US Citizenship General DiscussionChange of Address
As the title of the this thread eludes, I can't remember if I notified the USCIS if I changed my address.

Is there any way of verifying if I did?

I obviously don't want to re-do what I've already done....

I see I can fill out the online form (https://egov.uscis.g...ction=coa.Terms) so I wont have a paper trail.

Any help would be greatly appreciated.

And yes, I should have kept better records but 'life' happens....

US Citizenship General DiscussionCitizenship for my Daughter
I don't know in what direction to go in to get U.S. citizenship for my Daughter (8 years old).
A little background first. I brought my fiancee and her daughter to U.S. from Peru using K-1,2. We got married here in U.S. over 4 years ago. I tried to adopt daughter using a lawyer here. My wife did NOT want to contact the bio father.....Long story short got nowhere with that. We talked with a Peruvian lawyer. We found out that because the bio Father's name was never put on the birth certificate I could claim to be the real father and have the original birth certificate in Peru annulled and a new one issued with my name on it and daughter's name changed to mine. That's what we did so in Peru she is MY daughter. Do I file paper work for citizenship for her as my bio daughter or as an adoption? Will the birth certificate be enough? Will they want more proof? Has anyone had a similar experience?
Thanks

US Citizenship General DiscussionU.S. Passport
I should have provided more detail. Daughter is 8 years old. She was born in Peru. Biologically not mine.
After my wife becomes a citizen through naturalization our daughter will become a citizen. My main question was evidence of citizenship for daughter to get U.S. Passport.
The following was the best info I could find, but it refers to being born abroad to a citizen not to one be naturalized later.

Foreign Birth Documents + Parent(s) Citizenship Evidence

If you claim citizenship through birth abroad to U.S. citizen parent(s), but cannot submit a Consular Report of Birth Abroad or Certification of Birth, you must submit all of the following:
Your foreign birth certificate (translated to English)
Evidence of citizenship of your U.S. citizen parent
Your parents' marriage certificate
An statement of your U.S. citizen parent detailing all periods and places of residence or physical presence in the United States and abroad before your birth

US Citizenship General DiscussionU.S. Passport
Getting a little confused by some of the posts.
After my wife gets her citizenship. Does her daughter need to apply for a certificate of citizenship? Some posts say no. But the passport application requires proof of citizenship. Could my wife show her passport and daughters birth certificate as proof? I'd prefer not to get COC because of the price tag to file.

US Embassy and Consulate DiscussionTime after approval
Usually 2 weeks after the visa approval. It took me 10 days before i got my passport with visa. My other friends got thier visa in just 3 to 5 days after the interview. One week after my interview I called the embassy for follow up of my visa, then the next day they sent it in my address.

US Embassy and Consulate DiscussionI-134 Question
Good evening, everyone,

Now that our NOA-2 has been approved, my fiancee and I are working on everything necessary as soon as possible! From my side, I am working on the I-134 and have a few specific questions and would appreciate advice/guidance/insight. Our interview will be at the consulate in Kyiv, Ukraine.

1. Are photocopies of signed tax returns plus W-2 form preferable to IRS transcripts, or vice versa?

2. As I mentioned on this forum some time ago, my employment situation is somewhat unique. I will be frank about the situation so that I can receive the most accurate advice. I just graduated law school and am spending the summer studying for, and taking, the bar examination and consequently have no income at present. Prior to last summer, I lived at home and was largely supported by my parents, but earned a small amount of spending money every year, self-employed, doing genealogical work for hire. Last summer, between my second and third years of school, I worked for a major law firm and earned $30,000 for the summer's work. Beginning in September of this year, I will be employed by a federal judge as a one-year term law clerk at a salary of $57,000. Beginning in September 2011, I have guaranteed employment at a major law firm with a salary of $180,000. I also have about $3,000 in the bank and $1,000 or so in savings bonds.
My thought was that I would submit:
a. I-134 Affidavit of Support signed by me
b. Memorandum explaining this income situation
c. Signed letter on letterhead from U.S. Court concerning my employment from Sept 2010 - Sept 2011
d. Signed letter on letterhead from law firm concerning my employment beginning in Sept 2011
e. Income Tax Return + W-2 form (or IRS transcript? See Question 1) for 2009, 2008, and 2007 -- 2009 will show $30,000 income, above the guideline, but the two years before that will show the pittance I earned doing genealogical work.
f. Statement of Bank Assets
f. I-134 Affidavit as a co-sponsor from my mother, who has a consistent record of employment enough to support a family as well as real estate and bank assets (? Is this necessary?)
g. Birth certificate of my mother (? I read somewhere that this was necessary to prove that the co-sponsor is a U.S. citizen -- anything else for a co-sponsor)?

