Hello  kcoyclay1, based on my experience (5 year rule as well)

1. I also sent PP-size photos and also took two extra to interview IO did not ask for them and they used the picture taken during my bio for Certificate.

2. I took 4 years of tax transcripts to the interview, again, IO did not ask for them.

3. You only need to give one acceptable answer, unless the question asks for more than one.

Good luck to you!!!

Thank you so much!

Hi guys,

I sent in PP-size photos with my application and I noted that in my interview letter it was suggested that I take 2 passport size pictures. Did anyone submit 2 yet had to take another set to the interview?

2. I'm filing based on 5 years rule and traveled only once for two weeks out of the country in the application it was not required that I submit tax documents, did you have to take tax documents? I file every year so that is no problem.

3.Another question regarding the test; there are some questions that have multiple answers like what does the judiciary branch do, why did the colonist fight the British, and what does the constitution do? Are we to give every answer or are they looking for only one?

Thanks for your response.

I am from march 8 and still no interview letter for me.. I wonder whats going on.

That's waaaay too long. Have you called them? After I called, I was given an ID and was told that an email would be sent to alert the office that my 90 days had already passed so that they could schedule me and a week later, I got my letter. Nothing beats a try.

Just to give an update from lawyers office this morning .my case does not involve AF here are the facts i was not sentence to jail or prison for 1 year and the lost was not over 10k. If I fell on that category it could of been an AF. Per my lawyer that has been practicing immigration for over 27 years now. My statutory 5 years ended in 2012 I count good moral character from 2007 the day I was sentenced at the court house. And im not inadmissible because the crime Did not happen during my admission . Just AN remind I came to the US in 1986 so I should be good . Just waiting for another week for my re interview WITH my LAWYER. I hope I get approve the same day . Im on my 5 months now since I applied for N400

I hope that you get approved the same day as well pinoyme. All the best.

Mexico, Latin & South AmericaYardies - How did you meet your SO?
Hi guys, sorry I didn't respond right away. I was busy sending out resume's and writing cover letters blah blah blah.

KK, u got the answer already, thanks to Hotlegz.

Dada, J2ustice, JAPrincess, sus and NatAndBen, thanks for the comments. Sometimes I feel like I'm watching my own movie as it feels so unreal lol.

I remembered in 2004 when I was in Ja and going through the cancer journey, it was really hard for me but I had a sense of hope within. I was just diagnosed with cancer and my employer told me that my job would be too stressful so it is best for me to stop working, in other words, resign. It was the truth so I resigned. My landlord told me that he would never tell me to leave because I was unemployed and was going through so much, but the second month of not receiving his rent he gave me a summons to appear in court for non-payment of rent. My decision to get help in the US separated me from my younger son who was already traumatised by my sickness. Life didn't look too great for me at the time and I remember asking the Lord to strengthen me in all of this.

In Octoer 2004 an ex who lived in NY told me that I could stay with him and his kids and he would do as much as he could to help. Believing that this was a great blessing as we kept in touch after a while and seemingly had a great friendship as he appeared so understanding and seemed truly concerned, I consented to his invitation. He would research information about my condition and make calls and help in any way he could. He even took a trip to Ja for a week to give me some moral support. I thought it was so sweet of him and three days after returning to NY he purchased my ticket so that I could travel two weeks later.

After arriving in the NY I discovered within two weeks that his plan was to upbraid me and make my life miserable while I was trying to heal. He gave me good food but he cursed me everyday and sometimes he would curse me and call me all sorts of names for hrs and hrs talking about how I left him ten years ago in 1994 (I left him for being unfaithful and verbally abusive). When we were seeing each other he would 'joke" about how the doctors thought he was schizophrenic when they admitted him into an institution but he didn't take the medication because they told him that he didn't need the medications. Stupid me believed what he said but ten years later after seeing him in his environment I realised he was truly schizophrenic as he had ALL the symptoms and would constantly talk about hearing voices that was telling him to kill me. He also always thought that everyone at his workplace was out to get him and were trying to make him lose his job.

He had books on how to separate a woman from her friends and family and then kill her and I am not making this up. The title was something like "How to make a woman stay with you" and as I read it i realised that it had more information than just making her stay with you. I had no money to buy my return ticket so I stuck it out. Luckily he was sent on government business to Denmark which gave me three months of peace of mind even though he would curse me via email and phone calls as his scitzo mind would rack up all sorts of thoughts.

