Kiya,

Just keep going. No one will ever understand what we are going through unless they have experienced it themselves and then there are those who have no compassion. I will fight this injustice until I am no longer of this earth.

I know change is possible. The same thing was going on in South Africa and it finally was taken care of. As we all know, anything in the government areana takes lots of time. Kudos for those who continue to help others even when they dont need the help themselves. My husband will be here soon and we will continue this fight against injustice together.

I met my DH in 2003 and at that time joined many groups who were going through the immigration process in Casa. No one was denied. The denials started in 2005 it seems. So what changed? What caused this to happen? Who is responsible? This is what we need to find out. I know I have done so much research since we were denied and it is my opinion that the only sure way to get your DH/DF a visa is to be in Moroc during the time of his interview. Why wait to go until after he is denied? Why take the chance?

I know of an attorney in Alabama who may take up our cause. He fights immigration issues in federal courts. I was also hoping we could perhaps get Ellis involved. It will take money for all this but if we do it as a group, it is plausable.

We were denied March 25, 2005.

Petition received NVC in July 05.

Petition received at California Service Center in September 05.

Notice of Intent to Revoke received in October 05.

Reaffrimed November 05 and resent to NVC.

Case ready for 2nd interiew (?) January 06.

Still waiting...

Oh and we will be lucky to get an interview (if that is what we have to have) in April!!! Yet everyone else seems to be moving alone swiftly. Seems to me married couples should not be last in line.


It was suggested to me by a few people that the reason why i may be having to wait so long for a interview. Is that alot of people who were denied are getting their second interviews so that might be the hold up.

We dont have actual pictures of our wedding cause it was with a lawyer. But we do have pictures of the wedding party alot of them. I dont think it can be a big problem just having proof of your relationship should be enough.

I am writing as my story is almost the same. I am older than my finance. At his interview the CO was rude. He could not tell her where I went to college but my sons could not answer that either. My dad was in the Air force so I have lived in many states and gone to school from California to Long Island New York. There is no way I can tell anyone (not even closest people to me) about my entire life. We are upset because he was asked HOW DOES YOUR FAMILY FEEL ABOUT THIS MARRIAGE? and he tells her my family likes her. She called him a liar and would not give visa. He had photos of me and family because I spent the month of June with them.
And the congressman and senator should join forces and help you. You should be able to ask eve4ryone you can think of for help.
Want to raise some Hell with me? Maybe together we can convince someone that they discriminate with us because we are women. Old men of 70 and 80 are able to marry Russian girls of 20 and 30. Check out the marriages in Florida. Is happening a lot.

and yes the stamp is very important. on one of my papers NVC could not feel a reaised stamp and I had to ask husband to overnight new copies to my lawyer

The sheet of instructions we received from the consulate says nothing about this... In fact the instructions state we would not have to return to the consulate once we got the fdfirst 2 documents needed from them... Can anyond advise on this matter... I only have 2 weeks left for my visit and my husband works crazy hours so I would rather not spend what free time he has running around getting papers stamped... Thanks in advance for any info anyone can proide...

my marriage certificate was retuned to Rabat by the court where i married. and my husband had to get copies with offical stamps from them. i have needed several copies so make sure you have 1 for NVC, 1 for immigration, and at least 1 for yourself. you do not return to embassy with papers, you get them translated and certified for everything here in the US. Don't forget you will be applying later for citizenship, to add to bank account, etc and will need offical copies for everyone.

Yea,
I had to ask my mom for affidavit saying when i told her I would marry. She is 81 and had a lot of trouble with this as she said. I have not met him. I finally drove the 10 hours to her house and got her to sign notarized one saying just that i told her i would marry. talk to me on jeanne_darrow@yahoo.com as we seem to have a few things in common. My dad was deceased for 19 years I had to provide copy of his death certificate. To me this is ridiculous. anyone of us could just get married here without even informing family. We are all adults. But immigraiton is looking for things we dod not understand so I guess there is a reason. And i really had no idea when i told my mom i would marry him. I just called her one day and told her. This may seem an odd question but I had to ask this of the other members here on VisaJourney.com I am sure I can't be the first to have this problem, but has anyone else had the problem that one of their parents would not sign an affidavit for their RFE?

