My first lawyer (the idiot) filed and yet I received the NOA1 in the mail because he did not put his name in the correct place that he was representing us. (He did everything else wrong, why not that too). Once we had to refile and had a different lawyer, she did things much differently and correct. The NOA1 was sent to her and as soon as she received it, she emailed me a copy.

You should have a right to everything that they have on file for you. I would stop emailing and try the phone calls...demand that you speak to someone that knows about your file.

This is a US attorney and are they near you? Can you show up in their office in person?
I hate to say it but I do think there are more than we think out there just trying to make a buck and doesn't care if they do you justice or not. In my case, I don't think he was trying to be malicious or rip us off...he was just plain stupid...full stop!

Have you checked with the state bar to see if this attorney is in good standing? If they keep screwing you around, file a complaint as well with the state.

I know too well about having a incompetent lawyer. Another thing you may want to try is getting in contact with whomever is in charge of that lawfirm (if it is someone other than the one representing you).

thanks, kym. i think it might be a good idea for me to call him. you mentioned that you once had to refile... is this because the lawyer did not fill out the right spot for his representation? eeek, i hope i don't have to pay again--he charged me $2500 and i got a quote from another lawyer for $3500 so either way, i am screwed if i have to file again. also, when he messed up your papers, did he get a copy of the NOA, or only you did? i'm just hoping that we don't have to refile if he submits his correct papers. :-(


I don't think you will have to refile. Our refiling had nothing to do with our lawyer not filling out his representation correctly. We ended up finding out so many things he did wrong, I couldn't even go into everything. It was unbelieveable. But the reason we had to file again was because the lawyer sent our I-129F petition to National Service Center instead of the Nebraska Service Center. Normally, this should have been no big deal except a little extra time. But for whatever reason, the NSC didn't return the petition nor forward it on to the proper service center. Instead they "administravely closed" it and didn't contact or notifiy anyone of these actions. I didn't end up finding out it had been closed until almost 5 months after it was closed (thanks to the help I received here on vj). Anyway, it gets way more complicated than that, which lead to a congressional inquiry....but the point is that we mainly had to refile because of the error of USCIS.

Now for the first NOA1 I received it was sent to me because as I said before, the lawyer didn't fill things in correctly and they just had my address. He does have a copy of it now and honestly I can't remember if I faxed it over to him or if he got that on his own. I just know that when Darryl and I were meeting with the head of the lawfirm (discussing compensation) they had a copy of it. Once we refiled and everything was done correctly, I did not get a copy of the NOA1 at all...but my (new) lawyer faxed me a copy right off. When they sent out my NOA2, it said on there that it was a courtesy copy and the original was sent to: lawyer's name.

I have to say that you have paid an awful lot of money. Maybe the fees are different where you are than where I am. Our original fee was going to be approx. $1700.00 plus we had to pay all the filing fees (maybe that is where the difference is?). However, since none of this would have ever happened if the idiot lawyer would have done this correctly in the first place (which we had to cancel a wedding as well...that he told us would be safe to plan because we were allowing more then enough time), everything we had paid was refunded to us. We made a settlement with the head of the lawfirm, he really did try and be fair about it all. And since we are using another lawyer in the same lawfirm (whom we are very happy with), the entire process is being done for free...filing fees included. (and yes, I'm even getting a bit of satisfaction that the fees are going up and they have to pay them..lol....but hate it for everyone else).

Anyway, as I said before...forget the emails. They are too easy for them to ignore your emails and just respond when they want to which is what they seem to be doing. Call them...get him on the phone..put him on the spot...demand answers. Better yet, show up in person if at all possible.

Me and my fiance hired a lawyer and we have regreted it!!!! However, don't let our misfortune guide you in your decision. Our lawyer obviously had no clue what he was doing on this type of visa....he specializes in something completely different and we didn't know at that time. Of course he should have told us. But if I were in your situation, I'm sure I would do the same thing. Heck, we hired a lawyer and there was nothing complicated at all about our petition, yet it has been a year since we filed and my fiance still doesn't have his K-1 visa (although we are so close we can taste it!).

My suggestion to you would be to get references and make sure they are references for the same type of visa that you are applying. And actually contact these references if at all possible. You can also contact the state board to see if that lawyer is in good standings. As for the cost, that amount does not seem that much out of the ordinary. As a matter of fact, it is approx. the same as our lawyer was charging. However, we have since had all our money refunded and another lawyer (whom I like a lot!) from the same lawfirm is doing the complete process at no charge...plus some other forms of compensation...that is how bad this lawyer screwed things up!

