K-1 Fiance(e) Visa Case Filing and Progress ReportsNovember 2010 K1 filers

Hey all I'm new to this site so just trying to get some information....I filed at the start of november and my receipt date is nov 5th. I only just checked my status for the first time at last weekend as my rubbish lawyer didn't tel us that we could so. My current status is as follows (copied and pasted)

On November 30, 2010, your document I129F, PETITION FOR FIANCE(E) was processed and mailed to the address on record. If you have not received it within 30 days of November 30, 2010, contact customer service at 1-800-375-5283. If you move while your case is pending, please call our customer service center at 1-800-375-5283.

Has anybody else had the same status at any point?? Just trying to figure out what it means as it says "PROCESSED"

It may just be my NOA1 but I guess I'm just trying to stay positive

Any help and info would be greatly received

Good luck and best wishes to you all

looks like you are on the acceptance phase. no worries, you'll soon be getting your NOA1 notice :)

PhilippinesI thought NBI clearances take a day to process?
I suggest to those K1, Cr1 et al needs an NBI who leave in a province and can travel by land to go to Manila and get your NBI here in Manila because in the province it will reall take you for a month becasue they will send it to Manila then from Manila to your province.

PhilippinesNEED ADVICE ON MY 2 YR OLD DAUGHTER
Thanks to all of your advises/suggestions/negative comments I really do appreciate it. Well, sending her back doesn't necessarily mean that we/I abandoning her. My mom raise me well even without a father for 31 years. And I very much appreciated my mom how she brought me up. I am sending my child to my mom, who brought me up well to have a good attitude and respect to other people. Yes, I am a career woman way back in the Philippines having a good and high salary, good position and working in a well known american company. For me it is just the same having your chid with or without you. It is a matter on how you raise them. Ther are parents who happen to be with their child taking care of them and look where they are now? It is a matter of how your child was brought up and raised with or without their parents.

My concerned here is the legalities of having an immigrant status going back to PI and not on how bringing up the child. Anyway A BIG THANKS TO ALL OF YOU WHO GAVE THE ADVISE I REALLY DO APPRECIATE IT. I already got the answer on my question.

This forum really a big help. :)

PhilippinesNEED ADVICE ON MY 2 YR OLD DAUGHTER

Question. Who petitioned for you? How did you and your daughter get your visas for the US. You entered on Oct. 15, 2011. You have activated your LPR status. You are turning around to leave on Nov. 5.

I suspect that you entered as an unmarried daughter of a US citizen and that's why your "husband" didn't immigrate with you. Is he legally your husband?

Did you enter the US based on an F2a family preference category as the unmarried daughter of of a US citizen when you were actually married?

Have you petitioned for your husband yet?

My husband is an american and he petitioned us legally and i am married to him for almost 2 years. I entered in the united states as CR1 stats. Did I answer your questions? So what can you advise me?

PhilippinesNEED ADVICE ON MY 2 YR OLD DAUGHTER
We came here in California last October 15, 2011. My daughter knows her daddy in video calls and pictures. When we arrived she even hugs and kiss Daddy. Apparently for the past few days, she is having different attitude and tantrums. She kept on crying, kicking dad to make the long story short she is having different attitude everyday. I can do my errands, can't work because she wants me to be with her. She wants me to carry her all day and night. Opps she's not sick. I am thinking she is still on a period of adjustment. I don't know what to do but I need to work since there are obligations i left in PI and I don't want to pass all the burden to my husband. When I left PI I am in a good position and with a high pay and I am not use to ask money from him unless needed and it is priority. My husband and I talked and we have decided to send back her back to the philippines. My question is, what are the requirements to remain her immigrant status apart from the fact that it will only take 6 months and she needs to go back here in the US. I want her alsostudy in the philippines.....and get her if she is already 5 or 10 yrs old. Please I need your advise. We plan to go back in PI on November 5.

Thanks.

Philippines221g form

what was your annotation?

My annotation was NO CRIMINAL RECORDS ON FILE. I got all the original documents sent to NVC -> USEM. They guy on the window 73 did not gave me anything but a word that they will just call me if needed else I have to wait and sarcastically told me if in the case you haven't received any from us, then on jan 2012 start your medical again and lt your daughter travel in the US first.

hi all, just confuse...what is the difference between a green card and an EAD? Will I be needing it as well? I already have my green card. Philippinescommon questions during interview

My fiancee was asked the basics, what is your finace's name, address, place of work, job title, salary.

