Till now i have been working on how to renew my passport. I live in Florida, I found a website which the name is the Philippines Consulate and there is one in Miami....http://www.philippineembassy-usa.org/. I have told that I can renew my passport there. I called and talked to them and asked my problem. I have been told that I can only go to Washington D.C to renew my passport.
I also need to change my name in my passport into my husband's last name, so the consulate in Miami told me they can do it and that I just have to bring my "original marriage certificate" but not renewing the passport because they dont do it there and that they told me to go to Washington D.C. Now I am screwed because anyone I asked told me you can do it in your nearest consulate in your area. I dont know who to believe.
Is there anyone know about this situation??

hi, if you are renewing your passport with your married name and you are married here in USA you need to submit a report of marriage that can be download the form to the philippine consulate washington dc website, i live in kentucky and i already have an approved report of marriage that they sent to me but they cant renew my philipine passport which is a brown machine readable passport, they told me to apply for a new passport and not to renew it and they need me to appear personally to apply for a new passport but i dont have time to do that because i cant travel from kentucky to washington dc and im waiting few weeks from now and having a new born baby, i will just apply for a new passport when i get there to the philippines after i give birth and luckily we are moving in korea in august and i will have time to go to philippines to do that stuff.

PhilippinesDoes your wife think the US is too cold ?

Just wondering after your bride gets to the USA if she has problems adjusting thinking the USA is too cold all the time even in normal temps.

My wife to be said it was "cold" a few times in phil and I was thinking I wonder what she's talking about because I can see in the weather report the low is like 70-75 degrees at the time.

When I was with her on Christmas in Mindanao I was sweating all the time as usual.. lol. One time at night maybe it was 70 or 72 and she said it was cold. I was wondering what she was talking about but sometimes we had the air con on in the room and I was a little cold but she was ok.

My Dad's friend married a girl from Thailand and the weather was a big adjustment thing to her even though she moved to Arizona.

I saw one guy here lived in Alaska and had pics of his wife in the snow and they looked happy as could be.

I'm just wondering from your experience if the weather was a big adjustment issue for your wife or if it wasn't much of a big deal... :)



hi, yes its a very big adjustment, cold weather is difficult for me and i never used to it especially now that snowing in kentucky and i cant even go outside, but my husband bought me a warmer and electronic blanket for my sleep to keep me warm and turn on the heater for me, he knows its a big difference in the philippines.
but yes we enjoy snow and we even took pictures, even it so cold outside its nice to see the snow for the first time. and i preferred warm foods the same time.

Then, we were told to proceed to the 5th Floor to pay the medical fees at the Cashier.
Adult - P10,454.15
Child - P9,082.15 (14 years of age and below)
(It would be nice if you had the exact amount ready)
Then on the same floor, our vital signs,height & weight & eye test were taken.
Then we were told to go to the 2nd floor for Immunization Interview and Tuberculin test for your child.
I brought along my sons baby book. Please also know the license number of your pediatrician.
I was told that I was getting 3 shots. It would've been only 2 but I had no chicken pox marks to show them.
My son also gets 3 shots. We were told to come back 2 days after to find out the Tuberculin test of my son.
If you have your baby book, you will be asked to bring two photocopies of your baby's immunization record.
Then I was told to get my X-Ray on the 3rd floor wherein you have to squeeze in with other women in a small dressing room.
In here, you need to take off only your top including your bra and wear their robe. No dangling earrings and for long hair, you will be asked to tie them up. Children will not go through X-Ray unless their Tuberculin Test is positive.
Then off we go to the 4th floor. Your blood will be extracted for HIV test and Urine for Pregnancy Test. Again, your child will not go through this.
Last but not the least... US Counter, 5th floor. Here, my son went first because I had to be in the cubicle with him. The male doctor asked a few questions and told my son to disrobe.
Then it was my turn, the lady doctor will ask you questions then tell you to disrobe. They check your arms for needle marks (drug use) and slashes (if you have suicidal tendencies).
Then the lady at the US counter will give you back your passports and receipts. These will be shown to the guard when you return. We were out of there by 12noon.

