IR-1 / CR-1 Spouse Visa Process & Proceduresds230 part 1 question 30..

hieveryone!! i have a question on ds230 part 1 the quesion is list below
places you have lived for atleast 6months since reaching the age of 16
including places in your country of natinality begin with your
present residence..
my wife wrote down her home adress now may 2008 to present..
she wrote the adress the one she live year 2006
last 1 is in manila were she stay when she went to school
at college.. now my question is the nvc person told me that
she did it wrong but i dont see the mistakes cause my wife
wrote the present adress first and the last adress in the last line...
please help me thatks...

Hi,

I did read a topic about this question before in the "STUPID RFE THREAD" and the OP said the following :

my RFE was also question # 20 i wrote
spain 07/2008 to present but the line under it
Morocoo (dated before 16) to nothing (believinge the "to" in the upper line would be obviouse)

turned out no
sent in the new one
Spain 07/2008 to (date signed then "present")
Morocco dated when he was 16 to 07/2008

i wrote the date he signed and present cause two operators told me two different ways. I got the word on the phone call to the operator about the RFE 10/10 but still haven't recieved the offical rfe in the mail yet and it's 10/18.

Hopefully that will make it clear now.

Jenn I think you answered your own question.

Respect. The CO's dont respect our men.

Being there in Moroc possibly shows the CO that you have a valid relationship if you are there during the interview. You are not allowed into the consulate when he has the interview. You would be waiting at a caffe. But your DH would make a point of teling the CO your wife is here if he/she needs to speak with her.

I will need to use some excuse to get off work too. When we fianlly get the date for the interview I will not have the time to make a request for time off. I also dont have any vacation time built up since I was on sick leave for 6 weeks last fall.

The only thing I or you can do is claim time off for the family leave act. Do you know about that? You can take time off work to attend to family illnesses. Your brother in law may qualify for that. You will have to have a medical statement from his doctor. Check into that option.

For me I have a statement on file already because I have asthma. It means I can be off work for that and not lose my job. As long as I don't say where I am going I should be ok to be in Morocco for a few days or weeks. I just have my doctor take me off work. He wants me to go on disability ( last year) because it is so bad. I get so very sick from perfume and fragrances. I was quite ill in Morocc from the disel fumes last year. If I was to live there I woud have to live in the mountains, which I would love to do anyway.

I just want you to understand it is only my opinion that the wife be there for the interview. I know of nothing else that may help. It does not mean it will help, but it sure can't help. I would rather be there than wait another year to go by and try again.

Oopsy again...I mean it can't hurt to be in Moroc for the interview but it sure may help.

I wouldnt be allowed in the consular? Why not? Its just waiting! My brother in law has some type of brain cancer or tumor the really arent sure yet. But he has been this way for months now he cant even work he is getting some type of disability pay cause of it I guess. My mother used the family medical leave act like this for her husband in Morocco before. But she never had to have a letter or anything from a doctor. I believe right now I can probably get like 5 days off. And I definately want to be there, but if they dont know im there how can it help? I dont know much about the family medical leave act I was just told by a few people I should try it.

Im thinking besides im diying to see my husband again. That going is the only way to make sure he is approved! Its been since August 2004 I saw him last might not look to great to them. But if any thing or a denial would happen we could try and overturn it right there. While im there to prove them wrong!

Could you tell me more about Family Medical leave act since you have used it before please?! Thanks

I don't know why they won't let you in the consulate. To get in you must speak to the military police and state your business. I just know others where not allowed in for the interview if that was their purpose for being there. How will it help? It will help because you are there waiting for him. If they pull any ####### your husband can always go and get you to speak with the CO. They will know you are waiting outside because your husband will tell them! He must make sure the CO knows you are just outside waiting to hear the good news.

As to the family leave act you can accsess it at your place of your employment or on line.

for the birth and care of the newborn child of the employee;

for placement with the employee of a son or daughter for adoption or foster care;

to care for an immediate family member (spouse, child, or parent) with a serious health condition;

to take medical leave when the employee is unable to work because of a serious health condition.

