Okay so I don't know what was wrong with the site but it finally let me in.

So now I have another question for those who have been approved. After your approval notice was sent did they keep touching your case or not? Once they had sent it off to the NVC did they some how show on the site that it had been forwarded?

I just read a horror story about a woman whose case sat at the California Service Center waiting to be forwarded to the NVC for almost 8 months lost somewhere in the mail room.

Ralu&Doru - Oh I know you're going K-3 route, but I know with our affidavit of support it gave instructions how to have a co-sponsor and fill out for that person. I just assumed they would have the same courtesy for those who were filling the K-3 visa. Normally people in my position would just have to wait for instructions from the NVC on when to jump and how high, but thankfully people have put up manuals as to how to do things quicker. You can now pay the fees online and download all the forms so you don't have to wait weeks on end for things to come in the mail. Hopefully that will speed the process up because I have read that some people wait 8 weeks and others wait 6 months. I am not willing to spend another 6 months waiting for someone to find enough time to bother to look at my case.

zawjatsaid - Sorry to hear about the RFE, hopefully it is nothing too serious! Have you gotten any news as to what was wrong?

Danyel - So I had a thought today ya know on the time table thing you made for our filers. Well what if you put the approval date as well as which application was approved in red. That way others can see if they are approving day after day or if it's a weekly thing or whatever. What do you think?

Is anyone else having trouble signing into the USCIS website? I get to the log in page and then after I type all my information in and it just goes blank. It loads and loads and loads some more but nothing else ever happens. I'm starting to get a little annoyed cause I want to see if it is listed as being forwarded to the NVC yet or not.

If you find out exactly what you have to do let me know cause I'm not sure if we're going to have to do the same thing. There is a whole set of I-864 applications that I know you get sent for the I-130 process at the NVC. You may want to look at the I-864a and the I-864 because so far those are the two I have understood you need to file when using a co-sponsor. Does he currently live with his father or not? What did the lawyer say for you to do?

Weird thing is I just realised you, me and Danyel not only have close time lines but also have close birthdays. Strange how things work out!

okay so as you know my i-130 application was approved on may 16.
i noticed it was touched on may 18 and i just thought it might be them getting it ready for it to be sent to nvc.
however, it was touched again today may 19 and yet it doesn't say forwarded to nvc.
does anyone else have this happening or am i just being used as a touch ####### again?

I'm just trying to figure out the basics that Cody needs to gather before he heads my way. This time in 10 day's he'll be in my arms and then 5 days later Nikole will be here =) I just don't want his 3 week visit to put our application too far behind. I found information that is for the NVC process, first one being option one and the second one being option two

However, I am now horribly confused as to which one I'm supposed to follow or how much it's going to cost. Either the closer I get to labor the stupider I get or this is just getting more complicated =) Like for example, when calculating the poverty line we're supposed to meet we go by 3 correct because when my interview comes about Nikki will be around. I have a million questions and the more I read the more questions I have.

I have no idea how the I-130 process at the NVC works cause I have tried to find an official NVC site and I couldn't find one. I found something that said you pay fees, they send you something, you pay more fees and they send you something else. Then your case is moved from the NVC to the embassy and you do more papers there. However, I have no idea about fees and time lines so I'm a little stuck. Someone wanna help me please =)

Apparently, it went straight from your mouth / post to God's ears because I got an email today from the USCIS that our I-130 application has been approved as of May 16! We're so excited about the news as I'm sure most of you were too when you heard.

I'm not exactly sure what happens from here on because our case is going forward with the I-130 and who knows what happened to the I-129F.

Guess I better start doing some research and see what our next steps are.

Ralu&Doru - I guess that's the smarter way to do things, plan for a longer wait and then when it comes sooner it won't seem so bad. Your embassy send packet 3 to you? We have to pick up the packet from ours and if you don't live near it (like me I live 5 hours away) you have to have it picked up by courier. Once you have submitted packet 3, they will mail you packet 4 and give you an interview date. I don't know if South Africa is just more stuck up than other places or what but it seems to be even more hoops to jump through.

We're doing fine thanks! I can't believe she's almost here and that I'm going to see Cody within a couple weeks. It breaks my heart that he's going to have 15 days with his daughter and then not see her again till who knows when. Hopefully we'll get some good news soon and be able to go home but right now we're just hoping to be together for Christmas.

Are you guys planning on seeing each other before the big move to the states or you just going to wait?

I know it's hard because we're all thinking it but don't worry just yet. I looked at the January filers and only about ten of them have been approved so far. So the simple fact that some are already being approved in February is just luck of the draw. Your turn will come around too, I promise!! Venkat - sorry to be the messenger of bad news but a touch doesn't mean they are going to approve your applications within (x) amount of days. it just means someone some where for some reason has looked at your case. hopefully your case is being worked on so that they can approve it shortly but that's not always the case. my case was touched about six times in march and never since. good luck to you.

Ralu&Doru - im not 100% sure about the i-130 but i would assume they say you're spouse is in the country because they probably see that your k-3 visa had been approved already. my advice would be to call the uscis and ask them what you should do, maybe even get a second opinion from another lawyer if you don't trust what yours is tell you. good luck!!

Well it depends on how quickly you're wanting to be together. The I-130 requires money paid to the NVC and will take a little longer going through them than the K-3 will. However, you will enter the country on a green card and won't have as many hurdles to jump through once you're in the states.

Aren't you guys using a lawyer? If so, what did they tell you would be the best course of action?