It also depends on if either of you have been married before...I have a list of questions I used to have mock interviews with her before the interview. If you want it, message me and I will send them to you.

hi. if i may request you to send it to me as well as my interview is this coming aug.....i would gladly appreciate it.

Hi Mrs Salome, I am thinking that the delay is with your NBI. just like the other said, they're having a back ground check which is a normal process for USEM. If i may suggest you keep on calling USEM 3012000 loc 5184/5185 call them around 3-4:30pm, usually during that time they gave out status as of that day of your visa.

hi, just want to clarify..the CEMAR is our marriage certificate, am i right? im sorry im really confused about it..just want to make sure lang po..salamat :)

CENOMAR - Certificate of No Marriage - this is given to those who are still single
CEMAR - Certificate of Marriage - this is given to those who are already married

If you requested a CENOMAR and you are already married, the NSO will still issue you a CEMAR because the latest record/s they have is youre already married.

Philippinesmet once & got married
It will be surely ask by the CO. I am also on the same boat. I met my husband April 2010, got engaged May 2010, married July 2010 (his first visit here for 21 days). What I did during my interview were to tell them the truth, gave/showed them all original documents, showed pictures of our wedding with friends, relative etc attended the wedding. Be truthful of whatever questioned they asked. Is your husband filing for a CR1? Since you're married for about 2 yrs.If all documents (origina) we're complete and sent then you will not be having any problem, so as your husband. Reach out to me if you need any help.

PhilippinesCompetent attorney

An attorney to file a K1 is a waste of money. You are basically paying an attorney to put information down on a form that must all come directly from you and your fiance. I have helped a couple of people to file and they got through. You are better off just following the information on this website.

they are correct. you don't need an attorney to help you...let you fiancee do the process, and you can ask questions here as everybody here are very helpful

PhilippinesGoing Back to the Philippines

As long as you already have your green card you should be good to go. Green card holders are allowed to stay outside the US not more than 1 year.

Correct, but to ensure if i may suggest that you apply for a re-entry form as you can never tell if you will ne staying there more than you expect.

PhilippinesMedical Interview Problem HELP!!

I came to the Philippines to fly back with my fiancee. She is taking her medical interview today. They are telling some of the girls for some reason they have to wait until after their NEXT period to be able to get their vaccinations.. I can't afford to take off an extra two week waiting on this. When many of the other girls are told they can get their vaccinations tomorrow. They are giving her no reason why the need to wait.

Can anyone tell me why there would be a reason to wait until after next period to get a vaccination?

Please be specific with the issues you have in the medical. When I had my medical exam, they had me go back after my NEXT period (if this is the monthly female visitor)for my Physical Examination not for the vaccination. Are your girls finished with the Physical Examination? Since the last thing to be completed for the Medical Exam is vaccination so I wonder why.

PhilippinesBringing stepchildren here from PI

the quickest way would be for you to file now using your step parent relationship. your wife cannot file until she is here as an LPR. Even if you wife was already here, it would still be quicker for you to file using step parent relationship.
there is no permission needed for the children to leave the Philippines since illegitimate children are under the sole custody of their mother.

I agree with sunandmoon, my daughter was petitioned by my husband as her step daughter. your wife cannot petition them unless she is already a US citizen / LPR status.

PhilippinesArrest warrant issue

Would it be an issue for denial of visa if in the past was served arrest warrant? but not convicted, not even reach to court hearing and settled right away. There is a question in ds230 form question #41that made us confused because 3 intances were there in 1 question and only one instance apply to me. I guess i have to answer yes and explain my concern. But im worried if having that issue would be a hindrance to applying an immigrant visa.... Pls give some insights fellow vj'rs. Thanks.

Just tell the truth and explain. Also, if you are not convicted ensure that you have all the documents stating that the case was dismissed. You will need those documents (send the original copy to NVC/USCIS , then have an authenticated photocopy for your self). Also, double check if it is on your NBI (they call it hit) because upon interview if they see your NBI status as "NO CRIMINAL RECORD" USEM Manila will ask an explanation. Just ensure you have all the copy of the case.