So, my question is: Are all of these necessary? Should I err on the side of caution and go for a co-sponsor? Are any of the items above definitely not needed? While I am excited about the possibility, I am worried, given the rapid pace of things, that our interview could occur during August, when I've planned a trip to Ukraine to visit with my fiancee, and that I will not yet have begun work for the U.S. Judge and that this might cause some problem with an interviewer.
Thanks for any and all help as we do everything we possibly can to make sure this goes well!!!!!!!!!!!!!! We feel very blessed that our NOA-2 came in only 25 days and we don't want to do anything to screw up our good path so far.

US Embassy and Consulate DiscussionI-134 Requirements
Hello everyone,

We are moving along so quickly in time and would like to get things in complete order as we anticipate scheduling the interview very soon.

From a previous post, I understand that, because of my unique situation with definite jobs lined up which would put me well over the poverty limit for our prospective household of two :) , and with a tax return sufficient for last year, but without having started continuous employment until next month, I should have a co-sponsor. My parents have agreed to do this, and I understand that I will need I-134 applications from them, as well as all proofs and birth certificates. Here is what I would like to know:

My parents filed their tax return jointly. Their joint income before taxes is approximately $50,000. We have ordered tax transcripts from the past three years showing this basic information. Is it the income before, or after, taxes that counts? Should we also include their bank statements? Is it helpful? Overkill? All of their bank accounts are joint accounts. They jointly own a house, but I understand that absent a professional valuation of the house, this will not help - right? - copies of insurance policy with valuation or property tax valuation would not alone be useful?

I'm sure that they should each (father and mother) file a signed I-134 form, but how should they list their income / assets on this form? Divide them? List as a whole with reference to each other's form? Or ??????

Also, as of 2008, I was listed as a dependent on my parents' income tax return. This is no longer the case. I have a sister who still lives at home and is a dependent. On their I-134 forms, they will list that they have one dependent - my sister. Should she be counted as a half a dependent on each, or one on each or ??? Should we file any explanation to explain the fact that I show up as a dependent on some earlier tax returns but not now? And, how will this be factored in, in terms of determining the number of dependents for the poverty line?

Thanks for any help!!!!! We are so close, we don't want to make a mistake now.

What we need for the Military report a Dienstzeugnis so the Kreiswerersatzamt knows what to send?

US Embassy and Consulate DiscussionRenewed Passport to Schedule Interview

I'm so frustrated with contacting Lagos consulate with no response. So my initial passport is going to expire next year 'March' which automatically cannot be used for the K1 visa. So i had to renew the passport and i currently have a new passport number.

However, i'm currently trying to book an appointment date but with no progress because the system is still updated with the old passport number. The field cannot be edited for chnage, so i sent them an email and i nwas told to call or chat live with an agent. But i cant even reach them.

I really need to get an appointment date ASAP and i need to know if i should bring both passport for the interview.

Please Help!!!!!!

US Embassy and Consulate Discussion1-134 Co-Sponsor Now Sais No
I have lived in Peru for about 4 1/2 years, full time, with only 1 week to 10 days visits to the USA. During my time in Peru, my fiance and I managed to get pregnant and we now have a beautiful baby boy, Today he's 8 months!

Also, got the news by email that my Dad will not do the I-134 simply because if my fiance gets hurt and goes to the hospital, with having no insurance, the hospital has legal right to sue my dad for her medical treatment.

I can not alone be the sole sponsor simply because I have had no Income for the past 5 years. Basically my fiance supports me and I take care of my son.

So now what do I do, in the event it is not possible to find another co-sponsor? is there a waiver? What about the fact that we do not intend on living in the USA full time right now??? We have 4 stores in peru and the income is 10X's more than I would make in the USA... sounds crazy, but its true.

Anyway, I'm a bit heart broken at this point, and need someone to help guide me in the right direction. I cant see staying full time in Peru much past the new year coming. I have put in my fair time in Peru, and now I am deeply concerned about my son. I need to be with him, and obviously my son needs his mom.

K-3 Spouse Visa Process & ProceduresApplying for a K-3
We tried to file our petition as soon as possible after my husband's departure from the US (on VWP). Unfortunately, we had an attorney who sat on it for what felt like FOREVER. I guess since he got to go home to his spouse every day after work, he can't possibly understand our agony. whistling.gif

We had to hire a new attorney & finally got the petition filed three months after my spouse left the US. We were trying to minimize our separation as much as possible. Perhaps that's why you're asking -- so that you can visit & then file as soon as the foreign spouse leaves for home?

I'm glad you asked, though, because I was curious about this as well. I wouldn't have waited to file, but was curious just the same.

AFM, we are at about 24 days post-petition with no NOA1 yet... unsure.gif

K-3 Spouse Visa Process & ProceduresWhere is our NOA1?
Okay, to clarify for future lurkers, my attorney filed only the I-130.

And I think I was confused from reading the receipt dates on the timelines. It seemed like everybody was getting their receipts so quickly, and ours was delayed.

The receipt date listed on our timeline is 5/28/09, however, I didn't receive the notice in my mailbox until June 15th. Just thought if anybody else was confused, it might clear things up.

K-3 Spouse Visa Process & ProceduresWhere is our NOA1?
Thanks for your post. I'm pretty sure he filed the I-130 properly. I didn't get copies of anything, so I'm in the dark. I'm just a little worried because it seems like most applicants receive their NOA1 fairly quickly. We're now at 21 days since filing & I have nothing. crying.gif If the initial process is this slow, then I'm wondering how bad the rest will be.

My husband and I dated long-distance for almost 5 years. We've spent everything we have on traveling back/forth to keep the relationship alive. Now that the petition is filed, he can't enter the country, so the separation is extraordinarily hard. I have a full-time job & only get 15 days vacation per year.

I know I'm not alone in my anxiety - I'll bet everyone here has a similar (or worse) story.

So hard when all you want to do is be together and start building a life.

K-3 Spouse Visa Process & ProceduresWhere is our NOA1?
I'm wondering if anyone's noticed a delay in the initial receipting process. Our attorney filed our documents (I think both I130 & I120f, but not sure) on May 21st at VSC, and we have not yet received our NOA1.

Okay, you can all imagine my surprise this morning when I reached into my mailbox & had the NOA1 from the California Service Center.....

He is in a general practice firm, but they advertised immigration. I live in an extremely rural area of the US. The first attorney we went to see charged us $200 for the initial consultation, then never returned my calls. I switched to this guy, who sounded extremely knowledgeable. Then this....

Seriously, if anyone can learn from my mistake, then I won't feel so bad. I should have done my homework, I know. I think I just got in a hurry to get it moving.

Now look at us.... crying.gif

K-3 Spouse Visa Process & ProceduresWhat does "stand alone" mean?
Thanks for the replies. I'll let everyone know what happens. That's IF my attorney actually tells me what happened. They may have sent it back to him, and I'll never know.

I emailed him to find out.

Been crying for hours now. I know everyone here understands how hard the separation is, and I thought we were FINALLY under way, only to find out that we may not be.
JustJFemaleIreland2009-06-14 19:26:00
K-3 Spouse Visa Process & ProceduresWhat does "stand alone" mean?
You know, people ask all the time on here whether it's worth it to get an attorney.

I unloaded $3500 so far, and here's a prime example of why it's better to just freakin' do it yourself.

I'm so angry about this, I can't even describe it.

This is our LIVES we're dealing with here! I know I don't need to tell all of you how hard the separation is. It took us so long to get to this point, and now I find out that our attorney did it wrong, and that it'll result in yet ANOTHER delay???

I just can't believe it...I'm actually sick over it. crying.gif My husband is living on next to NOTHING waiting for this to all come through, as there's no employment where he lives. I'm trying to hold everything together here, and I'm glad to have a full-time job, but it's been such a struggle.

I can't believe it...I just can't believe it.

K-3 Spouse Visa Process & ProceduresWhat does "stand alone" mean?
Thanks for your post.

No, this was the first thing we filed. He sent it directly to the VT Service Center via certified mail.

We are still waiting for our NOA1 25 days later.... I'm wondering if the reason for this is because he should have filed at the lockbox & waited for it to be assigned.

JustJFemaleIreland2009-06-14 15:17:00
K-3 Spouse Visa Process & ProceduresWhat does "stand alone" mean?
I've been reading that I-130s should go to the Chicago lockbox.

Our attorney filed the I-130 with G-325As, G28, letters, birth certificates, marriage certificate, passports, photos, etc. at the VT Service Center.

Did he screw up?

It would totally be our luck if he did....

I did call the NVC yesterday. They stated that they still didn't have my husband's ds-230 in the system. He mailed it from Ireland and it reached the States on Nov.6. The person I spoke to did say it can take 10-15 days just to get entered into the system. Thanks to everyone for their input... star_smile.gif

I'm not sure how timelines for the K3 differ from CR-1's, but our documents were received @ NVC on 10/9 and an RFE wasn't issued until 10/20 (we didn't receive the email until 10/27).

They *say* they schedule interviews during the 2nd FULL week of the month, so you'd want to hope for a case complete by November 13th. If your documents were just delivered 11/6, then they're likely still scanning everything into the system.

I have noticed that the NVC sometimes schedules during the last week of the month as well, so if you can get a case complete, you might luck out and still get a late December interview.

We were scheduled on November 12th for a December 7 interview. Dublin moves really fast, so be ready.

US Embassy and Consulate DiscussionNoob asking for help

Hi everyone and thank you for taking the time to read a noobie thread.

I am American, she is Russian. we have lived together for more then a year in Saint Petersburg. We feel its time to move back to the states, and marry. So, with that said, what would be the fastist way to go about this? Ask for a k1 and possible wait 6 moths (more or less) for her to be able to come to her new home, or marry her here in Russia and ask if the US Embassy can do a Direct Consular Filing?

any and all help, tia
(F)

Before filing or juming into anything else check on the timelines on how long for a K1 petition in Russia. Consider also checking on the website if there is a DCF for I-130 (spousal petition) in the embassy where you are filing before getting married.

check on this info: :) Rome district office

Goodluck