Since it has been quite a while since you have seen your husband it would be my guess that being there during his interview would be a good idea.

Jen..
the reason why the priority is favorable to k-1s are because, the goverment has heads up on whom you are bringing over to marry. when you marry withou their knowledge they get pissed off about. they dont have warning so they pentalize us. bottomline the goverment can not play cupid.

Where are you geting your info at? The k3 has the same info on it as the k1.

Chi,
K-1 and k-3 are diffrent. same 129f petition but diffrent requirements
K-1 is for fiancee.
k-3 is for married persons.
you have to apply for k-1 if your intention is to be in the USA to marry.
K-3 you basicly dont have to apply for this- this is ONLY to allow the spouse in the
USA and wait for the green card. again its an option not a requirement.

if you married already in the USA or out of the USA.
k-1 is usless. however if the goverment dont reconize your marriage.
k-1 is the option for you.
if in the USA file to AOS
if out of usa file CR1 and k-3 if you want to.

thanks for your information!!! As soon as we find out interview date eventually I will ask my employer certainly!! I think it probably dont look to good that its been over 1 1/2 yrs since I seen my husband last. But that last time I was there for three months. And they do recognise marriages outside of the USA cause you have to go to the American Consular for a affidavite that your eligible to marry. I hope they will give me time off but not sure how incase Id get caught liying! Would anyone consider a brother in law immediate family?

Wait, you say>>>>

"if you married already in the USA or out of the USA.
k-1 is usless. however if the goverment dont reconize your marriage."

The government does not reconize marriage out of the USA? Sorry but that is incorrect.

I took family medical leave act last june when my mom had cancer. They wanted a note from her doctor determining her illness. Also if you have medical insurance you have to keep up on those payments if you don't have any sick time build up. But they usually want some kind of proof as to why you are taking off.

Thanks denali_1963 for your reply. Well they only know his brother has something probably wrong with his brain. It sounds weird but they arent sure and its hard to figure out cause my husband dont undertand what im talking about if i say like chemeotherapy. I do know is he has been like this for awhile forgets who he is, who other people are, he cant work, he is getting some type of disability pay right now. And its gotten so bad had to sell his house to afford the medical treatments. I think for right now they are calling him stable cause nothing has happened yet. But not sure if I could get anything cause its not really immidate family and if I lie they will probably catch me and want a letter or something. Which the letter wont be in english most likely. I havent been at my job that long started early September so I really havent earned much two days off with pay is about it!

thanks for your help

I think the Baccalaureate requirement is *relatively* new, even if it's not brand new. My husband's cousin's wife came here on the lottery 4 years ago and she doesn't have her Bacc, nor do many of the people he knows here from Morocco who came on the DV program.

I don't know if it's true, but Majid said they made that change in the requirements after many people had already applied. I do feel for them, even though Liz is right that it's incumbent upon them to check on the required qualifications before applying. $700 is a lot of money.

I agree with ohiobuck, I don't know why they are wasting their time interviewing people whom they know ahead of time don't qualify based on not having their Bacc... no wonder they're so behind on the family-based interviews!

I don't know if I would feel this way if it didn't impact me personally, but I really think that the family-based visas should have some priority over the lottery visas.

I also agree that you should warn your SO before their interview that there will be LOTS of disappointed DV applicants there. Majid said on his day there were 20 DV interviews, and only 1 of them got the visa, the rest were denied for not having their Bacc...

What can I say Morocco has their prorities up their somethings! I dont care what they are doing family needs to be a priority not a when we get there we get there!

My thoughts exactly...did you know that in Canada family-based visas take the highest priority? This is exactly the way it should be.

(F) ~Kiya~ (F)

Exactly I know all visas need to be handled with care and stuff. But a family based visa needs to their top proiority not last. I was told we get hardly any interview spots a month unlike others. How come? Why are we treated like #######?