I learnt how to take the blame for what "I did" in the past by ruining our "wonderful long-distant relationship" while I waited for him to purchase my ticket back to Ja. He even had the nerve to call me in Ja after I returned and cursed me out and even threatened me but I gave him the dial tone. He tried to pull the same stunt on me by calling me a month after my return to Ja to tell me that he would never treat me like that again but when I told him I was never going to return to his home, he cursed me and burned my cherished tapes of my children at age 2 that were left behind. I wasn't in a new relationship with this man, I thought we were just friends and he was helping me in time of need but I discovered that his sickness made him very revengeful and he also kept talking about us being together and happy, can u imagine that? I learnt that there is no such thing as common friendship with an ex, if they are too friendly and helpful 9 out of 10 times it is because they always want something more. It was my stepping stone and I didn't get the promised help but I learned something from it.

I went through a lot while I was diagnosed and God decided to step in and change it all. Beauty for ashes and joy for mourning was what I received when I met my wonderful husband as well as now being cancer-free.

We had a great day yesterday as we celebrated our second anniversary. Thanks for all who wished us well. I know this forum is about how we met our significant other and with all the joy I felt over meeting my husband I just wanted you guys to know that I believe it was a reward through the grace of God for all that I have been through. God bless you all

Mexico, Latin & South AmericaYardies - How did you meet your SO?
Hi everyone. I love to tell my story because I believe that my husband and I were really destined to be. It might not be as entertaining as most and I have to give you a little background first so grab the popcorn, here goes:

I came to the US on one of my annual visits in 2004 to see my first-born ( I have two sons); he lived in Florida and I truly wasn't sure when it was that I would see him again. You see, I was diagnosed with cancer in July 2004 and I didn't have a clue as to how to pay for the treatment so I took my two week vaction which I usually take in August to spend with him and celebrate his birthday. My family was all I could think about and how my diagnosis would affect them. We made it into a reunion and my sisters and their children came to Florida and all bundled up in my eldest sister's apartment. Eleven of us in a two bedroom, woyee.

Now the cost of the treatment was $850,000 and I had no money to take care of that so I decided to use that month's salary and pay for the trip. After the visit I returned to Jamaica and when I went to see the doctor she recommended that I return to the US and get into a hospital through the ER and there they will work out a payment plan.

Fast-forward to June 2005. A year passed and I had not received any treatment as I decided to build my immune system first. I had to return to the hospital for blood transfusion and the doctors told me that my prognosis wasn't good; they said that I am going to die because I delayed treatment and the cancer had spread. They told me to get on a flight within the week and as I get off the plane I am to go directly to the hospital and do not even think about going to anyone's home. Being a Christian and seriously hearing from the Lord I held on to everything that he told me and asked for three days grace period when I arrived in the US which he gave mebecause on the third day I had to call 911 because I was seriously ill (too graphic to write) and I was rushed to the hospital. I was admitted and spent thirteen days where I was given ten bags of blood in total and taken for radiation treatment at another hospital. The Oncolgy department at the hospital opened just for me on a Saturday because the doctor was moved with compassion. Doctors gave orders that if I needed them they were to be contacted without hesitation and the staff knew that. When I was released I had to return once a week for chemo and every day to the radiation department of another hospital for radiation.

Now what good can come out of this you might ask and where is the love story but here goes:
One day as I sat in the Oncology waiting room talking to another cancer patient I glanced across the room to see a man locked into a stare at my profile. I heard myself asking why is this man looking at me like that and turned away to continue my conversation but I could see him from the corner of my eye and the man would not take his eyes off me..even when I looked two more times yes.gif . He just sat staring like a cartoon character. I could mentally see his mouth hitting the floor and wondering what is it that this man is seeing in me because I had lost so much weight but funny enough I was feeling quite cute and petite, lol. I was wearing teenager's clothing and was feeling rather hip with my old self, rofl.gif woyee mi belly. Anyway, we didnt say anything to each other but nodded and that was that.

