K-1 Fiance(e) Visa Process & ProceduresThe requirement of seeing eachother hasn't happened yet!!
If you can't get a visa... and she can't get on a plane because she has an extreme phobia about it and can get medical documentation stating that's the case... then *maybe* it could be waived, but honestly, you just need to know why she won't leave the US to meet you, honestly though if it's not possible to meet, it's probably not going to be possible to get married either.

You only needed a K-1 if you intended to settle in the US.

Actually if they are already married and wanting to move to the US wouldn't it be the K3 they need?

Why doncha PM him and find out? Although I would be a little hesitant to give immigration advice over PM, as he might.

If its not too personal, pose the question(s) here and then PM him that you've posed the questions.

I tried to pm him and none to my surprise...it was full! I'm sure he was overwhelmed from all sides!

regarding files being misplaced. very seldo. Every time a filecahnges hands even from one officer in one cube to another in another cube , its wanded or scanned intothe system so its alwaystrackable as to who has it. The only thing that can sometimes happen is a file gets misent to the wrong place (ie the Vermont Center instead of say a district Office) butthe system will always know where it is, it just will take a few days to get it backto where its supposed to be because it has to be mailed back to its original destination etc..

So files don't get "lost" every file's location is know. Loosing a file is grounds for dismissal becaus eof the violation of the privacy act and security. Your file has too much nformation in it and each one is nottaken lightly. We treat each file as if its a persons life so to speak because it represents someone or a couple or family etc...

I ran into this thread much later than it was started, I hope I am not too late to receive a little of "insight" from Huskerkiev. I have found your posts very informative and interesting. Thank you for that.

This one particular post caught my attention!

So files don't get "lost", every file's location is known.

K-1 Fiance(e) Visa Process & ProceduresYeah! K-1 Approved, with child. Now I'm not so sure.
Wow...is really all I can say. It sounds like you have some issues, well, really both of you do. Now, I'm not trying to be rude but it really sounds like the both of you have some growing up to do.
She does NOT owe you anything although you have definitely done a lot for her, financially especially from what it sounds like. I'm not familiar with the culture but to me it sounds like you are being taken advantage off but that must be ok with you, otherwise you wouldn't be sending her this much money. Really, why are you buying her furniture and stuff, what did she have before you were in her life? And why are you paying for her family? What did they do before you?

I can certainly understand wanting to be with your family on Christmas, I have been away from my country for 6 years and it was only last year I spent Christmas with my family...in the USA of all places. It sucks, especially when there are kids involved but that is the price you pay when choosing a loved one in a different country.

I don't know what she is thinking but she kind of makes me mad. I think she needs to grow up and stop making it look like she is taking advantage of you - as a woman, that makes me mad and it make our gender look bad. If she does not feel ready to leave her family behind then she should say so and stop taking your money. She chose to have a child, now its time to grow up and take care of it, and if she does not want to be with you in the USA anyway well then maybe she should get a job. kids are expensive, I should know, I have one.

You on the other hand need to stop throwing you money around like its nothing - grow up, money is not everything and it will not buy love, at least not for a very long time.

I hope you both can sit down as adults and figure out what is best for everybody because you have now involved an innocent child. Follow you gut and stop acting like she owes you anything.

Toga,
From what I understand, it doesn't. You have to repeat the expedite request with NVC. And NVC has different expedite criteria. However, I heard they are easier to deal with compare to USCIS.

Sometime NVC can forward the case to the consulate for further processing i.e. paying fees and submit AOS, if the consulate agrees to that, which will really speed things up.

Leah

Thank you for the information. I guess I will repeat the process in the event the initial expedite is approved. This is certainly a learning process!

I had my working visa and fiance visa approved (by NVC) on my K1 visa interview. I told it during my interview and he said that they could give me one visa only. Since I choose to come for my K1 visa interview, I got my K1 visa. One thing you should know too: if you come with K1 visa, you should deal with the USCIS first to get a job and be a permanent resident.