This brings to my memory the ILW chat with Lawyers. I attended this last Tuesday and asked a question...got an interesting answer:

kiyah
My approved K1 petition was returned to the United States. What I want to know is what will make consular officers follow guidelines when interviewing applicants? What does one have to go through to show the Department of Homeland Security/State Department that a consulate needs to be following guidelines instead of re-adjudicating "approved" petitions? I feel like my rights as a US citizen are being overlooked completely.

ilwspeaker
If you have a particular complaint, there are channels you can go through at the state department. This is something that you might bring to the attention of either an attorney to put on the liaison agenda with the Department of State or possibly go through the American Immigration Lawyers Association and media people. If the story is good enough, they might just adverte it, along with radio stations. I just wrote an article through my newsletter about keeping engaged people apart. It's a joke that U.S. politicians "talk" about family values but don't behave like they have a clue what that means.

Her stating that it is a joke that politicians talk about family values but do not behave like they have a clue what it means is sooooo very true. It's like they are saying only what we want to hear to get appointed...sure there are some really great politicians in this country, but I believe they are way out numbered by the other side of the spectrum.

(F) ~Kiya~ (F)

Kiya you do good work maybe we should send you over there to teach them the right ways to get things done!

You are probably right it is equal to a high school degree, but I thought my husband sad a bachular (meaning college degree) like the USA. I knew they called it different than we do in the USA, that is why I asked for my husband to varify it. But maybe I misunderstood him or he misunderstood me when I asked was this a new requirement for a college degree and he said yes. He said it was new and was to keep more people from getting the visa and making the requirements higher. Whatever the case these people are fools for wasting their time to apply for a lottery visa and they don't qualify. And worst these people should've been denied before it got to the interview step at the consulate, when it wasn't on the application they had the education required Because these people are slowing up the Consulate and our cases and keeping us from our love ones.

This is just being handled wrong no matter what the case.

I will check with my husband about the education requirement again, I am sure I am the one that misunderstood but again there might be new requirements and if there is I totally agree and I know a couple Moroccans that also agree for the same reason.

Sorry, I guess I am venting, I am lucky things seem to be going well and my husband should be getting his visa within the next couple days. But I am still pissed about how long it took to get both his interviews. Becasue my husband should've been here with me months ago. It has been 10 1/2 months since I last saw my husband and it took this long for a K3 Visa because of the poor handling at the US Consulate in Morocco. And I don't want anyone else to have to wait like my husband and I had to.

Paula

I think there is a little confusion about the requirement for the lottery visa. The requirement is a high school diploma, which in Morocco is called the Baccalaureate. Here that is a Bachelor's degree, so unless you've had it explained to you, it is natural to assume it is a college education. It took quite a while for Abdel to make me understand that.

This is not a new requirement there, or one that isn't published with the application. It was right there on the website where you had to go to apply. If people were stupid enough to waste their money to apply, knowing they didn't meet that requirement, then that is stupid people wasting the consulate's time, not the consulate wasting people's money.

wow ohio buck thanks for all your replies. I know you have been away from your husband a long time but by the time I get to see mine it will be about two years since i seen him last. Today he was having a panic attack and asked me to move there just cause he cant handle waiting for the interview date. I dont like waiting either but we did all of this im not going to give up waiting for a date. Im not worried about his education he has been a teacher for I think 11 years and he went and studied English for two years before going to school to teach. He had one bad travel visa experience before but I think he knows how things are done there.

Im just not sure now, do I go in April or for the interview? If it takes longer to get his date and its in summer my job will fire me if I miss we have alot of critical days. And he has time off in April and not in the summer. And I feel its important Im at the interview but I dont see how it can help alot but I feel I need to be there. I might not want my job but I have to take it atleast until he passes this stupid interview. Were doing CR-1 and have been waiting almost two months for a interview date. And it seems as if yet again this month no date is there. I just need to see my husband to know he is a live person not just a person on messenger i talk too. Its been way to long since I seen him and I dont know how I do its so hard!