DAY 2 - May 20, 2009
We were told to be there at 9AM. Showed our passports & receipts to the guard. We went straight to 2nd floor to have my son's Tuberculin test read. I was so relieved when the doctor said the test were negative. FYI - You would know if your child is positive if the injected part swells. I asked the doctor of course,because I was curious.
Then my name was called at that same floor and asked to proceed at the check out counter and I was asked to give them (2) 2x2 Passport size photos. Again, please make sure to jot down your full name at the back of each photo.
Again, my name was called to proceed to the Immunization Room (same floor). Had my 3 shots which was surprisingly not bad.
The lady nurse was good. I even requested if she could do the shots for my son later. After awhile my name was called to proceed at a certain counter, Ground floor (Releasing Area). I was asked if I had with me a photocopy of my annulment papers. Both Certificate of Finality and the Decision papers. Of course, I did not have it because I never came across a post that mentioned anything about bringing them with you. Anyways, the guy at the counter asked me if I was the petitioner and who was found psychologically incapacitated? I said, I was the petitioner and the respondent (your ex-husband) was found psychologically incapacitated. Then he said, In that case, You won't be needing to undergo psychological evaluation. I was given back my passport and receipt and told to come back the next day and bring the photocopy of the finality and decision. This is where I decided to write this post. To save you guys another trip of going to SLEC. Then finally my son's name was called at the check out counter (2nd floor) and we had to give them (2) 2x2 photos. Then wait for his name to be called in the Immunization room. Fortunately enough, the same lady nurse had my son's record so she did my son's shots. After your immunizations, you will be told to go down to the Ground floor for Releasing. Now THIS part is the long wait. It was around 345pm when I decided to ask if we could just go back tomorrow for my son's releasing paper since I had to go back anyways to bring in my annulment papers. And they said, it was ok.

Day3 - May 21, 2009
The guy told us to come back at 9AM and we did. Showed passport and receipt to the guard. Submitted my papers directly to the guy that told me to come back. Told us to take a seat and wait for our names to be called. I saw him reading my papers while he was on the phone. At this moment, I was getting nervous. Then he placed the phone down and seemed like everything was okay. He just needed to see that I was indeed the petitioner and that the respondent was the one who was found psychologically incapacitated. My son's name was called and then soon after, I heard my name. We were given our personal copy of Immunization Records and I was given a CD containing my X-RAY result. SLEC will be the one to forward your passport/s to the USEM. My son and I were so happy we were done and out in an hour.

TIPS:
Food is not allowed but people were able to sneak in crackers and chips. Just make sure the guard does not see it upon entering.
We also brought with us 2 small bottles of water. This, you can bring in. There are also water fountains stationed on each floor, if I'm not mistaken.
Print and bring with you a copy of the map of SLEC.
LADIES - know the date of your first and last day of menstruation. This would be asked on the form and personally by the nurse and doctor. And wear comfortable clothes for the wait and clothes that would be easy for you to disrobe.
TO MOTHER'S - There are no Tuberculin test on a Thursday. So make sure you go on other days. Results will take 2 days.
There will be times that you will be told to have your lunch first or just come back because it will take 2 hours for them to type up the result or the room is full and some nurses took their break so we suggest you take yours too. Well, we didn't move an inch. And our names were called short after.
If you can bring extra copies with you like extra passport size photos and an extra copy of the letter from the USEM, why not.
Lastly to those women who were annulled but are not the petitioner and you were the one who was found psychologically incapacitated... According to SLEC : MNL USEM requires you to undergo Psychological evaluation. I inquired more about this and this was what the nurse told me at the Releasing counter. You will be asked to call and book for an appointment. He was not certain of the fee but the nurse said around P2,000 or less. And then, results will take 4-5 days.
I know this is such a long post but if i could save you another trip of going to SLEC, well and good.