I have no idea about the Romanian embassy but I know the South African one requires all documents to be in English. So you may want to consider having some of them changed over to use as proof. I have no idea about Yahoo messenger calls either, can you not print a list of numbers you have called somehow? I know I started tracking our AIM chats so that I could use that as proof, however I don't want them reading them seeing as they are private conversations. Good luck and keep us updated on when you get the hard copy of your NOA2 and how long it takes to go through the NVC.

ralu&doru - wow! i'm so jealous my i-130 time line hasn't been that close...ever. hopefully it works out for you guys and you don't have to wait a lifetime for it.

danyel - our time lines are still close to one another you're august 15 and i'm at august 1. do you know how long the wait at your embassy is after your application is approved? i'm still trying to figure it out for my embassy, but i have heard that it can be a matter of weeks or some even wait months just depending on how fast your embassy works.

I wouldnt worry too much! If it happens then deal with it, but just keep thoughts high and everything will work itself out. I didn't include any pictures with our application and I know a bunch of people who didn't either. Just cause you haven't had a touch in a long time it doesn't mean you are in for bad news otherwise we would all be in trouble =) good luck!

So after a lot of talking and research we have decided to resubmit our I-129F application, after receiving the letter explaining how they has lost parts of the original application.

At first we were planning on resubmitting it, then we heard how it was slowing down applications and wasn't actually being approved anymore. Having done a lot of research on both here and other websites as well as talking to a lot of couples who have been where we are. Cody and I have decided that this is what is best for us and if it doesn't come through before the I-130 then at least we tried and we're not out any money.

So it was shipped out yesterday and should be there by April 29. Fingers and toes crossed that we get some good news sometime soon after that =) Having something else to track gives hope that our little family may be together sometime before Thanksgiving.

On more exciting news, Cody will be here in 34 days and soon after that we'll be welcoming our daughter into the world. The next two months shall give hope to this waiting process and even more meaning to our lives.

i wouldn't count on seeing dec / jan / feb / march k-3 approvals any time soon.

M and K - okay so i understand if nothing is wrong one could get their application approved before the time line date says. what happens if there is an issue...does that mean it'll be longer than the time line says?

Danyel - there is always hope my dear! that's what i keep telling myself cause if you believe everything the uscis tells you you'd drive yourself nuts!

i really hope that they are right with what people say on here about the people at uscis...

so i called USCIS...luckily there is no RFE on my case wink.gif BUT she pulled my case and looked and said it'll be around another 158 DAYS until its processed!! i was like WHAT??! and i said do you mean from the date i filed or from today, and she said no mam, 158 days from today!!! i wanted to scream but the lady was rather polite so i was being nice, and just said....wow.. and she said i should be happy its only that, that the last lady was calling about her aplication on her 4yr old daughter and her estimated time was 892 days from today, and that i should be grateful its only that amount of time.

im in shock. im upset, and this is #######..... thats like another 5 months....FROM NOW. so aparently the vj timelines may not be so off....that would be september/october time sad.gif


p.s - no touchs on my case were made from this call.



WHAT THE HELL?

Then there is all the other time at the consulate!

Is that what you were told when you did the RFE trick?

Okay now I am confused, how exactly do they figure out our time lines? Ours all seem so different and yet we sent them in at the same time. WEIRD!


Ralu&Doru - I understand what you mean about the money and work and EVERYTHING in the universe seeming to be against us when we're planning a trip to see our spouses. I spoke to your husband about two weeks ago and he was telling me he was going to be coming to see you soon. We were all very jealous! My birthday is May 28 and our daughter is due June 10, so just like you I'm hoping and praying that one of us will get the good news for our birthdays. The only thing for us that would be hard is that the consulate that deals with visas in South Africa is about 5 hours away from me. So hopefully I can get everything taken care of so that by the time we get both passports for my daughter and she's old enough we can make the long trip home. Our goal is to be home before Thanksgiving, but realistically we know it's probably just a dream.

see ours currently says september 24 but a week ago it said october 8

i'm hoping that it keeps going down and down.

cause once they have approved your i-130 application it's still at least 2 months before you can come over right?

Ralu&Doru - thanks for your compassion for our family. sometimes i am so bitter about the fact that this is happening to us now after four years of being together and after a year of marriage. however i think everything happens for a reason and i'm just trying to find the silver lining to our situation. holidays are especially hard when you're celebrating them alone but we have decided that once cody is here we're going to have a couple days of celebrating for all the holidays we missed. its not the same but its the least we can do in our situation. how often do you and your husband get to see one another?

Danyel - so nothing comes from going through all that except to get a touch? it isn't going to prompt them to do a little more with your case? cody hates talking to those people cause they do nothing but bull #### and if you do get a descent person you have to wait forever to do so. then even after waiting forever they just tell you to wait a little longer. for some reason when you call before you submit your application they are really nice and friendly to you but afterwards they treat you like some kind of criminal.

random question - when does everyone's vj time line say their i-130 application could be approved by?

Ralu&Doru - I totally understand how you feel! This endless waiting is hard enough, when you see some cases taking 50 days and others taking 350 days it doesn't leave much room for hope. It's too bad they couldn't just put all these people to work doing name checks and just let us in. It's not like we're trying to get in so that we can work illegally or something. We just want to go in to be with our spouses and those we love. I could honestly wait a year while they process my application to work or whatever but I would rather be there with my husband. The thought that he's going to miss out on who knows how long of our daughters first year of life breaks my heart.

Danyel - What exactly is the RFE trick? And wouldn't a fake touch cause it to take longer?

oh i understand entirely!! i'm the same way i check my myspace, my facebook, here, my email and the immigration site every couple hours. its so depressing to see the date not changing.
