I am one of a countless number of United States Citizens who has applied for an I-129F, Petition for Alien Fiancé, for my fiancé who is at this time a citizen of <<COUNTRY>>. I filed this petition on her behalf on <DATE>, and the petition was received by the Vermont Service Center on the <<DATE>>.

I have seen press releases regarding how backlogs were supposed to be cleared by certain dates, and thus the processing of these petitions should return to more desirable waiting times. However, it appears that with each passing day, the waiting gets longer and longer.

• Net/Net: If I was on a H1B work visa, and got married, the visa processing would take 24 hours. However, as a US Citizen, I have to wait for almost 8 months to 10 months to get my wife/fiancé to the U.S. Where is the justice here???

The crux of the issue is far less about processing times, but about the lack of transparency that is being displayed by United States Citizen and Immigration Services (USCIS). At one point, the web site for USCIS displayed receipt dates that had been processed, but at this time simply displays a blanket date of “6 months.”

I wish to share some specific concerns with you so as to offer insight into how the petition process is currently affecting citizens.


• Net/Net: If I was on a H1B work visa, and got married, the visa processing would take 24 hours. However, as a US Citizen, I have to wait for almost 8 months to 10 months to get my wife/fiancé to the U.S. Where is the justice here???


• Significant delays in the processing of petitions. Many of us who filed
in May through the date of this letter are noticing that an extremely small
number of petitions have been processed/approved.
• A strong opinion that the prioritization of visas from applicants to work is inappropriate compared to the processing of family and marriage based immigration.
• A lack of accountability on the part of USCIS. No matter who we speak to, no matter what we are told, it seems impossible to gain any true information.
• Extremely poor customer service. Petitioners often get the run around from those working USCIS call centers or service centers, and are often read form statements that only regurgitate the blanket information on processing times from the various web sites of USCIS. One member has had a representative tell him his case was with an officer and was to be adjudicated within a short time frame, only to still be left in the dark two weeks later.
• Continued press releases from USCIS stressing the “importance” of processing employment-based Visas, or the Adjustment of Status petitions from others who already have their visas, yet leaving any K1 or K3 petitioners in the dark on their status.

I recognize that immigration benefits for my spouses is a privilege and not a right, however, being a United States Citizen, feel I deserve accurate information and the opportunity to have my concern addressed by knowledgeable officials who can give me facts (not inaccurate time estimates and scripted misinformation designed to appease nervous and sad callers). I also understand the need for security checks, as I am aware of our national security issues, but I do not believe this is the source of the most recent delays. Only the truth and some swift action on the part of USCIS can alleviate some of the stress associated with this process. My life, along with my loved ones abroad, are on hold and we have no idea when this first part of the immigration process will conclude. It is difficult to plan weddings, coordinate other family members, or plan essentially anything until this process resolves itself.

The wait for a petition to reach National Visa Center, then the appropriate Embassy and, finally, the attendance of the beneficiary at scheduled interview can add an additional 3 – 12 months to an already excruciatingly slow process. The USCIS needs to set a reasonable goal of 90 days and/or have expedited processing available for K1/K3 VISA applicants. Currently, we are completely and utterly at the mercy of the system.

I am not trying to make ‘demands’ as such. I am beyond frustrated with the process and feel that the process should be better run, and information should be much easier to come by. As a Citizen of the country, I feel that my requests for information and action are not unreasonable. I am simply devoted Americans lost in a sea of bureaucracy and red tape. While this is a generally accepted part of American life, these petitions and visas are dealing with our hearts and souls in our significant others. I love my country, and only want to share that dream with those that we love as soon as possible.

As a citizen, I am writing to you on behalf of myself because I feel that I am at wit’s end. We want information, we want answers, and the government is failing to give us any. We are requesting that you use your connections and power to help us make this issue known. It is slowly reaching a crisis status for all of us who are awaiting these visas to be approved. Our hearts are heavy, and breaking, because we cannot do anything within the letter of the law to speed the process along and bring our loved ones into our arms. We are not asking for special treatment, we are simply asking for transparency and for answers. We hope that with your help, we can get the government to give us some answers, and maybe the situation may become more bearable.

I respectfully request a response to this letter, so that I may know that my concerns have been heard. Even if it is not feasible for something to be done immediately or at all, the knowledge that someone else knows about my personal plight and the plight of thousands of other Americans will help put my mind at ease, even if only slightly.

I got a toufh on Septemper 28th, I called and did the REF trick on September 6th though and no touches since. So probably the same story.. I am pritty bummed my date changed on my noa2 date till November the 8th.. Wateing sucks

I called the USCIS yesterday and was told most likely my fiancé would be here in December or January. I am just keeping my fingers crossed. My concern was with my last trip to the Philippines I made her pregnant biggrin.gif kicking.gif and was concerned with dealing with more paperwork with our new baby. I am sure the person from the USCIS was just tiring to keep me happy but it still made me feel really good to hear that.