Same situation, the SLEC said it looks suspicious and they didnot explain deeper about it, and they're not sure what is it, but i dont have history of tb, i dont have cough and colds, the one thing that they want to make sure is to have a clear lungs and because of H1N1, i feel its unfair, my lungs is clear also from other doctor findings. now i am waiting for 2 months..sad..sad

i am more than 7 mos prego and we are really in a hurry and had my ticket dated jan 4, 2012 and i need to have my visa in hand on the 3rd so i can still have time for sticker in CFO (i already have attended the seminal just going there to get the sticker) We are planning to deliver our baby in the U.S. but at the embassy after interview they said i need to get new passport since my passport is defective (it was wet- i already had processed and will get it on the 27th)... so my question is, after sending my passport to them, im planning to ask and try to go to embassy if i can just deliver personally & pick up my passport/visa right at the embassy and will tell them that i already have a ticket. since i heard they accommodate expedite for pregos... so i just want to know if its really possible???? anybody tried pick up the visa at the embassy instead of the long and uncertain date to when we can really receive the visa through there courier??

Is it ok to block out or to cover SSN and Account number of a petitioner on affidavit of Support? i read that some petitioner are worried about their personal numbers/personal info.
Does it will cause problem during interview that Petitioners SSN and account number are not seen.
What if its petitioners choice to keep it private from the interview of his fiance? is it true it wont affect the documents because the important is the petitioner paid yearly taxes and above poverty and have a secure job?

Some petitioner decide to block out the numbers because before their money was lost through their SSN. And theres no reason to blame a petitioner because they want to secure money and their life. its the right of the petitioner and the SSN should be kept privately and not to show it to anybody.

hi kilipit! welcome to the group! you may call US embassy manila call center (1-909-101-7878) even if you dont have the letter, they will give you your case number and you can even set your interview appointment. you were actually just waiting for a letter of eligibility for interview from USEM (US embassy Manila) that's just what i had received and nothing else. You have the same case as my friend, shes a january filler, she got the NOA2 around March but until now she doesnt have the letter. she called the call center and USEM (US embassy MAnila) they did confirm that the letter is already being sent, they asked her if she wants to set up the appointment anyway, she said OK. I think you can also have the medical as well if you want to, just print the NOA2 email to show it to the guard at ST Lukes Medical.

I have a Questions for today from a friend.


Her petitioner was divorced twice, the fiance only have the second divorce decree of her petitioner on her up coming interview and this is also submitted as part of an application to Vermont, and they didnot ask any additional documents and they were approved.

The first divorce decree is in USA and cant get it right away because the petitioner is still in iraq for work. the fiance remember that her petitioner submit an email and proof of relationship in Vermont, one email is pertaining about the first ex wife divorced and the second ex wife divorced topic.

Her concern is, they said that whatever you sent to NVC will be forwarded to US Embassy, she is worried what if they read that during her interview and she will be ask if how many times her petitioner divorced, and she likes to answer it only once (instead of twice) because she have only the 2nd divorced decree on her hand, her petitioner didnt include the first ex wife name in G-325A because the divorced decree is in USA.(only included is the name of the second ex wife because he has the divorced decree on his hand)

her petitioner first marriage last for 3 months and then divorced
the second marriage last for 17 years and then divorced

Whats the best answer during her interview?

if she will tell that her petitioner was divorced only once, she can provide the second divorced decree.

if she will tell twice, she needs the first divorced decree too.

any opinion out there?

My hubby and I met online and we been talking for 2 years over internet. and then decided to get married. He flew here and got married. In short we met once and its on our wedding day. He spent here 2 weeks.And now he cant be have a vacation because he will be fire if he will. Their company is really strict. He can have a vacation on july and nov.

On interview the consul will ask how many times he visited you or how many times he come here. If I tell them we met once and it was our wedding Do you think it will cause a problem? They can denied me???