I kinda wanted a lawyer because I know if I mess up on any of the paperwork it could mean long delays and I want everything to go smoothly without having to worry the whole time if I messed up on a little part. to me it would be worth the extra money to make sure my fiance gets here without me having to constantly fix mistakes and send the paperwork back. I might not make mistakes but I more than likely would since theres a lot of paperwork and i've never done it before. My fiance is also very nervous about all of it too, she doesn't want to mess anything up. I appreciate all the replies so far. Does anyone know if using a co sponsor will lessen my chances of success?

K-1 Fiance(e) Visa Process & Proceduressponsoring
Hello I am new here and I have a few questions. I met my beautiful fiance several years ago but we are just now getting ready to go through the K-1 process. I will be traveling there in a couple months to visit her. I have been looking over everything required for the K-1 visa and I intend to get a lawyer to help with the process. My question is with sponsorship. I live with my parents at the moment and we recently moved so I had to quit my job. I was only working part time so not making much money. I am trying to get a new job here but i'm worried I won't make enough money to be the sponsor for my fiance. Will me living with my parents and being on disability prevent her from getting the visa? I'm so worried about it. I read I could get a co sponsor and i have several family members that could help me out. I know by the time she would get here I would have a steady job full time but i doubt I would meet the 125% income amount. I know my family would help co sponsor her till we got married and she became a citizen. I mean once she is here and married we will both have jobs and make well enough to support ourselves. we could have our own place but my fiance said she would actually like us to stay with my parents for just a little bit so she would have some people to talk to and all while i'm at work. So basically will me living with my parents and not having my own place prevent her from getting the visa? Also would me not making much money and currently being on disability be an issue? I really appreciate any answers. I thank all of you in advance.

K-1 Fiance(e) Visa Process & ProceduresK-1 Docs to File and a few more ???

Hello All:

I am new to this forum and have a few questions to clarify a couple of things.

1. When sending in the I-29F, are the only documents I list here required?

I-129F
- I-129F Supplement: Part B, Question 18, explanation of meeting in person [ONLY IF USED ADDITIONAL SHEET]
- G-325A and passport style photo (Petitioner)
- G-325A and passport style photo (Beneficiary)
- Birth certificate/US Passport (Petitioner)
- Letter certifying intent to marry (Petitioner and Beneficiary)
- Proof of having met in person in the past two years
- Proof of ongoing relationship [if including]

2. When is the I-134, DS-156, DS-156K, DS-157, DS-158, and DS-230 submitted?

3. On the I-29F application, in block 16 it asks for the info in the applicants native alphabet if not Roman letters. My fiance is from Ukraine, and speaks Russian primarily, and some Ukrainian. Are they asking for her information in the Cryllic alphabet here?

Thank you in advance for all of your help.

K-1 Fiance(e) Visa Process & ProceduresAre there any REAL people working for USCIS?

This is my first time posting on here, and I'm kind of at my wits end...

I received an email receipt on Jan 23 (the actual NOA "received" date is Jan 12) for my I-129F. It's now February 23 and I have yet to hear anything else. I know everyone goes through this paranoia, thinking "What if they lost mine? What if I'm supposed to be doing something??" and this is basically where I'm at right now.

I am working with an immigration attorney who only answers me in 1-word responses via email, which makes me feel like I'm bothering him. I have tried to contact someone- ANYONE- at the USCIS customer service number and it seems like I get caught up in an automated-hell. Does anyone know how to get a hold of an actual person??

Is this normal to not hear anything besides my NOA1?? I saw that some people received an NOA in the mail- I never got one of these.

Also, my fiance and I are planning our wedding at the end of August. With a received date of Jan 12, does this seem like enough time for the full process to be completed?

