IR-1 / CR-1 Spouse Visa Process & ProceduresTranslating PCC.
QUOTE (yohino @ Nov 2 2009, 08:48 AM) <{POST_SNAPBACK}>
Hey guys!

So,I just recived my PCC that I requested from Germany and I know I'll have to have it translated in to english, but does the translation need to be done by a practising, certified translator or can it just be someone I know is fluent in both languages? Like an english/german teacher?
The traslation shouldn't be to hard to do,I could translate it myself but I guess it looks better if a third party does it.

Thanks for your answers!
Best wishes.

I WAS TOLD IT HAD TO BE A CERTIFIED TRANSLATOR ....WE HAD OURS DONE AT THE COURTHOUSE BUT MY LAWYER RECOMENDED A FEW

IR-1 / CR-1 Spouse Visa Process & ProceduresInterview Approved.. but no visa???!!??!!

I was wondering if anyone is going through the same thing... I have searched and searched and havent been able to find anyone in my situation... here it goes:

Husband had his interview in New Delhi on the 27th of May. I was able to attend the whole interview with him Posted Image I watched the whole process.. finger prints, pre-interview <checking all our papers> and then finally the interview.. The Lady who did the interview made us both take the oath... and then she preceeded to ask me the questions... very simple like how we met... bla bla bla.. then she wanted to see some photos... then she looked at me and smiled and said I want to wrap this up really fast so flip quickly... so I did... while I was flipping she asked me if my family attended the wedding and I gave her a great big smile and said yes, they attended via web cam mom, dad, brothers, aunt uncles and grandparents... here let me show you... I fliped to the couple of pages where you could see my computer and web cam in the wedding ceromony... she started laughing and said I have seen enough... she scribbled some things on the file of paper work.. and then said congrats you are approved you will have your visa in 1 week... I then asked her if it would be ok to pick it up at the VFS office.. she said sure no issues with that... then we left on cloud nine Posted Image she didnt hand us anypapers/slips nothing... we just walked out smiling

Sooo... From the VFS website and other ppl I have talked to I know that within 3 buisness days we should of been issued the visa.. when this did not happen I called the embassy and talked with a guy... and he told me that we were put on AP.. I was like what!!!! I couldnt think..so I let him go... collected my thoughts and called them back.. <I think this is what irritated the next lady Posted Image > This reallllly rude Indian Lady is who I talked to next.. I asked her about hubbys visa and she again told me that we were put on AP... I asked her why the Interviewer told us that we were approved... the Lady said that she didnt know that they were going to put him on AP... then I asked why wasnt he given any slip or paper.. no 221g nothing... she said she couldnt disclose this... I then asked if the embassy puts everyone on AP she said no only a few.. I asked her how the Embassy would contact us if they needed any additional information or to let us know about the visa and she said that I would come to know.. I could see that I was getting nowhere except on her last nerve.. so I asked her how long should I should expect my husband to be on AP, she said that normal is 4-6 weeks and that I could call back next week to check on the status..... so now I sit in the firey pits of hell... I meant in India at a nice guest house... Posted Image confused..

sooo please direct me... I know that I might never know what this AP is for.. but I have racked my brain.. if they were doing a name check.. my god wouldnt you think they would have already done that? Background checks.. I mean ugggh.. I really wish the Lady doing the interview wouldnt of smiled at me and said "Congrats you are approved" it is kinda like a horror film.. the smile and the voice is even comming in my dreams!!!!

as I am writing this Hubby is singing..... "You're stayin' alive, stayin' alive.Feel the city breakin'And ev'rybody shakin'
And we're stayin' alive, stayin' alive.Ah, ha, ha, ha,Stayin' alive.Stayin' alive.Ah, ha, ha, ha,Stayin' alive.
Well now, I get low and I get high. And if I can't get either I really try" gotta love the freaking BeeGee's!!!!

There is an ap forum .It is under wavers and administrative processing. There u can find the ap forum and add you name to the list of ap people....And get more information on background checks and ap..

K-1 Fiance(e) Visa Process & ProceduresI-129F Packet question?
QUOTE (Jessica&Carl @ Oct 26 2009, 03:16 PM) <{POST_SNAPBACK}>
I'm getting ready to put my packet in the mail, but I have a question about it.
All the things say that you need an EXACT copy of the packet you send in, fine. What I need to know is do I put original receipts and boarding passes in the packet that I send to the service center, or do I make copies of them and put them in so that each packet has copies. Does that even make sense? I guess what I mean is, is it okay to have one packet with originals and one packet with copies because then they're not exact? Am I taking the "Exact" thing to literally? I just don't want to have to make corrections and for this process to take longer! Please help!!! ohmy.gif
And one more thing, who do I make my check out to when I finally send in the packet, and where in the packet do I put the check? Should it be just right on top?? I'm nervous and don't want to mess this up. My fiance and I have been apart for so long now, I don't want to make it longer by filing the paperwork wrong. I'm really appreciative of everyone's help! Thank you so much!!!

send copys of you reciepts and boarding passes....keep ur original for your interview..........

