applies or not seems to be asking for advise from these guys:

I found at another place that the opinion of the committee is authoritative and therefore much more reliable than a tick in the box on your DS-2019 made by a consular officer.

So, I stopped my AOS process for now and sent my documents there to see if I have a problem.

I guess my question now is, since i neglected to send in this info with the I-129, will it be sufficient for him to show it at the interview, or is there something they need to do with his name in the meantime (name checks, etc) that they might say they have to re-do with the old name? i mean, he was 11 at the time so it's not like he has a secret criminal history under that name that he would be trying to hide. but, this is the US government we're talking about! wacko.gif do you think they'll make a stink about the fact that it wasn't on the original paperwork and is now coming in out of the blue at the interview?? and if so, how do i go about amending it now?

I would rather wait until the interview to try to resolve this because I don't want to cause any delays in the meantime (and it seems as if any little thing can create delays). BUT, prior to the interview will they be doing anything with his name like checking FBI records and such, because I can just see them saying (once we get to the interview and show the name change papers) that they now need to do the whole thing over with his birth name, delaying us by months. If they do all of that after the interview, it shouldn't be a problem. Of course, considering the fact that he hasn't used this name since he was 11, common sense tells you there won't be anything under it, but I'm sure common sense doesn't override policy over at the USCIS. dry.gif

Having just dropped the I-129f papers in the mail yesterday and thinking everything was totally PERFECT, i have just realized something that has me in a state of panic! We filled out the forms and there is a section on both the I-129f and the G-325s that ask about "other names used." My fiance (he's Australian) was born with his father's surname, but his mother remarried when he was 11 and his surname was legally changed to his stepfather's. He has never used the original name except as a young child and every legal document he has is in his current name. I knew he originally had a different surname but it didn't come to mind for the forms. The only place the original name is listed is on a birth certificate, which was actually amended with the new name, so it has both names. The worst part is, there's no way USCIS will even know there was a different original name except if they ask for his birth certificate at the interview and see both names there. I'm panicking thinking we'll get that far and then they'll reject him, thinking we tried to omit something. We haven't...we tried to be very up front and clear about everything. Now I'm freaking out, and I can't stand the thought of getting all the way to the interview and then having trouble because of this. I don't know what to do. Does anyone have any knowledge of whether USCIS cares about a birth name that was never used legally (except as a child), or if this is something I should try to amend right away (no clue how to do that, either...) Or, will his birth certificate even be required at the interview?

Any help or advice would be greatly appreciated. Thank you!

wait, i think i've been confusing the NVC with the embassy. they investigate him at the NVC before it goes over to sydney?? i thought if we dealt with it at the embassy maybe it would be ok at that stage...then again, shouldn't it be? i can't imagine them wanting to investigate him under a name he hasn't used since he was 11...

You can do a fresh I129 and add the 'missed' info and then tell them at the interview what happened and give them the corrected form - many people have done this to correct errors in names/dates etc. I would assume that there should be no real issues - since your fiancee is also submitting or will be submitting police reports. I believe (and if i'm wrong someone correct me) that the 1st step is to check on the petitionner.

Now, where is the documentation as proof ? can you get at least a certified copy?
Maybe you can make corrections with the next step, writing a nice additional paragraph completing the info you wanted. And oh we also did a cover sheet enumarating all the documents, in the order they ask on the instructions. All in all to make the paperwork more easy for them to reach.

that does help a lot. as for the documention of his name change, it's packed away in sydney, so we DO have copies of it all, but we won't have access to it until may when my fiance returns to australia. so i didn't know if it would be best to send it to USCIS in may (possibly delaying the process or getting lost), or just waiting until the case went to the NVC to deal with it then. from your post, i imagine it would be fine to deal with it at the NVC level, and when he sends in his checklist and prepares for the interview, we can just maybe send copies of everything along with a paragraph explaining it, like you said. that would probably be best. thanks so much for your reply!

thanks! so you added the info when you sent the I-129F, yeah? i failed to do that (and don't have the documentation right now to send, either), so i don't know whether it would be ok to just deal with it at the interview...?? thoughts, anyone... *sigh* maybe this sounds like a simple problem, but it's really stressing me out...
