Could it be "carta del DAS" if it is, I believe that would be the police certificate that she would need for the interview, if I remember correctly my wife's was not too hard to get and it was pretty quick.

Good luck for both of you on the upcoming interview.

3.15)...Can I, while my fiancee will apply for a I-129F package, be with her in the US ? So we can stay together while the application is being processed or do I have to go to back home again ?

A..As long as you do not go beyond your visa expiration date and leave in plenty of time to do your part of the application then it should be ok. Many couples file the I-129F while the fiance(e) is in the US. However, the visa application itself is accomplished in the fiance(e)s home country, so the fiance(e) must return home to complete the visa application process and the interview at the US Consulate. So the bottom line is that you should follow all USCIS rules if you are here int he US and if your visa requires you to return home on a certain date that you do so on time.
http://www.visajourn...I129f.html#3.15

To this end then, how many visa waivers can I use in a row?

Do I have to return England when it expires, or can my fiancee and I go to canada for several days and then I can re-enter the US on a new visa waiver?

Hmmm, yeah, me and my fiancee had a meeting with a senator (her dad works for the township) and he did say filing while I'm in the US is quicker.

I dont mind going back home for the interview and figured I couldn't get an interview at an embassy in the US.

The senator also did mention that the process is antiquated and needed a severe overhaul and that we wouldn't have so many illegal immigrants if the process was more transparent. The UK system is just as arduous though.
Just food for thought....

This site is incredible by the way, the official USCIS website is not very user friendly - and I'm an electronic engineer!! blush.gif

K-3 Spouse Visa Process & ProceduresBring spouse through military??
This story is a little complicated. I'll give the basics. My wife's sister(who is Peruvian) just married a man with dual citizenship (U.S. and Panama). Nice Guy but man's family was not really in favor of the marriage. Man's Father advised him to quit job and get job where man's sister works. What he was told about the job was misleading and can not make enough money and needs to find a new job to support wife. Man's Father is now giving advice for Man to join U.S. Military, saying he could support her with the money from joining and it would help to bring wife here. I think the man's family is trying to sabotage marriage. I would like to give my sister-in-law and husband advice but I don't know how being a dual citizen would affect a K-3 visa. I also know nothing about being in the military and how one would bring a spouse here that way. If someone could help. Thanks

Just let me know if you still need a lawyer. I recommend my immigration lawyer. He's really good. He did all my paper works. My green card was approved in just less than 2 months without interview. His name is Atty. Gerardo Price... I can give you the number later if u still need one.

US Embassy and Consulate DiscussionPhoto scrapbook
Hi guys.

I'll be having my interview soon and I was thinking.

My fiancée made a scrapbook of us and gave to me as a Christmas present, it's really nice and well made. I was thinking if it was a good idea or at all possible for me to take with me to the interview to show it the officer interviewing me.

The scrapbook is pretty big and bulky though, but in it is a copy of what I used to propose to her (a crossword puzzle) and I think that would go well with the consulate.

What do you think?

Thanks in advanced.

US Embassy and Consulate DiscussionPhysical Exam
Hi guys.

My finacee and I are applying for the finacee visa.

I just came back from the physical at the Juárez, Mexico consulate labs.

Everything went on smoothly, just one thing is concerning me. When I checked in to have my name, passport and case number registered, they told me they didn't need my vaccination records. Ok, I said. I thought that was weird.

Ok, so I go in, they draw blood, ex-rays, etc.

When they finish the physical exam, after they ask me to undress and the check me out in the nude. They tell me that I don't have to go to the next area because my visa doesn't require the vaccination records.

So that's twice they told me, once at the front desk and second after the physical.

Is this normal? Or was there a mistake?

Thanks

K-3 Spouse Visa Process & ProceduresI-130 Not Filing Question

K-3 is not longer Valid it will not proceed from NVC stage it takes longer than I-130. the fastest petition is K-1 i got my interview and 5 and half Months from day one but in order to Apply for i-129f you need to know each other for 2 years of time and met. because USCIS will ask for evidence between you people met like Passport stamps Boarding passes and etc since you got married K-1 is no longer valid now.RFE means when you send your petition to USCIS. if the officer thinks you don't have sufficient Proof to show your relationship whether in the form of documents or pictures they will send a letter to Petitioner saying them to send more evidence that is called RFE. you must got to pakistan get married make sure you have your nikkahnama registered from Nadra.

