my big question of the day is.. will they interview differently for a K-3 interview as opposed to an IR-1?



Why do you have to think of your K3 when your IR-1 is already at the embassy? The embassy will not give your husband a K3 interview when his IR-1 is ready for processing at the embassy.

On the required documents it says, "All U.S. K Visa applicants", that is my fiance, not me. So am I correct that I do not need to send him any photos?

Hi everyone,

I have been scanning the VJ website for a little over 3 hours now and can't find answers to some questions I have regarding the DS-156 form.

If anyone could help me, I would appreciate it. Here they are:

#22 - "When do you intend to arrive in the U.S.?"

How should we answer that. We are applying for the K-1 visa and I would think he would come here shortly after his visa is issued (God willing), but we are unsure of this date for obvious reasons.

#25- "Name and telephone numbers of person in U.S. who you will be staying with or for toursim or business"

I guess he should put my address and phone number? It is for a K-1 visa not a tourist or business visa, but I guess this form is used for both those types too?

#26 - "How long do you intend to stay int he U.S.?"

What should we put here? indefinitely?

#27 - "What is the purpose fo your trip?"

To marry my fiance, right?

#32 - "Do you intend to work in the U.S.?"

Yes, he does, but we don't have anything set up yet because so much is up in the air with the timing of his arrival in the U.S. How should we answer this?

#36 - "Has anyone ever filed an Immigrant Visa Petition on your behalf?"

Well, I filed the I-129 on his behalf, do they want us to write that as the answer?

I was reading in the guidelines that you only send the DS-230 and the DS-2001 (checklist, signed) back to the embassy. All the other papers you bring to the interview and sign in front of the immigration officer, right?

I hope I am not forgetting anything. If there is something that anyone can add, please do.

Hello,

I was reading in the guides and from other posts that the DS-156 has to be filled out online for the bar code. But.... when my fiance received his packet, it had the DS-156 form in there, so he filled it out by handwritting it. I went to the US embassy in Ankara website and it said it could be filled out online for easier application, but it didn't state that it Had to be filled out online.
I am a little confused, can someone clear this up for me.

Yep, just like everyone said, it will be redirected. I had done the same thing on my K-1 petition because it was going to be easier for my fiance, but later I read were Ankara handles all the K-1 visas. It was redirected and sent to Ankara.

Good Luck with this process. Yilmaz, my fiance would have been here if he hadn't overstayed when he was here in the U.S. Now we are waiting for an answer regarding our waiver that we filed.

Say the truth. You met via internet. Your families know each other through meeting several times before marriage. Yes, it was an arranged marriage. Tell how long you know your wife.

I got married last year (Sept) to a US citizen also (my wife is from PA). We knew each other 2.5 months before deciding to marry in India. It was not arranged marriage through parents, we found each other through internet also. We agreed to marry through Arya Samaj, and our families have not met yet (mine are in India, hers are in PA). We're hoping my parents come to visit next year so everyone can meet.

Perhaps if we could get the e-mail addresses of those in congress who supervise the work of USCIS and ask them these questions.
After waiting so long for the approval of the K-3, it will be a simple matter of waiting another month or so for the I-130, and we will not have to adjust status which for us would be 2000.00 because of the child. Trouble is, time sensitive documents like police certificates, tax and credit statements which are good only for a short period and take up to a month to renew. We are ok with waiting a year if we must but I would go see her in Jaunary or February if I know this will be the case. If I make plans now for January, will I be approved in February and have to return in March? Because USCIS seems intent on secrecy, we can make no plans for the future, and as far as the LIFE act is concerned, it is apparently misunderstood and maybe totally ignored in Vermont. Were I inside the service center, I would see that the K-3 took precedence in order to assure the government that the adjustment of status payment would be money available to the government. If expedited service was available, I would pay that too. The people there do not seem to understand that the people who petition have lives too, and are still entitled to the pursuit of happiness,even if it is with a spouse who was born in another country. I am ready to leave the country now, just to be with my family. Maybe Canada, maybe England, where it is possible for hard working honest people to be treated that way instead of a potential threat to the country. I made a request of my government to allow my wife, the one I happened to meet in a different country, and her six year old child, my family now, to come here so we can be together as the LIFE act said was possible. I have done all they have asked, including submission of documents and of course the money that was required, but in return for that, I have no idea what I will receive or when. Constantly changing dates and processing times have shown me that not only is it impossible to speak with someone at the customer service number who can give any insight as to where our petions are and when processing will begin, but it apears that USCIS is unsure of the dates it is actually processing now. All you need to do is check the processing times on a weekly basis as I have done, and you will see the dates go from month to month, sometimes forwards, sometimes backwards, and when they are totally unsure, or maybe just to keep everyone confused, they will show maybe six months instead. Truth is they dont really know. But, if you are sponsoring someone for employment, and you pay one thousand dollars, you are assured a visa in twenty days or a definite reason for refusal and chance for appeal. It seems that money can speed things along, but for those who simply want life to be normal, we do not have sufficient reason to deserve such an opportunity. In these economic times, and the government making promises for lower taxes, stimulus packages that will cost billions of dollars, and the need to replace this money in some manner, does it make any sense to make it possible for petitioners to pay for expedited service for any reason?
I think it makes good sense not only for myself but for so many others who have waited longer than we have. In this way, at least we can play a role in the timing of our processing. Of course, I am back to common sense and logical thinking. An attorney once told me that was a problem for me, because the world does not work this way. I still hope he was wrong