As long as he is legally residing in Sweden, there should be no problem with the US embassy in Stockholm processing his visa application. If he's an asylee from his home country, he may run into problems obtaining required documents from there, but that's a whole other can of worms.

he is legally residing there and got a letter from immigration saying so but they want like swedish id or something from tax office saying he is resident but because he isnt permenant resident he isnt registered with tax office

We had this same issue with our noa 2. But i contacted senators and congressmen. They sent on formal inquirys and within 48 hrs ours was sent off to the embassy where we now have been since nov. Had interview on Dec.14th and was placed in ap.4 months later here we sit.My fiancee was living in sweden. We lived together for 8 months there in sweden. The embassey had him go back to Iraq, where he now wait for them to finish our ap in sweden before they will even transfer our case to baghdad.Where we might be subject to another interview and more ap for all i know.I know it has alot to do with where Alen is from. I have learned to take it day by day. Some days i need him to cheer me up because all i do is cry.Other days i have to cheer him up.Good luck on your journey and i hope it goes fast for you.Women arent ussually in ap as long as men.Why not fly over to Turkey or some country close and have her get a visa to come over and visit you while you wait?Good Luck

K-1 Fiance(e) Visa Process & Proceduresfiling i-129f for an asylum seeker

Hello, please help...
I am a US citizen, and my boyfriend lives in United Kingdom and he is an asylum seeker (...he is an Armenian citizen). Does he have to go back to Armenia in order for me to file i-129f? should i file i-129f or is there any other form
i called a lawyer and he is charging $5,000 for it. If it is something i can do, i rather do it myself.

Hi Anna,My fiancee was an assylum seeker in sweden he is Iraqi. He had to go back because they denied his assylum. But as long as he is legally in the uk.Has residency then you can file there. But whom ever this lawyer is omg hes nutz. Just file the paper work your self i hired a lawyer for half that but ended up doing most of the paperwork for him.If you read the k1 info on here you can handle it.Just make sure you have all you documents translated to english.Good luck Bridget

K-1 Fiance(e) Visa Process & ProceduresK1 NOID's at California Service Center

Looks like CSC may be changing...Here's the exact info from CSC that my Senator's office received:

"9/9/2010

I just received the above file and forwarded it to our adjudications unit for review. I will send you an update when the review is complete. Thank you...."

Then I received an email that my case was updated with USCIS:

Post Decision Activity
We reopened this I129F PETITION FOR FIANCE(E) on September 13, 2010, and are now reviewing our earlier decision. We also mailed you a notice describing the next steps in the process. Please follow any instructions on this notice. Our review should be completed within 30 days. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

Has anyone else received anything like this? For more info on our csae see below. Hope everyone is having a smooth journey. I believe it is also important to note my Senator's office involvement has been very strong in our case. Its seems like not so many are. I think that may make a huge difference also.

Monica :)

MONICA,I LIKE YOU FIND THIS CONFUSING. We my fiance was sent a letter from the consulate sayin we were denied and our case would be sent back. we emailed a request that a senoir officer review our case before it was sent back . As of june our case was denied and has never been sent back . uscis still says it isunder ap. And the consulate doesnt respond to our emails. I have no idea how long the consulate can sit on it before they send it back.we got our notice of denial in may saying we had one year to respond. I have no idea what to do. Should we refile or what our case has been . I have no idea if they will send it back or what.

just wanted to check in with all of you on ap and those of you who finally got your loved one home ...congratulations...since appying in aug. 2009 our case was denied at the embassey and returned (129f).I guess in march i will fly to lebanon to be married and try to refile. This has been a long learning process and we still have many months to go. Our jouney has been a long one but in this journey we have learned to lean on each other and take things day at a time. we will be together in time. each day passes ,is one more i lose with the one i love . but i have come to believe that god has set us on this path and we must travel it and endure to be together. each step is not one day lost but one day closer to the day we will be home together at last. this has not torn us apart but brought us closer as a couple and made our love stronger. If i live my whole life running between to countrys to be with this man i love so much ,i will count each day a blessing i had with him. good luck to you all. i pray each of you find your happiness....

