K-1 Fiance(e) Visa Process & ProceduresAble to meet 100% but not 125% of poverty guidelines. Affidavit of support before or after entering the US?

Hi there,

I am planning to sponsor my fiance to come to America in March 2015.  I have been researching the requirements for financial support, and I would just like to clarify something.  With the part-time job I have now, I am able to slightly exceed 100% of the federal poverty guidelines.  However, I can't meet the 125% requirement.  We have someone (non-family member) who is willing to be a co-sponsor.  I know that the government requires 100% for the I-134 (before entering the U.S.) but 125% for the I-864 (after entering the U.S. and getting married).  My question is, should we have the co-sponsor fill out the affidavit of support before he comes to the U.S., or can we just wait until after he comes, since I am able to exceed 100% of the poverty guidelines now?

All and any help is greatly appreciated.

Thanks!

USCIS Service CentersCSC K1 Processing Times (NOA1 to NOA2)

All past processing times as posted by USCIS are here on aila . org

Make sure you read the dates correctly as the date it was posted is not the same as date of 'processing time as of' - this is on the document itself just above the table.

Not sure how much it will actually help you though, I think all we can do is have patience, annoyingly. Good luck

Got it, Thanks!

USCIS Service CentersCSC K1 Processing Times (NOA1 to NOA2)
A month or so ago the processing time at the CSC for K1 Visas (NOA1 to NOA2) was 5 months, then it changed to 5.5 months, then again to 7.5 months (there may have been a 6.5 in there as well but I don't remember for sure). I'm 6+ months now so I'm going to contact my immigration attorney and I want to include all these changes with specific dates on each processing change. Does anyone have these figures?

Thanks, Steve

PhilippinesMedical, TB Screening, Exit country within 90 day after Medical (Manila)

We finally finished this process and are in the states now. Below are the exact dates of our medical and visa expirence:

Jun 28, 2013: St Lukes Medical Exam (Questionable x-ray, Sputum test to follow)

Jun 1, 2, 3:  3 days of Sputum tests done at St Lukes (then wait 8 weeks for results)

Sep 01, 2013: Sputum tests results came back negative (ok to schedule interview)

Sep 10, 2013: Interview at U.S. Embassy in Manila. At the end of the interview we were told right there on the spot that her Visa was approved (we receive her Passport with the Visa Stamp a week later. When we looked inside the Visa approval date that was given was dated Sept 13, 2013. """The Visa Expiration date was Nov 27, 2013 (3 months after Sputum results)""".

Nov 15, 2013: We exited the Philippines.

PhilippinesMedical, TB Screening, Exit country within 90 day after Medical (Manila)

Hi,

My Fiancee went to do her medical at St. Luke's in Manila last week. The chest x-ray showed something so St Luke's had my fiancee return to the hospital this week for 3 consecutive days of sputum collection (sputum culture results in 8weeks). 3 years earlier my fiancee was treated for mild TB so we're hoping what St Luke's saw on her chest x-ray was scaring from her episode with TB 3 years ago.

The reason for this post is that one of the people at St Luke's told my fiancee that if her medical is clear then she can do her interview. But this person also said that my fiancee will need to leave her country (Philippines) within 90 days of starting her medical or that she would have to do her medical all over again. This doesn't make sense. It would make since that a medical should been done within 90 days or 60 days of a interview but it does NOT make since for her to do the medical, then wait 2 months for the culture to be approved, then squeeze in the interview so she can be out of the country within 90 days of when she started her medical. I've been looking online for documentation to disprove it but I haven't found anything. Does anyone know specific information on this?

Thanks,
BakitHindi

K-1 Fiance(e) Visa Case Filing and Progress ReportsK1 VISA APPROVED!

Hi again ‘bakithindi’ :D

All the steps you mentioned were great, I think that would be the best considering your situation now

Well as per your fiancées interview schedule, she doesn’t need the hardcopy, as soon as you know your case number (something like MNL1234567). After you get the online NOA2 notice, call NVC 2 weeks after and try to ask if you already have a case number. When you have that she can pay the visa fee right away, fill in the DS156 online and obtain a barcode then call up US Embassy and get a schedule.

Well anyway that’s just a suggestion. as you want in US ASAP.. ;)

YES…you can very much accompany her every step of the way during her interview…
When I had mine there were 4 girls with their honeys (the USC) with them…(aaweeee….) (L)

In my opinion, it would’ve been really less nerve racking if my fiancé was there…I hope you can accompany her. It would greatly help her emotionally, not to mention someone can carry all that heavy folders…watch her seat and the docs when she needs to use cr…help her in looking out for her priority number to be flashed…and yes…a hand to hold…

Oh but you don’t need to accompany her in each window…lol
I guess windows 2 (Filipina preliminary interview) & 3rd (consul interview) definitely

Ask away and I will try to answer what I can… ?

Great. Thanks again, I really appreciate your help!

K-1 Fiance(e) Visa Case Filing and Progress ReportsK1 VISA APPROVED!
Hi Mary Therese,

Yes I got your joke. It was hard finding an available username for visajourney so I switched to tagolog and then walang problema :-)

Beings I'm in the Phils the things that are easily available to me are my 1040 & W2s and I'll go online to get my bank statements and summery of investments. I'm headed back to the states in July. If my fiancee doesn't have her interview by then I will get my bank to write a letter as well (this should be easy to do in person). But I hope the interview happens way before July. Originally I had hoped to get her to Oregon by mid August but now with the delays it looks more like it'll be Winter before I can get her on a plane. Bad timing kc I hate to throw my honey into a cold wet Oregon winter on her 1st day in the states, but even winter is better then never.

Btw if I'm still in the Phils when my fiancee has her interview do you think the embassy will let me go inside the area with all the windows so I can wait with her?

You've been very helpful!

Marami Salamat

Congrats Mary Therese!

Thank you for the full detail of your interview, it was very helpful. I printed out your report and gave it to my fiancee... she made some notes so she could be more prepared when it's time for her interview. Btw she doesn't have her CENOMAR but plans to attack that in the morning.

Question:
I was reading about the Form I-134 online and it says the U.S. citizen should ask all of his banks to draft simple letters confirming the accounts. But I read on another site that submitting the bank statements would be acceptable. When you submitted the Form I-134 did you have a letters from the banks confirming the accounts or did you submit bank statements instead? I'm not in the U.S. so getting letters from my banks would be difficult at this time.

Thanks and Congrats again!

K-1 Fiance(e) Visa Case Filing and Progress ReportsI-129F PETITION FOR FIANCE(E) (Approved)

Hi all,

I just wanted to mention I just received a email notice from USCIS stating that they have approved our I129F PETITION FOR FIANCE(E). We filed back on October 9, 2012. So now it feels like the wheels are finally moving again.

I'm jumping a few steps ahead here but when I get my fiancee stateside then we will have additional steps to make there as well. I was told that there is a step or two that will NOT allow her to travel back to her country until the step(s) have been completed. Can someone tell me what steps these are. We thought about getting married when she arrives plus start some of the steps... but we also want to travel back to her country within a month or two of getting married.

Thanks,
BakitHindi