I thought the K-3 was designed to allow us to be together while we wait for the CR-1.If the processing time is the same, what is the point of going through all the ####### for the K-3? The posted processing times, if accurate, shows that both of our petitions will begin processing at the same time. Could this be part of the problem with the service centers and why it is taking so long? If the processing time is going to be the same, why do they provide false hopes of us being reunited sooner with the K-3 visa after we filed the I-130 when it seems this only adds to their workload trying to process two sets of documents at the same time? Just trying to look at the situation with common sense and logical thinking. Good luck to all. Hope you all have a great Christmas gift grom USCIS.

The USCIS site seems to actually assume that all Americans are really ignorant people who will believe anything as long as it is repeated often enough.Being busy or receving many petitions does not make you go backwards, unless of course you lied to us the last time. It isn't any wonder the American work ethic has taken a nosedive. Look at the example we have to follow.
Ineptitude is everywhere and USCIS pulls from the same pool of employable people that all of have to suffer with. Stay on top of things,when you call and get an answer, and it is a card shuffling part timer, hang up and call back. as to speak with an officer.
That came to me from an officer at the service center. He also told me about the part time college kids who know nothing except what is on the website. Dont waste time with these idiots. It is an exercise in futility.
Good luck all.If the K-3 process date as of September 30 is May, then maybe when the site is really up to date, December should bring us three months closer.

Yes, I noticed this for the first time last night, the process times for Ki3 indicates May instead of ^ mos
and the processing times (or dates being processed) is as of September. I guess maybe to save time
and in the interest of being together sooner, we should have gone K-1 which seems to be the hot tip these days,
and denied her momma of being there to see us married. But then, could we really believe them if we asked at the time?
I think not. They have lied so many times that I think they honestly believe it themselves. Maybe Obama will crack the whip.
That is what is needed there. Maybe between naps they will process a few, but we are talking about living elsewhere. My government has already shown my wife an example of how she will be treated here. I am thinking I do not want to subject her to this kind of treatment. Maybe tomorrow, maybe tomorrow, maybe next month. She has that where she lives now.

If everyone would go to the processing times which sends you to the USCIS website and displays processing ties for various petitions, we can see for instance that the processing time for the K-3 has recently gone from 6months to March dates being processed. Of course, these dates are as of September 30. As a result of so many petitions receved in 2007, especially in July and August, Vermont is so busy they have lost all track of time, and they are so busy that they have not realized that July 2007 is a year and one half ago. They have been so busy that in a year and a half, they have not been able to take the time to add to the work force or transfer to other service centers less fortunate. They do not even have the time to update the processing times since September. And all of us here have done nothing but criticize them for not working faster. Often the problems do not lie with the workforce whichis often overworked and underpaid, but instead, with management who lacks leadership capabilities and the ability energize the workforce on a daily basis. Anyone with contact info for those in congress who are on the oversight comitee. I sure would appreciate the info. If you post a reply here and let me know, we can arrange exchange of info.

I just got the copies of my checks for the I-130 for my daughter and her mother, but the EAC
number stamped on the back does not match (it is the preceeding number) and our daughter's
check is not stamped with an EAC number at all. I read of someone here who had this happen before
but they did not answer as to what they did about it. Maybe this is why there was no touch to her
petition when Tanias was touched 10-5
Cannot seem to get a breathing voice on the phone even though I have listened to the recording
endlessly. Can someone help?

The EAC # on the back of the cashed checks does not match any of the numbers
on either the I-130 for wife and daughter or the I129F.
EAC number stamped on wifes check for I-130 only and her I-130 is the only petition
that has been touched the second time. Before I call and ask one of the idiots there
I thought I would ask here if anyone has seen this before and what thay did about it.

I have read that this is the habit at VSC and it may be possible the I-130 NOA1 can be used
as a guide for the date of approval, but when I look at my timeline, the approval date for my
I-130 submitted one month before the K-3 is May while the approval date for the K-3 is April.
Does this mean that because I submitteb the K-3 I will wait even longer for them to be approved together?
We have been apart 7 months already and it is really difficult. We are missing so much of life together.

Thanks for your efforts that may benefit us all. I was wondering what it would take to get someone's attention at VSC.
I would love to have a job like that. WOW Go to work every day, do as little as possible and have the boss support you
by telling the oversight comitee that there is just so much work to do. How can anyone expect more from people who are already overworked?
People need to be fired. Not terminated in a quiet office with the boss apologizing, but an outright kick ### "your'e fired!" in front of the complete
staff as an example for the others. Someone needs to light a fire under soeone's ###.

