Well, base from my own experience, your body will tremble, you'd be so shocked, you'll be shouting and jumping like a wacko (so make sure no one's around you) and if you will break the good news to your honey, he will have a hard time understanding what you're saying because you'll be too excited and would say things in between "oh my god, oh my god". I think my fiancee asked me to calm down and take deep breaths but it didn't help :lol: :lol: :lol:

I didn't check this morning, because I gave up, that they would work on our case...lol
and so I still went to USCIS and thought to myself 'why am I even checking?'.
I expected to see the same date '12/28/2006'...but first thing I saw was a 7!!!! A 7!!!! YAYYYYY
A change, a touch....I am soooooooooo excited right now, I just can't put it into words!!

what happened that the first k1 was closed. was it ever approved? if it was don't be surprised if they send an rfe for a "waiver." which is no bigger at all just a letter of explaination as to why you're filing again (even if it is for the same person) Theres a forum in K1 for Imbra if you have any other questions. I am so sorry to hear about all the problems and I hope you get some of your money back!

No, the first K-1 application was never approved and it has definitely been closed. It was a long horrifying day for my fiance and myself when all this 'info' came to surface. So much seemed to happen that day I can't even begin to explain it all once again. The easiest way would be for you to read the original thread (although it is a pretty long read).

A few words of advice.

1) Keep the course .... stay focussed on getting all paperwork and everything refield correctly ASAP. THis is more critical than immediately "going after" the incompetant attorney.

2) Once you have gotten all paperwork filed and are back on the road to recovery, you can a) go after the attorney directly, B) hire another attorney to do so (LOL!), c) file a grievence with the State Bar Association in the state where you live / attorney is licensed (if licensed to practice in multiple states, file a grievence in ALL states), d) file a complaint with USCIS AND a whole host of other actions.

THE KEY IS KEEPING YOUR HEAD ON STRAIGHT AND DOING THE MOST IMPORANT THING FIRST ...

I guess I have one question. If you're having to start over, won't the NSC need a new I 129f and etc from you as well? Why would Darryl send his forms to NSC instead of to you (so then you would combine his forms with yours and send them all together)?



Sorry, I guess I was not clear on that. Yes, we needed a new I 129f amoungst other things. He did express mail it all to me and his paperwork along with all of my paperwork was overnighted.

I guess I just wanted to share what our latest endeavor is in the immigration process for my fiance and me.

For those of you that had not read the very long thread from about a month ago when it seemed I was having a meltdown because of an incompetant lawyer, here is a very brief update....
--June '06, hired a lawyer to handle our K-1 visa process
--July 12, NOA1
--Oct. 31, touched
In the meantime, many contacts to our lawyer trying to find out 'status'. Checking the USCIS website daily. Stess, anxiety, & hope that we would hear something anyday!
--Jan. 29 '07, joined the VisaJourney website and posted to the forum asking for help since we were getting none from our lawyer. Rec'd many great responses and by the end of the day I had learned that our petition had been filed (by our immigration lawyer) in the wrong place and nothing had been done what-so-ever. It was devastated.

We have finally been able to track down our application and found out that it was closed back in October, probably when it was touched on Oct. 31. It seems someone would have been notified that it was closed, but the attorney's office claims they were never contacted. Honestly, I don't trust any of them, but no way of proving that part of it. Darryl and I both had to gather up all paperwork once again, have photos retaken, all the necessary things when you are originally applying for a K-1. Darryl express mailed all his information from Australia and it was all overnighted to the Nebraska Service Center - where it should have went originally. We are now waiting for our NOA1 (once again) and starting this horrible waiting period once again.

We are taking the neccessary steps against this lawyer for compensation. Darryl also has an appointment with the US consulate in Sydney on March 12 to see if they will renew his B-2 visa (another long story where our lawyer screwed us!). If they do renew it he will get to come for a visit in April. I am so nervous and excited for March 12 to get here to determine if we will get to see one another in April. What really sucks is that just months ago, I was absolutely positive that the next time Darryl came to the USA, it would be for good. Now, I am holding on to the dream that he will get to visit for 3 weeks in April...then go back home. Just doesn't seem fair.

We have also cancelled all wedding plans for our April 21 wedding and decided not to reschedule the big lavish wedding we had planned. We will take our losses, try to sell what we can and also try to get some compensation from the lawyer at fault. We would not have had to cancel if he had done his job properly. A big wedding no longer seems to be important to us (although it once was, since it is a first for us both), I just want to get him here for good and start our life together.

