K-3 Spouse Visa Process & ProceduresI-130 approved but no K-3
The I-130 for my wife and for our child were approved ut no K-3 yet. I was planning on the K-3 ut who knows
now when that will happen. Anyone have any idea what would bebest for me to do next to take advantage
of the time passing without the K-3 approval?
I sumitted the I-130 for both of them but only the I-130. I have since heard that I should have sent an I-485 as well.
Can anyone tell me if I am on the right path to use the I-130 to it's full advantage, immediate EAD and AOS etc.?

I have thought of the K-3 but perhaps the I-130 would be better now since the K-3 could be another month.
I could go to the USCIS site ,but I have always found more understanding and better advise here from those
who are in the same boat with me.

To those who have not seen approval yet, along with others here, my best wishes are with you.

K-3 Spouse Visa Process & Proceduresdocuments for interview, staples or no
These are not documents I am sending but rather documents I am taking to the interview. Multi page invoices and bills are mostly part of the package to prove relationship, receipts from calling card co, credit card bills to show purchase of the calling cards, telephone bills fron telephone co, electric and gas bills in both our names etc. I will hold these document together with binder clips, but the monthly bills I wanted to staple together so that page one and two stay together.
It may be a simple thing, but I know they can be picky about simple things.

Wondering if anyone has had any trouble in an interview if documents are stapled.I heard somewhere that staples should not be used but I have many multi-page invoices and bills and wanted to staple pages together to keep them from being mixed.
Thank you all

QUOTE (Brad and Vika @ Mar 20 2009, 09:10 AM) <{POST_SNAPBACK}>
Vika says the name of the document is "??????? ??? ??, ?? ?????? ?????? ????????? ?? ???? ??????". She also says that you can get the document at ????, the office where births, marriages, and deaths are recorded. Go to the office where her baby was registered. If they don't have the document, they will know where to get it.

Thanks Brad and Vika. Yes this is the document she has that was obtained at Central Registration, or as everone seems to know it as the "marriage building". Everyone so far seems to be in agreement that this is the document to have and that it will be enough to show there is no father to claim parental rights. Still, you have been through the mill there with documents and I am sure you understand that one document seems to affect another and it all fits together in some way, but the KEV-1 form asks for a court decree, so I am wondering if I should check that box and have them look at this document as the court decree, or if I should leave that blank as well as the other references to parental consent and leave them wondering and searching for a document giving permission. Perhaps the interview will be easier than I envision, but I plan for the worst and hope for the best.
Thanks again, and congratulations to you both.

The embassy wants a document showing sole custody of our child. When the birth was registered, the mother was alone and made up the name of the father (Ukrainian family law act 135) and used her family name as his last name) She has a document to this effect fron Central Registration. I am not sure this document is enough because the embassy asks for a court order. All the lawyers we asked about this tell us this is not done in Ukraine. This has been going on for months. In addition the wife has a document that shows she recieves a small amount of money evey month as a single mother. Am I worried about nothing?
Sh has made this name for the father because I am told in Ukraine the fathers name cannot be blank, even if it is ficticious.
Thanks much to everyone

K-3 Spouse Visa Process & ProceduresI-134 and dependents (K-3 interview)
the requirement for a household of five (counting dependents from prior affidavits) would be around 29,500 at 125% of poverty level. At a little over 40,000 per year I don't think there will be a problem, but I want to be correct on the form. Not that they believe I am trying to hide anything
To me, that is the important part of the interview.

K-3 Spouse Visa Process & ProceduresI-134 and dependents (K-3 interview)
one other thought would be that the government automtically considers any person for which an affidavit of support has been submitted, a dependant. But then there is the difference duration of the I-134 and 864 that the app does not account for in the question of dependency. If I list her as the one for whom I have signed an AOS for and also as a dependent, will they glance at the form and add the number of dependents to the number of people I have signed an AOS for in the past and over count?

K-3 Spouse Visa Process & ProceduresI-134 and dependents (K-3 interview)
Thanks for the replies. In reading the 864 agaiin, it appears that she must leave the country, become a USC or die. Otherwise the affidavit is in force for 40 work quarters which equates to ten years. Just not sure she is in the country or of her status. I have heard that her green card expired some time ago, but no other info available to me. I don't want to be dishonest or tell them anything I do not know to be true. Was thinking of listing the affidavit as I filed it and noting "possible expired green card", "possiby left the US"
Any ideas anyone?

