If you want to feel better, write a letter saying that you both intend to live at your grandmother's address, and give it to your fiancee for her interview (in case the consular officer asks her about it). No hurry to do it now, her interview should be months away, and your plans may still change. :)

Just switching quickly to another point raised by Ron-Tanya: Your NOA1 date is June 5th, so it's been roughly 3 months and a half. Vermont is really slow right now, and approvals take longer than the 5-month goal. Be ready for a longer wait than 1 month more until your petition approval (if approved). Based on recent VJ members petition approvals, your timeline indicates that your approval is estimated to be sometimes in December.
Add a few more months after that for the actual visa approval (again, if requirements are met).

About your question, the CPB officer may ask her questions why she stops in NY and not Atlanta. But having a proof that she has another flight for Atlanta a few days later should help.

First, you didn't send it to the Texas Service Center, but to the Texas lockbox. Check your NOA1 to know if your case is in California SC or Vermont SC (the only 2 service centers that adjudicate I-129F petitions). If you sent your petition package in May, this is completely normal that you received nothing yet. It takes about 5 months for the petition to be reviewed (more if your case is at Vermont SC, as they are really slow right now).

Second, it is not good to make plans in advance when you start the K-1 process, simply because you don't know when your fiancee will have the visa in hand.

If your fiancee comes to the US with the VWP to marry you and then comes back to her country, there is nothing wrong that. Except that she won't qualify for a fiance visa anymore and will be deny at her K-1 interview. Fiance visas are for people that are not married and intend to do it in the US with it.

2 options here:

- you really want to get married on December 1st, and you don't have the K-1 visa at that date: forget the fiance visa and you will have to start all over again with a spousal visa.

- do not count too much on Dec 1st, do not make definite plans about it, and continue with the K-1 visa. That is your best option right now. Again, it is usually advice not to make wedding plans before having the visa in hand. If you want to have a nice wedding with all your families and friends, best is to get civilly married in the 90 days after entering the US with the K-1 visa, and then organize another wedding with families/friends later, at the date you want.

It may be possible she will have her visa before Dec 1st, but schedule is tight... and will be stressful.

The place where you've submitted your file is just a sorting facility in Texas. That is not the Texas Service Center. As Phil & Alla said, you should have received a first notice of action by mail. Look at the bottom of it, and you should know if your case is being processed at Vermont Service Center or California Service Center (the only two centers that process I-129F petitions).

Timelines estimates are based on data inputed by VJ members, so it is as accurate as people enters well or not their infos. Keep in mind these are just estimates, so don't pay too much attention to it (especially the first few months after you submitted your package). Your petition may be faster or longer to be adjudicated than the estimation dates.

You only need to send the DS-230 Part I + DS-2001 back to the embassy, ONLY when you have the other documents in the list ready with you for your interview (DS-2001 is a notification of applicant readiness). The instructions letter is pretty clear on that.
Others documents have to be brought with you at the interview.

Hi Everyone,

I am new to the site. My American girlfriend and I got engaged last week and we are now looking at getting a K1 visa. We are both in the US at present but we will be travelling together to my home country of Australia in 2 months. We will be staying there for 6 months before returning for a wedding here in the US in spring.

What I would like to know is I know my fiancee needs to apply for the K1 visa from here in the US but how long will she need to stay here before she can come with me to Australia? Will she be able to leave right away after filing for the K1 or does she need to stay a certain amount of months etc for processing?? We plan to leave in early September and it would be horrible if I had to leave without her.

Don't worry she can leave with you as soon as you guys have filed, since the rest of the process will take place in Australie.
Once you have sent the K1 file in the US, the immigration will either approve/decline your petition. If approved, and there is no reason why you shouldn't be approved (i hope not!) USCIS will send your file to the American embassy in australia where everything will be sent to you.
it is only if imigration needs additionnal evidences, called RFEs that they might ask for others documents and the request will be sent to her, but I guess she can ask someone to watch out in the mail for her ?

In any cases, dont worry too much about it: you can go to Australia together after filing for K1.

Thanks somuch for the previous informations about me and my fiance k1 Filling since feb.29,she actually calls USCIS almost everyday but no much improvements yet,I'm so down and worried now because since my fiance came to Nigeria nd went back sha has taken in for me and the pregnancy was about 12weeks which is 3month unfortunately she lost the baby@night on the 6th of this month,which the doctor told her it was due to stress and worries,I call her every morning,any moment I'm free@work and before I goto bed so as tomake her not to worry because I know she's very emmossional and she does the same too,we are still going through d pains and hurts,after getting out of the hospital yesterday she called USCIS and explained to them she was told to send them a copy of her W-2 TAX PAPERS FOR 2011 and the letter from her doctor as an evidence of d miscariage,though she told me she will include the scan result of the before and after the miscariage.We are in a sobber mood now coz we all knw wat it takes to lose a baby,she cries anytime we talk on phone but I've told her God will surely give us another one soon.please guys advice me on this are we still on the right path?what else can we do to hasten the process because we love echother somuch we need to be together soon.Thanks somuch guys


You shouldn' worry about the K1 process if you submit all the papers everything will be ok. It takes time but not so much if you stop obsessing about it.
Everyone going through the process hurts to be away from their love but that's the way it is, unfortunately. Obsessing over it won't make it go faster..(and I know something about obsessing :whistle: )

I am sorry you have to go through this when a baby was involved. I don't know what to tell you to make you feel better, but that in my opinion things happen for a reason.

You seem to believe in God, so maybe if I tell you that sometimes a soul doesnt want to be born thats how miscarriages happen...this soul is probably at peace now and your fiancé and you will have other occasions to be parents.

Never doubt on that, stay positive and tell her maybe she should see a shrink to get help. Losing a child is not an easy process and it is important to have psychological support.

NOA1 stands for First Notice of action, it is the I-797C form your fiance received (please ask him to check!). Update your timeline on VJ with this date, your country and Service center (written at the bottom left of NOA1) so you will have an estimate interval date of when you can expect your Second Notice of action (=I-797 form) based on other VJ members data. It usually takes 4-5 months so yes, this is a long wait before the next step. :)

Yep, if this is the I-797C, that's NOA1. :) So you should receive the NOA2 (I-797) anytime soon hopefully (very important because you will need a copy of it for the AOS).

Looks like your file between NVC and Bangkok, so in the VJ timeline, between "NVC left" and "Consulate received".

The letter you received is the one from NVC. Looks like they were faster to send a letter about your case than the USCIS. You should have received the USCIS NOA2 letter before. :)

It asks for the A number she got (if she got one) during her previous visits. If she never got one before your fiance application, don't put anything.

For example, I visited the US several times in the past, but as a tourist (VWP) or with a J-1 visa (non-immigrant visa), so I've never got attributed a A (alien) number, and wrote "none" for each visit.

5 months is a goal, it can for sure be faster, as it can be slower. Keep in mind that the Vermont SC as the California SC receive A LOT of petitions everyday. Your petition is waiting on a box during months until an adjudicator look at it. They will look at it one day? and there's nothing other to do than waiting right now.

The good news is that it's been 3-4 months that you're waiting. Be strong and review everything you and your fiance will need to do after it's approved, and how it works in the Manilla consulate. :)

Good! To reply to your original question, it really depends on how is the process at your embassy. Some requires it to schedule the medical/appointment, some don't. In my case, I only needed it because it was asked on one form (DS-2001 on packet 3). Let's say it's good to have it, plus they will ask you for it if you call the DOS someday.

Except you originally didn't send it to a service center, but a lockbox. The Texas lockbox where you sent your petition (like everybody) and the Texas SC are 2 different places. A lot of members on VJ put TSC as their service center (K-1) just because they confused the TSC and the Texas lockbox, so data are screwed. Your file has never went to the TSC, but is processed in California.
