ah well that certainly works out nicely for you! for cody to come all the way out here it takes almost 2 days and costs anywhere from $1,300 - $2,000 depending on the season. so for us its never just a quick trip out to see one another...its a freaking mission. but you're right we will all make it and hopefully not have to worry about traveling shortly. cody will be here in 57 days so i have something to look forward to. we're still not sure if it will be for 2 or 3 weeks but anything after almost 5 months is going to be heavenly!!

I'm not exactly sure what you meant about the NOA hard copy. Most of us pulled our receipt numbers off the back of checks and checked our status that way. Getting the NOA1 in the mail is the "hard copy" version - I think this is what you were asking. Basically just means we have a letter from the USCIS saying that they have started our application process, instead of just a number. Does that make more sense?

You can check your case status and see how many times it is touched online at their website. This is the page if you need help getting to it: Case Status Online You have to create a a customer account and you will need your receipt number to link your case to your account.

oh man now i'm even more jealous!! how do you organize the time off from work? it costs so much for cody to come all the way out here and then he only gets two weeks. sad thing is the only reason he is coming the end of may is because our first child is due and we want to be together for the birth. i wish there was something else we can do so we could see each other more, but i guess we have had more time together in the past compared to others. i guess its our turn to spend time apart...i just hope and pray its not for too long cause he's going to miss so much of his daughters life.

remember when i told you we got part of our i-129f application back and they had lost the other part? well i assumed cody had sent it back to them and then last night i found out he had forgotten about it. he's in the middle of moving our entire house so lord only knows how long this is going to put us back. i was thinking about not sending it back to them...but my i-130 estimated date keeps moving back further and further, i figure it cant hurt us anymore.

Yeah don't worry about that I made my check out to USCIS and they stamped above it. It's not a big deal! I understand what you mean about the printed numbers on the back. I had 5 different sets of numbers printed on mine. They printed the case number in the top left hand corner of my check (back) and the rest were from Bank of America cashing my check. I have heard that in some cases they don't put a case number on the check and you just have to wait a little longer. Don't worry if they cashed your check your NOA1 is on its way. I wouldn't be too concerned about the money....if they cash one check you can always cancel the other. I would be careful about sending multiple applications before talking to someone.

this morning cody got a letter for the california service center asking him to re-submit certain parts of our I-129f application packet again. because apparently "they were separated from the original application and have been misplaced"

how reassuring is that supposed to be?

i was under the impression everything was scanned in onto a computer in chicago and sent to california...how to you loose bits and pieces of a digital and hard copy application?

good thing we kept exactly copies of what we submitted in case something like this happened!!

when we called and talked to immigration services originally about how they screwed me over and what exactly we had to do, the person we spoke to told us we had to write a affidavit of hardship and have it notarized and sent with our applications (this was the same person who told us to submit the I-130 and the I-129f together). we were told to explain the situation, explain that i am pregnant and explain how it was going to cost so much more because of this situation they had put us in. basically covering the costs of the doctors fees and hospital, since our insurance wouldn't cover it and how we were going to have to pay for plane tickets and what not. she said to talk about the family situation over in the states as well as here and talk about the cost of living difference as well as quality of medical treatment. basically explaining that cody couldn't just up and move here till i was given my visa and how the mess up they made put an added financial burden on us. when cody told me about this he just said that he was under the impression that it was just part of the process and didn't understand why it wasn't called for on the application. i'm starting to think that maybe its just something extra they told him to do.

i have no idea why we would be happy about it being under special review, like i said before we thought it was something that everyone did. cody asked if special review was good or bad and the guy told him not to worry that it was good. but that's all he said about it so i have no idea what is actually going on.

the reason cody called yesterday was because our lease is up at the end of the month and so he's having to move. he called to find out the best way to change the address they have on file for us. i thought i had mentioned this in my earlier post but if not sorry! anyways after the guy told him how to change it online and that they would send out a confirmation letter with the change of address, he told cody that the file was under special review. it's all very weird if you ask me!

