Passport arrived 9am this morning with Visa inside, almost exactly a week after I attended the interview (so 5 business days).

If it was something specific like that why wouldn't they just tell us that was all that was missing? Especially if we asked?

We hired an attorney..this is clearly unacceptable....if necessary I will go to our congressman...

We had all necessary docs there is NO reason my fiance should have been denied his visa...unbelievable...

Hi sorry for the delay. I am the petitioner who will make an estimated 24K-26K a year. I included a letter from the company I work for on company letter head paper signed by the manager. It stated that my position was permanent and full time including my earnings per week. I also included 2 recent pay stubs. (I also have a small part time personal assistant job as well), however because I had only worked a few months here in the US and not a full calender year we in addition provided a joint sponsor. He has 2 children and his wife works part time. So total including my fiance that would be 5 people. The sponsor is a US citizen. He has worked at his company for 5 years. His gross adjusted income for 2011 was 65K. We submitted 1040s and w2s from 2010 and 2011. A recent pay stub. We also included a copy of his US passport and all necessary documentation- My fiance is in the military in Italy and has been so for 11 years. He has supported himself for more than 11 years and has never depended on anyone other than himself for support. I have contacted my local congressman and am considering hiring an attorney. We do not have much money but if we have to resort to the attorney then we will do so. I hope someone can help me understand this refusal. Or give some suggestions before we hire an attorney. By the way, the refusal was for public charge and it was on a white sheet of paper. Thanks for any help or guidance you can send our way!!

My fiance is an Italian citizen and he had his interview today in Naples. He was not denied but given a white slip and they said he has 90 days to rectify the situation before denial- He told me that they said he would be a burden to the US government with the financial documentation we had provided. I lived with my fiance in Italy all of last year and was supported by my fiance while in Italy . I returned to the USA in August 2012 and found a job in September. My pay at the time was above the 125 percent of poverty level. I was offered another position the next month with a different company and took that job as the pay was better and had larger commissions. I make $500 per week gross at my new job. I included three pay stubs and a letter from the company stating my salary and that I was indeed a full time permanent employee. I also included a personal assistant job that I have that pays $200 a month with a letter from the person I work for stating the amount I make and that this position is also permanent. Total per year is $26,400. We also have a joint sponsor who has been employed with his company for 5 years and makes $60,000 plus per year,has a 401K, and real estate owned with his wife. He has two children and his wife works part time. We had all documents required from 2 years back 1040s, W2s, bank statements from 6 months back,and 2 recent pay stubs. My fiance also has his own home, he does not rent or live with his parents. How is it possible that my fiance was denied a Visa with this amount of money and the joint sponsors job stability? I am so upset as they told my fiance in other words,he needs a big sponsor who makes a lot of money in order for him to get his Visa. We tried to do everything right as the government would want us to and did not do the usual, get a tourist Visa and marry in the USA and apply for a spousal Visa. Now I wish i listened to those who warned me of this fiance Visa. Before getting an attorney I wanted to hear from people on this forum. Can anyone advise us on this devastating situation. Married life is pretty wonderful but it's definitely an adjustment. I'm not used to having zero time to myself and the whole quest for more independence thing kicks in every once in a while with Sebastian not being able to drive, work, etc. His EAD was approved last week but he's having a really hard time finding a job. But we're toughing it out!

Sorry I've been MIA for a while- nursing school is getting the best of me. I'm so glad to see all the good news in here! Marriages and apartments and jobs and cute babies smile.gif. As for us, our AOS process is going really smoothly so far. I can't believe how fast things are moving! Sebastian is having a really tough time finding a job though. There are no technology jobs here at all so 2 months later, he finds himself applying to work at pet stores and pizza shops. Hopefully something comes through.

Sebastian bought health insurance from assurant and it was under $600 for 6 months of coverage. It's not great for prescriptions or checkup visits, but it's there in case of an emergency and we couldn't really beat the price.

2008 taxes don't have to be filed until April 17th, so 2007, 2006 and 2005 are sufficient. I won't be filing at all this year since I haven't worked and my cosponsor hasn't filed her 2008 taxes yet, so that's the most current information. That's my understanding, at least!

As mentioned earlier, we did not complete the I863 vaccination form but are having it, along with the TB test results, available in case of an RFE. Neither of us have been married or convicted of any crimes, so if you have been, you may have to submit stuff pertaining to that.

PB&Jam- You just need the passport photos of the UK beneficiary. The London embassy photo booths but Sebastian says he's not sure how much they cost, or if they even work. Any place that does passport photos can make them 2" x 2".

ErinMeetsJohnny- The $1010 is the total cost of the AOS + EAD so long as you file for them at the same time. The flu and pneumonia shots are only required if you're over a certain age (I forget the exact number, I want to say it's over 65?).