The following week I had my chemo treatment again whcih made me late for radiation and there he was..still staring. This time I started arguing with God about the connection I felt from this man's stare and I didnt find it funny. I was in no mood for a relationship and I wasn't interested and this man was giving me the "gosh you are wonderful" look. I smiled but inside I was cussing (not bad words). The next week as the radiologist called the names of the patients that need to get in their gowns for radiation, she called our names together and she said "Coy, Clay'. Now if you look at my name you will see that I am now Coy-Clay, isn't that cute? Anyway the more I see him the more familiar he looked and he was wearing scrubs so as we sat in the inner waiting area one of the staff came to me and was commenting on how I looked too young to have an 18 yr old son as my son had visited from Florida to spend his birthday with me because I could not be there to spend it with him. Well Clay as I knew his name to be then heard what she said and asked me if I had an 18 yr old to which I responded "an eighteen and an eight. I told him that he looked familiar and the conversation started. I found out that, as destiny would have it, he worked at the hospital that I was admitted AND he worked on the very ward I was admitted on(true true). The only thing is that he was out sick as he too had an operation due to the cancer and was just returning to work. There was a lady that was so good to me when I could not eat the hospital food and she went home and cooked pumpkin soup for me and I wanted to thank her so he gave me the straight-line to reach her. he then asked the people at the hospital what kind of patient I was because you have very gumpy patients and they told him how i would wave to them every day that the EMS came to take me to radiation and when I return I would sing " I'm back guys", they told him that even when I didn't eat and couldn't walk I was still chirpy. This must have turned him on heart.gif yes.gif as he fell in love with sweet lovable me. I need to get over myself right?

Two week later I was told that I was going to receive two operations to complete my radiation and that would be the end of all my treatment. By then we were friends and I gave him my number. He called and invited me out to dinner to celebrate the end of my treatment but I didn't want to go because I really did not know him all that well as yet. He wasn't pushy but insisted sweetly to take me home after I came out from surgery as he had a mini-van. I said okay and sure enough he came after his treatment. The following week I had another surgery and embarrassment upon embarrassment they lost my underwear ( dont laugh). When he came to see me he overheard the nurse telling me that they cannot find my underwear and he volunteered to go and purchase one for me. Luckily I wore a size 5 then and he went and came back with a bingo rofl.gif

Two weeks later I had to return to see the doctor and he invited me to dinner, this time I went with him because in talking I realised that we had so many things in common. That began our dating and we went out for many more dinners and spent almost every day together. As we got to know each other we knew in our hearts that we were meant to be. We were ending each other's sentences from the first date and he was so patient with me when I could hardly walk after chemo and radiation and had to be peeing every 20 minutes wacko.gif .

We got married one year eight months later and this Friday, April 17 will be our second wedding anniversary rose.gif heart.gif kicking.gif . God has really placed us together because one year four months ago the cancer returned and spread in his body. That is the reason we didn't file earlier because I was concentrating on his health. Being through it myself I was the ideal person to understand everything that he was going through and gave him the love and support he needed. The doctor thought he would die in December of last year but I encouraged him and prayed. Now he is doing much better and the doctor is amazed that the cancer has significantly decreased even after they reduced the dosage.

What is fi yuh cannot be un-fi-yuh as the Jamaican saying goes. So hold tight VJer's and love respect and treat your spouse well. Mi gone........

Hello every body !

We did the stuff to see our case on line .
How can you see your case has been "touched" ?
Since our Noa 1 date, there is nothing else written. What does it mean ?
that it's just taking dust somewhere in VSC ?

Do you know if usually the timelines of VJ are reliable ? I mean, when they say "your case may be adjudicated
(for ex between january 15th and january 30 th) ", is it what really happens ?

Thx for your help

Lili

According to VJ it means when ur file has been physically touched or handled by an adjudicator.

National Visa Center (Dept of State)Quick ? on Tax info
You need to send the W2's as well, Let nothing that is requested be too inconvenient when it comes to something as important as this. Dig if you have to dig but send everything that they ask for. You do not want to get a RFE now would you? They RFE me for something that wasn't even on the list. Dont give them a chance to put your case on hold.

If you choose not to send year two and three like I did then just don't send it at all as it is indeed optional

QUOTE (mkg265 @ Mar 17 2009, 04:43 PM) <{POST_SNAPBACK}>
I just got off the phone with NVC and I got an RFE on my AOS packet because I included my sponsor's 2008 W-2s.
I-864 is filled out for 2007 and I included sponsor's 2007 taxes and sponsor's 2007 W-2s. Since the deadline is coming up I included the sponsor's 2008 w-2s for an extra measure. The woman on the phone basically told me to send the whole package again just without the 2008 W-2s.

I'm I retarded or are they?
Do I have to wait for the RFE in the mail or can I send the package again or send at email?

I would wait on the RFE letter as it has to be returned with the documents they requested to a specific address. It is strange what she asked you to do though. Never heard of anyone being told to resubmit a package because it had too many supporting documents wacko.gif .

