K-1 Fiance(e) Visa Process & ProceduresG325A Error Made - Worried!

I had made a mistake on the G325A (did not send all 4 forms). Sent in the corrected forms with a letter explaining the error.

Hey sapa_uscan, congrats on your NOA2! As for you robburnsefc, littles mistakes can happen no matter how hard you tried to avoid it. I'm sure the advices from our fellow VJers will help you a lot. We have minor errors on our G325a when we submitted it and we didn't do anything about it for now hoping they won't notice it. Otherwise, we might receive an RFE but we're keeping our fingers crossed that we won't. Good luck on your journey!

K-1 Fiance(e) Visa Process & ProceduresTwo quickies...

About the form, I did mention in my post that the example in the guides was the one I was looking at. I know that the G325A from can be used for a variety of applications, and in that particular example, it was ticked "naturalization". I guess with a K-1 you aren't filing for naturalization, so I suppose I'll keep my answer the same.

The USCIS G-325A had a bug in it causing it to mark naturalization. You would check 'other' then something like 'I-129F petition for fiance' as that is what the G-325A is being submitted with.

That made us crazy during the time that we were printing all the forms. We chose Other and wrote I129F (K1 Visa Application) but when it's printed, the 2nd-4th copies were marked Naturalization. We almost missed it but thankfully, we checked everything again and again till we noticed it. We just used white out and marked Other.

K-1 Fiance(e) Visa Process & ProceduresI-129F Sent directly to embassy?

So I called USCIS today to inquire about my petition not being at NVC yet after NOA2 and to ask about "and was forwarded to the consular office listed" on NOA2 and they told me that for I-129F they send not to the NVC but directly to the embassy. She didn't really give a normal answer as to whether this was previously the case.

Any thoughts? Was this true for anyone here recently? Do their support folks just not know what's going on?

Though, the NVC still doesn't have my petition and the Moscow embassy hasn't responded yet.

You're not the only one... I've seen cases like yours and you should be happy about it because your petition is on its way to the consulate. Just my .02... I'm sure someone can enlighten you more about this... Good luck!

K-1 Fiance(e) Visa Process & ProceduresDarn! RFE Mailed!

I DO have my airline tickets when I left India in Aug 2005 – and no, I had NOT submitted them with the I-129F. Never thought of it! My father paid for the tickets online in USA and sent them to me via a friend going to India… I have the original emails from Expedia.com confirming the flight (phew! just dug them out!). Geeze I never thought sending those would mean anything. Guess I should send those, in case that’s what the RFE is?

Well, if ever your hunch is right about the RFE (insufficient proof of meeting), you can now use the airline tickets that you have. I'm sure it will somehow and maybe you should also include an extra page of letter explaining why you're lacking of evidences. You said going out together in public is a taboo in India. Maybe (just maybe) they will accept it. Good luck!

K-1 Fiance(e) Visa Process & ProceduresDarn! RFE Mailed!

Am I missing something?!?! Photos of you and your fiancee in your apartment means that you have met (perhaps not in the past two years?).

Yes, I labled the photos with dates but they might question that! I wonder if anyone else has only had photos as proof of meeting? I know many people show plane tickets and passport stamps - but my passport says I did not leave India at all from 1989-2005 August!

The photos that we submitted in our packet has dates printed on it already (we used digital camera) but we still labeled each and wrote a little caption at the back of it. It would have been better if you have other evidences that will prove you've met within 2 years prior to your application. Good thing we were able to save proofs like boarding passes, tickets, itineraries, hotel reciepts/accomodations, passport page with immigration stamps, etc. But like what others have said, maybe you should try not to worry about the RFE until you got the letter. Who knows, it's about something else and not about the pictures. :) And who knows, after you've submitted what they're asking from you, you'll get the approval right away. I've seen cases like this looking from others' timelines. Anyway, good luck to you and I wish you a speedy approval!

K-1 Fiance(e) Visa Process & ProceduresCertified Copy- Is notary copy OK?

You have no time line. Are you talking about what to send to USCIS with your K-1 I-129F petition?

Per USCIS

USCIS no longer routinely requires submission of original documents or "certified copies." Instead, ordinary legible photocopies of such documents (including naturalization certificates and alien registration cards) will be acceptable for initial filing and approval of petitions and applications.

At the discretion of the officer, original documents may still be required in individual cases. Please be advised that USCIS no longer returns original documents submitted with the exception of Certificates of Naturalization, Forms I-551, Permanent Resident Card, Forms I-94, Arrival/Departure Document, valid passports, or those specifically requested by the officer. Such documents will be returned when they are no longer needed.

:time:

Hi
In the fist line I stated I had NOT filed yet. I am asking what type of certified documents they need in manilla?
Do the birth/passport etc docs need to be state certified or is a notary copy OK?

Notarized Affidavit of Support for the interview...
Certified Copy or Original Copy of Divorce Decree/Death Certificate if previously marriage
You might want to include your birth certificate (in case they'll ask for it)
Original Copies of W2, paystub, latest ITR (for at least recent 3-5 years), bank letter, etc...

I think all your questions will be answered if you will refer on the GUIDES... it's very informative.

K-1 Fiance(e) Visa Process & ProceduresA newbie with timing concerns!

Our time line is very similar to yours and we just got through. Even if you got your NOA2 today you still might not make April because you have to wait for it to go through NVC, then to the Sydney Consulate, then packet 3, then packet 4 and interview. That will take up to 3 months. Let me know if I can help in anyway with info. I just went through Sydney Consulate. See my other post "Visa Approved"

We know that it is next to impossible that Darryl will be here by April now. We are taking the necessary steps to cancel it all. Not only that, we were in hopes of having our first Valentine's together and then Easter....Maybe we can have a Halloween together...who knows. (We've already spent a Thanksgiving together).

I had already seen your "Visa Approved" post and replied to it. Let me say once again....Congratulations...it is great news!

K-1 Fiance(e) Visa Process & ProceduresA newbie with timing concerns!

Exactly what service center sent you NOA1? I would definitely fire that lawyer, they're apparently worthless! You really should have waited this process out to make solid wedding plans like paying anyone, but I guess you don't need me to tell you that.

Our I-129F was sent to the National Benefits Center aka, Missouri Service Center. The only thing on the NOA1 that would indicate where it is being sent from is the beginning of our receipt number: msc. I wish I could have picked up on that when I first received it, but how was I to know? However, when I would go into the USCIS website and look at the status, it did indicate there that my petition was at the Missouri Service Center. Yes, I am kicking my self in the rear daily asking myself "WHY did I not pick up on that?" I was naive I realize. I'm trying to not beat myself up too much over this...it was not MY responsitbility to catch this.....(it just goes back to all the "what if's" I keep asking myself).

As for waiting to make plans for a wedding. Yes, I agree, we shouldn't have made solid plans. However, neither Darryl nor myself had ever gone through anything like this...we relied on our lawyer's expertise and to guide us...that is why we hired him. He should have NEVER led us to believe that an April wedding should be no problem since we had filed back in June the previous year.

I will check out that link....thank you!
