No you dont have to secure two NBI Clearance because both your maiden and married name will appear (i.e. Diaz, Alicia Fernandez de Smith) that exactly how it appears Surname, Given Name, Middle Name and your Married Name w/c is de Smith means you are married to Smith.

What if i was married before and will be applying a NBI clearance with my single name?

QUOTE (silent @ Jul 7 2008, 04:19 PM) <{POST_SNAPBACK}>
I am wondering about a hypothetical situation, so here I go.

According to the rules for married couple, no where it is being said that they need to meet up in person within the last 2 years or basically there is no mention of meeting in person.

Now the question is what if the couple never meets in person but does a proxy marriage? Marriage is legal by every means, so will it be approved at least at the USCIS and also at NVC level for either K-3 or CR-1 visa?

We all know the consulate level is unpredictable at best and it will all depend upon the consular if he/she feels the said relationship is valid or not.

This isn’t anything serious, just I am curious about how things work with VISA and apparently I have a lot of time to kill tongue.gif

I have done some research and here's what i've found from USCIS.GOV

Pink slip is for the visa delivery, to many applicants that signifies approval. The CO will tell your husband if he is denied or not. Did the CO say something about document verification to your husband? During my interview, I was given pink and white slips also. The CO wrote down "document verification".

This is the first time I've heard of paying for 2 document verification fee for a single applicant.

You may call 011 63 2 3012000 loc 5184 or 5185 and inquire about the status of your husband's visa.

Goodluck!

hi chris-lei. i called the # u gave me and talked to grace.i told her that my husband was asked to pay for doc verification again even if that person was told that he already paid for it.at first, she was surprised it,but then told me that they might need to verify 2 docs...i dont know.im not satisfied with her answer.she told me also that his case is placed under ar,and that will take 2wks or more, plus it needs to be reviewd again.i told her...that's why we paid that fee prior to interview,to avoid delays.THEN SHE ASKED ME AGAIN ABOUT PAYING DELBROS TWICE.

Hi,from what i understand to the words that was highlighted above and from your original post
QUOTE
My hubby informed that person that it was already paid,he even showed the receipt, but he was told that there are 2 docs needed to be verified
it didnt say that he needs to pay another document verification fee.so i guess he's already been approved and all that they're waiting for is a result from the NSO.

relax and hopefully your husband will get his visa soon good.gif

Hi, I have just one question, even if I only have one wrong letter on my BC I still need to get my annotated BC? Can you share the process you've been through with your annotated BC, thanks... If I need that I think I should be doing it now.
Thanks for that very informative message.

Hi,regarding your question,i was told by my friend that she just submitted a notarized affidavit of discrepancy when they filed their k1 petition and she brought the same affidavit when she went to her interview and she got approved without having problem.

i have just corrected mine because of the thought that what happened to others might not happen to me since evey consul has different moods or point of view.also, since im done with my annulment and i'll change my passport likewise my IDs from married back to my single name, might as well correct everything.another thing is that,i've been using my name with Ma. in all my pertinent records,i dont want to have problems in the future that they might ask me why im using Ma. where there's nothing written on my BC likewise with the one letter error on it.

regarding RA9048,i just went to Manila local civil registry, they gave me a list of documents to gather like TOR,form 137,certified true copy both of my MC and BC,voter's registration.they had me signed an affidavit and had it notarized, since i'll be adding Ma. on my name,i had it published for 2 consecutive weeks in a local newspaper and after i got the certification of publication,i had it submitted together with all the requirements, paid at the cashier and was asked to make a follow up after 90 days.it was only after almost 4mos that i got my finality, included in the finality arethe certification that the petition for the correction/change of name has been granted, certified true copy of my BC with remarks(proper annotation) on it,and brought it to NSO east avenue Area B,after 2 weeks,i got my annotated copy of my BC.

hope this helps.you can pm me if you have question regarding this matter and i'll be glad to help smile.gif

good luck on your journey.God bless

QUOTE (jeffcloe @ Apr 20 2008, 10:57 PM) <{POST_SNAPBACK}>
Hi everyone, thanks for welcoming us here and thanks for all who gave and still sharing their sincere opinions on the first topic I posted, would like to inform that we thought the lawyer filed it in Vermont but actually petition was filed in California (which I think is much much slower than Vermont).

I am posting a new topic about Discrepancies in Documents. In my birth certificate, one letter is wrong with my surname, instead ...riga... (which is the correct spelling) I have ...rega... on my birth certificate. When I applied for my passport years ago I had it corrected (in my passport) since I supported it with a notarized affidavit of discrepancy.

Before sending my documents to my fiance in the USA, I asked the lawyer if I need to get a notarized affidavit of discrepancy, and he said there's no need to submit that but I was asked attached a copy of my passport.

