First i want to start of by saying thanks to everyone for helping me with all my questions. everyone is great and this is an awesome site.

i filed for the k1 visa on sept 25th. my fiancee is from colombia and she was talking to a friend of hers that received her k1 visa. she was asking all kinds of questions and the women told my fiancee that we might get denied because of 2 reason. one not knowing for very long and the other is meeting on the internet. we met online in april and i went and visited her in sept. my question is do you think they will deny this because of these 2 reasons and if they do what other options do i have. maybe get married in her country and file for a different visa? thanks in advance for all your help

Hello, I am new here. I have been searching the internet trying to chose the right company or law firm to help prepare a K1 VISA application for my fiance in the Philippines. The fees I have encountered range from $250 to $2,500. I live in the United States. I want someboby who really knows what they are doing and has experience dealing with the American Embassy in Manila. My fiance is rather shy in her spoken English (her written English is quite good) and she may need help to prepare for the interview, once we get to that stage of the process. Any comments or first hand experience?



you do not need a lawyer. this website walkes you through everything you need to do? and if you need specific help just ask and someone will help you. i was thinking about hiring a lawyer but i after finding this site i did it myself.

My baby has been here in the states now for a week and we are having a great time. She has met some of my family and they have warmly welcomed her. The weather in Seattle has been cool and sunny and the fresh air she is enjoying, no pollution like Manila. I just wanted to let you all know how we are doing and the patience is well worth it. It took almost 1 year for her to get here, the biggest thing in all of this process is patience, you must have.

Hello My VJ friends. We had a very eventful interview day today. We started this morning preparing documents to make sure we were prepared for the interview. We started at 7:30AM and were interviewed at 10:30AM. The interview was a breeze as the consular asked my Fiancee what she knew about me besides what was in the packet of information. More less was was discussed is why she loved me. This has been such a long process, but is so worth the wait and patience.

WE PASSED!!! I am so thankful for all the support. I am currently in an internet cafe near SM mall and I just wanted to let you all know. Delbros will deliver in the next few days and we are planning a trip with Fleur's famil from Subic Bay.

Thank you all so much and for all the answered questions. I learned so much from VJ. I can tell you follow the instructions that people tell you. Make no errors on the paperwork and if you have plenty of proof of relationship. Interview is a breeze.....

I haven't seen that happen. It all depends on service center and embassy. If things go smoothly and you're going through CSC, you're looking at an average of 3-4 months there, then another month or so at NVC, then another month for them to complete it and another month for it to get to the embassy and have an interview scheduled. So you're looking at a 6-7 month wait and that is all in a perfect world type of thing.

If you're going through VSC, things are going a lot slower for CR-1/IR-1s. I've seen people who filed back in August and haven't been touched since September/October of last year.


Depends on the country, also you can never compare cases. Each case is different and will require lots of patience.

same thing happened to me when calling NVC, operator saying have no record of it. then when called one day and it was there, case number assigned and on it's way to Manila. don't worry, it should be at NVC, just takes time to be entered into the system. keep calling, one day you'll receive the answer your waiting for. :thumbs:

My case was approved October 16, 2006 and my letter says my case was sent to New Hampshire. There is still no record of my case at either USCIS or NVC? I am really concerned. Where is my paperwork at? I am totally discouraged.

Something needs to be done about the way Visa's are processed in Manila. I am sure we will have to wait more than 120 days for an interview. Due to the massive amount of applicants, other countries you don't have to wait that long for a K-1. I would love for someone to explain to me why they don't increase staff over there to make it fair for applicants. I have an actual email from the Consular that says that we may have to wait 150 days from the date of reciept at the consular in Manila. I am looking at this non-immigrant visa to take 1 year just because my Finacee is in the Philippines. I will wait for whatever it takes, but why not add another 10-15 Officers to do interviews and move our loved ones a little quicker.

A lawyer is really a waste of money, you can do this process yourself. It's really very simple. You either have a true relationship or you don't. Knowing someone for 2 months will not cut it, USCIS won't like it.

It is an emotionally difficult issue to deal with - however, from the perspective of the government they have two people contesting something (and in the case of divorce, often bitterly) - they are bound by procedure and fairness to hear his side of the story.

He cannot be punished by deportation for the crimes he has committed. Presumably when he was found guilty of those charges, a judge enacted a penalty upon him (regardless of what that was). Given that he is currently a legal permanent resident, that residency cannot be summarily revoked and deportation ordered as additional punishment.

The conditional permanent residency is granted for a period of two years (and depending on the process, may be extended until a final determination is made on the removal of conditional status) - again, it cannot be summarily revoked - just as a person cannot be tried for the same offense twice, nor can they be punished for the same offense twice.

I'm not saying this to batter you down - I appreciate the emotional trauma of your position - I am merely trying to show you why the government is acting as they are.

You may get "lucky". At my AOS interview with my wife, we saw a family go into the offices from the waiting area. About 30 mins later, some law enforcement arrived and went back, and about 15 mins later, the father (presumably) left with them, handcuffed (the case officer of our case was surprised by this handling - "they usually go out the back door for discretion"). Was he being deported? I don't know. Depending on certain circumstances, the case officer, what his status is at his interview, and so on, he may be subject to removal then, but as someone else said, it may not be the case.

Of course, if he is subject to removal, and DOES try to play games with you - demanding money, intimidating, following, whatever - call the police, and inform them, and when you do, inform them of his immigration status (however, do not try to do this proactively - local law enforcement typically does not involve itself immigration enforcement for no other reason than "he's illegal").

