IR-1 / CR-1 Spouse Visa Process & ProceduresIR-1/CR-1 Advice for a friend...

well - i cant say tehy wont get approved
there are some people that have it against thier religition to meet before marriage, and they are allowed to get visas to come here

ok so thats a fiance visa..........
lets talk spousal

i know that plenty of people that have arranged marriages - and 2 days after marriage apply for the visa
i know of people that go overseas to pick out a wife, maybe visit 1 or 2 times. they get visas

so - im not sure that the visa would be denied.
think about it
immigration sees it all. im sure they have seen weirder.

i do think its good your supportive to your friend.
i think the fact she wants to come here and work and send money home, shows that she cares for her family. and his willingness shows that they agree on it. a dollar goes a long way in other countries. when my husband gets here i know we will be sending some money. maybe not always, but, we both know that we can help some of his family in india that we really care about.

i think that if you really care for your friend, you will just remain his friend and support. the one thing that made me angry after i got engaged was how many people immediately thought i was being used to get a visa. my best friend and her husband really killed me. thier words hurt so much. my thoughts were - do you think im such an idiot that i would make a stupid decision to marry without thinking of the possibilities and consequences. i was aware that people get used just to get visas. obviously i wouldnt have married if i thought for a second my husband had that in mind. also - the reaction of my friends husband made me feel as if there wasnt a possibility that the man could actually love me. was i so repulsive?

so - be careful with your response.
i no longer speak to my friend or her husband. i was her maid of honor.
this was all when i got engaged, she doesnt even know i got married. i dont know if i will speak to her.

ok - that being said

its weird she lied in the beginning. but - i lie if im in a chat room too. i put up my pic of pamela anderson and say im 21. makes better conversation.

its also weird she wanted to marry right away. do you know what thier chats were about? were the chats romantic at all before they met?

i dont think it makes a difference that he paid for the wedding. i dont think that has any significance unlss im missing something.

do some investigating on your own...........
ask him questions about her.
what her favorite foods are
what her favorite tv shows are
does she like to dance
does she like beer or wine.....
what is her parents like
do they like him
how big is her family
whats her life story.......school, places traveled,
do they want to have children
where do they plan to live int he states
does she have relatives here in the US
what things tick her off? meaning whats her buttons

what im getting at is that you can tell from questions like this how much they have talked about real life things. as a friend i think it would show your interest and he will like that. and it might help you decide if you think this is real or not. its not bad that you see red flags, it shows you care for your friend.

hope this helps and i wish your friend the best. hope it works out as he plans.

sam

about the wedding... FYI
here in the Philippines its a custom for the groom to cover all the wedding expenses unlike in the States...

about sending money...
we Filipinos have a close tie with our family, if we can help them.. will do...
its up to her husband if he will allow it...

how old is your friend?
if his old enough, i think he knows what he's doing and he'll take full responsibility of every decision they make as a couple..

about you being concerned...
i think your a good friend and just concerned about him,
but try to accept that he got married already and even though she cannot have a visa,
he will still be married to her whether they are together or not...

about the visa approval...
she might be approved if her husband can proved that he can support her wife...

IR-1 / CR-1 Spouse Visa Process & ProceduresDS230 STUPID QUESTION??

I'm pretty sure I understood the gist of your question, but I would personally continue to put CR1 on any generated documents because that's what you would receive anyway... what I meant to express is that my understanding is that it does not matter how long you were married at the interview, but instead how long when the beneficiary enters the U.S. --- so the visa could initially be a CR1 but then be an IR1 upon entry.

My understanding is that it is the date of marriage when entering at the POE that matters, so doing CR1 should be fine.

I will be cutting it close on the 2 year mark. If I generate the coversheet (james shortcuts) with a IR1 code rather than a CR1 code will I create a problem? I am hoping that if my wife gets here before the 2 year mark (a month early)she still gets the 10 year green card.

thoughts?

That is not my question? My question is if I place IR1 on the documents rather than CR1 will I cause any unnecessary delays. The problem is that my wife is pregnant and I will bring her here the moment that the documents are finished. We were married June 5, 2005. I might just miss the 2 year mark.