This experience isn't nearly as funny or kitschy as the movie Green Card... <_<

I see you filed at CSC... That NOA1 is a proof that they got your case and will work on it if it's time. You won't be receiving anything after that NOA1 until such time that they've really started flipping the pages of your packet. After a couple of months (sometimes within 3 months or so) you will then receive another notice either an RFE or the NOA2 (the approval notice). You need not to get paranoid or worry too much otherwise the whole waiting process will kill you. Hang in there! You're not alone! You see, we've filed back in December and still waiting for our NOA2... Good luck!

K-1 Fiance(e) Visa Process & ProceduresPutting lot of yellow post-its?

I am almost ready to file - have lot of papers and lot of information in those papers.
I was thinking of putting post-it notes on lot of papers indicating the information like
entry and exit stamp in the passport etc etc (lot of small and big details). As it turns
out there would be lot of these post-it notes over lot of these papers. So now I am
thinking..would these be annoying? Would they really read what I wrote on those
post-its? Anybody done this? any suggestions.

K-1 Fiance(e) Visa Process & ProceduresDid they lose our petition packet?: UPDATE

Update:

My fiance contacted his congressman and two senators and only congressman's office called back. The person my fiance talked to said he might be able to help speed up things. But my fiance got a call today from the congressman's office staff and was told there is nothing he can do for us since our case is still within the normal time frame.
When my fiance first talked to this person, he sounded sympathetic to our situation, so we got our hopes up....

I guess it is official that we filed our petition in April, not February to everyone else.....

I'm really sorry this has happened to you. I cannot imagine how hard it is for both of you... the months that have been wasted and all the frustrations...

Boy, I can't believe they can lose a petition... :(

K-1 Fiance(e) Visa Process & ProceduresHow long does it take 2 get ur NO2

Hi i Just like to ask whats the next step after i get my noa2 approval?? can u give me some information. Thanks goodluck in ur k1.. and to everyone
Jen

Uhm, if your petition already got approval (it's time to start gathering documents you will be needing for your interview), your case will be forwarded to NVC. NVC will assign a MLA case number for you and they will forward your packet to USE Manila. USE Manila will give you your medical and interview dates, also they'll send your packets 3 & 4 (meds and interview usually takes 3months or so from the time USE received it from the NVC). When your interview and medical goes well, it will be the right time to prepare packing your things, book your flight and fly. :)

Thats all I know.. I hope somebody who already experienced this corrects me if am wrong. God bless on your journey!

Julie

By the way, you can edit your timeline provided by this site.. Just go to your My Controls and Edit Timeline..

jhenny24,

You can look at my timeline to have an idea of how long it takes for things to happen... NOA1-NOA2-NVC-Consulate stages.

Actually, there's no such thing as Packet 3. USE sometimes sends pre-appointment letter to the beneficiary and it is mistaken as Packet 3, but for real, it is not it. As for the Packet 4, it is usually sent out 1-2 months before the interview date. But in my case, I think it's taking so long for them to deliver it (God knows why) ;)

Take a time to look at the GUIDES...

http://www.visajourn...mp;page=k1guide (something about after receiving the NOA2 is at the bottom)

http://www.visajourn...amp;page=k1flow

You will find tons of information there that will surely help answer all your questions.

It really depends on the service center. Vermont is as fast as a lightning (just exaggerating)... as for CSC, because of the heavy loads of cases they're working on, it can take up to 90 days to forever, to get the NOA2. Ours took less than 90 days, though, and I'm very thankful for that. There are Oct, Nov and Dec filers who are still waiting until now... Keep your fingers crossed that your case won't sit too long at CSC...

Good luck!

I think as long as they got your case, it wouldn't matter if you received the NOA1 or not. You'll be fine. You're not the first and won't be the last who didn't receive the notice of receipt. The most important thing is the NOA2 since you will need that in AOS once your fiancee's there in US.

Relax a little... Save your worries for the NOA2 if ever it will get delayed a little (God forbid).