K-3 Spouse Visa Process & Proceduresss card and number
Gary;

Thanks for confirming. It is as I thought, and even though I received a denial for my wife's w-7 because the embassy, when certifying her passport copy, only stated the attached document is certified so the IRS denied her ITIN because they did not identify the document attached as her passport copy. Stupid gets worse when they give me 45 days to respond, she is here in 20 days and we go to the local IRS office where they said they would overnight a certified copy of her passport to Texas. I then get a letter that began, "since you failed to respond in 45 days" so I returned to the IRS ofice. Yes, you guessed, all they could tell me is that even though they did what they said they would do, something went wrong and I would have to wait to see how badly my return was ruined and then file an ammended return. Yesterday we received in the mail her OFFICIAL ITIN. Now, I wait for the next display of ignorance. Actually the USCIS CS line was helpful the last time I spoke with them, and it is exactly as you have said before, it depends on who you speak with. Why they allow inexperienced people to give answers to questions from a menu only because they lack the experience to do otherwise though, that is thier mistake I think. It creates more problems and ill feelings toward USCIS than it helps. Thank goodness for the people here. I am told that I can get a SS number for the child being 6 years old and not anywhere near ready to work, if I bring all original documents to the local IRS office. I'll try it and se if it works.
Thanks again for your reply.

K-3 Spouse Visa Process & Proceduresss card and number
Is it possible for my wife who is in the country with a K-3 visa and valid I-94 to have a social security number
without first having her EAD? Everyone asks for the number she does not have from the bank to the insurance company.

On another note, on the back of her I-94 it is stamped and hand written K-4 as well as our child. Is it not supposed to
say K-3 on hers? Is there something I need to do about this? USCIS C/S line could not help with that one.

I trust the people here even more after one answered my question on the C/S line in a quite sarcastic way "I don't know,
I have never submitted a form like that before". That one caught me off guard and left me speechless.

Thanks to all here, and Dan, I almost wish I was going to Kiev with you. My wife is with me but I still enjoyed the city.
Good Luck.

K-3 Spouse Visa Process & ProceduresWacky AOS interview
This time it just seemed odd to me. My former wife came on a K-1 and at the AOS interview we were told that a green card would be issued and we should have it in two weeks. It was at the house in one week and we did not have nearly the difficult time with the interviewer. The interviewer explained to my wife that the US government was oblgated to protect US citizens from those outside the country who would marry just to become a US citizen, and he explained it more than once and asked her if this was the case with her, coming dangerously close to accusing her. He seemed to lighten up as the interview went on, but obviously has not been out of the country much because he did not understand Tania's propensity to give her American address in the format she would use in Ukraine which is almost backwards, and to the one who has never seen it or heard of it, almost unintelligable. I understand that procedures change minute by minute with USCIS, but I thought it was a little strange that the interviewer was not more congenial and forthcoming with information for us. I can only wait and hope things go well

Yes, she is K-3 and just received EAD and advanced parole even though she may not need it.
There was no cost and we may take a trip to Ukraine and I thought it wouldn't hurt to have it even
though the visa is two years. I just hpe everything goes smooth. I am at the end of my rope aleady
and I have been down hand over hand for a year and a half now. Bless you people here. There have been

Thanks HH;

I breathe a little easier now and I will probably sleep now, but one more thing odd. I gave him a copy of her I-94 and he wanted to see the original. He stapled the original to the copy and kept it. I did not realize what he had one because I was looking through documents but the wife told me later. Isn't she supposed to keep that in her passport?

K-3 Spouse Visa Process & ProceduresWacky AOS interview
AOS interview, went and suppled all the info I could, but at the end of the interview, He told me the Civil Surgeon did not fill out the form complete. The notice of interview told me to bring a vaccination supplement if I had not already sent one, and that I did, but he said we should have had a medical done. I explained that the instructions for the 485 stated that was not needed if she had a medical done within one years time. Her medical for the K-3 visa was in March of this year. He told me that medical was not valid here. I explained it was done at the direction of the State Department and was delivered to Immigration at the POE in a sealed envelope.
At the end of the interview, he told me we would hear from him in 4-5 weeks time. Does that sound normal to those of you who have been through this recently? I am deathly afraid of a denial for any reason and the resulting ####### I will have to go through afterwards. Just trying to feel easier about this all. If it is denied, can I handle it myself with more evidence or info? I do not knowif I am dealing with someone who actually knows his job.