All other documents were filed under the "conditional code".

i just want to share this...
one of the member in other forum was on a CR1 but during the interview they were married 1 year and six months, the consul told her that she will get an IR1..

When I first filed my I-130 my wife and I had only been married for a few months. We haven't rushed things and now that my interview is coming up we have been married for over two years.

IF they issue me with a visa will it have the two year conditional requirement attached to it?

I called the NVC and got our case number and had my wife email them with me as the choice. I didnt realize I had to wait for the Sometime afterwards for the DS3032 to be generated. Will this cause a problem if she already emailed them and it hasnt been generated?

when does the NVC received and gave u a case number?
mine was jan 29 ( MNL2007529*** 529-500= 29, its the 29th day of the year)then they generate the ds3032 and i-864 bill on feb 5.

IR-1 / CR-1 Spouse Visa Process & ProceduresAfter you receive NOA1

jsassman, frdmrk2, and ken and mintra: Thank you so much for such fast replies!

I had a feeling that the NOA1 was just to let me know they are starting to look at our case. The last time it says it was touched on the website though was the 14th of February. Is that normal? Shouldn't I have another touch by now lol?

I forgot to mention that mine was transferred to the California Service Center, so me and my husband are probably in for a really long wait!

Thanks again for all the helpful and reassuring answers everyone! I feel much better! :D

we haven't got touched through out the process,
so i guess that would be fine

i also thought that CSC would take that long, but as i see it now...
many people from VSC are waiting for almost 6 months, they have a thread here w/c is What's going on with VSC.
some of them filed July 2006 and still no NOA2

IR-1 / CR-1 Spouse Visa Process & ProceduresAfter you receive NOA1

Ok, so I am wondering what happens after you receive the NOA1? Do we just wait and keep checking the USCIS website to see if our petition has been touched? Or am I supposed to send something else in?

I read the NOA1 paper several times, and from what I have read, it doesn't say to send anything...so I think all we do is wait now, right???

This is probably a dumb question but I thought I remember reading somewhere that you have to send in something else after getting the NOA1.

I'm just a little bit confused here and I don't want this process to be delayed because of something that I might have misunderstood!

Thanks!

i think if u want to apply for a K3 you have to send a copy of NOA1 and I-129F
but for us we didn't pursue K3, we just stick with CR1 because its an immigrant visa unlike K3 w/c is non-immigrant visa
but K3 can be faster tho...

IR-1 / CR-1 Spouse Visa Process & ProceduresCR-1 application

Hello All,

Please I need help on something very basic but very confusing to me right now. To all or anyone that has already applied. Am filling out my 1-130 application right now but am confuse of what name to right for my wife as her last name here. We got married few days ago in the Philippines and on our marriage license it still reads her maiden last name. So what name do I write as her last name on this I-130 petition and on her G-325a, my last name or her maiden name? Please if anyone can help me with this small issue I would really appreciate it.

_alex

Use the last name she'll be using on her passport,
does she have a passport already w/ her maiden name? if so, she have to go to DFA to change her last name...
the requirements are... marriage certificate, birth certificate, id, maybe asked for baptismal and school record...
for spouse of foreign national it requires to get a CFO certificate

we got married last year and I'm using my husband's last name ...
my maiden name as Middle name... normally that's how it is here in the PI

IR-1 / CR-1 Spouse Visa Process & Proceduresplease help

okay my husband just got of the phone with the united kingdom immagration helpline and they impleyed we would roughly have a futher 5 months to wait to complete on our visa when the case is forwarded to the embasssy can some1 in simple terms please give us there timelines of ir1/cr-1 we currently waiting on the ds230 form (packet 4 form) and i am my husband's choice of agent and currently working with the nvc what are the steps that happen next because a flow chart of what the nvc sent with the choice of agent form empleays that we fill out some paper work with the nvc and then wait for an interveiw date at the embassy but the phone call emplayed that there are still alot more forms to fill out when the case is forwarded to the embassy PLEASE HELLP AND JUST EXPLAIN WHAT HAPPENS NXT IN A TERM ME AND MY HUSBAND CAN UNDERSTAND PLEASE!!!!! this hole process has just been a one state of confusion to the nxt and when we think we have some handle on what is happing something else confuse's us all over again lol

you haven't received the I-864 Bill yet according to your timeline... when you received this the petitioner should fill up the forms (you can find this forms on USCIS website and the instructions and required documents needed to submit)...