I just re-read the uscis I-129f form and realized that you had to provide proof of your relationship in the package too and am freaking out! He was under the impression that you presented that evidence at the interview process and they just run a background check at this time!

Our petition was sent maybe two weeks ago and we still haven't received our confirmation letter (with case number) that they've gotten it. Should we wait for the case number and then send a cover letter with all our phone bills, flight itineraries etc? Can you send additional information before you get a RFE?

HELP!

Was the check cashed already?

You should wait for now... if they got your case, they will surely send RFEs for lacking of necessary documents and proof of relationship. There's nothing you can do for now unless you want to send a new packet loaded with everything that you missed to include the first time.

K-1 Fiance(e) Visa Process & ProceduresIs it in my best interest?

I gotta say again--as the Non USC in the relationship--that it is a very very big step to leave your country, family, HOME. Even if it is for love. I can only imagine how much more difficult it must be and scarey when your family is not emotionally supportive on top of all that.

The question I don't think I have seen you answer yet is "DO YOU LOVE HER?" I know you've mentioned other women, more fishies in the sea, and having met online. Are you simply looking for a wife--any wife--any foreign wife? Or have you spent all this time with this woman and her child because you love them? I know that you must be heart broken about her sudden change of heart--but honestly, it may be the fear speaking on her part. She may simply need you to go and reassure her. It may not be fair to you emotionally-but she may be testing you to some degree. Or she may seriously be that afraid to go and abandon her family.

Personally, I wouldn't cancel anything yet. You are already going there, you have nothing to lose (not even the monetary since it's already booked and paid for) you may find that things can be worked through and- if not -at least you know you went down fighting.

either way, good luck

I am going to run with AngelD on this one. If you truly love her, and are going there again soon for a visit, don't cancel anything until you get back. Good luck, and don't cancel anything until you get back.

I definitely agree! Since you are going back here in PI this March, try to talk to her one last time. If she's really decided and stay firmed, the you can cancel the petition. I understand how hard it is for your fiancee to be the bread-winner in the family. I, for one is supporting almost everyone. It is tiring and frustrating but because I'm the only one who can help them, I just embraced the responsibilities. My fiancee promised me that once I made it to US, the money that he sends me monthly will automatically goes through my family here so I won't have to worry about having no one to help them. We have agreed on this and we're both ok. I think your fiancee is torn between two decisions (and probably confused and at the same time, scared)... Talk to her again, at least give it a try and if nothing progress, then I suggest you move on and start afresh...

Sorry again for what you have to go through... Always remember that things happen for a reason...

Good luck!

I am hopefully submitting the I-129F package tomorrow and want to ship overnight to the correct service center for North Carolina which is listed as texas. I have read somewhere that texas is closed and California is now the Service Center. Does anyone know for certain?

You will need to submit your I-129F to Texas Service Center and they'll be the one who will forward it to California. Right now, only CSC and VSC are the ones who process I-129F and all applications sent to Nebraska and Texas are being forwarded to California while all petitions filed in Vermont remain there. Good luck!

K-1 Fiance(e) Visa Process & ProceduresI-129F Original Submission: assembly and evidence
This might help you...

According to USCIS:

General Tips on Assembling Applications for Mailing

Mark both the envelope and the cover letter as to the nature of the submission. Example: ORIGINAL SUBMISSION - BRIEF FOR AN APPEAL - RESPONSE TO REQUEST FOR ADDITIONAL INFORMATION - etc.
Use the appropriate mailing address and mark both the envelope and the cover letter as to the form type. Example: I-129; I-130; I-690; I-698, etc.
Provide both the receipt notice number and the A-Number as an identifier, if they are available.
If the packet is being resubmitted in response to a REQUEST FOR ADDITIONAL EVIDENCE (RFE), please place the notice requesting the additional evidence/information on the top of the packet. Also, please use the special mailing envelope provided.
If evidence is being submitted in support of a previously filed appeal or motion, a cover letter stating "BRIEF FOR APPEAL", etc., should be placed on top of the packet.
In preparing your packet, please take note of the following:
Do not use binders or folders that cannot be easily disassembled.
Use ACCO fasteners to hold together thick or bulky applications or petitions. Two-hole punching the top of the material for easy placement in the file is appreciated.
The use of tabs assist in locating items listed as attachments. The tabs should be placed on the bottom and not the side for ease in filing.
Avoid using heavy-duty staples; instead use ACCO fasteners or heavy clips.
Avoid submitting originals unless specifically required. Avoid submitting oversized documentation when possible.