Since my marriage, my mother and others in my family seem to have fallen into the wind. I've heard a few remarks about religion off hand. A few remarks here and there about where my husband is from... but when I approached my mother to write and sign an affidavit I was smacked in the face with a remark somewhat similar to "I don't know anything about your marriage." Now given that this is a true marriage in every way that a marriage is... it blew me away. I can't even understand where some of this comes from, but I must live my life and not dwell on these things. So I move on to the next thing on my list. :wacko:

So now the problem is that my RFE specified that I must include an affidavit from both of my parents. Since my parents are divorced - my father is here by my side and eager to help. Now I must think of a way to address the fact that I will not have one from my mother.

Has anyone else had this same problem? Any parents not on board or helpful? Any problems from it? I'm praying it will be nothing of consequence. I'm sure there are other dysfunctional families out there like mine. LOL

Our case had gone to NVC and we recieved one email needing clarification. We have been waiting to hear that it was accepted and i read your answer here. So, I attempted to log into our NVC site and it actually says sign in failed. Your case is no longer being processed at NVC. Can this be right?? I was told by attorney that NVC calls embassy and schedules interviews and NVC would notify us. It appears the embassy does the scheduling. I recieved no word from NVC at all.


Have you send DS-3032 (choice of agent&address)?
Have you paid your AOS fee ($88) and IV bill ($404)?
Because, those two things should be done before sending the AOS package and IV package.

When the signing in failed (SIF) it means your case is closed in NVC, and you will get an email to give you a date to an interview. Good luck ;)

they need originals and when it gets to NVC, they also need originals. I had to get 2 copies of all and he sent me one for myself.
If you send copies, they will ask for originals and the process is delayed by that much more.

you really should revise the tax return and apply for her ITIN. Claiming her as dependent can only help your refund and her chances as interview. If you do this, make sure you get a certified copy of it before sending it out. It took IRS 4 months to do my refund and the lawyer wanted certified copies. I just got the refund after sending the paperwork in on 17th of February. The form to send in is W-7 for ITIN.

Were you married in 2010? If so, then filing single will likely be a problem in the eyes of a CO. I have seen posts from people who filed single even though they were married and their spouse was denied a visa.

What country is your wife from?

Good morning, VJ. I've searched for answers to this question and I've seen posts going both ways, so apologies for asking such a basic question. According to the guides and the USCIS website, it does not appear to me that the I-130 packet needs to include the beneficiary's birth certificate, or passport or any other kind of government-issued ID, for that matter. Is that correct? I've heard anecdotally that a foreign birth certificate is actually required at the USCIS step. Thanks in advance.

YOu will file CR-1 for spouse and should marry with child on the way. but do not expect him to be here for the birth. My process has taken 16 months from day i filed to interview. the Finacial is very important. for 2 it is just over $18000 but you will have 3 by time of interview. that is annual income only according to tax returns. Other things they look at at property you own, car titles, savings, chenking account balances, investments, etc. while you are with him, fill out the 130 and his bilgraphy, get as many supporting docmements that you can. His birth certificate, marriage documtents, ( translated into Enlish and cetififed -2 copies --1 for immigration and 1 for NVC. nice to have 1 for your files too) national ID, passport, etc.Not really a way to expediate for pregnacy. If ther was, a lot of people would use it. Hope this helps.

I just joined here and it looks like there is a lot of useful information on this site. Maybe someone here can help me with two questions. First, I guess it would be helpful to know that we met while in South Korea. I am American and he is from Cameroon. My visa expires at the end of this month and I will have to go home. We are going to try to get married next week if we can get the right paperwork for my husband. We are having some trouble because his consulate here doesn't know what to give him. We will either be filing for a spouse visa or a fiance visa. I am 6 weeks pregnant and really want him to be with me when our child is born.

1. I am worried about the financial requirements for sponsoring my fiance's/husband's visa. I read somewhere that either 100% or 125% of the federal poverty guideline is required in order to sponsor the visa. Is this correct? I think I will be fine if that is the case, but I know I won't make a lot of money. Will his savings be taken into account also? I am worried that his visa could be rejected if it is decided that I don't make enough money to support us both.

