The OP, can get cover under the Affordable Healthcare Act, if they do not have an insurance policy through work. We have cover, and earn well over 125% of the poverty level. 

 

I think the subsidy/tax benefit is for households making up to 400% of the poverty level.  If the households makes more than that, you can still get coverage, it will just be at full cost. In the affordable health care act - everyone must be covered by insurance - its just that through the marketplace if your income is below certain levels you basically get an offset and are not required to pay more than a certain percentage of the household income.

 

Low-income individuals and families whose incomes are between 100% and 400% of the federal poverty level will receive federal subsidies on a sliding scale if they purchase insurance via an exchange.Those from 133% to 150% of the poverty level will be subsidized such that their premium costs will be 3% to 4% of income with the sliding scale going up to 9.5% for families incomes at 400%. In 2013, the subsidy would apply for incomes up to $45,960 for an individual or $94,200 for a family of four; consumers can choose to receive their tax credits in advance, and the exchange will send the money directly to the insurer every month

Oh that is wrong,  Yikes.  The other possibility is that they were truly clueless and making things up, or trying to scare you, or whatever.  Unfortunately, they are the judge, jury, and executioner for entries.  You could call CBP and ask them for their rules, but if the border agent has any inkling that the visa will be misused, then they have the final say.

 

I am sure it hurts and I am sorry.  Rest assured it won't matter for your fiance visa.  Best of luck.

 

OP - sad to hear that you were refused at the border :(  However what Harpa has mentioned is correct....unfortunately the entry is left in the hands of the CBP and if they are misinformed or have any reason to think that you are intending to immigrate they have all the authority. Not that it helps, but at least they were nice to you....

 

Thanks for posting your experience so that people can see both sides of what could happen crossing the border with pending visa's.  While many people have have not had problems with this it is important to be aware of potential issues/refusals.

 

Hopefully your visa will go through quickly and this will just be a small hurdle on your way to spending the rest of your life with your love!

Some states are more lax than others with requirements, but as far as requirements for your visa it does not matter where you get married in the states.

 

We got married in Vegas - could not be any easier! Lucky for me, I have family there, so it made it a really fun trip smile.png Vegas does not require much - basically proof of identity and then you pay the fee and get a licensed minister to perform the service and file the paperwork. They also have have pre-applications for marriage license that you can fill out online.  We did this - so basically we just walked in, they printed out our application we already submitted online, verified identity with a photo ID (his passport/canadian drivers license), paid $65.  We spend less than 10 minutes getting the marriage license.  We had the ceremony scheduled for the next day and that all went smooth as well.  The company we used was so great!!!! We ordered copies of the license and received them about 10 days after the wedding.

 

Edit: Oh yeah - Vegas requires a witness. Most licensed ministers provide this service either included with the ceremony or for a fee. Our whole ceremony/pictures/witness was $129 for everything.

My husband and I got married within 9 months of meeting and we didn't have any issues at all.  Our biggest concern was proof of relationship but we just followed the guidelines and submitted what we could.  Sounds like you are covering those bases by visiting and such -  just keep documenting your relationship/travel/communication and you should be good :) Congrats to you both on your engagement!

As long as you get married within the 90 days in a state that allows same-sex marriage - that is AOK.  Once you are married in the US, you can live wherever you want (even if the state does not allow same-sex marriage).  It is fine that you are not planning a big ceremony - just that you are getting married and will have a valid marriage certificate to submit.

 

For instance, my husband and I got married in Las Vegas - no waiting period - did not need to be a resident/citizen of the US - just pre-ordered online, picked it up at the courthouse and then we had a minister that did a short little ceremony and he filed the paperwork with the courthouse.  It was just my husband and myself -  literally was done within a couple of hours. 

 

Just be honest in your interview that at the moment you don't have a big party planned.  There is nothing wrong with that.

 

Also, unsolicited opinion:  I would recommend deciding on a city/state of where you plan to get married so that you can give an honest answer about that in the interview.

