You do not need to notarize any documents for your initial I-129f. good.gif

I used to picture it like a huge big box store. You get all your stuff together and look at the long lines of people in the checkout. You pick your line and wait. Now, line #4 may be moving fast - everyone has their stuff in order and they are moving WAY ahead of you. You look to the front of your line and an old woman is paying in pennies, holding up your line.

This is the same with the adjudicators. Sometimes they get cases that require longer to process - leaving you to wait for them to evaluate the ones ahead of you while others move quickly.

Often the I-129F will slow up an application. This was the case when we filed. Those with an I-129F were processed 6-8 weeks after those with stand-alone I-130s. Expect your I-129F and your I-130 to be approved on the same day. when you sent in your I-129F it was married up with your I-130 and will be adjudicated on the same day.

And no, the 5 months estimate is just USCIS. After USCIS you will head to NVC which can take a while depending on how organzized you are. Then the consulate stage. The interview and medical is at the consulate stage, not USCIS so that doesn't factor into the 5 months USCIS posts. The 5 months is just the adjudication of the petition.

Hi Fellow Members

I know every one of you either has, or is going through the same frustration as my wife and I but this waiting game is really tough. I religiously check processing times, my case status etc etc and although our NOA1 is ahead of some members' I notice they have already received their NOA2's. Can anyone shed some light on why this might be and how close we may be to some good news.

In addition, whilst looking at the current processing dates shown for processing a I129F for a K3 visa at the CSC (which has been updated today) I noticed is about almost a month past the date I received my NOA 1. Is it fair to assume that the CSC is processing my I130 application instead? And if so what the main differences between the two processes. Finally the most obvious question of all. When the processing time is stipulated as 5 months does that figure include all stages of the process right through to medical interview etc. I'm sure it does but again would like to hear someone else say it.

I appreciate these may be obvious questions but I am desperate for some calrification. I miss my wife and kids with all my heart and just want to be with them as soon as possible. Any glimmer of hope would be welcomed.

Just a very quick question regarding the 'my case status' section of the USCIS web site, I would be extremly grateful if any members could shed light on my query.

Like you all I have been checking my case staus for months hoping to see the news I long for, I received NOA 1's for my I-130 and I-129f applications on the 8th and 14th of April 2010 repectively.

At the weekend whilst checking for updates on both applications my wife noticed that once she had entered our receipt numbers and clicked the check status button that some of the circles that identify the key stages in the process had dissappeared, (namely the RFE and RFE Review circles) and were now left with the Acceptance, Initial Review, Decision and Post Decision activity. As you will all be aware this is a significantly less amount of stages than usual and I was wondering if anyone had a similar experiece and if this indicates any form of progress.

Look forward to hearing from you.....

Hi All -

Seems this is the place to go for realistic experiences and expectations for this process, so here goes a newbie post. (I'm going to apologize in advance in case this topic was discussed somewhere)

My wife and I met in India but she worked in the US before before and has used an L1 visa during the past years. The most recent project, allowed for us to be together here in Florida, where we were married and followed the I-130 flow... (though at this point I'm still confused) As luck would have it her project was canceled. So we both returned to India for a spell to do the marriage ceremonies there etc and I returned to work here in the states and filed the K3 upon my return in May.

She has an opportunity to possibly use her L1 and come back for work and obviously be back to her home here, but the more I read about the timelines and issues, we're concerned now that it might cause problems with our official K3/I-130 filing...???

At this point, I have to admit we are starting to get real nervous at the thought of some procedural move that could make things worse...

Just got approved from VSC! So I guess there is some truth to the "no-touch" theory that they can process without. (even if somewhat rare?) smile.gif

I read along here about writing senators etc., so I wanted to comment. When there was no movement, nor any touches - I started harassing every possible political figure in Florida. Politely of course but repeating the 'pain' of the process and also suggesting that they come to VisaJourney to see how badly some of this is being handled.