by the by its a good thing he gave you the ability to edit posts, things look a lot better!

the affidavit of hardship wasn't to waive the fees for anything, we paid our fees just like everybody else did and he obtained all the proof from his employer of financial stability in order to support me when i get back to the states. not exactly sure where you got the idea that's what it was for but okay =)

that's the attitude i have about the k-3 visa, if they cancel it and send you a letter its not going to make the world of difference. however if they do approve it you'll be together sooner. and granted some people would rather go to the cr-1 way cause it's cheaper in the long run, but honestly i would rather pay the extra $1000 later on and be with my husband sooner. but its a personal choice every couple has to make cause the money might be an issue for some. good luck making the decision!

yeah the g325's all have to be originals from both parties. as for the processing time it really depends on how luck you get. some people say the k-3 visa is slowing down the process and people aren't actually getting them but in the last 24 hours i have talked to several people who have actually gotten theirs. plus one of our own february filers got their NOA1 recently for their k-3 visa. so it basically is up to you! as for the processing to get an interview i have heard that it's quicker to get one for the k-3 than it is for the cr-1 but you'll have to check with your own embassy (or people who used it) on that one. good luck and enjoy the week!

Hi, I know you said you do not want to see another lawyer, but your case sounds very difficult, and probably the only advise people can give you on here is to see a lawyer. I know they are expensive and difficult, but if you want to remain in America legally you probably need to find and immigration lawyer.
My other suggestion is to see if your petition is within the processing times for an I130, if it is passed them you can call ask the status and see if you are still on file and in the process with them.

How do I find out what's up with my case - I called USCIS and the "OFFICER" my call was bumped up to apparently didn't have anything better to do than to be nasty ... I kept asking her if she could check on a case number for me but she kept saying until my check is CASHED I don't have a case number - I told her that the online system was telling me that Chicago was already entering/issuing NOAs for forms received 2 weeks past the date when mine was received ... she apparently thought that what I was saying to her about the online info had NOTHING TO DO with my application actually being ENTERED ... that makes no sense?!?!?!?! Is she clueless, or am I?



if it makes you feel any better my husband called a couple days ago...was put through an automated system for 30 mins and then put on hold for about an hour and finally when the person picked up he asked them a question the person said "um...." and then hung up on him. needless to say he was not amused!

Ralu, no i don’t think so. i sent my I-130 alone too as stated in the instructions. Some people send them together... even though there is no official documentation stating to do so.

No don't worry the rules still say to file the I-130 and then file the I-129F afterwards. Some people (like my family) were told by an immigration officer to file both applications together. There are a few of us in the February 2008 filers thread who were told to do it that way. I don't think there is anything wrong with the way you filed. I honestly have no idea why we were told to fly like that, we called regarding a separate matter and that's what we were told to do. Question: We have been approved for a K-3 visa and in the process of gathering information for the interview we came across an issue. We filled out the I-134 Affidavit of Support, got the letter from my husbands employer and the past 3 years tax returns. However, my husband being the "wonderfully organized" person that he is has somehow either lost or thrown away his pay stubs. Is there anyway of getting around this issue? The letter from his employer states the hours and salary he's earning. He doesn't start working again until July 14 so won't have a single pay stub till the end of the month. Can I go to my interview without them or will I get into trouble?

For the funeral pretty much everyone they know will help pitch in money for funeral expenses and travel to the village for several days for the burial. I know my fiancé wants to be buried in Uganda, in his banana plantation, with his relatives. I hope to be buried there along side him also.
Ugandan’s do not culturally believe in cremation, and the idea seems to disgust most I have talked to. In a country where most people don’t have cars and there is not really funeral homes to help with arrangements I have seen many family member even transport a body home on a bicycle huge distances to make sure the body is take home to be buried. It’s amazing what a huge part funerals play in the culture.
