It sounds good. Try to be at the place of the adjudicator and send good proof that will for sure show you were at the same place at the same time. Don't forget to put locations and dates in the back of the pictures, and names of the persons (even if it's you and him).

You can include few emails and Skype log, it's not obligatory but it doesn't hurt. :) As the VJ guide states, DO NOT send too much, but some good quality proofs.

Sending 5 pictures is good for the petition. Your fiance will be able to bring more during his interview at the embassy, as well as other emails/Skype chats... :)

It says email is the preferred method to contact NVC, but I prefer calling, it's faster. You have the email address on that link and NVC opening hours for calling. :)

If you call, do not read what it says on that link about leaving an automatic message, this doesn't work for K-1. Just press 1 for english, and 5 to talk to an operator as I told you. No worries if your fiancee didn't receive the NVC letter, a lot of members have said to never receive this letter, although their case has been sent to the embassy. :)

I'm sorry you're missing your daughter for so long. But you didn't search well enough how long the process would take. The USCIS step is only a part of it (their goal is 5 months, but it usually takes between 4-6 months). Then comes the NVC step (usually few weeks) and finally, the consulate step. I believe for London, it takes 1-2 months...

Have your fiancee received a letter from NVC with your case number? If not, just call them at (603) 334-0700 , press 1 for english, and then 5 to talk to an operator. Ask if they received your case and if yes, what is the case number (should be starting by LND). Also ask when it was sent to London. Have your receipt number ready (on your NOA1), they will also verify what is the beneficiary/petitioner names, etc. Your NOA2 date is more than a month old, so your case should have left NVC by now! I would even bet it's in London already. But it will still be good to know your case has done the NVC step and that you got your case number.

If your case is at your embassy, I can't help you much, but UK members can. If you know your case has left NVC, you may call the Department of State to know the last update on your case. Have your case number ready (the one starting by LND from NVC). Call 202-663-1225, press 1 and then 0 to talk to an operator. Just ask what is the last update on your case. :)

I agree, there is no problem at all, the POE will be Vancouver, that's all. Just make sure you have enough time during your 2 flights, as it can take a while (I don't know how many people is your "whole family" but have at least 2-3 hours between the 2 flights). And yes, flying during summer is VERY expensive, even more if you're flying to NYC!

The K-1 visa is the most proper/legal way, that's all. The VWP authorizes you to comes for less than 3 months, and I just don't think it sounds very proper/true to say "oh yeah, I came with the intend to visit, and during my (short) stay, I decided to get married and stay here forever!". I would be the USCIS employee in charge of the AOS file, I would have suspicions of fraud... as coming as a tourist with the intend to get married and adjust your status is fraud.

I understand more people who come to the US with a student/work visit for like a year, meet a US citizen, decide to get married and then adjust their status without going the K-1 or spousal visa routes. The intend to get married when they entered the US was clearly not there.

I see, so the worst case scenario should not be longer than 6 month I assume if no RFE and package is perfectly done.

Congrats to the couple that got their done is a little over 3 months. That is fastest one I have seen. I have seen a few cases that took ~4 months.

I just hope that I will not need to wait longer than 4 more months. My filing location was California, it is just 20 minutes from where I live. Package is so well put together that I shouldn't be too hard to go though all the packages. Everything is so straight forward. This is just my wishful thinking, I am just trying to stay encouraged.


Do not hope for 4 months, there are very high chances that you will be disappointed. Now that your package is in CSC, it's going to collect dust for about 4-6 months before someone look at it, no matter how well you organized it. After this USCIS/I-129F petition step, it will be sent to NVC (add few more weeks), and then to your fiance's consulate for the K-1 visa application in itself (each country has their own timeframe, look at timelines from members of the same country as your fiance to have an idea).

The USCIS do not process petitions by how well they are organized or how straight-forward they are. Mine was too, and I waited 4.5 months before my petition was approved (without RFE).

You will have also better help from members who dealt with your fiancee's country consulate, as the process is different in each consulate. My consulate wanted a new letter of intent from the US citizen fiance, for example.

2. USCIS adjudicates I-129F petitions, not the K-1 visa. It is possible that NVC notices that there's a missing document or a form not correctly filed, and USCIS missed it. It's rare though... Usually the NVC step is pretty smooth, they assigned a case number and send the case to the appropriate embassy right after.

The NOA2 is the notification telling you your petition was approved and sent to NVC (even if it may say on it that it is sent to the embassy... it ALWAYS goes to NVC first). You don't actually knows when they send it exactly, and you don't receive notification when NVC receives it or send it to the consulate. The only way to find out is calling them and ask them (if you want, that's optional). Again, you don't receive notification when the consulate receives your file.