I must admit that some, i.e. Kathy Castor (D) Florida did nothing - pointed me back to "www.uscis.com" and even after further exchanges did not even bother responding to me with the generic govt letter. Mel Martinez was a bit better, responded multiple times and handed us off to their group in Miami who deals with immigration. They were at least committed and made attempts.

Bill Nelson's office however was extremely responsive. Even after my continued education about this process - learning that in many cases foreign worker/spouse visas are placed before citizens/LPRs etc, his office responded to me diligently. Last month, their office sent me a copy of the letter from the director of the USCIS - responding to his office. The letter was over 2 1/2 pages explaining to his office essentially what their problems are and why they are so slow in VSC vs. CSC etc. Also of note, the phrase, "Mr. Lewis has had multple senate/representatives contacting the VSC, including three separate inquiries from your office alone"... haha! smile.gif At this point, I started thinking my application was going to suddenly be lost... but I an glad to know that at least "someone" was trying to get their attention and it was being tracked. (Tax dollars doing something)

Upon checking to respond and thank Senator Nelson's office again - I checked on the status and WOW approved.

Anyway, its hard to say how much influence his office (or the others contacting) had in this process vs. just the internal mechanics of the VSC...

I read somewhere about a guide for the next steps once the approval goes to the NVC, anyone have a pointer to that?

There may be some confusion, here is what I was thinking of doing

- Move my family back home to Northern Ireland, via British immigration rules
- Use the time in Northern Ireland to qualify her for Irish citizenship though the "Island of Ireland" wording on naturalisation requirements (since I have both British and Irish).

In reality, given the job situation, and what I do for a living, nowhere in Ireland is really going to suit anyway, much as I'd love to move home. If you do have any information to clarify for me, that would be appreciated.

There seems to be some confusion with our friends at UK Yankee as well on how the settlement changes affect naturalising as a British citizen. I placed a call with Borders agency.

There are no changes to the citizenship route yet. Naturally residency will have to be granted first.

I was told Saturday to expect the government to eventually go for tougher naturalization requirements (called "nationality" in the UK).

I presume you are originally from Northern Ireland or you wouldn't be talking about moving to Ballymena to attempt an EU entry. Because this route only works for those born on the island of Ireland. AND it doesn't work anymore if you are living in the North. You must be living in the Republic and working there. In other words, you must have exercised your treaty rights in order to claim them.

AND the British government is trying to quash the route permanently. Unfortunately there are recent Article 8 court decisions which could eliminate the ability of dual Irish/British citizens to utilize the EU route.


I was born in Northern Ireland - hence the thinking behind this.
As I understand it, the Irish legislation states "Island of Ireland" rather then "the State" for naturalising spouses. I have checked the legislation documents on the Naturalisation and Immigration website. "the State" is used as the wording when Naturalising by other methods.

Does anyone know if this will change the requirement for citizenship? ie Cindy and I are considering moving to the UK when my stepdaughter reaches college. The aim would be for C to get her citizenship as quickly as possible. Would be we need to wait out the 5 years, or will it still be the 3 year rule? Technically regardless of status, she will have been living there for the 3 years. If they change that link, I guess we could move to Ballymena and go the Irish citizenship first.

I did not see anything where the Government planned to change the 3 year rule, just wondered if anyone else did.

Reason I ask, is that I sent a parcel over to C on Friday 3 July and it was meant to be 5 day delivery, but it still hasn't arrived. Sent it first class with the royal mail 5 day service so a bit disappointed. Wonder if any of you have found a better way to send stuff that is stil cost effective. And as for the my step daugher J, she thought I was winding her up when I said we had a chocolate bar that said "not for girls" and damn it didn't I find Yorkie in the brit section in a Sweetbay! I like watching it, luckily on Sky we get a fair few games. Although I am moving to Tampa, I don't think I will go to the games there, I see there are season tickets available. I'm a long time season ticket holder at Man Utd and the whole Glazer thing, well not going there. Have been to see the Giants play though, who would be "my" team.
I'm also a trainee referee for American football here in the UK with BAFRA, and this is something I would like to keep on when I move over. Seminole Heights highschool is literally 1 minute walk from where I will live, could be handy for HS games if I can get accepted as an official over there.