Me and My fiance (my husband now) just met once for 4 days and we had engagement party. then he filed the application for fiance visa, we did not receive any RFE and i had my interviewed in US Embassy, yes there's a possibility that the consul will ask you if how many times your fiance or husband visited you, even the pre-screener will ask you that, it was asked to me and i said ONLY ONCE, at that time my fiance working in Iraq as Chief in US Army so theres a valid reason for that, just be honest, i remember the consul ask me if its really love if we only spent time in a short vacation and i said what my heart said. I had only 2 minutes on my interviewed and the consul said, your visa is approved! now Im just waiting for my greencard to arrived without interview.

Ok, I'm going to say to your "friend" the same thing I said to you in the other thread. My attorney told me that the consulate in my fiancee's country has an investigations unit, and the investigators there often purchase background checks on the petitioner from private firms like Choicepoint. Apparently, it's less expensive than actually doing the background checks themselves. The purpose of the checks is to dig up information "not known to USCIS at the time the original petition was filed". This last part is important, because it is the foundation of most applications denied by the consulate under 221(g). The background checks usually include the results of a search through public records. That search will usually reveal previous a previous marriage or divorce.

Not every embassy or consulate does these investigations, and you didn't tell us which country was involved. So, the questions are...

Can the consulate find out about the previous divorce? The answer is yes. Will the consulate find out? The answer is unknown, but you should assume that they will. If you don't reveal the first divorce and the consulate finds out, then there are only two possible outcomes, and both are potentially bad. If they ask you if he was married twice and you say "yes", then they're going to want to know what it wasn't declared. At the least, they'll want the documentation for the first marriage. At the most, your application will be denied for misrepresentation. If you say "no", your application will be probably be denied for misrepresentation.

Once your application is denied for misrepresentation then you'll be barred from coming to the US unless you can get a waiver.

Your fiance's excuse about not being able to get the documentation for the first marriage because he was out of the country is weak. Unlike birth certificates, many states maintain these records at the county level rather than the state level, but most counties that I'm aware of don't require you to be physically present in their office to order a certified copy of a divorce decree. I got a copy of the divorce decree for my first marriage by writing a simple one-page request letter, and including a photocopy of my driver's license and a check for $2. I live 2000 miles away from the county where the divorce took place. Your fiance could have easily done this while he was in Iraq.

Ok listen, and I just read your post again where you say he did not list the first marriage on the G-325a so I can absolutely say he did not list on the I-129f. If this story is true, and now I question that, you are both playing with fire. My advice is abandon this attempt at fraud and start all over with a properly filed petition.

By the way, I got my divorce decree about the same way and did not need a copy of the drivers license! It was the easiest of the documents to obtain.

And not to pick on any one nationality, but these types of posts ALWAYS seem to come from Phillipines. What's up with that? Multiple posts from various member names about the same problem or "freinds" trying to slip around one rule or another. You realize it is why this is a difficult process for legitimate couples with SO in the Phillipines? Nice.

One thing for sure, she and her petitioner decide to show the first divorce decree on her up coming interview, she would prefer to say "twice" and if they ask why the petitioner didnt include it on I-129F and G-325A it because the petitioner thought it was only the most recent divorced that needs to put and that time he needs to fly back to iraq for work. however its good that the petitioner is willing to present the first divorced paper on the interview.

It was said that the packet is already in the Consulate for her up coming interview. they decide that they need to correct and show evidences to fill in the blanks.

her petitioner would like to give her fiance a new I-129F and G-325A completed and signed and notarized it and wrote the first and second divorced name of previous spouses and with the two divorced decree together to show it on her interview.

a waiver or statement and notarized it indicating that the missing name for first marriage and the first divorced decree is unintentional so that once they will ask for it, the fiance can show it directly to the consulate, on her interview.

Now you are confusing yourself. Read your second sentence. "I didn't get answered when I let her use the word 'I'". wacko.gif It would be so much easier if everyone told the truth and provided the necessary documents.

OK, I really don't care if you, your friend or the man on the moon want to lie to the State department and USCIS. Makes absolutely no difference in my life. Well, maybe it does, since then the honest people have to wait longer while they check out your friend's complicated can of fraudulent worms. But on the chance someone else can learn from this....