Darryl and I both try and remain optimistic although some days it is very difficult. It's been gruelling, but we know that someday we will look back on all this with a smile and a sigh of relief that it is over~!!!

When my husband was at his interveiw in Amman for the CR-1, we were put on A/R for this very topic. The A/R was for proof of a name change. I had not addressed that in any paperwork before hand, as I had not thought that would be an issue. We had a lot of other proof that was provided. i had already changed my name to his name and it's a good thing we had so that i was able to provide proof that i had done that. I really don't think his visa would have been issued if I had not. I guess they think its a statement to the world that you are married and its permanent. Maybe it depends on the consulate and other things also and maybe it is something you should address before the interview. I think they look for any reason to deny and this was ours. So you just never know! But in today's society many women do not change their names. Consulates need to step up to more modern times!!

My fiancee is 62, has health problems and also scared of flying but he already visited me twice to prove me that he really loves me. It's very necessary that you two meet in person since you met him through internet. Maybe he should ask his doctor if there's a special medication he can take to relax him during flight? I don't think I will be able to stand not seeing my fiancee that long. It will drive me crazy for sure. :wacko:

My fiance called the Kuala Lumpur consulate, sad to say we have to file it in Manila. The consulate said that it may take longer if it will be processed there because he has only been working in Malaysia for only 4 months and the consulate requirement is 1 year. I guess we don't have any choice - he'll just go back to Manila. Does anyone here had or have the same case? We need advice.

Sorry to hear that... well, in that case and if you think you really have no choice, use the consulate in Manila and make him go home when he thinks his interview date is really close. You might make him get a Police Clearance in Malaysia as well since he will need it for the interview. I'm not really good in giving advices but I'm sure someone in the same situation will help you here... Good luck!

I am seeing that some have had their letter of intent to marry notarized but when I went through the guide it doesn't say that it needs to be notarized.

It's their choices but it doesn't really have to be notarized... plain and simple letter stating you're both free and legal to marry and will do so within 90 days upon entering US is all it takes... Just make sure to sign and date it (to be safe). As far as I know, its the I-134 that needs to be notarized and will be used for the interview.

hello all...i finally received signed 325's, notarized letter of intent, and originals of translated birth and divorce documents from my wonderful fiancee today...a very long 3 weeks...we love eachother so much and we are both lucky...ok, so, here is what i got:

1-personal check to u.s. dept. of homeland defense for $170
2-cover letter
3-i-129f form
4-declaration of meeting letter
5-notarized letters of intent from her and i
6-proof of meeting-boarding passes, flight itinerary, credit card copy of flight purchase with itinerary on it, pics of us together at the family table, independence square on new years eve with fireworks and hotel ukraine clearly in the background, on back written who is in pic, where, and date and so on, couple letters and e-mails
7-signed g-325a's from each of us with passport photos attached with printed names on back respectively in zip-lock bags
8-copy of my birth cert...nothing is on the back so i didn't make a copy of it....should i paste a sticky note explaining???...
9-a copy of me u.s.citizen birth abroad cert...born on united states air force base in ankara, turkey...so, on my 129, question 10 "how was my citizenship required?", i checked thru parents and inserted my birth cert #
11-copy of all pages of my passport, front and back cover
12-copy of her cyrillic and translated divorce and birth certs

i have two-hole punched everything, tabs at the bottom of all docs, and inserted them into an acco two-hole legal size binder...all docs are letter...i am going to place it in a manilla envelope and just use the clips to secure and overnight to texas service center and then pray for rfe's and to keep as busy as possible so the time goes by quickly.....we feel like this is a huge step for us and we are both excited and relieved to get this off....

i know this is a lot of info, and would appreciate any input...here i am and here we go...and i get to start my timeline!!!

We swapped phone numbers and started to talk on the phone regularly. <Benficiary> travelled to visit me in person in America for the first time from November 18th 2004 to December 2nd 2004. He has subsequently visited me in person in the USA between the following dates: March 11th 2005 to Mach 18th 2005, August 25th 2005 to September 8th 2005, January 18th 2006 to January 28th 2006, April 26th 2006 to May 6th 2006, September 23rd 2006 to October 7th 2006 and January 3rd 2007 to January 13th 2007.

I know how sweet it is to call each other "wifey" and "hubby". But because you're filing for Fiancee Visa, it's highly suggested that you avoid using terms that will complicate your status. I've learned a lot from hanging out here in VJ and I'm sure you will, too.

As for letter of intent to marry, it doesn't have to be notarized, just an statememt that you're both legal to marry and will get married within 90 days upon entering US. You can find a sample here... all you got to do is explore and read a lot and you'll be in good shape.