Hey Bridget and yes you are still on AP until you submit your evidence and / or file your appeal and the case is processed or closed I know you wont give up and you will get through this its just a big hurdle that takes time to jump over it but you will. I got an email from someone else today and their case was reaffirmed so hang it there.

And no new news for us as usual the Ukraine Embassy was closed tuesday another holiday and they will be closed friday so I see nothing changing for us in the near future LOL and then they will be closed for labor day

Sounds like its a done deal!!! Congratulations

Well seems rhe embassey really email me back. I was so surprised. They said would it be possible for Alen to come to another interview with the consulate. I told them he could reinterview in Baghdad or they could speak with him over the phone. That he wasnt in Sweden but had to return to Iraq. No anser as of yet but seems they are relooking at our case. Fingers are crossed...

I have requested a senoir officer or the consulate review it and allow us to send whatever evidence we might have to the contrary. The dos still says we are on ap. hahaha ,after almost two most since we get a letter stating we are denied. Hopefully the consulate will review our case.

Lostinlove03 and Amit-N-Melody

I think you both could think of a few more intimate things to spice up the homecoming ........

Lostinlove03 tonight will be a long night but get some rest tomorrow will be a very long day Im sure you have a ton of catching up on and thanks for all the good wishes

To all the good people on VJ Im very sad to say I dont have good news. I feel like Im sinking down into a dark pool of water but just to let you know Im not exactly drowning yet. My husband went to the Embassy with all the requested papers and photos. He was interviewed again like it was the first time the interviewer didnt realize this was a reaffirmed case. At any rate she asked for a signed I-864 in blue ink by me. Now I have to send him this piece of paper by FEDex at the cost of $157.00 and he has to ride a train for 10 hours to put this paper in a drop box at the Embassy. The sad thing is we all know they have the signed I-864. So now I am wondering as always Whatznext. However after I got this piece of info I called DOS to see what they said. She said he had his interview so what exactly do you want to know. I explained the I-864 she sad she understood my point that they have to have it but that is the info the Embassy is requesting at this time. It disgusting to think we have such incompetent people working at the Embassy. Anyway bottom line is no visa yet

Kevbev09 congratulations LOL I guess some Embassys are better than others Keep us posted on the date the visa is issued.

Amit-N-Melody I might have missed it but do you have a arrival date for your husband yet???????

awwwwww im so sorry . the good news is maybe they will issue his visa as soon as they get this info.i know it is upsetting but dont give up hope. im tryin my best not to but im at a loss for what to do .good luck....

"Dear Mr. XXXXXX,

Thank you for contacting my office with your matter. I have contacted the United States Embassy in Montreal on your behalf, to which I received the response, "I'm following up with great news that the admin processing has been completed on this case and Ms. XXXXXX is being issued her K-1 visa." I hope this information will be of help to you.

If I can be of further assistance to you, please do not hesitate to contact my office again."

Soooo stoked.. after 14 weeks.. I can't wait til I have the visa in hand.. so sure something else is gonna go wrong or there was some mistake by the senator  would be great to have it on Friday though since we are already heading towards my fiance's on sunday for a family thing (in canada though).

Seems like a good week, hope it is one for whatznext too!

Bridget did you get a copy of the letter? Did you call the Embassy to see what they have to say The Embassy didn't even have to give the reason and if they will not discuss it with you there is nothing to do except wait and see what USCIS says. I know how upset you are. But just try and calm down until you know what you are up against. I went 10 months with out even a small idea of why our case was sent back. You should have read some of the post and reason that were given to me from our very own VJ members and I must say they were not very supportive but we are here to be with you and hope to help you through this.

I know it just so sucks. I really use to believe in my government ha...What happened to not guilty til proven. guess that only counts if ur not trying to immigrate. Im just so sad. I miss him so much but we are not giving up. Please pray for Alen and i we are just both so heart broken.

212 a, 3 B is a serious denial

http://www.golishlaw...utes/ina212.htm scroll down to the subsection a, then 3 then B...