C and I sometimes keep the line open on the phone, or over Skype with hands free units and we go about our think, getting dinner or working or whatever, and not always talking, but there if we want to, it's almost like being in the same room. Plus with the hands free unit I can talk to her and her daughter as well at the same time.

Hey there. After C and I got together I went through a crazy few months of phone bills before getting sensible over the whole thing. We did use Skype but that was a bit iffy, especially if she was traveling (which she does a lot) and the hotel Internet connection was rubbish. C signed me up for Vonage (from the US, not the UK) and with the $20/mo contract it's free for her to call me or me her, since I now have a Fl phone number at my home in Scotland. I get free call all over the US on it, and I also get free landline calls to the UK (so it's cheaper to call Dhillons take away in Livingston from it than use my own phone!) I had worried about the quality on my home DSL line and the fact it connects over the interweb to the US, but it's been fine, certainly better than Skype. I dunno if it would be as cheap signing to Vonage in the UK though. $20/mo is nothing since I am now not paying over £150 a month to Orange :-D

As for other novel ways. Well, we both have work blackberries (work for same company) so we are always taking pictures of random stuff, like being out at the shops and seen something nice, or worked on the house and mailing them to each other, makes it more "visual" and makes you feel a bit closer as you see what they see. And I send her flowers, usually with badly rewritten song lyrics and have her try to work out what the original song was!

On the driving front, something here bothers me though. The lack of blind spot eliminators in cars. Some cars have blind spots a car length long, it could be lethal! Is this the case with all cars or have I just gotten unlucky in the ones I have been in? Such a simple change could make a big difference.

Hey there. I agree with Troy, excellent topic. I'll outline my experience so far - hopefully it might even be of some use!

I have been in the fortunate position to have had a job where I was able to work remotely, hence I spent a fair amount of time in the the US prior to visa approval. Always staying on the right side of legal of course, more out than in, and when it comes to work, I was also in the fortunate position to be employed by a company in Tampa and about 50% of my work at least involved meeting with vendors and colleagues. I elaborate here because working remotely could get you into trouble, so I was very careful here to stay on the "correct" side.

So when I knew I was moving over I started to establish personal friendships with co workers in Tampa, and also with some of the vendors. This was great, I had a couple of people outside of C and I marriage I could hang out with. I also made an effort to get on with her friends. Indeed one even flew to NI for our wedding, so we'd go out for dinner, a bar now and again, just casual social, and I was made to feel quite welcome.

Driving. So so so important. I started driving over here early. Going to the mall, I'll drive! Take Josie and her school friends to the cinema, I'll drive! Can't do anything without a car in Florida. Where there is a side walk, sure as night follows day, it will disappear, only to reappear a mile later. In the mean time one has to walk down the road avoiding the 90% of drivers that swerve all over the road because they are on their cellphone which is worse than the alligators... Seriously though, driving makes you feel less cooped up and more independent. If I didn't, I'd be relying on C to go anywhere and everywhere. It gives me the freedom to go do stuff myself.

Lastly, eating like a local. I pine for real bread, tayto crisps, a bloody battered sausage supper! But I deal with the sweet bread, crappy chocolate. hopeless excuse for bacon etc, learned to accept it for what it is, can't beat it, it is the way it is and it is, for better or worse, my home now. Looking at the flip side, some UK stuff might be better, but I come to realise some stuff here is great too, and what a price! Holy crapola, food bills cost less! Especially eating out.

And very last thing I promise. Retail therapy. Go buy some clothes. It makes me feel good and the added bonus of the prices as for food. :-)

Although I didn't need it, I guess the rules are, whatever they say goes, even if the form says otherwise ;-) I lost my place as number 4 off the plane because she made me fill one in. I ended up near the back and a 10 minute wait at a line. I would advise to hedge your bets and fill one out just in case, even though you don't need it.