I only want to know if there are anyone in here who has same issues like this and have done their applications, I want to know if it will become a big deal later on and slower the process of the application.

Thank you so much, God bless us all.

I also had the same problem, when we filed for K1,i have just attached a copy of a notarized affidavit of discrepancy since my application for RA9048 is not done yet at that time but i'm going to bring my annotated birth certificate when my interview comes.
I had the one letter error corrected on my surname, also,my bc has no Ma. and since i'm using Ma. in all my pertinent records i had it included. It took me a total of 4 mos to get the copy of my annotated BC.

Hi all! its nice to be back again, my case is still pending we filed last year and if you've read my previous thread
this is my second time for k1 ( different petitioner) so here is the situation,I only met my fiance once when i was in USA
when we met in restaurant,he asked for my contact information, after few weeks i flew back to my home country( i went home on time before 90 days) we communicate through online, then after few months we decided to be officially gf/bf(cause before i wasnt ready to commit to serious relationship)
,when he filed for k1 we just sent my boarding pass no photos only my boarding pass, is that enough evidence of meeting for the past 2 years?
He came to visit me in my country but the k1 has already been filed.
So my questions are:
Does USCIS will see it as red flag because we just sent my boarding pass only as proof of meeting in person for the past 2 years??no photos etc?
Does it really an issue for the USCIS that this is my second time for k1 beneficiary?
How come our case doesnt get approval yet?

Thank you in advance

Hope everything will be ok for you.I'll be with you in prayers.Good luck and God bless

Her marriage was called "Null and Void" because the man she married had hid the fact that he was already married, and was still active in that marriage. He also went back to that family 100% after that. So its not a true annlment. The papers basically state, that she will go on as though the marriage never took place since it was an illegal marriage to start with. In the event that a woman gets pregnant in the philippines, and doesnt marry. Is it assumed that she has full custody even if the fathers name is on the BC?

Her case is called "Declaration of Nullity of Marriage" and yes,it's not an annulment.i also had the same case,Bigamous Marriage.like her ex,i also found out that my ex has a previous marriage. You're right, she'll be declared single again.
In getting her child's passport, just bring the kid's BC and her annulment papers. If the custody is hers,no need to get any clearance from the DSWD.she'll be fine travelling with her kid.I also have kid,he's 12yrs old and he'll be going with me,the only difference is that my son already has a passport that will expire in 3yrs,we have just renewed his passport in 2006.

Should I leave it as though I had no previous names, or
Shoule I fill that out with the information from my original BC?
Im sure this is an easy question, but my eyes are going cross eyed from looking over this thing so much trying to avoid mistakes, that all logic seems to have escaped me, and my brain is turning to mush. hehe

Was March the recording date because that is when it was considered 'final'? Many places have a waiting period before the divorce/annullment is considered 'final'. If that's the case, i'd leave the March date. If you know for sure it was 'final' in January then i'd change it. Someone from the Philippines could probably help you more.

good luck

well on the marriage certificate it is typed on the side that the marriage is null and void it says jpursuant to the decision jan23rd in the decree of finality it says february 10 th and the recorded stamp is mar 7th????

You've got all the dates mixed up,the date on the finality should coincide with the date where the decision was granted.maybe you focused yourself by looking at the date when the finality was released.

If the decision was granted January 23rd,then that will be the one that you should follow. You can also find the same date at the beginning of the sentence in the Certificate of Finality that goes like this..."This is to certify that a DECISION was rendered on (date where the decision was granted) in the above-entitled case....."

hope this helps.

The problem is more with the Philippine government than with the US. She will have to deal with the DSWD before the child can get clearance to leave the country. I would personally advise that the child is there for the Interview, I'm not sure what happens if she isn't there, but they talked to all of my children. She probably has to go through a medical at St. Lukes before the Interview as well.

Make sure that the child is listed on the G-325a as part of the I-129f, if she is coming over to the US later. This can become a big issue later, (it appears you lied if she isn't listed).

I can't speak for issues with the DSWD because my children's father was not opposed to them going to the US.

Good Luck

WHO DOES NOT NEED TRAVEL CLEARANCE?

o A minor traveling to a foreign country with either parent or with his or her solo parent or legal guardian;

How long did it take to have her certificate fixed, our NSO office told us 3-4 months and it seems it should not take that long. When would we need the copy of the birth certiifcate in the process, if we get it redone now, will it delay us or is 3-4 months from now before we need the revise certificate in the imigration process? Also, her certificatee was issued 6 years late, should I assume we need to get the additional records you got, or will we be told we need to provide the additional information?

I did some corrections prior to RA9048 on my first and last name at Manila(place of birth) City Hall it took 4mos(filed in Feb 2008,released in June 2008) from filing, pubilishing(local newspaper),transient(Manila Civil Registry to NSO then NSO sent it back to Civil Registry ofc) and finally the release of Decision and Finality. It cost me almost 5thousand pesos but it all depends upon the error that'll be fixed.