PhilippinesAffidavit of Consent to Travel Abroad

Hello VJ Members,

Please anyone help me with my situation. Iam a K1 beneficiary and planning to bring my son with me to US under K2 visa. I just got annulled early this year, and his biological father is currently based in Taiwan. He has his own family and doesnt want to do anything with our son. We agreed mutually for him to signed his Voluntary Termination of Parental Rights last year, to permanently free himself from his responsibility/obligation to our son who he never give child support since 11 yrs. ago now , and never been in his life after he abandoned us same yr.

Do I still need to ask for his signature allowing my child to permanently immigrate with me to the US oneday, even if he is presently out of the country? Will the notarized Voluntary Termination of Parental Rights will be enough plus the court's decision stating his being psychologically incapacitated for abandoning us both in the past making me my child's sole parent since then up to the present time, for the CO to consider not to require travel consent letter from his bio dad anymore?

And also, I know here in the Philippines that I dont need to secure clearance from the DSWD since Iam his mother accompanying him to travel abroad, will our immigration ask for the father's travel consent letter even if I have with me the court decision and the notarized Voluntary Termination of Parental Rights from him?

Anyone who can relate to me, pls. I will appreciate your reply. Thanks in advance!

You don't need to secure a travel clearance as she/he is your biological child.

Oh, better to get a travel consent from your ex, as he is still the father of your kid, just to be safe though you have all the documents.

PhilippinesBPI savings card online

Who among you here have tried using their BPI savings account which was opened in the Philippines, and have transferred money from BPI or have withdrawn money from BPI , while you are in the US?

My parents are transferring money through my BPI account and was wondering if I can withdraw them from the US?

Thanks

At the back of your BPI Card look for the PLUS, Mastercard, STAR or Cirrus logo, if you have that, look for any bank with the same logo and you can withdraw your money here in the US, apparently there are charges for like 3-5$ for every transactions. I was able to use my BDO and BPI ATM Savings accounts cards here to withdraw and shopping. Hope it helps.

PhilippinesFilipina temper ! How you control it .
There is no right or corect answer but for me there are the factors that needs to be consider being husband and wife:

1. You LOVE your husband/wife that's why you marry her/him
2. Because you marry him/her regardles of what culture and tradition she/he may have you MUST understand each other
3. Because you UNDERSTAND each other, you should have RESPECT to each other
4. Because you have RESPECT to each you should be HONEST with one another

There is no such thing as a perfect relationship, but if you have those 4 factors there will be SUCCESS in your relationship as husband and wife.

Translate: According to my Mom and Dad if husband and wife had a fight, do not pass a day not resolving the problem, resolve the problem before bedtime and that resolving the problem, husband and wife will have a deep sleep, smile on their face and hugging each other.

PhilippinesPhilippine debt
Having a debt in the the Philippines no matter how big it is will not hinder your petition with your spouse, fiancee etc as long as:

1. You communicate with the loaner to pay your debt even though you will no longer live in PI
2. There should be no criminal case filed against the debtor. If there's any, check with RTC or MTC of your location. Get all the documents needed, and have arrangement with the loaner
3. There is no check involve, if there's any it should always be a good check and never overdraft or bounced (this is BP22, can be a criminal case)

Please take note that if there are case's filed against anyone, it will reflect on your NBI (which is a requirement for the petition)and will result to 221g( correct me if I am wrong) during visa interview.

I suggest, just ask him if there's a problem with his debt, does it settle, if there's issue and cases filed etc, if none there will be no problem. If he wants to pay for it, then before he leaves PI he should have a PN for his debtor so there will be no problem.

Hope it helps.

PhilippinesBanking In The Philippines
Go for BDO, PNB, Metrobank or BPI. They're very credible in terms of remittance and online banking. If you're from Catbalogan here's the BDO address.

Samar - Catbalogan
Del Rosario St. cor. Allen Ave., 6700 Catbalogan, Samar
(055)251-5477251-5541356-1706(02)702-6000loc. 52246
Fax: (055)543-9110
8:30 - 5:30 PM Mon - Fri

I had a checking and savings account before with China Bank, it's really hard to deal with them esp if you're into online banking. If there's a problem with your bank account, you have to go to you're branch of account. With the banks I mentioned, they have remittance center in the US.

Hi,

Visit this site for the requirements. It is helpful as me and my husband married in PI before he petitioned. Wedding Requirements

But in our case, my husband did not wait for 10 days for the application. When he arrived in PI, the next day we went to Manila US Embassy for the Legal Capacity (just don't remember if we got it the same day), after getting the the Legal Capacity, 2 days after we got married :).
