I ran into a similar problem of getting a police certificate from outside the country. I had a friend of a friend who was an RCMP officer. He got it for us, thankfully. Your information is very valuable to others who might be in the same boat. I wasn't sure what else I would have done at the time (full-fingerprint requests take 3-4 months!). We were even considering my wife returning to Canada just for getting the police record.

I emailed my case worker as suggested about my questions. So I asked about the fact that every website says the K-3 visa requires the I-134 but someone else was told to submit the I-864. I've asked my husband to send me both so that I can be covered either way and then today I got this response.


Dear Ms. Vernon:

K3 applicants are not subject to the I-864 (Affidavit of Support) requirements at the time of K3 application, but will be required to submit when the applicant adjusts status to a Legal Permanent Resident in the United States. Similarly, the I-134 Affidavit of Support is also not required.

well http://www.immihelp.com/visas/visa-ineligible-classes.html lists all the reasons why they would reject it at this time. so double check with him to make sure that's the right section and maybe even have him email his case worker. i know i have emailed mine a couple times already and they are really helpful!!

Are you sure it is Section 212(a)(5)(A), as this relates to an employment based situation? 212 (a)(5)(A) states that an alien seeking entry for the purpose of seeking skilled or unskilled labor is excludable in the absence of an approved labor certification. This ground of exclusion applies to the second and third employment-based preference categories. "Alien labor certification" is a process that, when completed, results in certification by the U.S. Department of Labor that there are not sufficient workers who are able, willing, qualified, and available at the place of proposed employment and that such employment will not adversely affect the wages and working conditions of workers in the United States similarly employed. Glad to hear things went well! Can't say I have heard anything like that before (about the sheet) but hopefully he hears something soon. I know how much endless waiting can drive a person insane. Good way to look at it is that they didn't ask for more evidence! Good luck and keep us posted.

Okay so I'm sick of waiting for people to tell me when to jump and how high to do it. So today I took the process into my own hands and I'm taking a chance to see what I can do.

I was told I had to apply for a police clearance. When I did that I was told it would take 6 weeks. After waiting for 2 weeks and making numerous calls to try and speed it up, I found out that it will be ready on August 9, which is one week earlier than expected. Once I had that and the forms from Cody in my hands I was then able to apply for my interview date. This meant waiting another 3 weeks for my time to go to the embassy. So today when Cody's papers arrived I decided to be daring!

I gathered the forms I needed to submit to apply for my interview date and scanned them in. I then emailed my caseworker, who has been amazingly helpful and understanding and asked to have my interview scheduled around August 14. This is would give me enough time to make sure my police clearance was completed and not make me wait till September to have the interview.

I'm feeling hopeful and confident again which is something I have been lacking the last couple weeks. Keep fingers and toe crossed for me and I'll keep you updated on what’s happening.

I appreciate your response. I don't think they are processing my I-130 because we haven't paid the NVC fees or anything yet. We were getting ready to do so when our K-3 packet arrived from the embassy so we stopped. I emailed the embassy and asked them about the confusion because I couldn't find anything on their website so hopefully I'll get a response soon. I'll be a little ticked off if I need to ask my husband for another form because it takes just over 2 weeks for them to get here and I'm currently only waiting on my police clearance. I was going to just ignore it and go to the interview with the I-134 but I figured I should be better safe than sorry. It would suck to make the long trip for nothing!! Question: In the process of gathering information for the interview we came across an issue!! We filled out the I-134 Affidavit of Support, got the letter from my husbands employer and the past 3 years tax returns. However, my husband being the "wonderfully organized" person that he is has somehow either lost or thrown away his pay stubs. Is there anyway of getting around this issue? The letter from his employer states the hours and salary he's earning. He doesn't start working again until July 14 so won't have a single pay stub till the end of the month. Can I go to my interview without them or will I get into trouble?

Hope work isn't draining you too much! God only knows you need all the energy you can get your hands on when dealing with these people. Just a question...why haven't you applied for an IDD? So I have my medical on Wednesday and I'm starting to get nervous about it. Something about doctors, drawing blood and x-rays just rubs me the wrong way. Hopefully, it'll be a quick process and not too painful! Haven't heard anything about needing the HPV vaccine so maybe I'll get to skip that part. Then I found out that it's going to take 6 weeks to get the stupid police certificate which means it'll be a while till I can get my interview. I'm still trying to figure out if I can pay to speed it up, which would be wonderful, however seeing as it's not a priority to them I doubt it will happen.

How are things going with everyone else?

Okay about the K-3 interview I got the list of things I need to take with me and I got my medical booked for Tuesday at 9:30am (not excited about that!) but I was wondering as far as the I-134 Affidavit of Support and all the documents (tax papers, pay stubs, etc.) did you take originals to the interview or were copies good enough? I haven't seen anything about either on the papers so I don't know. I have to get a original marriage certificate for Nikki's American passport so we can mail it all at the same time...just means a longer wait till I get my interview. Advice?