There is no "waiver" for concealing prior marriages and not providing necessary documents. The visa for "you" if I may use that word, or your friend, will at minimum be denied, the case sent back to USCIS and at minimum be re-adjudicated. That means your friend and her fiance get to start over, at minimum.

A "new I-129f and G-325a" cannot just be given to his fiancee and presented at the interview. The consulate does not adjudicate petitions. There is one way, and one way only, to do this legally. Be it you, your friend or whoever....

Cancel the upcoming interview. Withdraw the existing petition. Start over with a new petition. At that time, your friend's dumb@ss fiance can explain himself to the USCIS when a second divorce shows up on his petition. This is NOT your friend's problem, it is her fiance's problem. If she goes along with it and is complicit in it, it BECOMES her problem.

That is just the technical aspect. Your friend is engaged to a man that did not care enough about her to follow the rules, step by step, item by item to achieve the final goal of being together with the woman he loves. They plan to marry for life, yet her fiance rushes things through, does not get a necessary document, puts the enitre process at risk and risks his future and hers over a divorce decree that can be obtained in a matter of weeks...tops, probably much sooner. In my opinion the guy is, at least, complete self-centered dumb@ss who considers you..oops, your friend, a disposable asset. Maybe much more than a missing document should be considered here, that is if anything about this relationship is legitimate. It may just be your friend wants a green card and her fiance wants a temporary sex toy, all the same to me.


Comment.. its not advisable to cancel upcoming interview, again there's an appeal, who knows she can have her visa, she get too much judgment here which is not good for some who experiencing problem during process. be gentle for some words.

Ok, I'm going to say to your "friend" the same thing I said to you in the other thread. My attorney told me that the consulate in my fiancee's country has an investigations unit, and the investigators there often purchase background checks on the petitioner from private firms like Choicepoint. Apparently, it's less expensive than actually doing the background checks themselves. The purpose of the checks is to dig up information "not known to USCIS at the time the original petition was filed". This last part is important, because it is the foundation of most applications denied by the consulate under 221(g). The background checks usually include the results of a search through public records. That search will usually reveal previous a previous marriage or divorce.

Not every embassy or consulate does these investigations, and you didn't tell us which country was involved. So, the questions are...

Can the consulate find out about the previous divorce? The answer is yes. Will the consulate find out? The answer is unknown, but you should assume that they will. If you don't reveal the first divorce and the consulate finds out, then there are only two possible outcomes, and both are potentially bad. If they ask you if he was married twice and you say "yes", then they're going to want to know what it wasn't declared. At the least, they'll want the documentation for the first marriage. At the most, your application will be denied for misrepresentation. If you say "no", your application will be probably be denied for misrepresentation.

Once your application is denied for misrepresentation then you'll be barred from coming to the US unless you can get a waiver.

Your fiance's excuse about not being able to get the documentation for the first marriage because he was out of the country is weak. Unlike birth certificates, many states maintain these records at the county level rather than the state level, but most counties that I'm aware of don't require you to be physically present in their office to order a certified copy of a divorce decree. I got a copy of the divorce decree for my first marriage by writing a simple one-page request letter, and including a photocopy of my driver's license and a check for $2. I live 2000 miles away from the county where the divorce took place. Your fiance could have easily done this while he was in Iraq.

Ok listen, and I just read your post again where you say he did not list the first marriage on the G-325a so I can absolutely say he did not list on the I-129f. If this story is true, and now I question that, you are both playing with fire. My advice is abandon this attempt at fraud and start all over with a properly filed petition.

By the way, I got my divorce decree about the same way and did not need a copy of the drivers license! It was the easiest of the documents to obtain.

And not to pick on any one nationality, but these types of posts ALWAYS seem to come from Phillipines. What's up with that? Multiple posts from various member names about the same problem or "freinds" trying to slip around one rule or another. You realize it is why this is a difficult process for legitimate couples with SO in the Phillipines? Nice.

her petitioner would like to give her fiance a new I-129F and G-325A completed and signed and notarized it and wrote the first and second divorced name of previous spouses and with the two divorced decree together to show it on her interview.

a waiver or statement and notarized it indicating that the missing name for first marriage and the first divorced decree is unintentional so that once they will ask for it, the fiance can show it directly to the consulate, on her interview.