then the beneficiary ( your husband can fill-up this and send it to you in advance ) have to fill-up the DS230 forms w/c also can be found on their website... and also the required documents to submit together with this forms ( you as the agent also will received this forms together with the "cover letter" w/c you will need to send together w/ your husband's DS230)

after you submit all of that, you have to wait for NVC to complete the review of your case, then they will send it to the Embassy.
now you will wait for the medical and interview schedule

P.S. there is also a shortcuts here to fill those forms, on NVC thread.. but I guess you won't need that co'z you may recieve your forms in a few days!
 after the completion of your case at NVC you have to wait 2-4 months for an interview

IR-1 / CR-1 Spouse Visa Process & ProceduresManila Medical Question

To all at the Manila Embassy, or anyone who might have an idea.
I just went to the Manila Web Site and punched in our case number to see if they had posted anything yet
as to Medical and or Interview Information.
When it popped up with some information, this is what came up.

Case Number: MNL200679XXXX-Edited
Visa Classification: CR1
St. Luke's Appointment Date: Friday, April 20, 2007 (12:00:00 AM)
Embassy Appointment Date: Friday, April 20, 2007 (6:30:00 AM)

I guess I was just wondering what the Embassy Appointment Date refers to.
It is posted with the same date as the Medical, and before the time posted for the Medical as well.
What is the Embassy Appointment Date and time, and what is it. Is it the same as the Medical, and just two different times for the Medical? Just trying to make sense of it as 12 AM is Midnight if I am correct. Do they really do Medicals at Midnight? I am really confused now...dont get it.
So just wondering, any thoughts appreciated.
Randy

IR-1 / CR-1 Spouse Visa Process & ProceduresChoice of Agent

I also wonder who the agent should be. I am new to the forum and I do not know what a USC is.
My fiancé and I will marry in Japan in April. Once I have filed the I-130 for her immigration would it not be best to have me as the agent?

Thanks!

USC stands for Unite States Citizen, it would be wiser to choose the USC to be the agent.
Choosing an agent is when your I-130 has been forwarded to NVC, after the approval at USCIS

Thank you!!

I am somewhat confused about the order we'll receive things. The Agent of Choice (my USC husband) will receive the DS-230 by the NVC and would have to send it to me to fill it out, right? But, I could also fill it out online, print it, and send it to him, right? Or do I have to keep it? Ahhh, confused :P

your husband as your agent will receive the DS230 forms together with the coversheet and instruction,
you as the beneficiary can now fill-up the DS230 forms online and print it out,
you can gather the other requirements now w/c you need to send together w/ the DS230,
and you will send this to your husband, as for me i send it as soon as the IV bill has been generated
so when the agent received the forms in the mail, he can send it right away..

the coversheet should be needed to sent w/ it
some generate their own...(james shortcut)

And another question:

Jame's shortcuts (generating the bar code) is in regard to appointing the Agent of Choice, right? So if we email NVC about appointing our Agent of Choice, we don't have to generate the bar code and can pretty much neglect the actual DS-3032, right?

you don't have to generate any barcode for DS-3032...
and yes you can disregard the actual DS3032 if you already e-mailed your choice of agent.

generating barcodes is for the I-864 and DS-230,
but for us we didn't do that, my husband just wait for the mails,
and as for DS230 i fill it up and mailed it to him as soon as the IV bill has been generated,
he will send it to NVC when he got the forms in the mail.

IR-1 / CR-1 Spouse Visa Process & ProceduresChoice of Agent

Actually, let me rephrase my question (I couldn't edit the post for some reason):

I have read that most people appoint the USC as the agent because it's faster. However, does the USC then have to mail the documents to the foreign spouse? As in, after my husband (USC) is appointed as the agent and receives mail from NVC, does he have to send it to me to Germany, too? Wouldn't it make more sense in our case then that I am appointed as the agent since mailing between the US and Germany seems to be working well?