NVC sends a letter to the US citizen saying they received an approved petition and what is the new case number. Some members have reported not receiving that letter though...

To resume, in normal processing, the notifications you receives go like this:
- the US citizen receives the NOA2 by mail
- the US citizen received the NVC letter by mail
- the foreign fiance receives the packet 3 instructions.

Calling NVC allows you to track your case, and have your case number earlier than if you were waiting for the NVC letter, that's all. :)

Did you photocopy the form for your own record or is it the completed pdf on your computer? I had this problem where even if I completed the form on the computer, some infos would not be printed (box unchecked after being printed...). I rechecked my whole package several times to avoid this kind of missing infos... Trying to find an explanaion here at your problem.. :)

It can be ok, but it's always at the officer's discretion. I would say leaving in May and coming back in June is not a good idea as it raises some suspicions... plus as you said, it will be her 3rd trip within a year.

If she takes the risk, be sure that she has a lot of proofs showing that she doesn't intend to immigrate illegally on this trip, and have a copy of the NOA1 showing that you started the fiance visa process. And be always prepared that she can be denied at the border.

I personaly came to visit my fiance during our K-1 process, at about the middle of it, and only for 2 weeks (I had only a cabin luggage, no check-in, and a lot of proofs, just in case).

Yes, if it's the I-129F or the I-130, in both cases it takes time to get through. Inquire about the DCF thing is good, you may be able to get that part faster (in the spousal thing for sure, don't know if it works for fiance). As reginakrys said, if you file now and that your fiance/spouse comes to visit you this summer, be sure she brings with her serious proofs of her coming back to Taiwan before her visa expires... The risk that they will think she's trying to immigrate will be higher than usual.

Everybody here wants to live their life with their loved ones as soon as possible, but the process of immigration takes time, and you can't change that... File either for a fiance visa, she can still come to the US in August but have to return to Taiwan before the end of her allowed time, or get married now, file for a spousal visa, and same thing, she can come but need to return before her tourist visa expires.

What I've bolded isn't true. The adjudication process is essentially this: the adjudicator opens your file and reviews your petition. At that point, they will decide to either approve the petition, issue an RFE, or deny. They don't pull your petition a series of times to review it for completeness and then put it back on a shelf for a few more months to review it again because no RFE was issued.

The stated goal of the USCIS is to review/adjudicate petitions within a five-month timeframe. However, there are plenty of examples on VJ alone where people have been well under and well over that estimate.

Just to be sure you don't confuse:
- petitioner= US citizen, you
- beneficiary=him, the one who get the visa

The first step in the K-1 visa process is for the petitioner to submit a I-129F petition. It takes about 4-6 months for it to be approved. Once approved, the case is forwarded to the National Visa Center (NVC) where they log your case into a system, assign a case number relative to the beneficiary country, and then forward the case to the beneficiary's country US embassy. Once the case is at the embassy, they contact the beneficiary and that's the actual step where he can apply for the K-1 visa. Depending on the country, it takes from a month to several months.

The financial docs are involved at the embassy stage. Nothing is required by the beneficiary, but he needs to be sponsored in order to prove that he won't become a public charge once in the US. The primary sponsor is always the US fiance. If you don't make enough money (below the poverty guidelines), the beneficiary needs a co-sponsor.

If she's applying for the EAD at the same time as the AOS, it's ( c ) ( 9 ). Read the USCIS instructions of this form carefully. This is a frequent question on VJ, a quick research in the search bar and you would have found your answer.
Are you married yet? If not and that you want to submit the EAD form right now, be aware that you're going to pay the fee and the EAD will be only valid until her I-94 expiration date. It takes 2-3 months to receive it so she may receive it few weeks before the expiration date or even after. This option is quite a waste of money. Best is to file for EAD at the same time as the AOS, this way the EAD form fee is waived, and the received EAD will be valid for a year.


Get familiar with the AOS from family based visas forums, you'll find all your answers before even asking them. ;)

From the Dallas Lockbox it then gets forwarded to anyone of the service centers!! Vermont, Cali, etc.... You will get a NOA1 shortly after you mailed the package letting you know they got it and which service center they have sent yours too, along with a ref number to look it up.

It can take up to 1 month but usually it's 1-2 weeks. Count 4-6 months then until you receive either a RFE or the NOA2 (approval). If you're talking about the estimation range date you'll have in your timeline after you write your NOA1 Receipt Notice date in it, it's based on VJ members data, so it may be right, as you can receive a RFE/NOA2 before or after that estimate. Nobody knows for sure.

Also, put California Service Center or Vermont Service Center in your timeline and profile depending on where your petition is being processed, it will be written on your NOA1 (bottom left of it). :)