Yes, you have to get married in the US - within 90 days of the beneficiary crossing the border with the K-1-

 

The K-1 visa is a one way/one time entrance to the US for a fiance.  Once the beneficiary crosses the border into the US, they can not leave until they have adjusted status - which is after the wedding.(*Technically they can leave, but they can not come back into the US on that same visa and you would have to start the whole process again as a new visa).

 

Since K-1 is a fiance visa and not a spousal visa, marrying in Canada and then using the K-1 to enter the US would be fraudulent.

 

My story - my Canadian husband and I got married in Vegas just us for the marriage. Then after he got his spousal visa we had a wedding party with all his family in Canada.  This was celebrating our marriage, getting the visa and being able to start our new life.

Well September 20, 2011 was our schedualed interview. It was a couple of hours of nerves, heat and success. We got approved. My fiancee was told at the clinic that not everything was ready and that he had to come back a week later. He did and he was sent to the pshyciatric Dr and then was told the clinic would call him and then tell him to pick up the packet. Still waiting very nervous because I dont understand wat is going on. My fiancee said they asked him questions during the exam could something backfire. So close but yet so far. Please post if you have any idea wats going on!!! Thanks

I don't know if this helps but I got a RFE cuz my marriage certificate was in English & not Hindi. My original marriage certificate was drafted in English & therefore I sent that in. So I don't understand why they would ask me for a legible copy with foreign language in it?

Anyways coming to the point, I think you should sent in both copies incase you end up getting RFE like me, but my case is slightly different cuz I don't have a marriage certificate that was issued in Hindi. So I just replied them with another copy & got it notarized stating it's a true copy & explained them that the original is in English language only.

Available. Yes, my MC (marriage certificate) was issued by the Registrar under the Hindu Marriage Act of 1955 (I'm buddhist btw). However, my MC was registered in the capital city (Delhi) & issued to me in English. Therefore, I thought I need to submit a copy of that in I-130 stage & at NVC, I would submit the original. They sent me RFE stating I need to submit original copies & along with translated MC in English. I wrote them a letter explaining, my marriage certificate was drafted in English Language & the copy I'm submitting is the original. I even got it notarized. I'm waiting for their response.

Hey guys, 

 

So I filed my I-130 for my hubby in march. I submitted all the documents that they listed on their instruction list. I just received an RFE that stated: 

 

"You must submit a photocopy of the original foreign language MARRIAGE CERTIFICATE AND  a new full English Translation of that document. This must be a complete translation of the original documents in its entirety. Extract or summary transaction of the original document are not acceptable. The translator must certify that the translation is complete and accurate, and that he or she is competent to translate from the foreign language to English"

 

Now, the problem is, I have what is called a FORM "B" Register of Marriage Under the Hindu Marriage Act, 1955. The certificate is drafted in English so I naturally thought that I have to send in the photocopies of that Marriage Certificate. I don't know what to do anymore. At this point, should I just hire a lawyer (actually I work near a law office & they have offered to help me with some discounts) or Shall I just go ahead & reply to that RFE myself. If so, How should I go with that? 

 

 

Any help or input would be appreciated!

I did the same thing. Checked everyday after I received email confirmation. I think my case update showed 15-20 days after I received my NOA1. So I would suggest to wait some more. Maybe another week?

I am not sure if it's right but just my point of view-

 

I think your lawyer asked for 2nd original copy just in case when NVC ships your documents to the U.S. Consulate in your country, they are afraid that it might get lost or misplaced. The "2nd original copy" is just a back up. As to how you can get it would depend on where it was issued. Ask your sister to go back to where her Birth Certificate, Marriage Certificate was issued & ask them for a certified copy (which holds the same value as a original document)

my rfe was recevied by USCIS on 6/17/13. i forgot to send in my blue cover sheet so i sent it late then they update the system with 7/17/13. now it has been more then 60 days i have not heard anything from them. i put in request they email me saying they working on it. what should i do. is there a major problem with my case or package?
