Yay! I logged into my bank today and saw the $170 check had cleared. Clicked on it and found a lovely WAC#. Created my account online and I see:

As well as they are asking for a death cert of my ex-husband, but i can never provide that because he was pressume dead and not dead. Now i only have a very short time to get the approval to get married. What will i do about this.

Are you a Filipino? If you are then, this is difficult to do as Philippine Law is conservative. And there is no way you can do in just a short time. I don't know how and what to tell you. Sorry but, you definitely need a lawyer and I guess you have to wait and postpone your plan of getting married.



Yes I am a filipino and I understand what you mean as well as thank you for your reply. The case were done in a right way but it's not recognised here. Now we will be going back to the philippines to get married. Will they question this again when i apply for an entry visa here to be reunited with then husband? I am going home first by July & i will be changing my passport name as well back to single name or will be my then husband surname. Thank you and God bless you.

Your case is very compllicated. However, you are right ... best thing to do is to go home to PI and process your papers from there, because the US immigration in PI will honor your annotated MC and a copy of your presumptive death of your ex-husband. If you want to change your passport into single you can. Just be esure of what you are going to tell to the US immigration in PI because your record may be in the system. I hope this helps.

Seems USCIS liked my package I sent - no interview, no RFE -


"The USPS reported that they picked up mail from USCIS containing your new card on March 2, 2012. You should receive your new card within 7 days."


I normally checked their site each day - but the last week - I figured to wait till the 6 month kicked in.


Hi Bobby and Umit. Yilmaz and I sent our packet into VCS on Oct.5th and had the biometrics on Nov. 8th. Still no word.
Congratulations on your good news though!!! California is working fast!! :)
Are you guys planning a trip to Turkey anytime soon?

Hi,

 

We did a removal of conditions for my husbands permant resident status. He got his new card in september of this year, we didnt realize this mistake until just now. His original greencard has an issue date of 7/6/2011, and his new ten year green card has an issue date of 7/6/2010. He wasnt even here in 7/2010. How do we fix this? Will thier be any repricussions for not noticing this earlier. He is able to apply for naturalization soon, and hope this wont affect that.

thanks, i did search the forums and it seemed everyone who mentioned it said it was useless, but few people seemed to have actual first hand experience, it was all hearsay.

i do not want to apply for citizenship, so that is not an option for me at this point.

some of you may have read my previous posts about my struggles with my removal of conditions, which i filed in the fall of 2008. most of the information is in my signature.

i contacted my Congresswoman's office about my case and they sent a request to USCIS on my behalf in early March; haven't heard back. i also filed a complaint with CIS Ombudsman around the same time, aka Homeland Security, and finally got a response a few days ago. it isn't much of a response, just a token letter saying their offices have initiated a formal inquiry into my case and that i will be receiving an answer from USCIS within 45 days. sounds unlikely after everything i have been through, i've already received several letters telling me i would get an answer and never got one.

anyhow, i was wondering if anyone else has filed with CIS Ombudsman due to a delay in their removal of conditions? anyone know if this will help or if it is a lost cause?

the real question is, do you want to stay married to this guy? sounds like there are a lot of problems...

if you do want to work it out and file jointly, any bills at all that he alone had going to his parents house, and anything you might have received at that house, bills or letters even addressed to either of you at the same address. that would help. also you can get notarized statements from family and friends stating that they have known you X number of years, that the marriage is in good faith, and any other details that would help. obviously, explaining the situation will be partially necessary, but i would refrain from mentioning marriage problems in anything you are filing, i wouldn't mention that he can't get a job, or anything that would look bad. that is, unless you plan on filing separately, and that will be another ordeal... but might be easier, who knows.

I feel you, I was on the same boat, I filed for ROC on 06/30/2009, did my Bio on 08/14/2009 and never heard from Vermont Center, my case got out of the normal processing time. Did Serveice request, my husband did expedited request and nothing was done (BTW my case hasn't even been touched since 08/16/2009 until May of 2010 after I filed for N-400) I guess it was stuck under a pile of other files or I don't know. Called the 1-800 # million times with no help. One officer told me that they will request my file to be sent to them. NOTHING, I guess she was just trying to left up my spirit as she was as well wondering how come this case hasn't been touched for that long time. And then finally I applied for N-400, that was the only way my I-751 was brought up and pushed and I started seeing it's been touched almost everyday. On May 26, 2010 they have finally approved my case and I got the hard copy just last week, after more than one year.

I know how it feels as I've been there, the funniest part is that my CR-1 immigrant visa was approved 2 month before our 2 marriage ann. So if it was delayed just a lil' I wouldn't have gone through all this. But I believe that things happen for a reason.

Hang in there. I understand that you have your reasons for not applying for Naturalization. Keep the faith and keep the positive attitude. It has to come to an end one day very soon.

thanks a lot for sharing your story. what i am wondering now is, even if i DID want to naturalize, if there actually is something wrong with my file in terms of it having been flagged by another agency like the FBI, they might take forever to process that too. at this point i doubt my file is just at the bottom of the pile.