I have the nikkahnama, its attested by the Pakistani government.

it looks like the best thing will be to go there to show that i at least lived with her for a little bit ( i hope 2 weeks or so is enough )

K-3 Spouse Visa Process & ProceduresI-130 Not Filing Question
Okay, so if i can find an affordable ticket, the best thing i should do is fly over there, live with her for a little bit, maybe re-do the nikkah, then come back and apply for a k-3 spouse?
This would take the least amount of time for her to get here right?

Also, what do you mean by RFE?

Page 1, Who May Not File Form I-130?, #4

4. A husband or wife, if you and your spouse were not both physically present at the marriage ceremony, and the marriage was not consummated.

My Situation

I am a natural born US citizen.
I went on a trip to Pakistan in the middle of May.
Met my wife on May 15th and 5 days later we were engaged.

Now here's the dilemma, on June 22nd we got married, however we did it over skype. I was here at home in Pennsylvania, and she was there in Pakistan with our families and her friends. My uncle represented me in person in Pakistan for the marriage.

So in short, I was not physically present for the nikkah( marriage contract), and of course no consummation yet. The rest of the functions are planned for the beginning of January.

My question is this, can I still apply for her as a spouse? Or would it be faster for her to come here if I brought her here as a fiance'? ( Legally married in Pakistan but not US right? )

US Embassy and Consulate DiscussionCFO

thats alot of questions. i'll try answering a couple. the CFO can be attended at anytime. you do not need your pasport to attend. when you need the visa is to get the sticker. CFO may ask for a copy of your divorce decree. my fiance attended in Cebu with no problems. you probably might want to get another Cenomar if the one you have is more than a year old. no guarantees the medical will be done in one day, even if you show up very early.

Thankyou for you reply to my questions. Perhaps She should try the CFO in cebu since she lives there and if it seem to be a problem then we move on to Manila later. However when she went to ask simple questions they refused to give any advise to her. I cant give her the original divorce Decrees so fast but I can e-mail them to her if it will be good enough! again Thanks Alan

US Embassy and Consulate DiscussionCFO
Hello , As you can see I am new here. I applied April the 17th 2006 with U.S.C.I.S in Vermont and finally have a date at the embassy. I am going to be in the Philippines to show my support for my fiancee. I have been informed by others that it is possible to attend the CFO in Manila, (never in Cebu), My fiancee lives in Cebu and (NO WAY). She went there and asked questions and they told her that she needs to know all information when she arrives there and they made her feel like she was at the wrong place to ask CFO questions. So I am here depending on those who have already gone through this. I bought my tickets to go to the Phili. in advance due the worries about the prices going up in December as I have seen in the past. I had to quess my fiancees time at the embassy acording to the past history in Visa Journey and it was right on target. I have my tickets to land the Philippines on the 15th and my fiancee has her St. Lukes appointment the very next morning. WOW. I was advised to miss the morning at the ST, Lukes Hospital and attend the CFO while she has her passport. I am concerned if this is ok. We have the appointment for Friday so it means we will be in Manila for the whole weekend. It seems that it may be of no gain if I must stay in Manila for the weekend. I am thinking that it is possible to have her in line at St. Lukes at 3 am then she may be done in one day only, then we go home on the last flight out of Manila and they now have late flights from Manila to Cebu.Last year they did not have late flights. Is it better to pay the Plane tickets for both of us to fly again from Cebu later for the CFO? Do we have something to gain by missing the morning time at St Lukes and attending the CFO which starts around 10 AM. [http://www.cfo.gov.ph/fs_cebu.htm] This link makes me think that the advise was wrong that was given to me becasue they ask for the visa and she dont have this till after she is approved, however I was told by one lady at the embassy that they do accept early people but they only get the certificate and must return again for for the stamp after they have the visa. Once again we will fly back to ge the stamp so. Is it wise to just forget the CFO untill after she has the Visa? I am certainly confused at this time about what to do so it all flows best for us both. My Fiancee cant fly there early because I will have my Divorce Decree in my hands when I fly to the Philippines and they do ask for this as i have read in the past from other expieriences. Unless that is only in Cebu? According to counseling requirements only, She needs to have 1. two valid I D cards with photos. 2. I have no idea what Duly completed guidance and counseling form IS? 3.She was never married and i already have the CENTOMAR because one year ago I took her applied for this.4.Other documents as may be required by the counselors????? what is this about??? other documents so once again it seems hopeless that she can attend this untill I arrive with the entire paket that most people send Federal Express and so it means the same day she is scheduled for her Exam at St Lukes is the only early option. It all comes down to whether it is feasable to try to do this in one day or make the weekend of this. Perhaps it is only a dream to think it will be in one day if she is in line early ,but i was told that the girls who are in line b4 5 am get the lower numbers and they finish in one day. I know that St Lukes takes her passport and after that time there is no CFO untill she gets it back from the Embassy. I hope I explained this well enough to get some feedback that will help me make the proper decision... If it is a gaurantee that she will be in manila for the weekend then it may be ok to go to the CFO first? Thankyou all so much! Alan