Her petitioner was divorced twice, the fiance only have the second divorce decree of her petitioner on her up coming interview and this is also submitted as part of an application to Vermont, and they didnot ask any additional documents and they were approved.

The first divorce decree is in USA and cant get it right away because the petitioner is still in iraq for work. the fiance remember that her petitioner submit an email and proof of relationship in Vermont, one email is pertaining about the first ex wife divorced and the second ex wife divorced topic.

Her concern is, they said that whatever you sent to NVC will be forwarded to US Embassy, she is worried what if they read that during her interview and she will be ask if how many times her petitioner divorced, and she likes to answer it only once (instead of twice) because she have only the 2nd divorced decree on her hand, her petitioner didnt include the first ex wife name in G-325A because the divorced decree is in USA.(only included is the name of the second ex wife because he has the divorced decree on his hand)

her petitioner first marriage last for 3 months and then divorced
the second marriage last for 17 years and then divorced

Whats the best answer during her interview?

if she will tell that her petitioner was divorced only once, she can provide the second divorced decree.

if she will tell twice, she needs the first divorced decree too.

any opinion out there?

I am sure the answer to my question is somewhere in this forum but my eyes started to burn from staring at the screen so long searching for it and my head started to hurt from all the acronyms being used. I was wondering what happens after I receive the NOA2? The US Embassy we will be dealing with is located in Manila, Philippines. Does the Embassy send a package to my fiance when they receive the approval from my Vermont service center? This amount of paperwork is insane but my asawa is worth it. It's crazy the how and where you will meet that special person that you see yourself spending the rest of your life with. It was for me anyway.

Also, on a side note I am a bit leery of the amount of money i make and if they will deny us for that reason. I make over the poverty limit for 4 people since we both have children. I don't have much in my account because I have been sending money to my fiance and I have traveled to the Philippines four times this year. I made under the poverty limit in 2008 due to losing my job and being out of work for a couple months during the crappy economy. Does anyone think that would be a problem. I also moved in with my mom because she recently got a divorce and needed help with things around the house and the bills. I basically just help out with bills when needed and don't have a set rent. Does anyone think that would raise a flag in the interview? I intend on going to the interview with my fiance whenever we get it all worked out and set a date. Hopefully i can only stay a week after the interview and she can get her visa and we can fly back together. Well I hope someone on here can give a little advice or help with answering some of these questions.

She will received it by email and theres an instruction on where she needs to follow, read and download forms that she will need to fill out for her interview. and on your side you will received a letter from NVC that they will forward the approval to US embassy Manila. she can ready now her documents such as original birth certificate, cenomar, police certificate, nbi clearance, she will need documents from you too and its all listed on that email for her to follow, once she received the email she can go to St lukes for her medical and she needs to print that stuff to bring with her, and bring cash to pay for it. plus money for visa fee. i dont think you will have an issue on this red flag, if you are not sure on meeting a poverty guidelines just go ahead and find a good friend or relatives that could help for affidavit of support. a week to stay with your fiance on her interview might be good for you but you never know what will happen on her interview day, she might get her visa in a week or she will have a delayed visa issue depends on how her interview will be like. hope it helps.

yes, you said it right.
you will have the original police clearance and original NBi certificate/clearance on your interview day.
make sure you have all your originals documents with you.
for this processing all you have to do is complete all the documents, all documents that you think are helpful to your relationship will do. if you have an engagement pictures with you and your fiance you can include that. make a copies of your own on every thing that you are sending as part of your K1 application.

Me and my fiancè are having problems with the address for the petition. He's the citizen, he's in the military and he will send the petition right before going to deployment. It means he wouldn't be able to check the mail. Is there a solution to that? Can he like add a secondary address (like some relative's) where he can get the notifications? How?