Given the total lack of trust and faith I have in VSC, how would I know if my file has been transfered to CSC? I dont even bother checking
the website anymore because I don't trust them enough to feel confident that they either update on a regular basis or even correctly for
that matter. I have sent an I-130 for my wife and our daughter, and of course the K-3 which is a total farce in Vermont.
The only one to have been touched, or at least updated is the I-130 for my wife, last touched in October. I have no idea what kind of mistakes
and ineptitude I can expect from the simple minded people who work in VSC, but I can only hope for a transfer to CSC where it seems
people care about the people they are dealing with.

I am going to visit my wife in January because I haven't seen her in seven months. That may take the edge off of the wait a little. I have called my senator
and have a call planned for my congressman tomorrow. Let's stay on em people.

If anyone knows more about the transfers, please help us out. I don' trust asking the USCIS. What they tell you on the phone is only enough to get you off the phone. Now THATS training.

I will be in Kiev inJanuary as well in january. I arrive onJanuary 9 and we are going to spend a week in Egypt.
I have given up all hope of anything speedy. But I suspected jus as you said. Just because I have not received an e-mail,
it does not mean nothing has happened, bu all I get on the 800 line is a recitation of the 797. The scripted fools there can do nothing more. I am surprised they can find their way to work in the morning. The absent CRIS e-mails are just another demonstration of the ineptitude and stupidity at VSC coupled with a good dose of ignorance. The rarely do what they say and seldom follow through with what they say they will do. In reality, VSC is probably a work at home great grandmother who sits at her kitchen table, stamping documents one at a time, and hand delivering them to the post office five miles away, on foot, all by herself, providing she can remember where she left her walker last.
I have absolutely no faith in anything they tell me. Until I have solid proof that they actually do something, I will feel that they are for the most part, classic government workers who do as little as possible, complain about the work load as much as they can, and have lost sight of truthfulness and good work ethics. I wait to hear back from my senator and congressman. but till then, I will not even waste my time with the call. Whatever they tell me may be true, maybe not.
I actually had one obviously young kid tell me he could not give me some information before I sent my I-130. His reason, he never filled one out and submitted it. I had to call back to get someone competent. I was almost in shock when he said that. I worry that my documents will be lost or misplaced while they lay around in Vermont for so long surrounded by this caliber of people. In my mind, not hearing anything does not necessarily mean they just haven't done anything for me yet.

How do we find out if we have been lucky enough to have been transferred to CSC of if we are still
locked in with the people in Vermont who obviously don't care about families living apart.
I wonder how they would feel if the found they had a family member who was forced to live
without heat or hot water for extended periods of time without notice. Maybe they would not consider
that to be suffering. Maybe a person does not have to be smart to work inside.

they would not ignore the problems we are having. Perhaps they believe that what they do hear concerns isolated incidents and the problem is not wide spread. If each representative receives hundreds of leters by fax and my mail, it may be difficult to ignore, although it is what they seem to be good at. It does not change unless we change it. It is our concern and ot that of congress unless we make it so. It seems they need to be reminded that they are where they are because we put them there, and the people who will eventually be here will indeed be able to cast thier own vote!

Just read that VSC is processing K-3 visas for May 7 2008 and also K-1 visas for May 7 2008.
Apparently they still have not realized that people are watching and comparing notes. This would put
any approval for me well outside of the six months shown before. I think they did this to prevent
the phone calls from congressional representatives.
I wonder how long it will take before VSC stops blaming poor performance on all that happened in 2007.
Will they ever be able to admit that they have a problem that they cannot correct themselves?
If the extended waiting periods are caused by something that happened a year ago or more, waiting
and allowing time to pass, hoping for the best won't fix it I am afraid.
We need new leadership in Vermont. Someone interested in getting the job done, and not
stringing people along to justify their existance.

EVERYONE WAS RIGHT!!!!!!!!!!!!!

Today I received the e-mail that my wife's I-130 was approved, and I feel for those who sent petitions before July, and I know there are some, but even though I did not expect the approvals, I also expected the K-3 approval first. I thought that was supposed to be the game plan.

Now, I have the I-130 approval for wife and child, I am wondering which is better for us now. Any suggestions?
I have spent so much time in limbo, that I did not even pay attention to the next step.

So.............as I have done since September, I ask those of you on VJ who have gone before me.

With the approval date of the K-3 unknown, what comes next in the I-130 process?

WOW!!!! Good news and what appears to be an indication that my fear sthat USCIS would find some way to foul up what is a relatively simple process.
In July I submitted an I-130 petition formy wife and one for our child, and in August, the K-3 Petition.

Today, I received an APPROVAL for or little girls I-130, but not the wifes, nor for the K-3 petition.

How would they expect the little girl to come without her mother? Has this happened to you, anyone?

What in the world do I do now?