2. I read something on here about a request to expedite a petition but I couldn't find any information about it on the US Immigration website. Can anyone tell me the requirements to expedite a petition or send me a link to the information? Does pregnancy count as a good reason to expedite a petition? I will really need his support, both emotionally and financially when our baby is born.

Thanks for any information! I am really starting to panic about everything!

This is strange question. Where does the USA member live? you would come into international airport nearest that location. And you must go thru immigration and customs whenever you enter the US. Even US citizens go thru this. If you come from Manila I am sure you would land in the west and go to US citizen state from there.

you can get mail faster from Morocco. Can send thru Chronopost there. they send to Miami and Fed Ex delivers it here. 4 days and you can track it thru the process.
Use the old form it they have not put up new one. Will be accepted.

Just use the existing form. No need to wait or worry. USCIS will accept it.

Yes, POE is first place she lands in the USA. She will have to pick up all her luggage and take thru customs and immigration and then they will be put on plane to go on. She must appear with her bags for customs. and they will be xray with her present. Even we as citizens go thsu this. Newark is not bad, the immigraiotn lines move pretty good.

My wife is tentatively scheduled to leave the Philippines with her CR1 Visa on July 1st.
She transfers planes in Tokyo and then flies to Newark New Jersey.
She has a 3 hour layover in New Jersey and then flies to her destination Washington Dulles in D.C.
Will she have to be processed through Customs in Newark or Washington D.C.?

You must wait till NVC asks for it. they do not have your packet yet. You will get notice to go to the proper webpage to pay the 2 fees and after confirmation of fees receicved (about 1 week), you will get the information to fill out the forms. From me they wanted our birth certificates, Marraige record, 3 years certified taxes, his National ID, 2 passport photos, copy of our passports,police reports and they will ask for proof a former marriage is desolved by divorce papers or death certificate. And the 2 forms filled out and signed.

My wife and I filed our I-130 with a priority date of May 26th. It has been assigned to the C.S.S. which according to tracking on this site, is now working on March 1st petitions. I want to have the Affidavit of Support ready to mail ASAP as they ask for it. When should have all the info gathered and prepare it? Actually mine left for trip to NVC on 11th of Feb and i finally got scheduled this June for the interview in July. And I heard nothing. Not till the lawyer sent me email for appointment.

It's been 20 days after my NOA2, and NVC has no record of my case yet! I have spoken with 3 different customer service representative but they dont have any information about our case! Is this normal????!!

sorry the one guy is wrong. He got his visa over a year ago. I did have to get affidavits from his family who not attend. Like Brother that was in Spain and his mother who was in the hospital. They also asked for other family and friends who did attend. And one from my mom as to when I told her i was going to marry him. Maybe you will be lucky and not have to do the long RFE I had but I would get these statements now. there are places to translate and certifiy them. Also need 1 copy for USCIS, 1 for NVC and at least 1 of marriage license for yourself. think of all the places you will have to show one in the states.

I forgot to mention in that, it was only my father from my family/friends side who attended my wedding. I will most definitely get an affidavit from him. But how about my other family/friends who did not attend, would an affidavit from them be valid?

Yes, I was in Morocco for EID and mine came thanksgiving weekend. I was on my way home a week later but this did allow me to see what to get from my husband and get him started on affidavits. We had just over 2 months to respond.

I think this is great advice. I got the same RFE you did, before my I-130 was approved and I sent 7lbs of evidence. We had a couple of months to respond to that RFE.

USCIS only gives 30 days from the time that they send out a NOID/NOIR to respond. It took 8 days for ours to come in the mail and my mail runs at the end of the day. This gave us less than three weeks to respond to USCIS.

Personally I would wait until after I got the NOID/NOIR and handled it before I would leave. I wouldn't take any chances. I had a friend that told me to take my Christmas break and go visit my husband, but I was scared that I would get the letter from USCIS while I was gone. Thank God, I listened to my instincts. The mail came during my holiday break.

