Hello VJ´s!!

I'm wondering if the status of ya´ll on the USCIS page has been updated or is stopped just like my status.
Since we started our process and received our NOA1 never had the status changed.
Is this normal, or do you advise me to call USCIS and ask what happens?

In the same situation here. We applied in August 1st, the I130 and after receive the NOA1, we apply for I129F. USCIS does not know where it came from these comments that the visa K-3 is administratively closed. For you to be aware of what happens with your case I advise you call the USCIS and ask how is your process. I did this last week and they told me that CSC is delayed by 48 days. And if the K-3 would be closed, it was being advised on the website of USCIS.

Time to be aware of the facts and get the terminology correct. USCIS doesn't process visas. K3 is a visa. It's also a visa you can expect never to see. You filed an I-130 and an I-129F. Filing the I-129F caused your I-130 to be pulled out of line and put back a couple weeks to the I-129F's place in line. They'll both be approved and sent to the National Visa Center on the same day, where NVC will promptly KILL the I-129F. You will then proceed with the I-130 through to Consular processing of a CR1 or IR1 visa for your spouse. You ain't never gonna SEE any K3 visa.

Adjudicating those petitions will take as long as it takes. You filed them into a black hole, just like the rest of us did.



Do you believe that I should change my timeline for the CR-1 as the K-3 does not exist?

On 12 Jan my husband sent this enquiry to CSC:

My wife and I have waited the five month processing time, now we are told it will be another 46 days. Is there something that we can do in order to get our process back on schedule? Thank you for your attention on this matter.

and they said this:

We are currently processing I-130, Spouse of USC that were filed around the first week of July 2011. Your petition was filed August 1, 2011. The processing time for your petition would be about 4 more weeks.



Here we gooooo!!!!!!! Not too much time now guys :)

hey guys! i was wondering why CSC is stopped right now? I mean, i am looking everyday in the timeline on igor´s list, and just the K1 visa is being approved @ this time. The last K3 aproved was on dec 7th 2011. I have 155 days waiting since we apply for the K3 and my husband just call USCIS yesterday and they said the CSC is back up. They said it will be another 48 days on top of the five month wait that we have already endured.
Any help, or idea?
And, why the K1 visa is faster than K3?

well i just came from Embassy I had an interview it was really smooth....The thing is Cosular didnt Even ask me for any proof. Nothing else he just want couple documents were in Checklist thats it i didnt need to prove anything he didnt even ask For Fiance Letter of intent .he asked me couple questions about her and me well then he was like we have to talk to ur fiance...Thats it Then he said this is envolpe u get at ur home,,, and u will find ur indian passort with visa pasted and u will get an another envolpe says DO NOT OPEN that one....and u will get ur passport in 2 weeks by mail.......So whats everyone thinks? Have i got Visa yet or what? Even he forgot my sign for DS156K I have to went back in and ask him sir am i supposed to sign a paper? He was like ohhhhhhhh yess i almost forgot thanks for remind me and ur good to goo

[b] ANd i called them Today They said my status is Administrative Processes She said they will get approve by tommarow and then they will print the visa sticker and send me the passport next week....AM scared Administrative Processes is For Fingure prints check? Can anyone help please??[b]

Oh my god Dannnrr it meghan They have such a stupid staff i am telling u ....Omg I so stressed my fiancee called DOS today they said who told u that visa is issued allready? Dang i talked to 4 diffrent people thats what they told me that my visa has been issued and my fiance called today she asked her when i am geting my passport she said decision is not made yet? what the hell? are those people are nuts? its 16 days allready and she said visa was spoiled or what they have to re issue it ? OMG If they gona make us relly wait like that we both gona go to Embassy and yell at them...

Sadly the embassies are in the habit of telling people their AP will only last a certain amount of time. AP can last anywhere from one day to several years. I suggest you hop down to the Waivers forum and join the AP thread there. You are not alone and will receive a lot of support and information from others who are/have been on AP.


why will they put u on AP ? When u have all the Documents and they tell u u gona Recieve ur Passport in 2 weeks? what the hell is that tho?why would they put u on Freakin AP? It been 4 years we are waiting to be together and now they are putin in AP? Dang WE gona go to Embassy Straight IF anything happens We aint gona stay Calm ...And this is so stupid when u have all the papers everything how can they just do this...