Hi folks,

am I correct in understanding that after the I-130 petition is sent to the NVC we have to appoint an agent to receive further documents? If my husband (the USC) has received all mail until then, who should we appoint as the agent? Would it make more sense to appoint me (the beneficiary) so that I receive all the mail?

Please clarify. Thank you :)

it's better if the USC will be the Agent...
He doesn't have to mail you any doc's, he'll be paying the bills as your agent..
and also will fill-up I-864 forms
and you as the beneficiary will fill-up the DS-230 w/c can be downloaded on the USCIS site, then you can forward it to him even before it has been generated... together w/ other required docs

Well we dont have time or money to have her go all over the philippines to get a second copy of police clearances. I really hope only having one original will not be a problem. Plus she needs one from Austia and they told her already it takes 8-10 weeks to get one.

she don't have to get police clearance of every places she lives in the Philippines, an NBI clearance will suffice.
ask her to request 2 copies of police clearance from Austria, one for NVC and the other for her interview, she might be put on AR if she can't present it during the interview

Thanks I called NVC they said everything needs to be original except copy of passport. She stated that the documents will be waiting for here at the embassy when it is sent over. Is this true? i forgot to list a copy of her passport,
yes, the docs will be sent to the embassy,
but during the interview the CO will ask for this original docs,
she only needs an NBI clearance,
she will only need police clearance if she's been out of the country for more than six months since she turns 16 (from that country)

My wife is currently over in the philippines and just finishing up getting her police clearences. My question is when I sumit the ds-230 what do I need to send in with it? I know I have to send in copies of the police clearences and a certified copy of the marriage certificate. What about the birth certificate does that need to be a copy or original. If I send in the original doesnt she need that for the interview? Is there anything I am missing?

documents I am submitting
Form ds-230
Copies of police clearances
Certified copy of marriage certificate
copy of or certified copy? --Birth certificate

NBI clearance (true copies - indicates for travel to the US)
NSO copy of Marriage certificate
NSO copy of Birth Certificate
DS-230 form

don't send photocopies you might get an RFE,
just asked your wife to request for 2 copies each,
she will also need it for the interview all true copies not photocopy

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat is GOING ON with VSC

I applied on September of last year and I got the K-3 interview set for March 22 for my spouse and the CR1 is completed. If it takes them a long time to complete your paper, it is simply because the papers weren't filled out correctly, or papers are missing or not enough information given.

If you were married outside the US, I would recommend in case you didn't do so, to make sure your marriage certificate and birth certificate of your wife is taken to the "Minister of External Relations" of her/his country to get an an stamp that authenticates all the signatures in your certificates. And then once that's done get a translator. I have a scanner and I sent the translator a PDF of my flies to get translated, it took them 1 week to get them from them. There are agencies that will translate and notarize the papers for you.

And this is extremely important, ALWAYS SAY THE TRUTH in your forms. Regardless of your situation.

Please don't open your mouth when you have NO CLUE about our individual cases. You were fortunate enough to go through the process without any hiccups - good for you. BUT for you to smugly say that it's because "simply papers werent filled out incorrectly etc" -- what a load of CR@P. In the few cases - perhaps - but for all of us? It's not as simple as that. If there were missing info - a RFE would/should have been sent out.

And for you to imply that we did not state the truth in the forms? I can't speak for everyone but we have nothing to hide. We got unlucky and got caught in the pile. You have no idea how long it took my husband and I to compile and research for the I-130 petition. How many times it was checked etc.

So please take your ill advised narrow minded statements elsewhere. Like people here havent been through enough with the wait and they have to read some ignorant "advice" like that.

i've been always reading this section everyday... just waiting if someones got NOA2
co'z i feel sad for u guys that u have to wait that long for a NOA2

when my husband told me that our papers are at CSC, i thought that we have to wait that long...
because for the past years VSC is the fastest to forward petition to NVC...

and i agree that no one has a right to say that u did a mistake just because u waited long enough for a NOA
they just have to be thankful enough not experiencing the long wait ur in
and just support and pray for a speedy process at VSC...

hope i can read approvals on the coming days....