Everyone with high phone bills needs to use some kind of voice over ip like yahoo or msn or skype. I have found even if it is used an an internet shop it saves a lot of money. Espesally those of us june filers that have fiance's in the Philippines. :)

I don't mean to be a whiner, but I think I had better stop looking at my K1 timeline on here - the estimated adjudication date keeps getting further and further away... It started out being mid-September, and now today it has jumped from Oct 14 to Oct 20. I know it doesn't really mean anything, but it's so depressing........!!!


My adjudication date started on the 6th of october and now it is the 24th. I agree. Very depressing. :(

This step does have an end. Ours took 10 months of being apart including preparation time. That truly was the hardest thing I have ever been through but I truly think it has made our relationship stronger.

I filed I-129F and have not received any NOA yet...however, my fiance who is on a work permit in New Zealand might go back to his home country in a few months....how do I notify the USCIS of the change in the address and the foreign emabassy?

I am sorry to say that I don't know the answer to your question but I do have a similar situation. My fiance is in New Zealand (currently on a visitor visa but applying for a work visa) but it is not his home country. Do you know if it will be possible for him to interview for the K1 in NZ even though he is not a national?


I am not sure about Visitor Visa...but if he gets his work visa then I am sure he can apply for interview in new zealand !



I am also too in the same spot. I called the USCIS about this and they didn't know either. She said to notify the US embassy in Manila when they received the paperwork. But really she wasn't sure either. There is a form that talks about address changed but that is for someone that is already here. She also thought a letter with the receipt number from NOA1 might help but probably wouldn't get it changed on the paperwork.

Problem with Skype there isn't a lot of proof that we talk becides screen shots.


I won't clutter this thread with it, but I downloaded a program that created a spreadsheet of all our Skype PC to PC voice/video calls (date, time, length, etc.). It came out looking like a massive phone bill. I'll put the details in off-topic.

I got a smaller credit card of mine put in my fiancé's name. That works very well. I get monthly statements and it is only $5 for her to get money. It is working out well



My aunt is going back to Vietnam so I figured I would pass some money to her to give to my fiancé to help her out with bills, food and school. I just wanted to show financial support in helping her out. I know that giving cash is hard to provide. I also figured that there might be no way of showing proof when it comes to cash.


Giving someone money is NOT proof of a relationship.



I completely agree that giving someone money is not, in and of itself, proof of a relationship. I do wonder however, if demonstrating support of your fiance(e) would/could be one part of a total picture of an ongoing relationship. I have often wondered if this fact would be looked on favorably or unfavorably by the consulate officer (CO) during the visa interview.

On the possible favorable side, the petitioner is demonstrating their comittment to support the beneficiary (loosely analagous to the support demostrations that will be required later at the approval phase via I-134, etc).

On the possible unfavorable side, the consular officer may view this support in a negative light: ie that the beneficiary is somehow demonstrating a (financial) dependancy on the petitioner. Even if no such dependancy actually exists, could the Consular Officer latch on to a perception of one?

Folks, please...No Flames...Please read the whole post...It's an honest question regarding perception of the CO at the visa interview.

Nowhere here am I saying that one should or should not provide money or other financial support to their beneficiary. Everyone should do as their circumstances and heart dictate.

Nowhere here am I saying that demonstration of support during the pre-interview timeline is asked for or required by any rule, form, law or any other such governmental vehicle.

The question is what is your opinion regarding the disclosure of any financial support that you may have given in terms of its potential impact on the CO at the visa interview: Irrelevent?, Beneficial?, Negative?

I also have her pay for there internet. When I was there I left her a laptop and we talk every day with Skype. That has lowered my phone bill a lot. Problem with Skype there isn't a lot of proof that we talk becides screen shots. On my credit card statement every month it shows I pay for internet. I also have her pull money to pay rent and power so the computer has power to work. In all it is still less then my phone bill.

Sorry you're not having a good day, but hopefully the RFE will be something easy that you can send to them as soon as you get the notice. At least you know they're working on your case and it'll resume as soon as you send back what they need. Most people get their approvals quickly after and RFE is taken care of. I know how said you must be since she just left as well, but at least you got to spend some time together...I'm envious smile.gif

I am really sorry to hear how you are being treated Alane. It really sucks. Out of the 3 times I called only once did I get someone that wouldn't tell me anything. I know they know if it is with an officer or not and I think it is bunk they aren't telling you. I involved a senator I am not sure if that helped or not but maybe. I wish I could offer more. My crazy point was at 148 days, so your doing a lot better then I did. If you still haven't heard anything next week I would call again. We are all praying for your speedy approval. Have faith.
