Am I the only one to just realize there are 2 different forums for May 2009 filers??? and they both have about 54 pages ... I kept wondering why sometimes the May filer forum didn't look the same as it did the last time I looked at it ... LOL ... Anyway, if there is someone else out there as slow to notice such things as I was, be aware there is a May 2009 filers forum and a May 2009 k-1 filers forum

No problem. It's a long process. Without the support here, I don't know what I'd do!

I think they say the medical is good for a year, so it's best to book it close to the interview time. There's no wait time right now but I don't know how it will be later, so maybe booking it way in advance would be better. Mine is October 21.

I can see your timeline if I go to your profile, but not on your posts. I also was wondering how some people show their timeline on their posts ... it seems a different format... anyway, you need to update your timeline in your profile ... just find where it says "my assistant" on the main page and then there is a drop-window with the option to edit your timeline. As for showing it in the forums, I don't know ... can anyone help?

ugh! 4-6 months for the consulate interview! that's horrible! my sympathy to you. Probably because there are a lot of Visa applicants from Canada, so those are busy consulates. Well, at least you are on the same continent together... I hope you are able to visit frequently. Not so easy when your love lives on a different continent. We've only had two visits together in 3 years, one for 3 weeks in Italy, another for 3 months in Texas.

I think "N/A" is appropriate response if they never were married, and leave dates blank. The people at the consulate are smart enough to figure it out, I think. scroll back a few messages and see my post about how to track with DHL ... it might be a bit more difficult to track for consulates that have a heavy volume, but not impossible... it was easy to identify ours because there are not many from italy. if you don't understand it, pm me and I'll try to help you if I can. today i found out our package has been received by the consulate in Naples. I found this on the DHL tracking site. when any of you reach the point where your petition leaves NVC, you can go to DHL website, then "track by reference" then put in EXP XX XXX 2009A ... but the X's are the day and month it was shipped, for example 14 SEP ... just play around with the date a bit, then you'll see a list and you scroll to look for your consulate city in the destination column... I was so happy to see our petition delivered and it even tells you who at the consulate signed for the package. Good luck to all still waiting on next step, and thank you again to Rhaina for telling me how to track the package.

I think your case is at what they call "AP" (additional processing). I don't know how they judge which ones go through AP. It apparently can take from 3 days to 35 days...I just hope that mine takes 3 days........I'll have to check Monday.


Thank you! how did you find that out?? is it something like a random audit? where do you check status when your case is at NVC? they don't have a place online like USCIS does, where you can just type in your case number, and you can't call them without paying long distance, then they tell you nothing anyway. And my e-mails are returned by an automatic response system, telling me I don't supply the required information, even though I did.

That's why I tell my fiance to never fully trust what's on paper.
He does it way too much.


But it's so unfair! That letter said we were approved, it gave us the consulate case number, the alien number everything, and then they took it back! Incredible. When I called them, they were very curt, too ... approaching rude. I think they need some love in their lives.

We have a nightmare situation ... DHL says they delivered our petition to the consulate in Naples last Thursday, but the consulate says they don't have it. There is two forums one for K-1 VSC filers and one for K-1 CSC filers. This is the one for May 2009 CSC filers, but unfortunately when it was started they forgot to add CSC in the header.

I don't see any forum topic that says, "whine here" so I guess this is where I'll do it. Our I-129 was "approved" 2 or 3 weeks ago, then sent to NVC, then we got a letter from NVC more than a week ago saying our petition was forwarded to Naples, but this morning I called Naples, and they don't have it. Ridiculous. Now what? NVC forwarded it but the consulate claims not to have it. Any words of advice? Any similar experience? seems our petition just vanished into thin air.

I think the short answer is ... come on a visa waiver and just don't mention the fiance petition, just tell them you're here as tourist, or visiting a friend. you might open a can of worms by mentioning the fiance petition.

If that was NVC that told you it was sent out yesterday, then it probably was. There were about 100 petitions shipped out of NVC on Friday, maybe more. I mean at least 100 embassies were shipped packages from NVC. Each package might contain more than one petition. Good luck.

