I am just curious to see if there are any other people who received NOA2 on July 9, 2013 and have had their case received by the NVC?  I have not received noticed and when I called they said they had not received it and it can take up to 8 weeks...  I know the 8 weeks is worst case... right?

Yes, you can have his mother be the joint sponsor, if she qualifies. File the petition about 9 months before you want to actually immigrate. Whether that's before or after he becomes a US Citizen, is of little consequence. BEFORE, means he'll be sending one extra letter once he has his Naturalization Certificate.

When you marry won't have an effect on your petition length.
It's when he files the petition.
If he files the petition as a USC, then you'll move faster like the normal USC petitions.
If he files the petition as a LPR, then you're basically just filing for no reason for the file to sit there for months and then he'll upgrade it after citizenship.

I'm not completely versed in the LPR vs USC filing process/upgrade blah blah but that's what I've gathered from reading.


Thank you for your help! Yes! after we get married and after he became a a USC, we will start our CR-1 process. But he is still in college though... Our problem now is affidavit of support... :wacko: maybe we will wait until he graduate and get a job? or can we have a joint sponsorship from his mother instead? :help:

Hi Everyone!

Im from the Philippines while my fiancee is also a Filipino but an Immigrant at Hayward,California for 18 years now. Yes, he is only an Immigrant because he is not a citizen yet; because he took it casually before. We are together for more than 2 years now.Me and my fiancee are planning to get married in-front of our family and friends this June after his semester at college. He is planning to get his citizenship at December 2013 after our civil wedding at June 2013. After that, we will start our CR-1 visa process.

We are getting married at june 2013 because of the fallowing reasons: 1. It will be "sukob"(filipino tradition issue) for my Older Brother's wedding at 2014. 2. If we don't get married now we have to wait upto 2015 to prevent "sukob" (Filipino tradition)3. Financial Issues 4. I will be having my NCLEX Review and exam after July. my concentration will be divided if we decided to take it on December 2013 instead of June 2013.

Is our plan ok? or is it better to get married after he became a citizen instead? please let me know if you have suggestion for us. Thank you so much! :star:

So the card he has the "permanent resident card yes is his green card.

ohh i see.. wait i have to clarify this first: ahm... his non-american passport has no visa, he only use his permanent residency card to enter united states. is that a green card? or LPR card? is there any difference?  sorry i know this is a stupid question from a newbie like us... please bear with me rose.gif

 

 

Yes, permanent residents can petition spouses. The difference between him being a permanent resident vs a citizen is that for a spouse of a citizen, visa numbers are available immediately, whereas for spouse of a permanent resident, they are not. However, the wait is not that long currently.
 

Being a college student is not relevant other than him not having income. If he does not have enough income, he will need to get a joint sponsor.

Yup. For spouse of permanent residents, there is a wait for the visa number to become current. The wait is very short now. File soon before it gets longer.

Absolutely false. If you're a citizen, you can leave the U.S. for however long you want and come back at any time.

 

But you're still a long way away from being a citizen. As a permanent resident, you need to maintain residency in the U.S. There starts to be questions if you leave the U.S. for more than 6 months; and you need to have a re-entry permit if you want to leave for more than a year.

 

 

It's up to you. If you wait until you're married for 2 years, or almost married for 2 years (so that by the time it gets approved, you'll have been married for 2 years), then you will skip the whole Removal of Conditions thing. But is it really worth being separated?