Please read RA9048 and you'll find out everything you want to know.

Thanks,

If her BC states that her father's name is Danilo then you should write Danilo because that's where(BC) they will base her father's name.Just my opinion though.

Forget the stats and the odds.. There is no 100% guarantee for a happy marriage based on stats.

Another reason I'd like to see some stats is because there are SO many filipina women that have been married before and have difficulty getting out of the previous marriage(s), (as witnessed on here) based on that fact alone the success rate doesnt seem to be too high, im a little concerned that a lot of these women (mine included) just want a green card. From what I can see, she loves me very much, but i cant help but have a little doubt. I'm very sceptical when it comes to this, I have one failed marriage already (not a foreigner) I certainly dont want another one.

This is my first time to post because it's always my fiancee who's posting here but i just like to share some insights regarding this topic.

When a filipina decided to get married they didnt think that they will be separated from their husband and get an american for a greencard.it just happened that their previous marriage didnt work out and fall in love to a man not from their own country.the reason why there are lots of filipina who had difficulty in getting out of the previous marriage was because of the high price they need to pay let alone the long wait before they finally get the decision and finality.and im sure if they have the means to pay for it,they will do it just like what my fiancee did, more than a year before i met her,she already filed and paid in full(from her own pocket) for her declaration of nullity,it was just the waiting that really S***S.but im glad now it's over and just recently we got our K1 approval.i only came over there once but it was the best ever in my life.i have doubts and fears too like you,and it's just normal.i know somebody who've been enggaged for 11yrs,after just a year of being married, they separated.so knowing somebody for a long time is not really a guarantee that you already know the person that well.

Life is a risk and each one of us deserves to be happy,if you have doubts and afraid to give yourself a chance then stay out of it.but if you truly love your fiancee and would like things to work out for the both of you, then take your time, little by little you'll discover the answer to your questions and im sure that'll be the right time to decide if you'll go forward or backward.

good luck and i wish you all the best

QUOTE (James08 @ Aug 3 2008, 11:29 AM) <{POST_SNAPBACK}>
It sucks but the way to do it is annulment. I am assuming they were married in Filipines. It must be filed where she lives and will cost around $2000 and take anywhere from 6 months to 18months without major problems. Hire an attourney that practices Family law. They will have to establish psychological reasons the marriage was not valid as the easiest way so expect that psycholgist fees will be part of the lawyer fees. My fiancee and I are 13 months into both our engagement and her anullment. I do not even dare go for a visit waiting for the decision so we can finally file for visa. Do check and see if the marriage is recorded for sure. If it is not you just hit the lottery, because if it's not, it's not legal and you are not lying when you say she is single because under the law she is. In short you can't annul what isn't recorded. Best of Luck.

Well i have to disagree with the highlighted part,it's not always the case that if ever she has no record it would mean that she's free or single.there are some cases that the marriage wasnt recorded at nso but when u go and check it at their local registry office,it's there and it's recorded.also,US embassy has their own way of finding out.

She has been unable to find where he is, now this is holding up our application. She is looking into annullment, does anyone have any experience with this and if so, how much more difficult does this make our application. Will they hold her first marriage against us? Will it look like she is just trying to get into the US seeing that her first husband also was American?

Hi,your fiancee needs to file for an annulment before u two could get married or before you could file for any K petition.I remember somebody who posted here about how his fiancee got denied without telling them,it's very unlikely that USEM will deny the petition without reasons,he swore that his fiancee was never been married but it turned out that the embassy was able to find out that she has a previous marriage that was never been annuled.i just couldnt find the link but what im trying to say is that no matter how you tried keeping it to yourself, the truth will always come out.and no matter how you hide it,the embassy has its way to look, check and find it out.

If she wants help regarding her annulment, just send me a message so i could help her out.

The divorce would of been the way to go if you are dealing with a rationale person. But getting some guy to file a divorce that he is under no obligation to do is not that easy. Like for example this guy might of gotten remarried to someone else so getting a divorce from the 1st marriage is going to screw up his current marriage so there is no incentive for him to file it. We figured annulement was the way to go cause then we didnt have to deal with the guy. It was expensive but it actuality only took like 2 months from start to finish.

really?it only took him just 2months for his annulment to be done?that was really quick!

You might wonder how I could go with him. Well, I really appreciated the advanced technology. We couldn't be so close to each other without laptop and camera. Even though we were on the opposite side of the world, and we haven't seen each other for more than one year, we could see each other through the camera. I had so much fun going everywhere with him.

Sometimes, I was indeed worried about our case because it's been 4 months since we applied for K-1, but we haven't received NOA2 yet. However, Hodgie always asked me to be positive. Every time after I talked to him, I got more confidence, so that I could continue to wait for my visa patiently.