K-3 Spouse Visa Process & ProceduresIllegal Mexican wife

Granted it was in 1992 and laws have changed but my ex-husband was here illegally. He emtered "WITHOUT INSPECTION". He He was allowed to stay here during the process and was approved. He was even approved for AOS after I had filed for divorce. Best to talk to a lawyer. I would even call USCIS and ask them questions on what to do. You don't have to tell them who you are until you file your paperwork.

As you say that was 1992. 9/11 changed a lot if things, I doubt they will be lenient. They are stepping up and putting their foot down on things that they had turned a blind eye or shown favour to.

I am a USA citizen with two children aged 5 and 2 they are both by my illegal Mexican wife and both children were born in the USA.
I have read conflicting directions on how I should go about making her legal.
Can someone tell me if I should file the I-130 or should I file for a K-3.

I also want her to stay in the USA while any decision is being made on her status.

Based on the laws here if she was not inspected by immigration upon entering the US then USCIS will not recognize nor approve the petition but begin deportation process. If she returns to Mexico without their knowledge then you can petition for her but if she is in the system they will deport her and she will be barred from re-entering the US for ten years.

blink.gif I've seen in other posts people looking up to find out if their packet has been touched. How/where do I go to see if ours has been? And also we were a bit unclear when my husband will get approval to move to the US, is it when the I-130 or I-129F is approved? Or when the whole thing is over? Thanks!

A touch can be seen on the USCIS website after entering your receipt number in the "case status online" section or after you register on the USCIS website and request that an email be sent to you whenever there is "activity" or change on the status of your case. Sometimes it is a RFE and other times it is information regarding your case. This involves someone physically handling your file. The activity is called a touch.

You got it. That is exactly what I meant. thanks for the info.
Another question to you if I may: For some application they ask for the same copies. seeing that it is going in the same envelop do I need to make copies as per application or one copy will suffice? For example. I-130 and I-485 both need copies of marriage license and divorce documents as well as the G-325A. I will be mailing everything on 01/17/2009 and need an urgent reply. Thank you so much.

Hi there,

My husband is ready to file my petition but it's the beginning of the year and he has not yet received his W2 and 1099 to file for 2008. May we submit our 2007 tax copy with our petition or should we just wait until it is filed in February to submit last year's copy?

Another question is: Should we make two checks to the Department of Homeland Securities, the petition fee of $355 and the Biometric fee of $1010 or just place one check of $1365 in the envelop as all documents are being mailed to the same address (I-130, G-325A, I-485, I-693, I 864 and I-765)?

I take it you are adjusting status, not petitioning for a visa process, so no foreign embassy will be involved. If you're filing now, you can go ahead and us the 2007 return and then take the 2008 return with you to an AOS interview if there is one. Yes, write two separate checks but everything can go in the same envelope.

I'm no lawyer but it seems as if you have documented proof that:

a. Your ex-wife has never been to the US
b. You do not own the home they are referring to
c. You have tons of emails to your girlfriend

If they are refusing you based on these assumptions then take all the proof you have. Get a letter from your parents showing ownership of the home and stating that your ex-wife has never lived in their home. I would "out-proof" them. Failing that there is a website in which you can get immediate answers from Immigration lawyers called JustAnswer. Go to justanswer.com, sign up and it will cost you $15 but you will get an answer. If you do not approve the answer that you get then you can request a new answer and you do not have to pay for the answer that you did not choose. Cut and paste your question below to justanswer.com and in about 3 to 5 minutes you will get a legal answer.

All the best, hope this helped. Let me know the outcome...praying for you.

QUOTE (bryb @ Mar 17 2009, 05:39 PM) <{POST_SNAPBACK}>
Still waiting on a interview date what should I wear to my Visa interview I am so undecided on what to wear.

I believe that we should dress appropriately. No belly showing, no cut out jeans that shows everything when we bend down lol. If you can ditch the jeans for that day do so, unless it is a nicely styled jeans with a great top and a nice pair of shoes and accessories. You dont want to appear as if you are the next welfare-case-to-be nor do you want to appear as if you are neither mature nor responsible.

When I went for my biometrics there was a lady there in a too-tight jeans that was also a hipster or whatever they call it. She bent over to pick up something that fell and someone's husband saw her exposed rump and went "wooooooo" with appreciation. I had to tell him ' not here sir, please do not do that here. This is the wrong place for you to be doing that, this place has eyes." He replied 'oh yeah you're right, I forgot where I was." While I think we should all exercise self control we should also dress appropriately. Can you imagine if that was his AOS interview? He would have been denied immediately. Anyway, dress nicely, you are representing your spouse so dress the part where he would give you a wink of approval and say, "I am so glad you are mine, you are looking wonderful." Get it?