So today when I went to get the mail there was a big yellow envelop from the American Consulate General. Not expecting anything for a long time, of course I was a little nervous to open it. Upon doing so I found the packet 3 forms for my K-3 visa!!! The damn visa we had thought went missing, seeing as CSC couldn't tell us what happened to it. This means Miss Nikki and myself should be seeing Cody sooner than we planned! We're so excited I called Cody (who is stuck in Salt Lake City) and woke him up (not generally a good idea) but he was as excited as me. Anyone got tips for getting things ready or is it as simple as the form makes it out to be?

Update - We got our IID number from the NVC so now we can pay all our fees online =) they also have said they sent our applications out so hopefully things will move a little bit quicker now.

jedinite - we originally applied for the k-3 visa as well as the cr-1, however our k-3 visa basically disappeared and our cr-1 was approved. nvc said that they only have record of our i-130 application. so i guess the answer to your question is yes, csc has approved cr-1's just not as many as the k-3's.

Ralu&Doru - good luck with the interview and medical =) so far things have gone through smoothly...we can only hope that it keeps going that way!!

zawjatsaid - congratulations!! i can only imagine how excited you guys must be right now =) hopefully the rest goes as quickly as it did for Ralu&Doru.

We found out today that our NVC case number and first set of forms were sent out on June 3 (the day Nikki was born).
Now we just have to get an IIN from NVC so we can pay things online =)
This seems to be a really good week so far!!

i know how you must be feeling cause i used to look at the january filers and cuss because they were getting so many approvals. but then at the same time i would look at the december people weren't getting anything and feel bad for them wondering how they felt about the january people. nothing about this process makes any sense to me. i've been reading trying to figure out what happens after the uscis approves it and its back to having the luck of the draw. some people get nvc numbers in a matter of days....others wait 3 months to hear anything. currently i would just like to know which freaking application has been approved so i can figure out what im supposed to do. don't worry your turn for more madness will come soon too!!

The point wasn't to start a "I'm right your wrong" type conversation, I was just stating how I saw things. Personally I find it petty that they worry about a translation and not about a divorce decree. However, it's neither my case nor yours Catt and so in all reality nothing that either of us says matters. It was simply a chat between two people who have been going through the same thing from the beginning and not just bashing the procedure of the USCIS. Because believe me if that was the point, there would be so many better places to start. Hopefully if you decide to par take in our thread from here on out (which you're more than welcome to do) that we can get along and see everyones views on something.

Catt - I assumed being a marriage certificate that a translation wouldn't be just a random piece of paper that someone wrote on. If it's an official document translated by a company or something it should be verified.

zawjatsaid - Maybe you should consider talking to them about the divorce decree or sending it with the marriage certificate. Because I know if you have previously been married you have to prove that it's legally over. You may consider something to avoid having any more issues. Good luck!!

So I just totally had a brain wave / shock / horror attack...whatever you wish to call it.

We never got a NOA1 for our I-129F application so maybe our approval of the I-130 wasn't actually a solo thing. Maybe we got both applications approved but since we never received the NOA1 and weren't able to track it and don't know it was approved.

They won't give us any information for the I-129F so I have no idea anymore!!

Could this be possible or am I just over reacting here?

So after a week of waiting and calling....waiting and calling and waiting some more, I finally got through to the NVC automated system. They have no record of my I-130 meaning it hasn't been sent to them. Does anyone know how long it takes for the California Service Center to forward the case to the National Service Center? Or maybe a short cut to get them to do it a little faster?

On a happier note, Cody is expected to arrive on Thursday (May 29) but just found out from work that they are going to be closed till Wednesday morning so he doesn't have to work all weekend. He's now trying to move his flight so he can get here earlier cause Nikki (our daughter) has been threaten for the past two days to come early. I guess we'll see what happens!!

zawjatsaid - I'm guessing the RFE was for the fact that you didn't include your divorce decree in there. That's nothing too serious then and luckily you have an idea of what is wrong so you can have it ready to send back as soon as you get the letter. Keep us posted on how things go!

Venkat - Thanks! I have the NVC number however I have yet to get through to the system. So far I have had nothing but a busy signal and one can only take so much of that before they start looking for another way of getting around things.

Ralu&Doru - Hahaha yeah we fill in different forms but I figured if they explain how to have a co-sponsor on one they should do it on the other. Sorry I wasn't trying to confuse you =) I don't know how they can touch something if they don't have it. Mine was marked approved about a week ago and we have yet to get our NOA2 so I guess I'm opposite you. At least you know where your applications are and you have a high hope of being done with this all this stuff sometime soon.

Okay so I don't know what was wrong with the site but it finally let me in.

So now I have another question for those who have been approved. After your approval notice was sent did they keep touching your case or not? Once they had sent it off to the NVC did they some how show on the site that it had been forwarded?

I just read a horror story about a woman whose case sat at the California Service Center waiting to be forwarded to the NVC for almost 8 months lost somewhere in the mail room.
