My concern was that it might be perceived, by the powers that be, that we did this to speed up a process or to circumvent a K1 visa. This is totally not the case, but I would hate to make an error that could effect us in the long run.

We simply could not figure out a way to spend time together on a long term basis to build a relationship without jumping into marriage. The fact that she wants to attain a 4 year degree gave us this opportunity. In all probability, we will get married one day. That could be years away though.

First of all, let me say, you have a great site here and I'm thankful for all the wonderful knowledge i've learned reading up.

I have what I consider to be a unique situation. I might find out that it is not at all. I'm a United States citizen and my girlfriend is from SK, Canada. She is currently living and working in Canada. I am living and working in Pennsylvania. We have known one another for a couple years, but only met and started dating in June of 2008. We think we have a good thing. We love one another. But being a bit older and more mature, we're not ones to rush into anything.

We want to spend more time together. We want to be sure what we have is real. So, the first thing we said was, how can that happen? Work visa! That turned out to be impossible as Barb does not have a 4 year degree. So, she pondered this and said that she really would like to go to college and achieve a degree. Something she always wanted to do.

So, she got a letter of acceptance from the local college here and plans to attend school, starting in August 2009. For her paperwork and what not, we clearly stated she would be staying with me. So, in this aspect, we are getting two things. She's working on that degree she always wanted and we will be feeling each other out to know if marriage is right for us.

If at some point during her 4 years of college, we do decide it is right and we do get married, is this ok? I certainly don't want to do anything illegal or anything that would jeopardize our future, should we both agree we want one together. Any and all advice is appreciated greatly and thanks again to you all!

In thinking about this, I might have a heart attack if she got turned away. I do think that would just crush my morale.

She's having her mother drive here to North Dakota, then catching a flight here. Two fold reason there. First, it's 300 bucks cheaper. Secondly, if there is an issue, she can just go home with mama. And she's not stranded alone in some place with no one.

For my NOA2, I can't help but wonder how nice it would be to have a job where it was acceptable to have a 6 month turn around on requests. But I digress. I'm not bitter. wink.gif

What I do have for you guys today though is a couple questions. I've read through more pages and wikis and forums, and guides than I care to recount for one day. So, straight to the horse's mouth I go.

My fiance is planning a visit to see me in August. She'll be here 10 days and returning home to sit out this process like I am. She lives in Sask, Canada and I'm in Pennsylvania. I've read several places that say it's a good idea for her to have proof of ties to Canada to aid in her being allowed to visit. I'm just looking for ideas as to what those things might be? A signed letter from her employer? Thanks!

Part 2 of my query for today: For someone residing in Regina, SK, where would they attend their interview? Or, what options would they have. I have recieved 5 different answers from 5 different people. So I thought I'd check with you cats. Thanks in advance!

Same thing pretty much just happened to my fiance in Napoli. We would have NEVER done the Fiance Visa if we knew this would happen. I have a job and make above what is necessary to support him but I only have been working for a few months as I was living the year before that with my fiance in Italy. Our joint sponsor also make more than double the amount of the 125 percent above poverty level. We are still pursuing it and I am going to my Congressman and if necessary we will hire an attorney. It is very deceiving and I am so very disappointed in this system. How do they expect me to now leave my new job and go to Italy, get married, return and wait the 1 to 2 year wait for the spousal Visa???? There has to be a better solution!!!

Hey Dutch,

Check with your local Stadhuis to see if they will accept a marriage in Las Vegas. I have some EU friends who got married in Las Vegas years ago who recently moved to the Netherlands (Leiden) and their Las Vegas marriage certificate was not accepted by the stadhuis here.

And I know the rules for an American citizen marrying an Dutch citizen suck. They make it pretty much impossible for a non-EU citizen to marry an Dutch citizen. My fiance and I have looked into it.

I filed married, filing jointly, with the attached W7. The refund (paper check) has come in payable to both of us, and now we have a problem. He's not listed on any of my bank accounts, and of course, since our petition is in process, he can't personally come here, which is a requirement for adding him to my account.