Us smile.gif Zach has a dismal savings account (and not something we tried to hide either) but I guess his advantage is that he'll be getting a PhD Scholarship, which ensures he'll be above the poverty line for at least the next 4 years. And his parents co-sponsored us even though we were assured that we'd be OK even with just Zach's (but we figured it's better to be MORE than just over the line).

I had my interview yesterday (in Australia though) and my fiance hadn't worked in the US since 2003 (he has been studying/working here in Australia). Anyway, he wrote an Affidavit (evidently, a letter) explaining his situation and the fact that he couldn't supply tax forms since '03 because he wasn't working in the US. Instead he provided his payslips, etc for his Aussie job. They were happy with it all (we provided ENOUGH evidence/support).

I am quite confuse regarding this matter..My fiance filed the petition(K1 application) last June of 2007. I am confuse if I will continue teaching next semester (October 2007-March 2008). My schedules and responsibilities might destruct me later on especially if We will start hearing from the USCIS. My friend who filed same thing adviced me not to resign because normally approval of k1 visa will take up to 10 months( base on her personal experience) But, as I go over here, Its less than 10 months for most couple to get their visa approve! pls help! I am not in the same situation, but my fiance lives in China and is there on a business visa, but from Algeria, he will interview in China. And unfornately for us, China is a country that can take quite awhile. Good luck with both of you.

Contact the consulate in the country your fiance is in now, and they should be able to tell them. My fiance is living in China and there on a work visa, he has residency in Algeria. I e-mailed Guangzhou and they said he could have his interview in China. I have read on here where others are in the same situation and they have been able to do it that way. Good luck.

Yes, she will be able to show significant funds on hand, and I would be covering all the travel/lodging/food expenses. I don't know if an email of support from me will carry any weight, though.

I also forgot to mention that she travelled to Canada last summer, and returned home according to the terms of her Canada Temp Resident visa. She has not interviewed for a tourist visa.

I mailed the I-129F yesterday to CSC.

She says that 1st of the year (now) is prime time for tourist visas for Filipinos. She already got/paid-for a visa application when we were considering a tourist visa last summer.

I told her to get an interview appointment ASAP. At the embassy she would advise her interviewer that I-129F has been filed by US citizen, not hiding this or any other facts.

Reason for going to US: To help me prepare for three K2 children (prepare the home, investigate schools & colleges, etc.)

Ties to Philippines: Since one of the K-2's is already 18 years old, the K-2 is the ONLY way to get her to the US with us. There is no option to marry in the US, obtain the K-3 and bring the 18 y/o as a dependent. Therefore my fiance' MUST return to the Philippines, attend the exam and the interview, and obtain the K-1 and three K-2 visas. We could also site the usual ties of job, family, property, but I think those are immaterial given the I-129F.

The simple risk of denial of the tourist visa is of little concern to me, if there is a chance of success, I want her to try.

My biggest concern is whether such a denial will harm the K-1 process in any way.

The chances of her getting a tourist visa now are quite slim.I 've heard that in order to qualify for a tourist visa you have to have at least 300usd in the bank, a job,and pay the interview fee of 200usd.In all honesty,your best bet is to file for the fiance (k-1) visa.If she were to come on a tourist visa,and you were to marry her,that in itself could cause you some problems because USCIS will look at that as fraud.

Not if she returned to her country and they filed K-3 or CR-1.
And it's about more than how much money you have in the bank (and the fee for a visa is 131 USD) - ties to your home country, etc etc.
It's also very hard for a single young female to get a tourist visa from South America - adjusted visa refusal rate for Colombia is 33.3% which while not the highest, is NOT low. source.

I discussed this very idea with my atty... that is, Tourist Visa => Enter US => Marry => Return Home => USC Files K-3 petition. He says that while it's true that the Tourist Visa terms would appear to be met by returning home, there is a misrepresentation on record in the form of the Tourist Visa application where marriage was not given as the purpose for the trip. Later, the fact that marriage occurred during the "visit" could raise an eyebrow. The earlier in the visit that the marriage occured, the more dubious the stated reason for entry becomes. He suggested that after about 6 months it would probably not look suspicious. Well, it takes about 6 months (after you mail your petition) for your fiancee to get her K1 interview, so that is the route we took, and I mailed mine the first week of Jan'08.