(B) Terrorist activities-

(i) In general.-Any alien who-

(I) has engaged in a terrorist activity,

(II) a consular officer or the Attorney General knows, or has reasonable ground to believe, is engaged in or is likely to engage after entry in any terrorist activity (as defined in clause (iii)),

(III) has, under circumstances indicating an intention to cause death or serious bodily harm, incited terrorist activity,3

(IV) is a representative (as defined in clause (iv)) of a foreign terrorist organization, as designated by the Secretary under section 219,4

(V) is a member of a foreign terrorist organization, as designated by the Secretary under section 219, which the alien knows or should have known is a terrorist organization,4

is inadmissible. An alien who is an officer, official, representative, or spokesman of the Palestine Liberation Organization is considered, for purposes of this Act, to be engaged in a terrorist activity.4

(ii) Terrorist activity defined.-As used in this Act, the term "terrorist activity" means any activity which is unlawful under the laws of the place where it is committed (or which, if committed in the United States, would be unlawful under the laws of the United States or any State) and which involves any of the following:

(I) The highjacking or sabotage of any conveyance (including an aircraft, vessel, or vehicle).

(II) The seizing or detaining, and threatening to kill, injure, or continue to detain, another individual in order to compel a third person (including a governmental organization) to do or abstain from doing any act as an explicit or implicit condition for the release of the individual seized or detained.

(III) A violent attack upon an internationally protected person (as defined in section 1116(b)(4) of title 18, United States Code) or upon the liberty of such a person.

(IV) An assassination.

(V) The use of any-

(a) biological agent, chemical agent, or nuclear weapon or device, or

(b) explosive or firearm (other than for mere personal monetary gain), with intent to endanger, directly or indirectly, the safety of one or more individuals or to cause substantial damage to property.

(VI) A threat, attempt, or conspiracy to do any of the foregoing.

(iii) Engage in terrorist activity defined.-As used in this Act, the term "engage in terrorist activity" means to commit, in an individual capacity or as a member of an organization, an act of terrorist activity or an act which the actor knows, or reasonably should know, affords material support to any individual, organization, or government in conducting a terrorist activity at any time, including any of the following acts:

(I) The preparation or planning of a terrorist activity.

(II) The gathering of information on potential targets for terrorist activity.

(III) The providing of any type of material support, including a safe house, transportation, communications, funds, false documentation or 5 identification, weapons, explosives, or training, to any individual the actor knows or has reason to believe has committed or plans to commit a terrorist activity.

(IV) The soliciting of funds or other things of value for terrorist activity or for any terrorist organization.

(V) The solicitation of any individual for membership in a terrorist organization, terrorist government, or to engage in a terrorist activity.

(iv) Representative defined.-As used in this paragraph, the term 'representative' includes an officer, official, or spokesman of an organization, and any person who directs, counsels, commands, or induces an organization or its members to engage in terrorist activity.

When they did thier namechecks or background checks he came up in a big way IMO... whether they are right or wrong in thier decision of terrorist ties it will take a great deal of evidence/legal skills to get through this hurdle.. it will have to be addressed to ever get him a visa... when they send the case back to USCIS this must be addressed.... I am so sorry to see that this is what they came up with.. best of luck... and I am hoping you made a typo in your post and it was not 212 a3b

No i didnt post wrong. It is that. But no he has never even had a speeding ticket. He is christain and has never been in trouble ever. But if you read our interview info 3 weeks before our interview the embassey had a call from someone threating them. Alen was the only Iraqi applying at the time. He was questioned by the police as was everyone else whom they could find whom had called the embassey that day. he let them take his cell and examine hes numbers and calls on it. He was never arrested they told he was free to go and they knew it wasnt him it didnt make since for him to threaten the embassey he was tryin to imigrate thru. They also gave him his phone back. omg it makes me so sad that people can just make up there mind someone is bad because of his origin or the color of his skin.im so sad

Yes they say AP depending on who you talk to some people will say the case was returned for additional processing call USCIS but we know that is useless. Until you receive the letter from USCIS it is still under going AP. AP is a term they use loosely

:bonk:Is it just me because im in and out lately or is know one getting off ap lately. These people need to get off there butts and off vacation and get to work. lol.....we are all waiting waiting waiting.......

Okay here goes I called DOS on Friday the 9th and spoke to Chris he told me your case is pending AP I tried to pick him and he would just say the case is in AP. I called on Wednesday the 14th and spoke to Katie she said on they are just waiting on an interview date its summer and they are busy with other visas I can tell she is looking at the first screen and I said You know its been 2 years and Im getting a little confused as to why its taking so long. She said mmmmmm wait a minute she apologizes and tells me she was on the wrong screen she says its in AP they are working on it and I said how long will this go on she said oh! oh! they sent a letter dated Thursday the 8th requesting a new medical, police report, DS230 and new photos Im in shock and I tell her thank you and hang up. So I tell m husband to schedule a medical we have the police report and to call the call center and see if they give him an interview date( Ukraine has a call center you buy time to talk to them $12 for 8 minutes) They ask for his case number and tell him his interview is August 18 So now I have still not heard from the Embassy and neither has my husband so Im not sure what he is suppose to do. Im just hoping that the call center would not give him a date unless it was cleared by the Embassy to do so. I called DOS today and spoke to Brian he told me the same thing I told him my husband didnt get a letter and he said they also sent me one so Im waiting for mail from Ukraine LOl in the past they have always sent emails why not now. At any rate it seems to be moving forward.

wooohooooo sounds like things are finally moving forward for you....congrats....