I'm about to file my I-751 on my K-1 visa... about 2 months after expiry (yikes, I know, I know).

Is there any supplemental advice that can be given on the best way to do this?

I am writing a letter to accompany the application, explaining why the application was late (my wife's sister attempted suicide, she raced to the other side of the country to be with her, but with that and a few other things, it set in chain a series of events that lead to her having to drop school for the year with a medical leave of absence, and in the turmoil, this envelope never got sent), but any other suggestions would be appreciated... and well wishes, too!

Some countries have a tourist visa exemption agreement. Thailand has 'no-visa required' agreements with about 40 different counties and I don't need a visa to travel there, just a return (round trip) ticket and funds to live on for my stay there. The latter 2 aren't generally checked on at immigration but they can turn you back.


True, to a degree. But you are not travelling on Visa Waiver, you have a specific visa. You should not be dinged for insufficient ties to a country, when the ultimate intention, be K1 technically a "non immigrant visa" is immigration (hence the 'adjustment of status' upon marriage).

I travelled one way after asking this question of the Sydney consulate.

I got no grief from anyone but the travel agent (who said I should be prepared to show visa etc, fine).

Qantas Melbourne didn't even bat an eyelid, they checked my passport (but not my visa), and one way ticket. Essentially, "not their problem".

No issues with departure card, though I did say "leaving temporarily" (until I was sure everything worked out fine).

No issues on arrival. But at least LAX, you /will/ be sent to the visitor line at Immigration - you are not a new immigrant yet.

If the airline or such tries to tell you need a roundtrip ticket (which might not be a bad idea, depending on circumstance), either a) get it fullfare so you can at least adjust the flight if you want to use it effectively as credit, or two, show/tell them you have a visa that is valid for one way travel. They "cannot" refuse to sell you the ticket (beyond their 'right of refusal' anyway), as your NIV status, etc, is a matter between you and the US Government. If the USG takes issue with the one way ticket and excludes you (not that you want this to happen, it'll be a whole world of hurt if you try to get in again, even as a tourist), it's done at their expense, not the airline.

Did he own the business last year? Was he working last year? If either of these can be answered with a "yes" then you need a tax return - even if his tax return from last year (if he has one) doesn't show his current financial situation, you still need it.


Statement from his accountant would go a long way here, in the absence of tax returns.

One of those things isn't really like the other. "You can do it! Unless you get caught!"

Perhaps not the wisest thing to advocate. From then on, you realize that he has to say "Yes" to that question on pretty much any country in the world's visa process, that horribly awkward "Have you ever been refused or denied entry to a country?", which is going to make immigration queues at airports far more fun.

In my experience, pay stubs that have year to date earnings are excellent supporting evidence. Employer letters are optional.

my second question is the first thing they say i do is fill out the ds156k for nonimigrant. so i fill out this for me, is this correct?

third question is they say i pay 131 to Banco de Crédito. is this also correct?

and my fourth question in this thread ( http://www.visajourn...?showtopic=2572 ) said we need to send these forms in OF-169, DS-2001 and DS-230 part 1. what is OF-169?

Fifth question is DAS CERTIFICATE – Entries and exits to and from Colombia for the past 10 years. This document may be obtained in Bogotá at the DAS Office located at Calle 100 #11B-27, Edificio Platinium. if she has never left does she still need these documents?

If your income is sufficient to meet the requirements, you don't need to include any information on bank accounts or any other assets.

i was looking at this form I-134 just getting things prepared as i wait for the noa2.

so first question is #10 submitted a visa petition on behalf of the following person, which would be my fiancee correct? and is this question not answered when they asked me in question 3 This affidavit is executed on behalf of the following person?

2nd question i believe it is question 7 it asks if i own real estate valued at and my question about this is do i have to put this down if i do not live there and i rent it out? i own half of this with my ex because we could not sell it? and if i do the next line says With mortgage(s) or other encumbrance(s) thereon amounting to: do i but total i owe to pay off bank or is it monthly payments?

and last question is about Oath or Affirmation of Sponsor i do not understand who i get to witness me signing this, any notary republic will work?

yes is there policy. so i will be fine just providing them pay stubs and tax transactions? sorry if i am redundant but i just want to make sure i have everything that i am able to give them so they do not deny.

You do not need the w-2's for the years your IRS tax transcripts cover.

You will need your 1040's/W-2 for 2009 if your sending them in.

Recent paystubs are good.

Depending on the embassy - they may want that letter showing your currently employed - what are their requirements?


the embassy is in bogota colombia and i do not see anything about there requirements except this I-134 Affidavit of support. (Instruction says: You must sign Form I-134 in your full name. For this reason, it is not necessary to sign Form I-134 before a notary, nor to have your signature notarized after you sign.) as far as the letter showing employment i can not get from my employer. the only thing that i can show that says i am still employed is a current pay stub.

hi all i have a I-90 question i was wondering how i prove that they uscis made a mistake on my birth date because on the i-485 we made the mistake but during the interview he asked us if there was a mistake and we said yes and he would correct they birthday but did not. so i do i have to pay the application fee or just send it in without.

other question is when i file application i choose option for uscis mistake on green card but it doesnt ask what the mistake is so how to they know?

also is the birthday that big of a deal because we want to go to colombia soon but i heard for them to fix it is taking at least six months