Thanks everyone;
The interviewer must have been just as everyone said, the drone who had to check on everything he did not know. We have received Perm res cards and EAD and received subsequent ss cards. I thought I would be done with these folks for a year and nine months, but they spelled our child's middle name wrong on her card, so I have to be back on the phone with them.
The Vaccination Supplement was all I needed and the medical in Kiev was accepted as her medical within the las year.
I have found the site to be helpful in every respect, especially while we were waiting. Those of you still waiting, hang on. When it finally happens, it sure is wonderful and is certainly worth waiting for.
Those who have been through AOS I have a question for. Is there anything I should be doing in the coming year to prepare for the 751 to make the experience less frustrating and preparation before the interview less of a fire drill.

Thanks again

K-3 Spouse Visa Process & ProceduresNotification for Biometrics

Everyone in your situation has had a similar situation.... because what you are experiencing is the process...

You pay but they will not do biometrics on the child... You will need to get the child a new card when she turns 14 and then you will pay for biometrics and then and only then will they actually do it.

Thanks so much for yur reply. I have constantly been on edge throughout the process because I am anticipating the mistakes that I have heard about and many others here hava had to deal with. Our child did receive a notification that she has been verified as a dependent in the request for removal of conditions of the principal (mother) and this receipt alllows her to remain in the US for one year from the filing date or until a final decision has been made, whichever comes first. I am assuming she will receive a new card when her mother does, if I am understanding the one year thing, and the connection with the final decision on mother. Is the fingerprinting part of biometrics? If so, the child has had her prints taken already and it shows on the card she has now. I have not received fingerprint cards as I have read I should. Should I see this as a problem to be addressed?
Thanks again for the time you spend here helping others.

K-3 Spouse Visa Process & ProceduresNotification for Biometrics
07/09/2011 my wife received her NOA receipt for the I-751 application, and her daughter received a similar I-797C (VERIFICATION OF INCLUSION OF A DEPENDENT), and following that notice was another I-797 stating the date for my wife's biometrics. The child did not receive such notification at this time. Does the biometrics include fingerprinting for the replacement greencard? Even though the child is only eight years old now, the original card did have her fingerprint. I understand children under the age of 14 do not require biometrics, but still, I had to pay for it. UCIS money thing) Just wondering what happens if the child does not have her prints taken as before, and they discover this later.
Anyone have a similar experience?

US Embassy and Consulate DiscussionInterview Report
I will keep this report short and detailed, hopefully it will help someone going thru the process!

Patricia got to the embassy at 5:30AM, and was third in line, it gets really cold so better be prepared.

Have passport and appointment letter ready, at around 6:15 a woman came out and told everyone waiting what line to wait in according to the type of visa they were there for.

For K-1 they give you a green tag and put it in a visible spot.

At 6:30 they let you in and go thru the security check, no cell phones with camera or any electric devices are allowed in. Once inside they will give you a colored folder, brown for K-1 visas with instructions on the inside on how to organize all required documentation, if you have any questions there is someone assigned to help with that, evidence of the relationship had to be set up outside the folder, no clips, staples, etc.

Now the waiting starts, it didn't seem like they were calling in any type of order, the first time she was called to a window she was asked a few questions, in her case they were:
01) How did you meet your fiance?
02) How many times has he traveled to Colombia?
03) How long have you been a couple?
Then, they checked that all documents in the brown folder were organized accordingly and kept it, she kept all the evidence for later, they asked her to sit down and wait to be called again.

Next she was called for fingerprints, they had a tough time with her because her fingerprints didn't show for some reason maybe because of how cold it was outside, they had to try many different things and nothing worked, they gave her a tissue with some type of lotion and that did it, then she was asked to sit down again and wait.

Finally, she was called again for the real interview (was about time) the CO was going thru the documentation in the brown folder and the questions started:
01) What's your fiance's name?
02) When did he come to Colombia?
03) Have you been married?
04) Has he been married?
05) Do you have children?
06) Does he have any children?
07) They asked her my ex-wife's name because I had been married before ( this one she did not really
expect but she had read it in my divorce certificate)
08) Asked her if I spoke english?
09) Where did she learn english? (I guess it was a good idea after all that she spent all of last year in school)

That was it for the questions, then he looked at all the evidence she had, pictures, letters we sent to each other, cards, phone bills. Then wrote her name on a green piece of paper for next day's appointment to pick up the visa and told her that it was approved.
The next day she got there before 4:00PM, gave her a yellow sealed envelope, her passport and X-rays and some instructions for when she travels to the USA.

Some of the questions she was asked were in english, so I guess it's good if you know it.

Well this was it ladies and gents, I hope it helps somehow while you are floating thru this visa journey!