Honestly, I'd remove the binder. You're creating extra work for the processor to take it all out of the binder and arrange it the way they're going to.

Even if they can easily remove the sheets out of the plastic inserts? The pages (forms, documents, etc.) are not 3 hole punched. They are inside transparent proctetors that are punched.

They will arrange your file according to their procedure, so the easier to access documents, the better. Going through each plastic to retrieve documents is an added work for them. I remember, we punched holes on all our papers, bound them with 2-prong ACCO fastener, put tabs at the bottom. It is a lot presentable and accessible.

The evidences of meeting and on-going relationship look good to me. good.gif BTW, don't forget to include a copy of your fiancee's birth certificate. If in foreign language, make sure to include a translated copy.

Good luck!

K-1 Fiance(e) Visa Process & ProceduresCan we get married here in the Philippines after I can have my K1 Visa?
I have two friends who both got married in the Philippines (they were K1) prior to their entry here in US. They say it's just for the ceremony so that their families can see them get married and they didn't register their marriage in our Marriage Indices. When they got here, they had the legal marriage with certificate and such. No problem so far but I'm not suggesting that you follow their lead.

If I were in your place, I'll do what I think is righteous. I like to follow rules and regulations and not jeopardize my chance to be with my sweetheart... whistling.gif

K-1 Fiance(e) Visa Process & ProceduresNOW WHAT?
QUOTE (BRIAN AND ISA @ Oct 2 2007, 09:40 PM) <{POST_SNAPBACK}>
We received our NOa2 last week and wanted to know if their was anything we could do while we were waiting for the infamous packet #3 & #4? Thanks. I appreciate the help. She is getting all of the passport style photos, but is there anything else? Thanks again. good.gif

Congrats on the NOA2! You can now start gathering all the pertinent documents to send her. According to Visajourney's Guides:

What to send to your fiance(e) once the I-129F is approved (Receive NOA2):

1. A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one).

2. Send all originals of the documentary proof that you submitted for the I-129F to your fiance(e) for their interview at the embassy.

3. Send an original letter affirming your desire to marry your fiance(e) and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F).

4. I-134 Affidavit of Support form. Ensure it is notarized (by a US Notary Public), with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all.

5. You will likely need at a minimum (for the above form) two to three of your most recent pay stubs and a signed letter from your employer listing you job title, start date, your salary, and the status (full-time) of your position. Begin collecting these ASAP after your NOA2 arrives. You will also probably want to include other evidence such as your banking information and other assets as required by the I-134. Specifically you will need at least 2 of the 4 options mentioned in Section II-Supporting Evidence of the I-134. See this FAQ for more tips and ueful information on the Affidavit of Support Form.

6. A copy of the NOA2 that you received in the mail.

7. Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, etc from between the time you filed and present (NOA1 date-now).

Examples: Copies of phone bills, cell phone bills, emails (you can edit personal info with a marker), letters (edit personal info also), stamps on the letters (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)

Just follow the guides and you are good to go. Good luck!

When one submits evidence of the relationship at the interview, are the pictures returned ?

In the Philippines, they did return all the pictures I brought with me during the interview. The set of photos that they kept is the one I submitted along in our I-129F original packet since it's considered as originally submitted evidence. It is advisable to have copies of everything in case they'll keep yours... good.gif