Please come, NOA2! August 16 is my birthday. NOA2 would be my best birthday gift if it could come.

I'll pray that you'll get your NOA2 soon.Advance HAPPY BIRTHDAY!!!

So i got my first NOA2 on June 5 but the NVC still hasnt received it. After 4 weeks i had USCIS investigate the case (they said give them 30 days). So just a few days ago i got another letter from the USCIS. Its a I-797 Notice of action...and its the identical to the first letter i got only this one has a notice date of July 24th... Can anyone explain? Is there something i missing here? Thanks!

Oh,in our case it's different,we already have a new case number from NVC but my fiance never got hold of our NOA2 hard copy yet,it's been 10days since we got approved thru email blink.gif I told him to call on monday to ask if they could re-send it,maybe it got lost in the mail.

Glad to have this visa journey site, my friend give me this link, she said this place can hlp me, im new here, but then i have big problem im facing right now about my process,
ill start with my approval, last May 28, 2008
thinking of like other normal process i was hoping june will be my interview
June, nothing from uscis, July got news from uscis housed our papers in NRC national record center, since ive been in usa once, i think they make sure i dont have any crime or record on their country,
August 07, 2008 got new approval letter from uscis dated August 1 2008,
now my question, this means that uscis are done with their review on our case????, never try to call nvc yet since we got new approval. and my worries they got us approved twice,
update on my case, Ausgust 01 2008 approved
August 03 2008 last touch

any couples had experince this b4?
giving us new approval means prolong the review? and wait again another 2 months?
is there any validity of the Noa2?
please help!!!

Your post is very confusing.when i checked your timeline,it was just recently(aug 1) that your petition got approved.now all you have to do is to wait at least 1-2wks and you can call the NVC for you to get your manila case number.and then from nvc they will send your case to the US embassy Manila.and after a few weeks, either you and your fiance can call USEM for your interview sched good.gif

K-1 Fiance(e) Visa Process & Procedureshi, is there anyone in here that filed a k1 visa, who used to be married and have a annulled marriage?

my marriage is anulled in my previous failed relationship, met my bf now and decided to file a fiancee visa? my concerns is does it affect the timeline of my processing of visa? does it takes longer?

As long as you already have the Decision and Finality of your annulment, you're fine.I've included a copy of each in our K1 package application,it took us 4mos to get approved(check my timeline) smile.gif

good luck on your journey!!! good.gif

Well,i just got home from SLEC,they just wanted the copy of the decision and finality of my case, the doctor didnt talk nor ask to see me again.i just waited for a while then my name was called to proceed inside the immunization room. But the lady that i met the other day who went thru her annulment told me she was interviewed by the doctor, she also mentioned that she's already done with her interview but had to re-do her medical since it already lapsed, she had her first medical last March.

anyways,i'm done with the medical and will now prepare for my upcoming interview smile.gif

I'm not clear on the when a psychiatric evaluation is requred. When is this required for people who had their previous marriage annuled? I guess the question is under what circumstances is it required?

It's not clear to me either, and i have no idea regarding that psychiatric evaluation since the court didnt require me that.when i asked the nurse about it,she said she didnt have any clue either and she was just following the rules.

It makes sense they'd want to see it if it can be an indication that someone may need psychiatric evaluation, but they should definitely say up front you need to have it.

That's my point, they should've told me that last tuesday and even when i was there earlier yesterday, even though i didnt bring it with me,i could've gone home and get it and brought it back at SLEC,going back and forth from there is just an hour away.anyways, they've already delayed our process for 2 mos because of that sputum tests, another day of a delay will not cause me any harm,it's just their incompetency that i'm pissed off.other than that,i'm good.i have just posted this for the benefits of those who had their annulment so they could bring it with them during their medical to avoid such delays.

i'm off now to SLEC to give what they want.hope no more delays and will come home done with everything and with the new interview sched.

ciao

I was asked of the psychiatric evaluation report after I told the GP I was annulled and that I was declared psychologically incapacitated. As I didn't have a copy with me when I had the medical, I still have to have my psychiatric evaluation report faxed to me. I thought that the report was needed only when it's the applicant that was found to have personality disorders. Are yousaying it is now a must regardless of who was declared psychologically incapacitated?

Yes,it's a must now.i was able to talk to another lady at SLEC who was furious because she was asked also to submit them the copy of her annulment papers she said she didnt have the copy and she lives in Laguna, but then,i still saw her yesterday and told me that she have just submitted her annulment paper and was given vaccines after that.as for my case, mine is not really an annulment,it was a declaration of nullity.my ex has an existing marriage so he committed bigamy.the court didnt require me to have a psychiatric evaluation.but still SLEC would want to see the decision and the finality so i've no choice but to give in to their request to get it all done.