Tourist visa too? We have been waiting forever (15 months) for her Philippines annulment which must preceed (a.) proposing marriage to her, and (b.) filing the K-1 petition. Since we started that process I heard there are faster ways, by getting a divorce in another country and Phil's would recognize it (too bad...water under the bridge for us). But since we waited so long, we decided to take a shot at the tourist visa, trusting that a denial would not harm the K-1. We are being bare-naked honest in the Tourist application and showing Fiance (me) in the States. She can talk about job, owning a house, etc. at the interview, but I think having a fiance in the States trumps the typical ties like those.
Reason for entry: "Search school options and prep house for K-2 kids."
Guarantee of return: "(a.) Violating the tourist visa could kill the K-1,
(b.) MUST return for a K-1 medical and interview in order to bring 18 y/o and 2 younger ones,
(c.) We met in Canada and she returned home in accordance with that visa."
Support during travel: "(a.) 'Tacos in the bank' (her USDollar savings passbook),
(b.) staying with K-1 petitioner, who is also buying the tickets"
If it all works out, she can have a couple of months here to help me prep the house and check out the schools, and then go back, do the process and return with the kids. I'm not overly confident about getting the tourist visa, though, in fact that's why I'm searching the forums for comparable experiences. If she gets denied, so what, we tried.

If you can come up with some reasonable ties to Colombia, and if you've ever bought a lottery ticket, then the odds for a tourist visa are better (maybe not the best way to get married). I also heard that if you get denied a tourist, you can go back and try again. You might think of a way to out fox USCIS but I think they've already heard all the really artful stories and they probably read these posts.

Hi all..
We are recently enganged and about to start everything for the K1 visa. We found this site has been helpful for preparing our paper. We have some questions and hoping that may be some of the members could give us some advices. Regarding foreign fiancee, she has applied a working visa before and has been approved by NVC. The paper is stucked in the US embassy abroad for more than a year (waiting for the interview) due to the working visa retrogression. Would it create a problem for our I-129 petition? What shall we do with it? An other question is about the address of fiancee abroad. Is it going to be used for the mailing address by the embassy? Since the address (outside US ) isnt compatible enough for mailing address, is it possible to put PO BOX address in that address' box of G-325A?
Any advices will be greatly appreciated.

I have broken things off with my fiancée because of something that became known thought the medical testing during the K1 process that I didn’t know before I started. I allowed the visa to be processed because I do care for this person even though I choose not to marry her because of this. I thought that if I canceled the petition It would have left her in a bad spot with the embassy (Manila) and she would have even a harder time getting approved if she finds another or even attracting another if they knew what they were up against to get her. Believe me It wasnt good!! Anyway when I found out about the problem it caused me to have to fly to Manila three times this year to deal with it. I jumped through all the embassy hoops to clear her name so she would be ok in the embassy eyes. It was difficult but she was cleared and approved but by getting her approved I never thought about the problems it could cause me.

Since then I have met another that I'm interested in so I’m wondering if I petition this person in the near future will this cause me a problem even though I never fulfilled the visa of my X-fiancée? This has all happened over the last year and I figure if things go well I will petition a K1 again next year.

i didn't get response from my fiance who is in iraq for his deployment. last time we talked was like 6th of february this year. i'm getting my packet 3 soon. i'm not sure if he can complete all the forms needed for me to bring for my interview like DS-156, DS-156K, DS-157, FS-257a, recent tax return and w-2 and notarized affidavit of support. last time we talked he said they were having problems with the electricity so he might not be able to check or reply to my emails, and his parents have told me that even snail mails may not be delivered to them because their convoy might have problems with the supply line. but i don't worry if he can't complete it, as long as he's safe and ok over where he is.

Someone correct me if I'm wrong but I think the only form that he needs to complete is I-134 and provides supporting documents. As for the DS-156, DS-156K, DS-157, you will be the one who will fill-up these forms...

Ok... feel a bit silly, but just figured out how to change the consulate. Cuba is not listed, so it is blank now. Cuba has no official consulate or embassy due to relations with this country. Sorry for any confusion.


Do you really have your NOA2? NOA2 is your approval so either it is a mistake or you went through Vermont because 5 days for CA is not normal


At first, I thought it was fishy that they got approved in 5 days at CSC but looking at the timelines, they did receive harcopies of NOA1 and NOA2. Such a lucky filer :whistle: :whistle: :whistle:
