There is a Texas Service Center, yes, but that place DOESN'T process I-129F petitions. Members on VJ put incorrectly TSC as their service Center because they think their case is there since they sent their petition to the Texas lockbox (as everybody here). The Texas lockbox is a sorting facility that then forward petitions to either California or Vermont. To be short, Texas lockbox is a different place than Texas Service Center.

Igor's list depends on what VJ members put in their timeline. Stats that you see on Igor's list for TSC are wrong, and are a mix-up between data of people that are in fact either in California or Vermont.

Yes, there's a misunderstood here. You first said you got a NOA2, but then said you had not heard back from the USCIS unless that they received your RFE response. So, has your fiancé really received an approval letter for the petition (NOA2)? Did they ask for a date of your divorce in the RFE or do you mean they asked for it in the I-129F form?

I'm just asking because I'm curious, that doesn't change the fact you need to withdraw this petition (unless you receive a denial letter very soon).

Technically you didn't lose any time, as the soonest you guys will be able to re-send the I-129F package is when you both are free to marry. Just prepare a new package carefully, and send it as soon as you meet the requirements.

Best is to withdraw and refile. (Check also if your state has a "waiting" period after divorce. Even if it's like 6 months, you won't be done with the K-1 by that time yet, but it's still good to be sure).

The NVC step (after NOA2, your case is sent to NVC before going to your embassy) takes roughly a week and a month. After that, your question is country-specific and should be answered by members who dealt with the same embassy as you will. Looks like it takes at least 3 months after NOA2 to get an interview date.

I advise you to create a timeline so you will contribute to the website by adding your data and so will help members that will come after you and will wonder the same thing. :)

It's not a red flag if she comes to the US to get married AND then return back to Canada (and then start the process to get a spousal visa). The bad thing is to enter the US with a non-immigrant visa and have the intent to immigrate.

Difficult to know if you will have your visa by April. We started our K-1 process last year at about the same date (end of August), and I got my visa in hand by mid-April. My case was at CSC too, although it doesn't mean anything, as the processing times for CSC and VSC tends to move a lot over a year.

It also depends on your home country, some countries are faster/slower than others to issue an interview date/send the visa.

When you start the K-1 visa process, best is to NOT make plans for a wedding date. Usually, and what is advised, is to get married civilly after getting the visa (in the 90 days after entry in the US), and then make plans for a wedding with family and friends at a later date (the one you want).

If you decide to stop the K-1 route, be aware that you won't be refunded of the $340...

You will have to pay visa fees though, and I don't know how your consulate wants you to pay them. But certainly not AOS fees if you're doing the K-1 process. :)

To be more clear, AOS= Adjustment Of Status.

K-1: Once the K-1 visa is issued in her passport, your fiancée will enter the US and you will get married in the 90 days after her entry. That's after your marriage that she will have to adjust her status by filing for AOS (and then get permanent residency=green card).

Spousal visas are different, and require to AOS first in order for the spousal visa to be issued. Therefore, spouses with a spousal visa become permanent residents as soon as they enter the US with their visa.

Yes, no need for it after AOS approval and green card in hand. It's an arrival/departure document that proves you entered the US legally with a visa. With another kind of visa than the K-1, like for example a J-1, you are required to give it to the airline company when you leave the US. It shows that you left the country.

With the K-1, the intent is to immigrate to the country so once your permanent residency is approved (green card), there's no need for the I-94 anymore.

To do short, the I-94 is used for visa procedures. With the green card, there's no need anymore to use a US visa as you are now a resident of the country. No need to show at the airport that you left the country once using the K-1, as you are now free to travel in and out of the US with your green card.

The dates keep pushing away because that's based on the recent approvals, meaning it took 186 days in average from people with cases in Vermont to be approved recently. By the time you will have reached 5 months wait, I have a feeling this average time would have decreased (Vermont will catch up slowly months after months).

The estimated average time from NOA1 to NOA2 is often very different at the time you filed, and at the time you get approved, purposely because there is about 5 months between those 2 steps. As you filed recently and Vermont is slow right now, don't consider you have bad luck. It means nothing and maybe in 5 months, Vermont will be fast and CSC will be slow again (that's what happen every year).

You can look at the VJ estimated interval approval over time, but don't rely too much on it for now. :)

Maybe you've seen approval from those country members because they are more of them on VJ than others? Or more of them that filed in their timeline? There can be lots of explanations, and the data you see on VJ are very little compared to the actual amount of people sending petitions.

I know it's hard to see others who filed after you and being approved before you. Just imagine that cases are assigned to adjudicators, and some cases/adjudicators are faster/slower to approved...

Stay strong, try not to focus on others, you're being angry for nothing because you can't control much of the process. Stay busy by getting you informed of the process after the NOA2 approval. It can help you save some time later. :)

What other people said... But to be more clear:

- You can still receive a RFE. They are not looking at your case for months, it just that your case is sitting somewhere for months. So, as soon as they look at it, they will either approve it, deny it, or ask for a RFE. If you still didn't hear anything, it's because no adjudicator have looked at your case yet.

- The financial requirements of the K-1 are verified at the interview stage. Once your petition is approved, the case will be transferred to NVC then the embassy. It usually takes about 1 month after NOA2 until it reaches the embassy. Your french fiance will then receive instructions from the embassy, and he will actually apply for the K-1 visa at that time. You, the US citizen, will be his financial sponsor. You will have to show proofs that you meet the USCIS requirement to sponsor him, like recent pay stubs, letter from your employer, tax transcripts, ... No worries so, if you were not making enough money at the time of the petition. What is important is at the time of the interview, and even if you still don't make enough money, you guys can have a co-sponsor to help you. :)

- After the K-1 in hand, your fiance will fly to the US, get married in the 90 days. After that, I suggest that he adjusts his status (AOS= Adjustment Of Status) quickly, so he can become a permanent resident (green card). You should also file for EAD (Employment Authorization document) and AP (Advance Parole, travel document) in the same time as AOS because it's free if you do it with the AOS, and your fiance should then be granted the right to work and travel temporarily. It is usually approved in 2-3 months, and the EAD/AP card is valid for a year. By that time, the AOS should be approved. :)

At the embassy in Paris, a woman will tell him that he won't be able to leave the US for about 2 years after he enters with the K-1 visa, but that's wrong (don't know why she says that to everybody). As I explained, if you get married in the 90 days and then apply for AP quickly, he should be able to travel out of the US in a lot less than 2 years.

I think there are as much "risks" as with taking the K-1 route. Just have him take lots of proofs of his intending return to France (having a job and so a letter from his employer would be great, return ticket, ... among other proofs). Give him also the "notice of action" from the USCIS that you, the US citizen, will receive after you will have sent your I-130 petition package. If he is questioned at the airport about having a wife in the US, he can show proof that you guys are doing things the legal way (meaning filing for a spousal visa, and not intending to immigrate through the VWP).

There's always a risk to be denied by the officer, but telling the truth and having proofs supporting it helps a lot to convince.

As already said, get married (in the US or France preferably), have him return to France and file for a CR-1 spousal visa.

Looks like being able to work in France and then in the US is a strong factor for him. If you choose the K-1 route, your fiance will be at least 2-3 months without being able to work in the US: you will have to get married and then file for a work authorization (EAD), which takes 2-3 months to get approved, and he will be basically "stuck" in the US. He won't be able to leave the US until he has an AP (advance parole = travel authorization) in hand. AP and EAD takes the same time as it is a combo-card. So with the K-1, the fiance(e) (then husband/wife) has a period of inactivity of at least 2 months...

With a spousal visa, he will become a permanent resident as soon as he enters the US, and so, will be able to work. The green card should come automatically a few weeks after his entry.

Just to clarify: the green card won't come in his mailbox in France... It will come in your US mailbox after he enters the US with a spousal visa.

If you want to feel better, write a letter saying that you both intend to live at your grandmother's address, and give it to your fiancee for her interview (in case the consular officer asks her about it).