K-3 Spouse Visa Process & ProceduresGetting Married in Peru and Wife is Pregnant
Well, I an 30 and have been in Peru for 4 years now. We had a baby boy in June. Here is what I can say. From 3 different attorneys, two say get married in the USA after the baby is born. Thats what we're gonna do. We could have gotten married in Peru before the baby, but we decided to get our Sons natural Citizen Papers from the embassy, then start the I-129F process.

I am new to the I-129F, so this is why i had turned to this forum. From what I can see, from the day you mail your I-129F, she will be in the USA within 8 months. Not too bad.

While she is waiting for her visa, I am taking my son to the USA for 2 weeks to visit his American Grandparents for the first time, then returning to peru with my son, and flying back to the USA to start the waiting game. I will stay in the usa until I have my NOA2, then come back to peru and wait out the remaining 4-5 months for her embassy interview.

ChinaGZ Interview Fee

[font=Comic Sans Ms] My fiancee's information packet says that we must pay the RMB 830 interview fee before being permitted to interview for the visa. How much longer before? Must the money be deposited in one of the approved banks before she will be invited to interview? Or can she arrive in GZ a day early and go to a bank then? The Consulate's information is sketchy, and it does not pay to have her application pushed down to the bottom of the pile after working our way up to the top. Anyone who's already been there, I'd be grateful for feedback. Thanks.

Asia: East and PacificPetitioner's birth certificate

My fiance is probably 3 months away from an interview in HCMC. I was wondering if we have enough documents. I saw on some web site that they require the petitioner's birth certificate. Is this true? I do not have a birth certificate since it was lost in VN 27 years ago. Will the Naturalize citizenship certificate be enough? If you know the answer please let me know. Thanks. :help:

If you do not have birthcertificate, the following documents below are accepted in lieu of your birthcertificate.

---A copy of your naturalization certification or certificate of citizenship issued by USCIS or the forme INS.
---A copy of Form FS-240, Report of Birth Abroad of a Citizen of the Unitd States, issued by an American embassy or consulate.
---A copy of your unexpired US passport
---An original statement from a US consular officer verifying that you are a US citizen with a valid passport.

OTHERS:

---Church records
---School records
---Census
---Affidavits

Hope this helps.

Asia: East and PacificPhilippine NBI clearance

Hello!
I'd like to ask a question to the Filipinos in this forum who have had to get an NBI clearance as part of the US immigration process. I left the Philippines when I was 21 years old (that was almost 17 years ago), and have read that at some point I will need a police clearance from all countries I've lived in since the age of 16. Anyway, I've contacted the Philippine consulate in Toronto and they told me they could help me fill up the form (including fingerprinting). But then, I have to get a relative of mine in Manila to personally deliver the form to the NBI office. I asked them if I could mail it instead and they told me not to as it will just get lost (somehow!?!). I have to get a police clearance from Singapore, too, and apparently mailing it to them is not a problem.

Anyway, I would like to know if anybody has tried to mail the form to the NBI. (Or have you all made a trip to Manila?) I assume that not everyone in this forum live in Manila. I still have relatives in the Philippines but I don't know how much work I would have to put them through if I ask this very huge favor. Also, how long does it take to get the clearance?

Thanks!

What they did to me here in Phil. Con of HK, is they took my fullfinger printing, and then i sent the form thru FeDex to my sisters in Manila with my authorization letter and she was the one who process at the NBI. It took her only one day to get the NBI clearance. She sent me back the clearance via FeDex.

K-3 Spouse Visa Process & ProceduresK3- I130, I am finally filling it in!!!!!!!

When filling out the I130 do I use my married name?

I used my married name when my husband filed for our I-130. I have no idea if it will cause any problem if you won't use your married name on the petition.

also want to know, on the I130 required proof it asks for 'a certified copy of marriage certificate', but the FC-029 states that 'the INS has changed the policy requiring.... You may submit ordinary legibly photocopies of the original document.... You may be required to present the original....' Does this mean that I can submit a copy of my marriage cert?

This is true, you can submit a photocopy of your marriage certificate but show them the original at the time of your interview.

Is it required to send in a signed copy of the FC-029?

This is already an obsolete form. We did not use this with the petition.

:) Goodluck.