Hi! Well if u r still on NVC, I suggest u to call them. 603-334-0700. I don´t know what part of process u r right now, I was on IRCR-1 and we sent the DS-230 part I and II together. But when I got the packet 4, there was again part II, and I had to sign it in front of them at the interview.
Well feel free to ask me any question, I will try to answer your doubts. Don´t worry, u have no idea how "difficult" my case was and we got the visa, so I´m sure u will get it as well. The interview took us (my hubby was with me) less than 10 min. I had a very nice scrapbook, photobook, chat prints, etc, but the nice young girl didn´t ask for any proof. It was kinda of dissapointed cause I had loooots of things to show her.
She only asked us how we meet each other, Ahhh, it was nice we could go together to the window interview, some other consulates don´t allow wives of husbands to be at the interview, well, she also asked him how many times he came to visit me before our wedding, if he met my parents, when do we plan he to meet them (I´m from Bolivia), she told me my english was pretty good, she asked me how I learned english and If I have been in this country before. That is it! She was a very nice and smiley girl, yeah, she has a very nice smile! She was young, but she was not the only one. There are at least 2 CO.

well our case is allready in embassy i have got the packet 3 its k1 fiance visa..and all i got is DS-230I to send with packet for make an appointment...i talked to the lady on phone she said dont worry we will fix it when u will come here for your interview.and send the checklist asap..so i am call india see if they have got my Police clearance certificate. and Do you know how much time it takes..to get police clearance certificate from ministerio de justicia? i send em form like 2 weeks ago...havn't got anything in mail yet...well we have phone record photos,tickets,AND we have baby boy as well...he's 7 month old now....hopefully everything ill goo good...

Yes, you can process from any consulate. You will just need provide police certificate from any country you resided for more than 6 months. They may ask about your residence, so you should bring documentation just in case.

Ahhh, you would not want to interview from a country where your current status was "illegal". Yes, they have full access to your passport, and may wonder where your visa is. I imagine if, for example, a work visa was also revoked, they would have access to this data if they so desired.



No, i've been here working legally for 5 years with a indefinite contract and with work and residence card.. Just wonder if it is relevant for the embassy about the status or is it ok for me to process my interview here where i am presently working and not where i was born or living for 25 years.. Or they ask about my legal aspect here... Thanksssss

Hello there Jimmy, thank u so much for a very useful info. I would like to ask how did u sent the DS230 by mail? Correos? Or Courier here like dhl or usps.. Another question can i schedule my medical ahead of time before the interview date? Bcoz mostly i read about like the pick up time of medical exam result is about 12:30 and if will took u 20 minutes to walked thru embassy and the interview time is 1:00.. I prefer a date that i wont rushed up, pick up the result and the next day just go directly an hour before the interview.

Another question: what documents they require in Madrid Embassy Checklist.? I got here what are usually asked in other country, i dont know about MAD.

Thanks guys. Pretty much what I was thinking, but just in a bit of denial and was grasping at straws a bit. Right now we are gathering all of the information to send to the Chicago Lockbox, and from there I guess the best thing to do is to send in the I-129F and whichever one gets processed first is the route we go, correct? Is it even worth sending both in?

Another question I have is that as we are living in Spain, they will send all documents to the address we live at without a problem, correct?

Hi guys,

I have a couple of questions and basically am looking for advice on what route to take from people who have been in our shoes.

In March of this year my wife and I got married in Spain and we have been going through the process here to get my resident status, and months later we can see the light at the end of the tunnel. Before all of this started I researched the process for when we wanted to come to the states and I saw that as long as my wife entered legally that she could petition for an AOS and go through the resident process in the states. However, I was very foolish and assumed that entering legally as a tourist would not be a problem, and have only just recently found out that it would entail lying for the motive of traveling to the states and that she could face consequences. We had been planning our moves and big life decision pending my Spanish resident status and it's almost finished (literally in 43 days), and now it looks very dark and ominous after we discovered this new information... so below are the options we have been tossing around and I would like to know what people think and if they have any advice.

1. Tourist Visa --
What does everyone think about having my wife enter on a tourist visa and then to start the process from the states. Is this possible? If so, is it worth it?


2. Student Visa --
We both want to study and are in the process of applying to grad schools for the Fall of 2012. Is it possible to say screw the spousal visa and live together with her having her student visa? If so, what would be the reality of things if after school we decide to stay in the states? Would the act of being married before entering the states years prior, but then her living with a student visa for some years and then trying to get a spousal visa years later be a serious problem? I know this visa takes a long time as well, but then my wife could come over for three months on the tourist visa and then go home, and come back over once the student visa gets processed.


3. K-1 Visa --
Is it possible to apply for a K-1 visa and get married (again) in the states? I only ask because a Colombian friend of ours has told us that she knows people in the states that got married in Colombia and then to be able to go to the states and live/work they got married there as well.


4. K-3/CR-1 Visa --
I know that this route is the most sure and honest thing, but it also seems to be the longest. Also, we live in Spain and I saw on the Madrid Embassy website that they will no longer do DCF (Direct Consular Filing) after August 15th of this year (yes, I am kicking myself in case you were wondering!). The website says that we have to start the process with the Chicago Lockbox and go through the process. However, it is difficult to get in touch with the embassy and I have questions/worries about the I-864 form, for example, as I'm not going back being employed and I don't have my own residence (no house/apartment).

If you guys could let us know what you think and have any advice we would greatly appreciate it. The last 48 hours have been hectic to say the least and it seems like good help and information is hard to come by.