USCIS Update:

The man on the phone said it's all up to the discretion of the person reviewing our file. He said lately many people have been asked to require the I863 and many have not. Same with the tuberculosis test. He said not to mail anything at all in unless we get a request for it, as it will likely never make it with our case.

So we'll wait and see!

Thanks for all the info Talyss! I didn't consider that some people don't have the DS3025 to submit with their application, I figured everyone did. I agree that there seems to be conflicting information on the I693 and if you look in the stickied thread about vaccination supplement forms, it seems a few people have been RFEd and asked to produce it plus their TB results. These new rules came into effect in July 2008, so we're among the first people to go through AOS since it's been implemented.

All that being said, we've already mailed our packet out with just the DS3025. We're going to pay the $30 to have Dr. Arnold transcribe the form this week and have it ready just in case we get an RFE. If we don't need it, we don't need it. Still not sure what to do about the TB test results, but I'm going to give USCIS a call and ask if a Civil Surgeon has to perform it, or if any physician can. Oh, immigration!

Unfortunately, it looks like the TB test is required for all of us? Maybe I'm misreading something, though.

From the USCIS website:
"The new TB testing and treatment requirements became effective on May 1, 2008. However, CDC allowed a 30 day grace period. Therefore, any medical exam that takes place on or after June 1, 2008 must be performed in accordance with the new TB testing requirements."

The USCIS website seems pretty clear that the I-693 is needed. Us July filers are likely the first people to suffer from the new requirements they set forth, so even though we've only seen a few RFE's for not having it, it seems like we'll be seeing more. I'll let you know how I get on with Dr. Arnold- $30 isn't bad at all for peace of mind and not risking delays!

We gave up and mailed everything but the I-693 this evening. We just want to get the EAD asap. We sent in the DS vaccination form from the UK medical in place of the I-693 but we'll be mailing the I-693 separately.

Well, we just got the run around by ANOTHER civil surgeon, and coincidentally the last one in our city. They tried arguing with us that we had to do the full medical exam, even though we showed them the I-693 instructions and specially highlighted the K-1 visa portion. We contested and asked why they'd refuse to operate the way USCIS mandates they do, and the physician said, "We do things our way around here. Go elsewhere." and walked away. We were like, "It's fine. We'll just pay the extra fees and get this over with" but they refused to see us. Needless to say, we're both furious and reported him to the USCIS.

I highly recommend you guys start reporting these physicians who are refusing to do I-863 the way the government mandates. I think if enough of us started making calls, we'd see more action on this front.

Anyhow, question for those of you who used Dr. Arnold. Did you have a TB test done? Was it done by a different civil surgeon or just another physician? Did Dr. Arnold transcribe the TB test results, or did you just send in a copy that another physician completed with your AOS forms? We're not sure how TB fits into this.

I thought AOS was supposed to be easy, but it's quickly turned into a nightmare for us. I'm a full time student and absolutely cannot take a day off of class to drive 3 hours away to try our luck with the other nearest civil surgeons. We're considering mailing off our application without the I-863 (just using the DS form he got in London) and mailing the I-863 later on once we get it back from Dr. Arnold. Does this sound reasonable?

Sorry for the rant...I'm still shaking with anger.

They still give the stamp. Sebastian got one too. The controversy is whether or not employers will take it seriously, since the new I-9 form (I think?) requires a work authorization card that has a photo ID on it. Or something like that.

To be honest, the whole thing confused us quite a bit and we just decided it'd be easier for him to not look for serious work until the actual EAD arrives.

Oh don't worry- we're not going anywhere! I like the idea of doing AOS in here too.

I think we'll have the doctor fill out the I693 even though there's conflicting information. It's better to have too much than too little and it's only going to cost an extra $110 ($80 for the forms and $30 for the TB test). We'd consider mailing it to Dr. Arnold but we'd rather just pay a little more and get it over with so we can file ASAP.

For those of you who had your DS vaccination form transferred to the I693 (how pointless is that, seriously?), did anyone try to tell you your vaccinations were incomplete? I know all of us London embassy people went to the same place and likely have the same form.

Sebastian and I went into the civil surgeon's yesterday and even though it says "Series completed" next to his tetanus shots (as well as all other relevant shots), they tried to tell him he had to repeat the whole tetanus series. The receptionist was beyond nasty to us and although I'm usually an overly polite customer, she was being so demeaning that I interrupted her in mid-sentence, told her we'd take our business elsewhere, and slammed the door. This delays AOS yet another week while we wait for an appointment at the one other civil surgeon around here. Don't get me wrong, we're exceptionally grateful that we're finally together and married- but with the economy being so horrible it would be nice if he could start looking for serious work.

If this is better suited in an AOS thread, I'll move it but I know a few of you were talking about vaccination stuff last week.

Well, we're married!!!! I'm surprised to say that it doesn't feel that different. I think that's a good thing- our relationship is strong and comfortable and the title is trivial.