Jennie,

To answer you question, I had heard from my lawyer that the Casablanca, Morocco Consulate is one of the smaller consulates. And the same staff that handles K1 and K3 Visa's also handles all the other Visa's throughout the week and they only typically handles ours once a week. I also heard through my husband from people in the consulate and what he's seen personally when he is at the Consulate, they are working on the Lottery visa. On Feb 21st he said it appeared to be full of lottery appointments and on Feb 28th the day of his interview he said he was the only interview like his, and there was like 30 lottery visas. He said only 3 of the 30 got approved, and he had to sit through this experience of seeing all these other upset people when they finally took him last that day. Luckily his interview went well. One more thing I am pissed at his on the lottery visas most of the people being denied are because they don't have the bachalor degree. I guess this is a new requirement from what my husband said. But why didn't they make this clear to these lottery visa applicants and why did they send them a letter saying they have wrong the lottery visa to take their money ($700) my husband said to only deny them. Sounds like they know they are going to deny them and are taking their money and they are only slowing down our interviews. Is this a way Morocco is trying to get their budget???????????????????

My husband talked to a couple of the guys that worked at the consulate and earlier he talked to two contacts through people he knewl They checked on his case in the consulate and got back to him a few months ago, i f this tells you who my husband has been talking to.

All I know is Morocco seems to have their priorities messed up and it isn't just with K1 and K3 Visa's. They should handle these first come, first serve and not lie.

My other complaint about Morocco is everyone is trained to tell you as little as possible. This is for anyone getting denied to even the ones getting the Visa and they have to wait first for the security check, or when they are called to drop off their passport. I guess they went through "me can't tell you anything training".

Sorry I guess I am venting when I just meant to answer your question where I heard about the lottery visas and why slow.

hang in there.. I know it sucks..
I am like you- I want them to give me the interview date.
and I dont want it in Aug either! - I want it now I miss my husband too.:(

im just annoyed my case has been done for two months and not even been touched since. The case is still sitting there. Just collecting dust! I thought u had a interview date already?

Wow you found out alot!! I heard it might be because of the diversity lottery people! I wounder if they are still behind? I know 3 out of 30 people getting approved isnt right but they have a point if you have a higher degree of education when you come here you can find a job much easier usually. But still I see your point and its alot of money to anyone to lose.

I was so pissed today when my senator told me they just pull any people from the Morocco waiting list for a interview every month. They dont care how long you have waited or anything just anyone! I think Morocco has their head up their something!

I want to go and see my husband but I so want to be at his interview! But if we get a summer interview I cant go they will fire over it! And he has time off in April so it would work out fine!! Im annoyed and miss my husband so much! What type of visa did your husband have a interview for before?

I know! I think the interviews need to be done by first come first serve. Not just whoever they feel like pulling out the pile this month!

jenn,
I have to agree with you. but, let me post this question. do you feel the same way if you got
an interview date it was say 3 months OUT. wouldnt you think its ok or not
for the embassy to make your interview date closer? example what if you got an interview date
for AUG. do you think its fair? of course not. do you think the embassy should step up the date
because you said so? I think that would be more fair - do you agree? I think thats why
the embassy has the option of pulling this and that case. I think ALL of you should havine your
congressman and sentators bust their tail for YOU!

Mary K.
I am praying that it will be a GOOD and wonderful thing... praying that Atif will pick up his visa!!! wishing you all the best... and sending LOTS of mojo

No pisses me off they can just pull out who ever they want not even go on application or case complete date. I have a friend their case was complete about three weeks before me had a February 7th interview. My senator is lazy wont do anything unless i call her. She wont reply to me emails the only way I get her to do anything is if I actually have to call her then she is willing to do something. So its annoying no one cares then I heard that I was annoyed! The senator didnt even know anything tried to tell me the National Visa Center schedules interviews for K1 and K3. I know im just person going through their little game to get a thing in my husbands passport but I know more then she does apprently.

Im not sure I can take to wait to see my husband I want to be at the interview! But my stupid job has all these critical days this summer and if I dare miss one they can fire me over it! And I can probably get time off and he has time off next month. So i guess Ill have to see.

I can take this wait just to see my husband again! Makes me wish i would just of stayed my first time I was there almost three months probably could of did the direct consular file thing and got him here faster!