Thanks for your reply. No, he didn't use a lawyer. It was just a district court hearing before a single judge. It occurred long before Ireland became computerized, so this is going to take forever. I'm scared we're going to be sitting waiting at the NVC for months because we can't provide anything.

We are at the point where we need to provide our civil documents, including prison records.

I checked the reciprocity thing, and Ireland says prison records are "available." That means, they're going to expect them for my husband's crime in 1982.

We wrote to the court for the criminal charges - nothing found.
We wrote to the prison back in April - no response.
We requested his PCC ages ago, and they just keep saying they're "working on it."

My husband called the prison this morning and got some excuse about records being archived and everything's up in the air. Long story short - I don't think we'll be able to get them.

I guess my question is this - what happens if we simply can't provide the court and prison records to clarify what the PCC will undoubtedly show?

We've had such a hard time getting any response from any of the places you're supposed to request this stuff from.

So now here we sit, having rushed our way to this point, and we're at a complete stand still.

Should I send what we have and wait for the request for more info?

My husband has no bank account or credit card, and sadly, we neglected to put him on my accounts before he left the US. He pays for everything in cash.

I was wondering if anyone has ever tried those credit cards you can buy and refill from Walmart. They make a student edition, which means that the US Citizen could reload them from here, and our spouses could use them in their home countries. The paperwork says that they are valid anyplace credit cards or debit cards are accepted. I think it costs $3 a month to have the card, and of course, there ATM fees for withdrawals, but it seems like maybe this would be a good way to pay the fees without having to carry cash?

Anybody tried it?

It was the paper check. No bank would deposit it without foreign spouse being present with identification. And since he can't enter the country, that's impossible. I even wrote to the IRS and explained the situation, and the reply was that I should send the check to my spouse and have him endorse it so that it can be negotiated. Oh gee, ya think? blink.gif They totally didn't get what I was trying to tell them. It had already been endorsed by spouse and nobody would deposit it!

We'd have been much better off if we'd have put an account number on the return for direct deposit.

One word of caution: if you don't have a joint bank account, and you file a paper return jointly, any refund check will be made payable to BOTH of you, unless you put an account number on the return.

I filed a paper return and had one heck of a time getting my tax refund deposited. Believe it or not, I just got it in the bank last week!! Most banks want both parties there with ID. If your spouse can't enter the country because of a pending Petition, it's a problem.

I'm glad to read this because I just Express Mailed my package Friday, and I specifically told the guy I didn't not want Saturday delivery. We did not check Saturday Delivery, so imagine my panic when I read the notice on the USPS tracking page that indicated they attempted to deliver on Saturday and left a note indicating that it could be picked up at the post office and after 5 days, it would be returned to sender....

I'm scared to death. I'll call in the morning just to be sure, but after reading the posts here, my heart rate has at least calmed down a bit.

If you know the county in which the divorce was filed, you can write to the clerk of courts. Check for them online, and they may have their fees for obtaining the documents online.

Thanks, you guys are sweet. I'm naturally devastated and scared that my future is nothing but sadness. I have health concerns, and care for my 71-year old mother, so I simply cannot move to Ireland. While I would happily die in the arms of my husband, I simply will not leave my mother, who took care of me when I was vulnerable.

In the end, I may be asked to choose between my husband and my mom - who can do that? It's an impossible situation.

BTW, Selma, your big day is fast approaching!

I can't believe there aren't more first week of December interviews. Just a handful of us! I guess maybe a lot of the embassies were filled for December by the time NVC got to scheduling. I think the USCIS picked up the pace starting in February, and maybe the NVC has been having trouble keeping up.

hi guys i just called the NVC automated system and i've just found out the they alredy have generated AOS Bill and the DS-3032.so my question is can i use the fillable forms to save some time?or i must use the original form?THANKZ



With the form I-864 you can use a fillable form but, with regards to DS3032, you have to use the original as it has a barcode and the case number on top of the form.