What will you do if they ask for RFE here in US. My RFE was 4 pages and what my lawyer sent back to USCIS was over 25 pounds of evidence. I would think in Morocco as my husband is from there, you would get same RFE the rest of us are getting. I could not have gotten this eveidence in Morocco like my dad's death certificate and affidavit from my mom, birth records on my chilren, etc.
It is up to you. One way it is good to be this long with you. Other she needs to be here to handle what comes up with immigration.

but my wife will stay with me for 1 year till i got the nex interview

Our instructions say they want both birth certificates and passports and copy of death notice of my late husband. And some other information on me. this is all in the instuctions I recieved. I sent these to USCIS and NVC and now will take them to interview.

I contacted my senator in March of 2010. They move as slow as USCIS. this woman is like me. Her benificary is in Tunisia. A muslim country. that is the delay. She has been sent as I was to the California center. that is the place they send when they suspect fraud. She will probalby go thru the RFE I did and trust me it is intense to the point i had to drive 10 hours to get my mother to make affivadit saying when i told her I would marry him. My husband needed affivadits from brother in Spain saying why he could not attend our marriage. Many many things like that. It was 4 page RFE and the evidence weighed 25 pounds when I returned it.

Contact your Congressman and Senator.. If you go to their websites it will give contact information and release forms so they can contact USCIS..

we filed thru california too back in september 2010....and just got approved yesterday in morocco. thats 9 months...i do believe its different for each country of the beneficiary and not where you filed your petition. patience is the key...everything happens at the time that it should...at least for us it gave us time to really really TALK ABOUT EVERYTHING and see things we didnt know about each other even after 6 years and now all the waiting has paid off...just have patience and say thank you everyday that you simply have met someone who loves you and youre crazy about them.....and you are going to have the rest of your lives together after all this is passed.....

Of what year? OUrs was Arril of 2010 and just got approved this year in February.
The process takes time. Look at the country with the appovals. That means a lot. April to November I heard nothing and then got an RFE 4 pages long and the evidence returned weighed 25 pounds. It was not a packet but a box of proof.
Good luck to you but patience is what you need now.

I made 3 trips (stayed one month each time). I went to meet him and his family. and travel to 3 cities to see little of Morocco. Went back for long process of marriage and paperwork. Went back 6 months later for visit, their holiday and our honeymoon period. USCIS likes a honeymoon and photos so go, and consider this that time. The more time you spend as a couple, the better it is. I am going back now for his interview. That is also important to show support. Hope this helps. Jeanne

Anyone can tell me if I take another short trip to visit my wife during the CR-1 process can be a good proof of ongoing marital union? Especially during the interview in embassy!

My attorney said to have 2 of all 3. and if you have IRS office close to you, it is much faster to go inside and just aske for them at the front desk.

You do not file 129 with 130. My lawyer did my petition and only 130 was sent.

My I-130 is approved but i called USCIS and i come to know the following.

I talked to USCIS today and Now I understand what we should of done, When we filed I130 we should of filed 129F with it, so when the petition is approve you can still immigrate on the 129f for 90 days, and within that time file I-485 adjustment of status to stay here.( in other words ),Instead of waiting for a visa number from the embassy/consular that has no processing time frame on when your name/number will become available, the 129f will allow you immigrate here until a visa number becomes available ,so expect to wait 2 months to 3 years.

we would need to know how much time you spent in City A? HOw old?

I have a specific question regarding Police Clearance. I was in City A (Andhra Pradesh, India) in hostel doing my intermediate when I was 15 - 16. Then I was in City B (Andhra Padesh, India) doing my Degree for 4 years. Then I worked in Kuwait for 2 years and then I am back in City B, which is my birth/ native place.

I got Police Clearance from City B Police. I am in the process of getting the Police Clearance from the Passport Office and I will be getting the Police Clearance from Kuwait.

My question - Does NVC insist on Police clearance from City A, where I lived in a hostel from age 15 to 16 (as I was going back to City B during vacation/ holidays). The Police Clearance rule states that we need Police Clearance from the age 16 onwards. But the City A and City B are in the same state. I am thinking a loud on whether I really should go ahead and try to get a Police Clearance from City A also. Appreciate any input from people who have experienced similar situation - please no general answers like it is needed since you lived there after 16 years kind of stuff as i am looking for answers from guys who are/ were in similar situation.