I'm new to the forum. Thanks to VisaJourney, my fiancee got her visa approved and she'll be coming to the States in Jan. In my case, it might be a little different, I will actually be going visit her in Taiwan, then return to the States with her. Also, her mom will be tagging along and staying with us for 3 weeks. So my question is since there are separate lanes designated for US citizens and non-citizens at customs, can I accompany them going through the non-citizens lane? I could perhaps provide translations if deemed necessary, or is that not a good idea? The only reason I'm asking is because the last thing I want to do is anger a customs officer, making the whole process unpleasant. Not to generalize, but from other forums that I've came across, some customs officers give K-1 visa holders a hard time. So any experience in this regard would be greatly appreciated. you can accompany her on the line for non US Citizen on the port of entry, you dont have be separated and your mother in law can fall in line together with you as family. if the officer will tell you different then do so.

In your friend's case, it sounds like it was willful misrepresentation to both USCIS and your friend. I don't know if it was "lucky" or not. I don't know if either USCIS or the consulate would normally have found out, or if it would have been typical for them to miss it. As I said in my previous post, I don't know if they will find out, I only know that they can find out. In either case, when someone lies and gets away with it I don't think that's "lucky".

If it was caught at the USCIS stage then I suspect they would just issue an RFE for the first divorce decree. There are several people in the RFE master list thread who only submitted the most recent divorce decree and got RFE's for the previous ones. In some cases, the previous marriage was revealed on the G-325A, so figuring out there was a divorce decree missing wasn't exactly rocket science for the adjudicator, nor would they likely presume it was willful misrepresentation since the petitioner did reveal it - they just neglected to provide documentation for it. Consulates tend to be less forgiving if they discover something USCIS didn't know about.

It's not unreasonable that someone would assume the previous divorce decrees wouldn't be necessary. The US doesn't allow polygamy, so someone could reasonably presume that getting married a second time implies that the previous marriage ended in divorce, and that the only proof needed would be the most recent divorce. That's an honest oversight that comes from not reading or following the instructions. That's not the same as intentionally leaving this information out of the application because it was inconvenient to obtain the documentation.

I'm a little surprised your friend was engaged to someone who was somewhat closely related to her and she didn't find out about his first marriage sooner. From what I've seen of my friends from the PI, gossiping about family and friends is a major pastime. Everybody knows what everybody else is doing. blush.gif

I don't know if they will find out about his first marriage. However, I do know that they can find out, if they do some basic background checks. My understanding is that they often purchase a report from a company like Choicepoint. These reports contain information like where he has lived, his driving record, his employment history, and public records, which can include criminal history and marriage/divorce records. It's difficult to say what they will know, but it's safe to say that any high fraud consulate is going to have an investigations unit that will attempt to collect at least some of this information.

It's not wise to have submitted a petition when he knew there was information missing. The fact that it was marginally difficult to get the records at the time is not going to be viewed as a good excuse. All it takes to get a copy of a divorce decree is a letter, a photocopy of some identification, and a small processing fee. He could have done this while he was in Iraq with minimal difficulty.

Let's presume that they find out about the first marriage. If they ask you at the interview about any marriages previous to his last one, and you say "Yes", then they're going to want to know why it wasn't disclosed in the petition. At the very least, they're going to demand you produce the documentation on the first marriage. At most, they'll send the petition back to USCIS with a recommendation that it be revoked. If you say "No", then they'll probably presume that he intentionally misrepresented his case, and they'll send it back to USCIS with a recommendation that it be revoked. Since the misrepresentation is real, you won't have much chance on appeal. You'll receive a 10 year ban, and he'll need to apply for a waiver before he can resubmit the application.

At this point, I don't know if it's possible to submit this information since it modifies the original petition. You fiance wasn't honest before, but if you want to salvage the application then I suggest he start being honest now. Whoever has the petition now, NVC or consulate, he should contact them and tell them about the situation, and ask how he can go about submitting his divorce documents from his first marriage.