BTW I did see some shipment to Thailand in DHL tracking website, but no way to tell whose it was, unfortunately. NVC won't tell you the tracking number, which I find ridiculous. It would save a lot of people calling repeatedly to NVC. I myself called NVC every day, sometimes twice a day, I talked to supervisor, I wrote them a registered letter, and I finally e-mailed my congressman. The day after I e-mailed my congressman, my petition was sent... a coinky-dink or no? who can say?

I'm not sure if this is any help, but I never received my NOA1 and I called USCIS and they told me they wouldn't mail another one. The computer also told me to follow the instructions on that form, but of course I couldn't follow the instructions if I didn't get them, so I just kept my fingers crossed. Then about 3 months after that I got NOA2, and that one I DID receive in the mail. Anyway, my point is, I never did follow any instructions, and my case went to NVC anyway.

You have my sympathy. I know this process is so confusing. Sometimes you are scared to do something, and scared NOT to do something also. Ridiculous they don't make the instructions clearer.

I have never applied for a B2 visa because I have usually traveled as a tourist under the Visa Waiver Program. Now that our petition for the K1 visa is pending (NOA1 received a few days ago), can I still travel to the US as a tourist? We called USCIS and they said "no problem as long as you get back home for the interview". so simple?
Also, having traveled many times to the US in the past few years, I read it's advisable to apply for a B2 visa, but then again, will the US embassy give me a visa while our petition is pending?
On the B2 visa form it's expressely asked if someone ever filed an immigrant visa petition for me (and I'd say that the I129F form to obtain the K1 visa is exactly the case, although technically K1 is not an immigrant visa...). If I say yes, I think I can forget about the visa.
Anyone in the same situation?



Yes you can travel on the VWP.

Be sure to bring plenty of documentation you will return to Italy.

Do I have to bring the papers about the K1 visa petition?


It's my understanding if you come to the US while a K-1 is in progress, it's best not to apply for a visa but just come as VWP and don't mention the K-1, just say "visiting friends". Of course you wouldn't deny the petition if asked, but you don't have to offer that information.

My SO came here earlier this year under VWP and they didn't ask him to prove any compelling reasons for returning to Italy. He's also self-employed, and has no children, no loans. And he had already sold his house, but they didn't even ask him about all that.

Once your petition is approved - NVC will forward it to the correct Embassy/Consulate (the correct one that processes K-1 Visas for your actual residence.) Not to worry.


thank you for your quick reply, did it happen to you, too? I was getting REALLY scared, but I really hope the NVC will be clever enough to send it to the correct Consulate, no matter what I wrote.


I did the same thing and put the Milan consulate... The automatically deferred it to Naples mad.gif Although we would prefer Milano!!!!!



yeah no kidding, I don't know why Naples and not even the Embassy in Rome. Naples is the farthest one, and honestly I'm a little bit concerned about going down there... helpsmilie.gif
well anyway I'll take the risk of going to Naples, if this means that I will receive the visa laughing.gif


lol my Fiance doesn't want to go to Napoli either... must not be a very good place to visit. I told him he should just tell them he's from Roma and maybe they would genuflect when he enters. You Italians! As bad as the U.S. with regional snobbery lol.

Your profile's not set up yet, so I'll have to make some assumptions: You're applying for a K1, right?



There are a few things that you can do. First, call NVC and see if your packet has left them yet. The number is probably on your NOA2. (603) 334-0700 I think you have to get to an operator because the automated system doesn't work for K1s.

If your packet has been sent on to London, they will give you a London case number. It starts with LND. With that, you can schedule your medical. Your fiance(e) can also order their police certificate. http://www.acpo.poli...ertificates.asp

You can work on the I134, gathering your income proofs, ordering your tax transcripts or organizing your cosponsor (if needed).

Your fiance(e) can start getting packet 3 together. We waited until the letter actually came in the mail from the embassy, but others have only waited until the embassy has acknowledged receipt of the file and then sent it. You can find out if the embassy has your file, has sent packet 3, or scheduled an interview by calling DOS (once it's sent on by NVC). 202 663 1225

Do I understand you to say if your case has a number beginning with the consultate code (ours is Napoli ... NPL) then you can assume your case has been forwarded from NVC to the consulate? !!!

I'm wondering the same things, really fearing the Napoli part of this, even my fiance is, he doesn't want to go to Napoli, but on the positive side, I've read on here a lot of people say the embassy officials are very nice and polite, so we're hoping the best.
