I just got back from an appointment with my local office.  When I mentioned the word transfer, the rep had a look on his face that said "not again".  He said whenever they start transferring cases around, things get very confusing and it makes them look very bad (he couldn't have said it any better).  He also said that usually it takes congressmen and senators filing inquiries and complaints for them to get their act together.  So thanks to everyone who has followed up with their congressional representatives, if you haven't please do so.  

 

As for actual news on my case, he said that my background check had been completed on June 3rd and my case was transferred to the I-129f unit (whatever that is) on June 6th.  He didn't have any information on an expected timeline.  Based on the information Angelina relayed, I'm guessing my case is sitting in a box waiting to be assigned to an adjudicator.  I asked him if there was a way to file a complaint and he said Ombudsman is the method for doing so.  Ombudsman is not a way for you to get more information on the status of your case, but it is an oversight and accountability method that we should all use to voice our complaints.  It won't do us any good, but maybe it will help for future I-129f filers.

I submitted a complaint/request through Ombudsman last night.  I also schedule an appointment with my local field office for tomorrow morning.  I'm not hoping to get specific answers about my case, I think we all know the current status of the cases (they're sitting collecting dust), but I want to use it as a method to explain what we've all gone through and see if I can get the attention of someone higher up the food chain.  I'll let you all know how that goes.

Wait....did your congressman talk to the ISCIS liason at the center that is appointed to the political types or did your congressman offive just make an inquiry to the general folk...say like eqial to a tier 1 person.....

He spoke with the USCIS liaison at the TSC.  This was an official congressional inquiry.

I just received a call my congressman's office.  He initiated an inquiry at TSC last week and they replied today.  Basically nothing new.  They said that VSC transferred approx 7000 petitions (I asked if they were all I-129fs and he did not know the answer) because VSC was getting slammed with petitions and they needed to offload some of their workload.  My petition has been received and scanned but not yet assigned an adjudicator.  I asked if any petitions have been assigned an adjudicator or had even been started and he also didn't know the answer to that.  TSC said they are trying to process them as quickly as possible but could not provide a timeline and to call back in a month if I haven't heard anything.  He's going to email me the full response, but the response wasn't very encouraging.

Oh and my fiance (Alzaire on VJ) sent a strongly worded letter to the CIS Ombudsman last night to the new correct e-mail address, and our congressional liaison said she had contacted the congressional liaison department at TSC and she will get back to us as soon as she hears anything.

 

Haha, keep in mind he wrote that back in 2003 when apparently approvals sometimes only took a few weeks.  Since then, they eliminated two service centers from processing I-129Fs and now we have to wait a minimum of 5 months.  They should train the local field offices on family visas and have them processed there.  That would make this process so much quicker.

Some of you posted over the weekend about USCIS working weekends.  I saw this link posted on VJ last week and thought I'd share it.  Apparently a former Nebraska Service Center employee (back when NSC processed I-129Fs) went through the fiance visa process and hosted a Q&A right here on VJ.  He said that basically, USCIS employees work 40 hour weeks but there is some flexibility.  Some employees are given the option to work from home and log whatever hours they want so long as they add up to 40 at the end of the week.  This might explain why some people have seen weekend approvals.  So as a general rule of thumb, the USCIS offices are closed on the weekend, but some employees might work cases from home if they need to put in some hours over the weekend.

I just returned from my Congressman's office where I opened a inquiry.  Spoke with a very helpful staffer who said he would contact USCIS today.  I already wrote one of my Senators (a very senior and high ranking senator) but would doubt I'll hear back from him in a timely manner.  I'll write my other Senator tonight.

I read on the topic about Alien registration numbers that if you really get A# assigned than it is really a good thing. There is also explenation by one member there that we all got the same notice after noa1 that our alien registraion number has changed ..... but that was not true, becouse he contacted someone in USCIS and they told him that is like a mistake notice for all dec and jan filers i think. You may wanna serch that topic, it has been posted in january i just can't rememver the exact name od the topic.

 

Interesting.  If anyone finds the older post, I'd be interested in reading it.  I called the main USCIS customer service number after I received the notice in January that USCIS had updated my Alien Registration #.  The rep told me that they simply assigned my fiance an alien registration number and there were no more updates.  I'm not sure who said it was a mistake notice, but my experience was this was a legitimate notice and something fairly routine.

You need to change the service center in your timeline for Igors list.  You need to change the service center in your profile for what appears when you post.  Kinda dumb.  I encountered the same thing.

I don't mean to damped everyone spirits, but the Alien Registration number is one of the first things that happens after the NOA1.  My NOA1 was Dec 20th, and I received an email in early January (can't remember the date but i think it was Jan 2nd) indicating USCIS had assigned an alien registration number to my case.  I can't speak for everyone here, but I've had an alien registration number assigned for many months, I just didn't know what that number was until I received the transfer letter on Saturday.

I live in New York so Chuck Schumer is one of my Senators (main author of the US Immigration Reform Bill for those who don't know).  I wrote him yesterday regarding the mess of our cases being transferred around but also urged him to consider adding family visas (fiance and spouse specifically) to the immigration bill.  I also provided him the VJ website so that he can read some of our experiences and get a better idea of what a horribly inefficient process this is.  It won't have any affect on us, but hopefully one of his staffers takes a look at this site and convinces Schumer to address this process and help future applicants of fiance and spouse visas.  The best we can hope for is that he puts some pressure on the Texas Service Center to complete processing of our I-129Fs in a timely manner.

In case there is still any confusion about where our cases were sent, I have this to offer.  Several weeks ago I submitted a request for expedited processing.  Today I received a letter of denial of that request from the Acting Center Director of the VSC.  At the end of the letter, the following information was printed:

 

"Your petition or application was transferred to Texas Service Center on May 23, 2013."

 

So I think its safe to say that our cases were indeed transferred to the TSC.

Now I am totally confused... Just spoke to a person at the uscis... She says that indeed our files ARE sent to our local office and nor St. Albans. She has seen this before with I 129 f and 130
she suggest calling you local office ....

 

Does USCIS publish local office numbers?  I've never been able to find any number besides the main 1-800 customer service number.  Do you know where to find the local office numbers?

I just called and heard the same message.  It's confusing whether they are referring to the VSC (located in St. Albans, VT) or the St. Albans field office.  If you look at the field office info for St. Albans on the USCIS website http://www.uscis.gov...000082ca60aRCRD, it says this field office is only open on Wednesdays and is closed all other days.  So did they transfer what seems like hundreds of cases to a small field office that is only open 1 day a week?  This all seems very odd.

Personally, I don't think the customer service reps we speak to when we call USCIS have the latest information available.  They probably don't have access to much more than we do by checking our case status online.  Seems to me like they transferred our cases around, but the dust hasn't settled and only the people who have the paperwork in front of them actually know where our cases were transferred to.  Everyone seems to be getting different answers so my thinking is to wait until I receive an official letter in the mail.  I've waited 5+ months already, is another few days going to kill me?

For those of you still waiting, if you have not received that notice that your case has been sent to the NVC, I highly doubt it has left USCIS.  I'm not going to tell you to stop calling everyday, but the trend so far is a notice, then approximately a week later a case number.

For those of you who have been in contact with your congressmen, I would strongly encourage you to attempt to meet with them and explain all that we are going through.  I say this because soon the House will draft their own version of immigration reform legislation.  The Senate version does not change the way fiance and spouse visas are handled so I am going to strongly urge my congressman to address this miserable process.  Specifically, point out the disorganization (the mess of nobody knowing where our cases were when they transferred) and the delays from VSC to TSC and then from TSC to NVC.  Also, why do our cases have to go through the NVC at all?  Why not just go straight from the service center to the embassy?  There must be a way to computerize the whole thing and eliminate the extra weeks-months of NVC processing.  Midterm election season is coming up so if you make your voices heard, congressmen/women will listen.

I've been in contact (complaints and non-complaints) with my congressman's office for a month or two now.  After 3 weeks of waiting from NOA2 to nothing from NVC, I emailed the office again and heard back today.  Seeing as few others have seen notices from USCIS without congressional intervention, I would strongly encourage everyone to contact their senators and/or congressmen/women to inquire about the status of your cases.

Yeah, TSC may not know the procedure CSC and VSC does this, as they are new to the game. Perhaps pressure on the Ombudsman might be in order here too.

The TSC does process other petitions and I'm sure they have dealt with sending them to the NVC.  I have a hard time believing they are completely unfamiliar with this process.

Angelina, are you referring to the same email/text notification service that we signed up for to track the I-129f?  Or is this a separate tracker with NVC?

Download the Fiance(e) Letter of Intent (2nd file) at http://www.visajourn...ontent/examples.  You need to sign it and mail it to your USC fiance to mail back to the TSC.  They need your actual signature so a scanned copy will not be enough.  You don't need anything extra unless there are extra circumstances regarding your situation, (for example if you are getting a divorce and need to show divorce papers).  Just the letter so long as your single and have nothing preventing you from getting married.