Thank you for your reply, SO, I guess he will just take his chances and I will report pack for others that might go through AP at the New Delhi Embassy.

This process has confirmed my sneaking suspension that I am a control freak... via the withdrawal symptoms that I have been experiencing.. <sudden out burst, crazy emails at 1am to the President of the US, posting weird pics that only I laugh at,angry replies on VJ to innocent ppl>

All the statistics that I have looked at were so sporadic that I figured my case could of been finished from 1 week into Ap to over a year... not to mention in WhatzNexts AP Tracker ppl from India had the highest number of denials :(

Thank you for your encouragement... to think that it would only be 1 to 2 more months is exciting...

I am also a serious control freak so this whole process has been hard for me because there is no way you can control this.I have gone form anger to crazy to sadness to depression then finally now i am at acceptance. Ok so u might think this is funny but i use to work at a drug rehap. And its kinda like aa and na. Step 1You have to admit you are powerless to control our journey, the dos and the embassey. Thats the hardest step. for me and you for sure. Step 2.Believe that a power greater than ourselves can resort us to sanity. and so on.....Its called the 12 steps to recovery. I seem to be better after seven months of Ap. I have had to find a creative outlet for my crazed energy from nerves because i was having problems with a bleeding ulser from worry. So i opened Shutup&drive. It is keeping me so busy i dont have much time for going insane waiting. i miss Alen so much . The other half of me is missing but i must go on and do this so im ok and it will give us a great income. He want even have to look for work when he adjusts his status because i will have a job at our business for him. It takes alot to open a state approved driving school but it is very lucritive. So if you are so crazy from worry and not being able to control this. Do you work? Have hobbys? try and find something you can do to take you mind off the wait. It really has helped me alot. And i have ocd and am a control freak....

A writ of mandamus to my understanding would NOT be for us right now... it is for someone that has spent an excessive amount of time waiting... i am sure we have heard all the operators tell us... well it could be 2 weeks it could be 6 months or even a year.... What I havent heard them say is that it will take 2 -5 years ... ya know... so I would think after the one year mark that we could think about filing one... it is basically you sueing the government.. it sounds glorious and most of what I have read has been the lawyer sending the embassy a letter of action with 30 days to respond.. and most of the time <except in this 1 indian case I was reading> they get the visa sent out pretty quickly.

i am feeling kinda numb today...

Awww im sorry. It is hard at first then after a while you just become use to the fact that you are at thier mercy. It has been 7 months of ap so far with us. We filed july 28th of 2009. The waiting stinks. I was lucky i got to live with Alen til dec. But he had to return to Iraq and i cant go there. I miss him so much. But have been trying to spend my time getting a new business up and running. That in its self will make you crazy. So i just added to my stress level. What was i thinking. Lol.... I know we cant really go together and file suit against DOS but it stinks that we have no rights or they dont have to let us know what is going on. I think they should have some sort of deadline to finish AP. And if it cant be completed in that time they should have to let you know why or give you some sort of idea when it ill be finished. It is wrong to make people wait years to be with there loved ones.

I have written letters to fox and cnn and got no response. Im not sure if or how to go about trying to make a change in the system. Mabe research senators or congressmen whom want immigration reform and try and go to or get a congressional hearing. There needs to be change. But i have no idea how to make it happen. Most people dont want to help immigrants they dont want more immigrants so why help us. It sucks . We are all suffering but seem to have not to many options for help. we are coming up on 7 months of ap.

Well I had my Joke of Week I called the dreaded DOS. Depending on who I talk to my case was.....
received at the Embassy May 12
received at the Embassy May 14
undergoing security checks
waiting for an interview date to be scheduled(does that mean it takes 6 weeks to schedule a date)
the famous its still pending
or its under Administrative processing
all your papers will have to be updated the Embassy will let you know what they need (When?)
when it is reaffirmed they have to update the seurity checks
My question to them today after all these different response was What is the last entry date you show her response was May 14 when the Embassy received it so what the heck? she said
feel free to call everyday......I guess she felt sorry for me

well if anybody deserves to get out this ap forum it is you. Im still praying for you.Hang in there......gonna happen soon ,i just know it...