All the best on your interview

His income tax return will show his correct income, yes? Oops. Forgot to claim it and pay taxes on it? Well this is just one of the benefits of tax evasion. His boss has no record either as he would be in even more trouble for not withholding payroll taxes. Your fiance doesn't have an interview about income, YOU do. He has to give you the documents and YOU have to explain it. You are correct it does not actually say you have to prove income. You can go with that.

Better line up a co-sponsor

I think we will line up a co-sponsor.

I asked him if he claims taxes on everything he earns or just the checks, and his response was something along the lines of "only the checks, I thought that was all I needed to since that's all I get on the books." It's not deliberate tax evasion on his part, just ignorance about the tax system and no thanks to his boss for doing things a bit dodgy.

So now I'm wondering how much he should claim to earn on the I-134... what he actually earns, or what is declared on his tax return (I'm going to guess it's the latter). Does anyone have a link to, or could explain, the process of having a co-sponsor?

Thanks again for the advice.

So with $88.41 declared as weekly pay, how does he pay rent and utilities. Does he have a bank account etc? Better get a co-sponsor. These things usually comes back and take a big munch out of the be-hiney.. better to be upfront with Uncle Sam.

I'm not sure what's going on with my application. I sent my app 01/11 and received my NOA on 1/20. But since then, I've heard nothing and my online application status just says my application is pending. Based on applications sent from the DC metro area in Dec. and Jan. I'm wondering if there is a problem with my application because I still don't even have my biometrics date. Any thoughts?

One main difference perhaps is that my application was forwarded to the National Benefits Center

/quote]

Maybe you should call the number on your NOA and ask them just to set your mind at ease. I filed after you and I have done my biometrics two weeks ago. When you dial the number press 123 to speak to a customer service rep. Have your letter with you as they will ask for your receipt number. Hope it comes in the mail this week. All the best.

QUOTE (BeHappy @ Aug 6 2009, 08:47 AM) <{POST_SNAPBACK}>
I applied for conditional Green card in 2005 and I received the approval in 2006. On that card said "Resident since: 08/03/2006" I still have a copy of that green Card and the original of the approval letter (I-797, Notice of Action, Welcome to the United States of America) with Notice date 08/04/2006.
I applied for "Removing Conditions on Residency" in 2008 and I received my new Permanent Card in 2009. On my new card says "Resident since 04/20/2009. "
Is this a mistake?
Shouldn’t be "resident since 08/03/2006" the date I became conditional permanent resident based on my marriage with an American Citizen?
Would be a problem with my Naturalization file due to the date ( 04/20/2009) on my new Permanent Resident card?
I would appreciate any help and any advice!
Thank you,
BeHappy

I just checked with a friend who just renewed his GC, and he said that his is dated from the first date of residency. Make a copy of all your documents and the current GC and send a letter to USCIS. Call first to get information regarding the correct location or look at your letter that you recieved with the GC for the address to mail correspondence to in the event of any errors. Keep a copy of your records.

If memory serves me right, the I-90 has instructions regarding errors and what to do. All the best.

Thank you, all!

Follow Jimmyhou advise and call. She is already in interview scheduled status which is different than in line for scheduling. Many of the interviews are scheduled within a month. Waiting a month may put her in a position where it appears as if she did not turn up for her interview if the mail was lost and that would not be a good thing. All the best. Keep us posted regarding the outcome so that others may benefit.

US Citizenship General Discussiondid biometrics 4 days ago and received this update.... would it take that long for interview schedule?

Three to Four months between Biometrics being taken and Interview date itself is not unusual.

The actual date is determined by the length of people waiting in line at your local service center and you can see the length of time it all took for me (so far), in my signature...

That's true, bjrichus. Between being placed in line for an interview and the actual interview there is at least a waiting period of 3 months; however, as you correctly stated, it depends on "the length of [time] people [are] waiting in line at your local service center."

Your timeline revealed that you were scheduled for interview approximately 2 1/2 months after being in line to be scheduled. I'm still waiting. My 90 days of being in line to for scheduling is August 12 but New York has many applicants and it is estimated that the process is presently at 5.9 months which, if it remains that way, I should expect to be done by the end of September. However, we are all anxious :clock:  - which does nothing for us but stresses us out    :bonk: .

your N400, APPLICATION FOR NATURALIZATION was placed in line for interview scheduling.

Check your local office progress on the USCIS website and you will see how they are doing. Some states move quite quickly while others are slow because of the amount of individuals filing. There is a standard 90 day wait time but some have received their interviews before and some after.  :time:
