Please i need to make an enquiry on Abuja consulate in Nigeria for K1 Visa......What's the experience like? I noticed that most VJ members for K1 visa are using Lagos consulate.

The reason in the letter was that our petition Did not span the entire period of our marriage in sufficient detail. When reading the documents we sent them i.e. Travel documents of when we went to visit his family together (why would I take a vacation with someone I don't have a relationship with?!?!) Send them the recent documents. Also send a history of your documents form the time your husband/wife was here. Make everything in detail for them to avoid asking the question WHY? Goodluck

Apr 16, 2009 - interview for jointly filed I-751. The IO tells me that the rules has recently changed, now if someone files jointly but get divorce finalized before his/her I-751 interview, an IO may amend his/her case at the time of the interview and approve it. He also tells me I will receive a decision letter by mail.
Apr 16, 2009 - fingerprints
Apr 22, 2009 - divorce waiver I-751 returned by VSC because I forgot to sign the check.

Apr 30, 2009 - decision letter received. It says:
"Conditions removed as of: 4/23/2009.
Your request for the removal of the conditional basis of your permanent resident status has been approved."

CR means you're a CONDITIONAL RESIDENT.

They did not ask for my green card when I had my infopass. They just asked for my passport and stamped it. So I have my old green card for me to keep. whistling.gif

We went to USCIS Newark to get the stamp on the passport to prove legal status. We got that... but no one there could tell us what is going on.

In January 2009, we received a fingerprint request for our son - 12 months after submission of application. Our son is only 5 years old so I don't think they'd need to do FBI background check on him. I think the delay was because they did not have our son's fingerprint. I hope it won't take another 12 months from January 2009.

Anyway, the officer there told us that my wife can apply for citizenship even if she doesn't have her permanent green card. The only problem with this is that it will further delay the green card process. Of course, if she gets the citizenship then they'll save money on not having to produce her green card, so they want the green card to wait for citizenship result.

Should I contact my senator? How do you do this?

Assuming you responded to the RFE with what they needed - I wouldn't think it would take much longer to hear something. What was the RFE for and what did you respond with?

(With such a short time to go before you need to travel, it would probably be a good idea to schedule an infopass appointment.)


it was a request for evidence of relationship. so i sent in a packet that included documents such as: joint insurance, joint bank account, joint car ownership, joint lease, shared utilities, signed statement from my mother-in-law and from a good friend, and some pictures.

i am bad at remembering dates, but i think i sent it in early august.

i haven't posted on visajourney in a long time! but now i am getting impatient and am hoping for some input from others who are waiting for their CRI89 to get approved.

i got a request for evidence in august and sent in my evidence 2 weeks later. i haven't heard anything since. my NOA (aka, my extension) expires in 2 weeks, and i need to go to canada in november. last year when i was waiting for my NOA, i needed to travel, so i had to go to an infopass office and get a stamp. now i fear i will have to do that again (the office is 2h away).

has anyone else been waiting for over a year?

LOST GREEN CARD

We applied for removal of conditions using the I-751 (ROC) in Oct 2009, but my wife lost her wallet with all of her I.D.s including the Provisional (2 year) Green Card about two weeks ago. She has already completed her biometric appointment in St. Louis in December 2009. And, we received her one year extension as her application is being processed in California Service Center. Therefore, no new Green Card was sent to us. :wacko:

How does one get a duplicate Provisional Green Card when expired Green Card was lost, misplaced or missing? I think my 20 month old son must have been playing with his mother's wallet and put somewhere in the house. Yes, we tore the house apart looking for the wallet, but there is no sign of it anywhere. :crying:

What is this process for Temporary Green Card replacement? :unsure:


i don't think she necessarily needs one. it might be good to notify USCIS (somehow) that the card was lost. but personally, i am already on my second I-551 stamp in my passport, and every time i have traveled out of the country, when i come back into the US and present my letter and my green card, the immigration officers have given me back my green card telling me it wasn't necessary since it was expired, what they needed was the letter (and in my case, the stamp in my passport, because my letter is expired now too!)

just bob, yes i asked them. i had to get a stamp in october 2009, they gave me one good for 3 months. and i had to get another one in january 2010. i asked both times and they had no information for me.

ok so i had never heard the term "writ of mandamus" before and didn't realize this is essentially a civil lawsuit! after looking at the link you provided and reading how one user went about doing this, it sounds fairly involved, as it is a lawsuit against USCIS essentially! wow. here i was thinking i was just going to write a complaint letter to the district director, not serve them a lawsuit!

i guess this could be an option if all else fails. i contacted my congresswoman today, and mailed my DHS form to CIS Ombuldsman. so we'll see if anything happens with that first.

What is your district office ? You can search for the exact address on www.uscis.gov and address the letter as

you can also do a search on the internet and see who is the current district director of your Distirct office , but if you cannot get that information just address the letter as above

Make sure you write a letter to the district director , he or she has more authority on the case and will be able to help you in a better way

District Director is the head of the Local Immigration office

CIS Ombudsman can help look into you case and advice what is happening to the case and also nudge uscis about your case

I feel your pain! I filed my I-751 in December 2008 and, like you, have been getting the runaround ever since, even though my case is very straightforward. I'm now on my second I-551 stamp! In the end, I just filed for citizenship when I became eligible in December 2009 and now have an interview scheduled for April.
No longer having to be at the mercy of the USCIS was one of the main reasons I decided to file for citizenship. Perhaps you should think about that before you completely dismiss becoming a US citizen.
As a permanent resident you will never enjoy the full rights afforded to citizens, and if you intend to live in the US permanently, wouldn't you want to have them? I've lived here and paid taxes for seven years now, so I strongly feel that I should. (And luckily for me, I don't have to relinquish my UK citizenship.)

Anyway, good luck. Hope things work out for you.


sorry to hear that you have been getting the runaround too. i have my own reasons for not wanting to become a citizen, and that will not change. as a permanent residents, i have all the rights that i feel that i need. my father-in-law isn't a citizen either, and he served in the military, he has veteran status and the benefits that go along with that. he is about to retire and will be getting social security just like a citizen would. i don't think he is missing out on much, other than voting. anyhow, that's just my opinion, i understand why others want to naturalize, and that's respectable. its just not what i want.

mainyasha, thank you, it is reassuring (but also unfortunate) to know that there are others in my shoes. i wonder if there are people who have waited over a year to have their ROC approved that might be able to shed some light on why it took so long for them. i just don't get it!

rnqueen, as i said previously in this thread, i am not interested in becoming a citizen of the US, so that is not an option for me.

bradcanuck, glad to hear they helped you! i think i might call my congresswoman tomorrow. what did they do for you, would you mind explaining? i am not sure what to expect when talking to them, and what kind of timeline i would be looking at to see anything happen with my case, etc.

as for the I-751, i filed it in Vermont in October 2008. i was sent to the nearest USCIS office in January 2009 to get fingerprinted. in April i got a noticed that my file had been transfered to California. in August i think it was, i received a request for evidence, which i sent back to them a few weeks later.

i didn't hear anything back from immigration for months, so i called in December 2009. i was told my case was outside the normal processing times and that they would put in a request to push it through. a few weeks later i got a letter saying the processing of my case had been delayed and that i would hear back from them within 45 days. i didn't, so i called again in early February 2010, they didn't have any new information, except that my case had now been transfered to an adjudicating officer.

i just got a letter in the mail today, conforming that they had indeed received my answer to the RFO back in September 2009, but that my case was not ready for a decision as the investigation into my background remains open. the letter says to wait another 90 days, and if i don't get a decision or NOA to contact them again.

has anyone experienced anything similar?? wouldn't they just send me another RFO or schedule an interview if there was anything they weren't sure about? i'm really at a loss here and am getting worried...

I don't know about being 'required' to have current biometrics on file, but they may well want a new one from you if it's been over a year since your last one when they FINALLY get around to adjudicating your case.

I'd be inclined to contact the USCIS ombudsman's office too. Can't hurt at this point.

yup i already filed with DHS ombudsman. i was told that was pretty much useless though in the grand scheme of things.

i'm currently having my canadian passport renewed, so as soon as i get it back, i will need to get another stamp in my passport. so off to infopass i will go, maybe they will have something to say!

oh and to the person who mentioned moving, i haven't moved since filing for removal of conditions. i originally filed through Buffalo, did biometrics there. because i live in Erie PA, but for infopass i have been going down to Pittsburgh instead.

i already initiated two service requests via phone with the USCIS in the last 6 months. twice they simply sent me stock letters in the mail telling me my case wasn't read for an answer. i plan on calling again soon. the last letter i got, in late february, asked me to wait 90 days for an answers. i am not expecting much.

heard from the congresswoman's case worker today. he said he hasn't heard back and that sometimes it can take months. i asked him about the USCIS having a timeline for answering requests from congress people, and he said no, they are slow, nothing he can do. :wacko:

my current concern is that my biometrics will be expiring in a few weeks. someone here on VJ told me that in itself might be enough for them to send me a decision before then. if not, does that mean they will be sending me another appointment for biometrics soon? are they required to have current biometrics on file?
